Is this a high time to make a strict law to stop fake cases emerging with the misuse of power?

The whole nation seen today how the editor-in-chief of no.1 Indian national news network Republic and more over the nationalist journalist has been arrested in a disrespectful manner, how the Maharashtra government treated Arnab as if he were a criminal by making use of Mumbai police and officers. The policemen physically assaulted the most honest journalist of our country.

Maharashtra government has to made a big policemen and officers’ team including encounter specialists to arrest one journalist. This will tell clearly how much fear they have about Arnab Goswami and his supporters of this country. They intentionally took him in crime branch van to project him as a criminal.

They wanted to expose Arnab by using so many fake cases, But by doing these acts they themselves have exposed in front of country that how fearful they are about Arnab ji. They have beaten his son and didn’t allow him to meet his family members. What sort of emergency is this?

While the mumbai police can give a clean chit to SSR case victims and bollywood drug case victims, why they have treated Arnab ji the one who always stood for the country in this disrespectful manner. Is that political power becomes more superior above country for them? Is that the fear of coming truth of recent injusticed cases( pulghar case, SSR case, bollywood drug case and TRP case) by the republic investigation made them to do this antinaional act? Or Is that the foolish thinking of shutting up people’s mouth against government by doing this anticonstitutional act?

If you can’t tolerate the words against your government and if you can’t deliver justice, how can you give the good administration to the people of maharashtra? If CMs of all states started doing this, what will be the consequence? Have you ever thought about it? Why you people are forming government and appointing policemen, If you can’t do your duty of serving people without selfishness?

Assume for a while, If honorable PM have done like this. But he will not do these kinds of works which are not in the favor of country for his personal sake. So, the people who don’t even giving respect as a prime minister of our country also for their political issues are free now also and living happily without any fear. Arnab goswami who always fight for our country is in need of our support. So now we should fight for this great fearless patriot. So, this is a high time to make strict law to stop fake cases emerging with the misuse of power.

बिहार चुनाव और महिलाएं

अपने बहु प्रिय नाटक “ध्रुवस्वामिनी” की पुनः यात्रा ने मन में पाटलिपुत्र की महान स्त्रियों की विरासत की चिर स्मृति मन में जगा दी, वो भूमि जिसने १६ महाजनपद की अवधारणा देके भारत को राज करना सिखाया उसकी महिलाएं कितनी आत्मबल से लबालब होंगी जिन्होंने भारत को उतरोतर सम्राट तैयार कर के दिए!

आदिकालीन माता सीता हो जिन्होंने लंका जैसे साम्राज्य से अकेले निडरता से आंखे मिलाई, उर्मिला जिन्होंने अपने स्वाधिकार से लक्ष्मण को अपने स्वच्छंद धर्म निर्वाहन को प्रवृत्त किया।

कैसा विषद आत्मबल रहा होगा सुजाता का जिनकी “जैसे मेरी मनोकामना पूरी हुई, उसी तरह आपकी भी हो” के शुभेक्षा से भरी खीर ग्रहण करने पर्यन्त बुद्ध को आत्मबोध हो गया।

फिर यशोधरा, मूरा, शुभाद्रंगी जैसे वीर जाया माताएं और राजकन्याए हो, या उभया मिश्रा जैसी विदुषी जिनके सामने शंकराचार्य को भी लगभग घुटने टेकने पड़े, बिहारी महिलाओं के शौर्य को बहुत अंदर जाकर ढूंढना नहीं पड़ता।

वैसे तार की जोती की माने या ऐसे भी बिहार मातृ सत्तात्मक रहा है means Bihari guys आर मोस्टली mumma’s boy (जोती जी से साभार) सिवाय एक यादव परिवार की बहू आधी रात को घर से निष्कासित की जाती है उसे अपवाद रखें। अपवाद तो गांधी परिवार में मेनका जी के साथ भी ऐसा ही हुआ परंतु हम इसे लेकर भारत में और बिहार में महिलाओं की पारंपरिक स्थिति पर धारणा नहीं बना सकते।

पर जैसा कि सर्वविदित है कि सामाजिक कुपोषण का पहला शिकार भी स्त्री होती है, वर्षो तक घोटालों और प्राकृतिक आपदा झेलता बिहार निश्चय ही अपने कई समर्थ नौनिहालों से हाथ धो चुका है और इसका बहुत बड़ा मूल्य महिलाओ ने चुकाया। एक जातउद्घोषक सरकार में एक जाति विशेष महिलाओ का चुन चुन के बलात्कार की बात हो या बाहुबलियों की अतिशयोक्ति, बिहार की लालनाओ की परीक्षा सदियों तक चली।

वैसे लालू के समय में जो बिटिया शाम होते ही ढोर जैसे घरो में बंद कर दी जाती थी, अब शाम को विहंगो जैसे साईकिल पर उन्मुक्तता से बैठ बिहार विहार करती है, इस वाक्य के अलंकृण निश्चय ही भावतिरेक में, लालू के उस काल को सोच कर आता है जब अपराध ने अपनी नई सीमाएं नापी।

और सीमाएं ही नहीं अपराध निरन्तर नए रूप और प्रतिमान लेता, और स्वाभाविक है समाज में अपराध की पहली और अंतिम भोक्ता महिलाएं होती है चाहे आपको कुल का मान मर्दन करना हो, व्यक्ति का या समुदाय का।

पर NRCB की data से यह जानना बहुत सुखद रहा की नीतीश के शासन में बिहार में महिलाओ के विरूद्ध अपराध भारत में तीसरे पायदान पर है, राजस्थान और दिल्ली से कहीं सुरक्षित बिहार अब उन्मुक्त स्वशन लेता प्रतीत होता है।

तो इस चुनावी मौसम में तब मन हुआ जानने का कि राजनीतिक पराक्रम के खेल में महिलाओं के नियत कोई चुनावी वार्ता है भी या नहीं और कुछ दिन से कुछ बिहार के चुनावी एजेंडे पर देखे गए, साथ ही कुछ राजनीतिक भाषण का भी जायजा हुआ।

आशानुरूप सबसे निराशाजनक बात थी कि बिहार के राजपुत्रो ,तेज प्रताप यादव और तेजस्वी यादव के भाषणों से खानापूर्ति वाक्यों के अलावा महिला विकास और सशक्तिकरण ही गायब था। चिराग ज्यादा सुनने में नहीं आए पर वोह अपेक्षाकृत काफी कुशल वक्ता और नेता है।

ऐसे ही भारतीय जनता पार्टी का पक्ष रखते हुए श्री गुरुप्रसाद पासवान को इस बीच काफी न्यूज चैनल पर सुना जिससे पता चला कि बिहार में इस बीच राजग सरकार के अंतर्गत
१. ७ करोड़ जन धन खाते जो अक्टूबर २०२० तक खुले उसमे २.५ करोड़ महिलाओ के है
२. ४ lac मुद्रा योजना के अन्तर्गत आवंटित ऋण में २.५ लाख महिलाएं लाभान्वित हुई है.
३. १.५ करोड़ महिलाएं सेल्फ हेल्प के माध्यम से एमेजॉन, फ्लिपकार्ट जैसे बहुराष्ट्रीय कम्पनी में बहु आयामी भूमिका निबाह रही है।
४. इसमें सबसे महत्वपूर्ण समाज की इकाई व्ववस्था, पंचायत में दिया गया आरक्षण उल्लेखनीय है।

यह जानकारी उत्साह जनक है और उससे भी ऊपर यह सुखद है कि बिहार के राजनीति में लालू के जाति गोलबंदी और और तुष्टीकरण से ऊपर महिला विकास और सशक्तिकरण की एक स्वस्थ और बहुप्रतीक्षित विमर्श शुरू हुई जो अब तब बिहार के राजनीतिक पृष्टभूमि से नदारद थी!
इस सकारात्मकता का स्वागत होना चाहिए और ईश्वर इस वार्ता को “पुष्पित” पल्लवित करे!

How can India overtake China economically?

Till 1980s, China and India were almost at same position, but after that China started to overtake India.

The first reason is Political Stability. China has one party system, no nobody questions their policies. The example of political instability in India is Maharashtra. As soon as Shiv Sena Government came in power in Maharashtra, they put a hold on Bullet Train project of the previous BJP led government.

The second reason is Infrastructure. China has invested heavily in their infrastructure, which in turns attracts FDI. Today, almost every company has a manufacturing hub in China.

The third reason is ‘Make in China’. China started their project in 1980s, whereas India started, ‘Make in India’ in 2014. It took more than 40 years for China to make their project successful. While in India, some political parties have started crying in 6 years that Make in India is a failure.

The fourth reason is mindset. China had accepted long ago that their population is so large, that not everyone would get Government jobs. So instead of encouraging their children to prepare for government jobs, they improved the skills of their younger generation, to work in industries and manufacturing sector.

At the moment only service sector of India is a bit better than China. In India, the service sector contributes to more than 60 per cent of GDP while its GDP share in China is much smaller. The reason china is an economic giant today, is because of of it’s manufacturing hub. India’s Industry sector contributes 23% to the GDP, while in China it is 40%.

India needs to focus on Industry Sector. For this, India needs to shift (skilled) labors from agriculture sector to Industry sector.

‘Pen-is mightier than sword’- Kuf’rs & the growth of Islam

First things first.

‘Pen is mightier than Sword’- is the original phrase, put together by Edward Bulwer-Lytton in 1839, to propose that, advocacy/propaganda via writing/journalism is more powerful – and will give much, much better results than the use of direct violence.

This maxim has been kinda proven in the recent USA elections – with the Left-Liberal democrats using their entrenched propaganda skills (via Twitter, Google, WaPo, NYT and the like) in combination with (probably unnecessary) significant violence (via #BLM and other assorted protests) run-up to the elections.

Anyway. Be clear that, this post is about Penis and NOT ‘Pen Is;’ About PMtS. ‘Penis Mightier than Sword.’ In the specific context of Islam.

Of course, in Bharat, there are the associated bleeding issues of the huge fecundity of a given/average Muslim family, its average size, early marriages, infusion of foreign funding, brainwashing that happens from childhood, minority appeasement, proliferation by migrants (in India’s case, Rohingyas and Bangaldeshis), politics of appeasement (by congressis, communists, dravidians and the like), slavish media, and D gang money & muscle – not to talk about the ISI kind of encouragements to Islamic terrorism.

However, as I mentioned earlier, the thesis of this post is that, given the strategic use of the Penis, along with the tactics of ‘oont aur musaffir‘ (or the ‘Camel and the Tent’ parable, if you will – one version) the imperialist & colonialist Islam ideology is poised to reap rich demographic dividends & benefits.

The hard fact of PMtS is the soft power of incremental, not readily noticeable demographic changes, that grow by way of compound interest over time. Especially with respect to the spread of the Islamic ideology. Specifically via the Penis. And, spread through the control of the Wombs.

Islam (and mostly Catholic Christianity also) has always spread through two basic ways.

1. Sword: putting infidels to death, unless they convert wholesale. Or under the threat of the Sword, or converting them by offering them sops like menial jobs, relief from taxes imposed on infidels/kuf’rs like Jizya, release from slavery etc.

2. Penis: using the Islamized penis to impregnate the wombs of the enslaved infidels/kuf’r women, little girls even. The ensuing and hapless generation,estranged from its cultural roots, grows up as self-loathing, gruesome warriors and wombs of Islam.

These two ways are very much authorized by Islam, and are authenticated in Quran. They were also very religiously practiced by the inventor of Islam. Hence, using Swords and Penises are normal and recommended forms of dawah or the preaching of Islam. It is all halal, thanks so much!

However, as an effective strategem, Penis scores massively over the Sword – across many contexts and axes of approaches. As in:

Costs: Obviously, the costs of wielding a Sword are high. One has to clean the sword after use, for example. But one does not need to clean the Penis at all. It can be reused  as many times as needed, with the technique of Islamicus interruptus.

Maintenance & Effectiveness: Also, unlike a sword, which needs to be polished & sharpened often times so that it remains effective & retains the ‘halal cutting edge’ — the Penis as a weapon, need not much be taken care of, at all. The more the Penis is used, the more effective it becomes in terms of endurance, its goal.

Short term Vs Long term: Using a Sword is relatively a short term game. One has to repeatedly do it and administer the swooshes to generation after generation of kuf’rs. It is not to say that is not effective, but energies have to be extended and applied over a longer period and you can kill a given kuf’r only once, which is not satisfactory; however, using a Penis is like ‘put it, forget it.’ The same Penis can be reused again and again to impregnate not only the same kuf’f woman but also others. No need to clean it for multiple use, either physically or metaphorically.

An added bonus is that, progeny that would result via such Penisism is already brainwashed and would be a willing foot soldier of Islamic expansionism with Sword, if male – and if female, can be reused as a hatchery or a momin factory.

Propaganda leverage: Usage of a Sword, invariably results in responses and reactions – and most importantly bad press, not that Islam really cares about a bad image. Sometimes there are pinpricks like condemnations, but even this can be managed over time – if the Swooshes of the Swords happen in bits and pieces, literally! However, when the conversion happens via Penis, then LeLis would invariably support them, even moderate kuf’rs would encourage them, talking about the ‘merger of the hearts’ and what not. In this case, ignorant folks and useful idiot-kuf’rs rally to the self-defeating cause.

(Tick whichever is applicable: a) Eashwar Allah tero naam b) Vasudaiva kutumabakam c) Aa no bhadraha kritavo yantu vishwatah d) All of the above) Actually it is good press, even. Works very well in the long term interests of the Islamic ideology.

Historical memories: Sword swooshes with their blood and gore create a long term deleterious image – that refuses to go away; however, when Proselytization by Penis happens, a little semen by droplet semen, literally nobody notices; it is like Cancer, the silent killer. Or like a terrible Virus, that invades another culture, and uses its DNA & nutrients to proliferate. Since this is not seen as an attack or an illness, the target culture/society does not invent any vaccines for it, nor does it take remedial/counter measures; sadly this tamassic nature only results in demise of the target cultures. Ancient Zoroastrians, Pagans, many Jewish tribes, many Christian communities which have ALL seen their early demise, are great examples of how the Islamic ideological penises are NOT to be handled.

Directionality: It is possible that  there could be a  few rebellious Penises from the yet-to-be Islamised target cultures, that are interested in an Islamic girl/vagina; fair enough, it is all evolutionary behavior and play of harmones and youth… Call it ‘ill fated love,’ whatever. However unless the aforementioned Penis belongs to a rich, well-to-do kuf’r, the part and its owner are invariably cut off with a Islamic Sword, even to the horror of the hapless Islamic girl; sometimes the poor girl is also finished off as an example and as an added bonus. All of us know that, these tragedies happen as a matter of routine in Bharat. These gruesome treatments, exemplar executions and ‘nipping in the bud’ of a counter jihadi-love sends many signals. Three morals of this are: 1) Penis can be used in only one direction 2) If they are used in the counter/opposite direction, then Islamic Sword will be put to good use 3) Wombs are protected, only one-way entry will be encouraged.

Given the above axes, it is no surprise that PMtS strategy is working absolutely fine, for Islamic dawah and ideologies.

It is as important to control the Authoritarianism of the Penises,  as to control the access to target, kuf’r Wombs. This can ONLY be done via a proper, persistent and reinforced education to the kuf’r young men and ladies – clearly telling them as to what is at stake, and what gruesomeness can a mere harmone-crazed love can lead to etc.

I sincerely believe that, along with ‘birds and bees’ kind of knowledge transfer/talk to their adolescents and other impressionable youth – the kuf’r communities also need to talk to them about the deleterious potential of the Penis, which as an instrument of accession provided to the messianic/Islamic cultures, works almost always against the Polytheist / Pagan / Bharatiya faiths – and more specifically against their individual selves, their welfare and their very being.

Of course there are rare exceptions, wherein there is genuine affection, consideration and mutual respect between a Penis and a Vagina, irrespective of the faith of the owners of the respective body parts – but these exceptions only prove the general rule. I personally know of a very few exceptions, but also know of many, many more general cases – directly, and much more through media.

So. PMtS = TRUE.

‘Love Jihad’ – this phrase may be repugnant to LeLis (Leftist – Liberals) – but it is a lived reality in the context of PMtS. I am saying this from a proximate cause of a close friend of mine (who is an ex-LeLi), whose ravaged daughter has come back to her Indic household, broken, bruised and much aged (beyond her chronological age!) – poor thing. That, this daughter was highly educated, had a great career in STEM etc things did not really matter. She just ‘fell’ in love. Which on the face of it, was normal, correct thing even.

That the Muslim lad, who married her, showing-off his brightness + liberal and academic credentials, also did not matter. Once the wedding happened, then the constant struggle jump-started – name change to dresscode to dos-and-donts to… Actually the ‘liberal muslim’ lad started enforcing Islam on her with direct threats and even occasional beatings (all pukka approved by Quran of course!), but what else did she expect? (luckily she was not pregnant when she came back, but not many are lucky like her…)

It is subsequent to listening to such horrendous tales by the pitiable father that I posted a couple of tweets.

I had seen (once) this daughter when she was a little, bright girl and it really hurts to know now that, her whole life has seemingly crumbled around her, and she her natal family are forced to pick up the threads of existence after shifting to a new town, shorn of their geographical & cultural roots.

Love Jihad is a lived reality for many, many young ladies. And, I am not over-generalizing based on one data-point; many such Lovejihaded girls suffer in silence. Many do not have the luxury of getting back to their natal homes and the dharmic comforts that they offer. They do not have any support system worth speaking of. Tragic.

Love Jihad is definitely, a significant tool for implementing the Islamic ideology of ‘Penis mightier than Sword.’

And, now I recollect the relevant parts from the brilliant novel – Aavarana of SL Bhyrappa, in this context of a Hindu girl getting married to an educated Muslim scholar… (and paying dearly for it)

Aavarana, at a variety of levels, is NOT merely fiction.

As a target population of kuf’rs, we need to take cognizance of the Islamic ideology and its very effective tool, Penisism.

Please note that, I am not talking about some theoretical scenario – I have actually sat in ‘relatively peaceful’ and ‘less hateful’ Friday salaat al-jumuah in some mosques, wherein the madarsa sheikh/Imam who lead them, even talking encouragingly about this ‘love’ as a tool for Dawah, the proselytization of kuf’rs and for increasing the number of the faithfuls…

Postscriptum: It is not that Evangelical Christianity does not do this. It does it with much better polish & aplomb. It does not completely negate the Bharatiya narratives (unlike Islam) but, insidiously digests them; this is even more dangerous than Islam, because it seeks to control the target Wombs, and distort/digest the Dharmic pathways wholesale.

The Hindu-shaming of Hindu festivals

The subtle sermonizing on our festivals was not enough, that now the backdrop of our festivals has again become an opportunity for some to divide us on linguistic fault lines.

“Durga Puja is indeed more Bengali than Hindu” an argumentative Twitter user ranted. Some of us have suddenly had a revelation in recent times that celebrations which revolve their existence around Hindu calendars are ought to be painted ‘Secular’. The argument is being made that Hindu festivals are celebrated by non-Hindus in large numbers which makes them less ‘Hindu’ is thwarted upon the very origin and existence of these festivals. A similar narrative was being wrapped around our minds during Onam, this year. A caste angle was also brought in specifically in this argument that Keralites, unlike other Hindus chose to celebrate Mahabali over Vamana, the latter being painted as casteist in popular notion. Certain questions tend to arise as we dissect through this recent narrative – Does the celebration of Durga Pooja and Vishu by Non-Hindus make them non-Religious festivals? Is there a conscious attempt to hide the Hindu credentials of our festivals or is it a quest for regional identity? And does acknowledging the Hindu character of these festivals make them less inclusive for our Non-Hindu brethren?

The communist worldview of authoritatively commenting on the Dharmic way of living and patronizingly inserting its paradoxical logic on Hindu rituals is hilarious. However, it is proving tragic for Hinduism as leftist agnostic ideals have called upon a war by questioning the very character of the Hindu sensibilities. A normal layman Hindu is far away from discovering this scavenges on his own ideals by ulterior narratives. He in turn, goes on re-checking his own practices one festival after another. A Hindu is a womanizer when he celebrates Navratri revering the feminine divine and disregards the womanhood after the nine-day festival ends. Come Diwali, he destroys the environmental balance in a single day by burning crackers. On Holi, he proves himself to be a molester, by throwing semen-filled balloons on women. This rhetoric is beyond mere generalizations. They not only strive to convince you that Hinduism promotes anti-social elements but they make our regional identity contest with our consciousness as a religion.

And when the systematic witch-hunt fails to carve out divisive results, it’s already the time to embrace the festivities but work for its Hindu credentials to go away. Your festivals will be retained, but the religious character must be washed off. The subtle sermonizing by influential brands on our festivals was not enough, that now the backdrop of our festivals has again become an opportunity for some to divide us into linguistic fault lines. Thus, Vishu becomes Malayali festival and Durga Pooja and Bengali one and certainly, these are not Hindu Festivals. The reason given is simple – Just because they cut across many non – Hindu Keralites and Bengalis, these festivals don’t remain Hindu anymore!

The very nature of an Indian Festival is a complex one. It is a celebration of goodness and coming together of a community regardless of social barriers through birth anniversary of a religious divine, a historical event, welcoming a new season, a change in the astronomical setting or sometimes all combined into one! Our festivals resonate greatly with the natural cycles which make them ecologically sensitive, given we being a surviving pagan culture. Plus, it is a backdrop for spiritual fulfilment and a playground for self-expression. We have thousand different ways to celebrate one festival, with each home having its own culture to go about it. And thus it is the very nature of Dharmic Festivals that their dynamism resonates with all communities and they thus cut across all the cross sections of the society to celebrate it.

So when all communities come together to celebrate a Hindu festival, does that make it a non-religious one? In fact, it is Hinduism itself which goes beyond many boundaries to make it an all-encompassing inclusive gathering. Our Festivals are deeply secular because they are Hindu at the core. They are also religious at the same time because there is a science attached to the practices. The science of pouring life into a decorated idol called Prana-pratishtha, feeding the goddess Bhog and praying her like a mother, to her immersion into the natural forces underlines the Dharmic philosophy of cyclic life. At the outset, worshipping an idol itself makes us religious and at the same time makes us infidels when looked through the Abrahamic lens. From being religious celebrations to socio-cultural gatherings, Hindu festivals are deeply religious and culturally liberating at the same time. For Religion and social order don’t contest against each other in India, they only converge into each other many a time.

A game of Identities

Now, if a Bengali celebrates Durga Pujo he must be secular because he invites his Muslim neighbours to the Pandal. But if a Hindu celebrates the festival revering Durga, he is a hypocrite as he will be generalized for committing crimes against women for rest of the year while worshipping a goddess for mere nine days. At the same time, A Bengali-Hindu in the same Pandal becomes communal because cannot see the festival beyond religious lines and deters to give away its Hindu credentials.

Identities remain personal in India’s social context and they are central to individuals. But, when they are snatched out of one’s personal space to suit a vilification of our collective social possessions, it becomes a hate-driven agenda. Moreover, it is always the Hindu ideals that are challenged. No eyebrows are raised when Nusrat Jehan, a TMC MP performs Pujo and the Mullahs go berserk.

The trope of creating divisions within differences has been systematically employed to create fault lines by highlighting our religious, cultural and linguistic identities. Never before on the account of any Hindu festival in Kerala or Bengal, were the linguistic identity and religious identity separated. It looks like these identities are made to contest against each other to serve a purpose of creating pockets of political vote banks. It also seems like the intellectual divide-and-rule is here to stay.

The slandering of our fundamentals by unassuming divisors within or external is not new. The festive season of pontificating the eternal discourse of dharmic ideals is here. The challenge now remains for us to keep celebrating our ideas and not give away them against sophisticatedly carved out divisive world views. We as a nation must realize that despite of our million ways live and look at life in different ways; we are bound by a sacred geography that is the seat of continuing Civilization. Also, for a civilizational state like us our federal character is bound by our strong sovereignty.  It is only when we assert our civilizational priorities that we will give away the slandering of our Hindu consciousness.

Gross violation of Supreme Court guidelines – Illegal detention of Arnab Goswami

The arrest of Editor-in-Chief of Republic TV Media Network Arnab Goswami is a blatant misuse of power by the Maharashtra Police. The illegal arrest is an attack on individual freedom and the fourth pillar of democracy. The more serious charge is violation of the Supreme Court guidelines passed in the judgment of DK Basu vs State of West Bengal AIR 1997 SC 610. The following requirements to be followed in all cases of arrest or detention as preventive measurers :

(1) The police personnel carrying out the arrest and handling the interrogation of the arrestee should bear accurate, visible and clear identification and name tags with their designations. The particulars of all such police personnel who handle interrogation of the arrestee must be recorded in a register.

(2) That the police officer carrying out the arrest of the arrestee shall prepare a memo of arrest at the time of arrest and such memo shall be attested by at least one witness, who may be either a member of the family of the arrestee or a respectable person of the locality from where the arrest is made. It shall also be counter signed by the arrestee and shall contain the time and date of arrest.

(3) A person who has been arrested or detained and is being held in custody in a police station or interrogation centre or other lock-up, shall be entitled to have one friend or relative or other person known to him or having interest in his welfare being informed, as soon as practicable, that he has been arrested an is being detained at the particular place, unless the attesting witness of the memo of arrest is himself such a friend or a relative of the arrestee.

(4) The time, place of arrest and venue of custody of an arrestee must be notified by the police where the next friend or relative of the arrestee fives outside the district or town through the Legal Aid Organisation in the District and the police station of the area concerned telegraphically within a period of 8 to 12 hours after the arrest.

(5) The person arrested must be made aware of this right to have someone informed of his arrest or detention as soon as he is put under arrest or is detained.

(6) An entry must be made in the diary at the place of detention regarding the arrest of the person which shall also disclose the name of the next friend of the person who has been informed of the arrest and the names and particulars of the, police officials in whose custody the arrestee is.

(7) The arrestee should, where he so requests, be also examined at the time of his arrest and major and minor injuries, if any present on his/herbed, must be recorded at that time. The “Inspection Memo” must be signed both by the arrestee and the police officer effecting the arrest and its copy provided to the arrestee.

(8) The arrestee should be subjected to medical examination by a trained doctor every 48 hours during his detention in custody by a doctor on the panel of approved doctors appointed by Director, Health Services of the concerned State or Union Territory. Director, Health Services should prepare such a penal for all Tehsils and Districts as well.

(9) Copies of all the documents including the memo of arrest, referred to above, should be sent to the illaga Magistrate for his record.

(10) The arrestee may be permitted to meet his lawyer during interrogation, though not throughout the interrogation.

(11) A police control room should be provided at all district and State Headquarters, where information regarding the arrest and the place of custody of the arrestee shall be communicated by the officer causing the arrest, within 12 hours of effecting the arrest and at the police control room it should be displayed on conspicous notice board. (Para 36)

These requirements are in addition to the constitutional and statutory safeguards and do not detract from various other directions given by the courts from time to time in connection with the safeguarding of the rights and dignity of arrestee.

In law, there is a principle of “presumption of innocence till he has proven guilty” it requires a person arrested to be treated with humanity, dignity and respect until his guilt is proven. In a free society like ours, the law is quite careful toward one’s “personal liberty” and doesn’t permit the detention of any person without legal sanction. Article 21 of our constitution provides: “No person shall be deprived of his life or personal liberty except according to procedure established by law”.

On 04.11.2020 Arnab Goswami along with his mother-in-law, father-in-law, son and wife have been physically assaulted. Mumbai Police entered Goswami’s residence today and allegedly physically assaulted his family members and him. Republic TV channel has telecast visuals of Mumbai police entering Goswami’s residence and what appears to be a scuffle. Armed Police carrying assault rifles barged Mr. Goswami’s house and physically assaulted him. He was forcibly dragged by his hair into the police van before being arrested by Raigad Police in Maharashtra. The police forcibly shut off news cameras before barging into the residence of Mr Goswami and attacking and thrashing a reputed national TV news journalist. Arnab was dragged out of his own home as nearly 40-50 police officers cordoned off his residence. Moreover, the cops also attacked his 20-year-old son and manhandled him as he tried to capture the brazen attack by the Mumbai Police on camera. The incident, which has been captured on camera, shows Arnab screaming at the cops to not touch his son.

Arnab Goswami was forcefully dragged and physically manhandled before being taken into the custody in the death case of interior designer Anvay Naik, who allegedly died by suicide in Alibaug in May 2018. A suicide note purportedly written by Naik alleged that Goswami had not paid him his dues. It is pertinent to mention that the closure report was filed by the police and the case is re-opened maliciously to settle personal score.

Maharashtra Governments should not act with a vindictive mindset against their critics. Journalists and media organizations should not be harassed and persecuted for their comments and views, however unpleasant and biased they are. In Lucknow Development Authority Vs M.K.Gupta , it was held that ”when public servant by mala fide, oppressive and capricious acts in performance of official duty causes, injustice, harassment and agony to common man and renders the State or its instrumentality liable to pay damages to the person aggrieved from public fund, State or its instrumentality is duty bound to later recover the amount of compensation so paid from the public servant concerned.”

The author who is a Lucknow based advocate has personally prayed before the National Human Rights Commission that directions passed by Hon’ble Supreme Court of India is a sine qua non under the criminal law jurisprudence and therefore contempt of Court proceedings and Departmental action should be initiated against Maharashtra Police officials who has violated above safeguards guaranteed to the citizens of the country.

उत्तर प्रदेश में अंसारी गैंग के अवैध निर्माणों पर लगातार योगी सरकार का वार

उत्तर प्रदेश में समस्त अवैध निर्माणों तथा सम्पत्तियों पर योगी सरकार की पैनी नज़र बानी हुई है। हाल ही में गाज़ीपुर के माफिया मुख्तार अंसारी के होटल ग़ज़ल पर कार्यवाही करते हुए उसे ध्वस्त किया गया था। अवैध निर्माणों के मामले पर शिकंजा तेज़ करते हुए अब सरकार ने वाराणसी में अंसारी गैंग के मेराज़ तथा मऊ में ईशा खान के गैर कानूनी इमारतों पर बुलडोज़र चलवा दिए हैं।

मेराज़ अहमद, मुख्तार अंसारी के अंतरप्रांतीय गिरोह का सहयोगी तथा जैतपुरा थाना अंतर्गत अशोक कॉलोनी का ररहने वाला है। शास्त्रों के फ़र्ज़ी कागज़ात लेकर लाइसेंस बनवाने तथा उनके नवीनीकरण के आरोप में मेराज़ पहले ही जेल में बंद है। उसपर आईपीसी की 419, 420, 467, 468, 470, 471, 216 तथा 120बी के तहत कई मुकदमे चल रहे हैं।

मेराज़ ने अशोक विहार कॉलोनी स्तिथ अपने मकान के पिछले हिस्से में एक अवैध निर्माण करवा रखा था, जिसके लिए उसे 2 महीने पहले ही वाराणसी विकास प्राधिकरण (वीडीए) द्वारा नोटिस भी जारी किया गया था। नोटिस का कोई संज्ञान न लिए जाने तथा अवैध इमारत के ज्यों के त्यों रहने के कारण वीडीए ने स्वयं कार्यवाही करते हुए उसे ध्वस्त करवाया। ध्वस्तीकरण के दौरान वीडीए की टीम तथा सीओ चेतगंज संतोष कुमार मीणा, इंस्पेक्टर जैतपुरा साक्षी भूषण राय सहित भरी पुलिस बल मौजूद रही।

दूसरी ओर, मऊ में गाज़ीपुर तिराहे पर अंसारी गैंग के एक और माफिया ईशा खान की अवैध इमारत को गिरवाया गया। आरोपों के अनुसार पेरिस प्लाज़ा नामक यह अवैध इमारत सरकारी आईटीआई की ज़मीन पर बानी थी। इमारत ध्वस्त करने के समय मौके पर सख्त सुरक्षा बलों की तैनाती रही।

Reinventing 21st century leadership

The concept of business existed since Medieval times and will exist even after 1000 years. To do business you need 2 parties, the buyer and the seller, the customer and the employees. Modern day business is plagued with the idea of a third party called the Shareholders who has complicated business and has caused most customers and employees great pain. Numbers have become order of the day and humans are being treated as a sugarcane in a squeezer  as more and more organizations are trying to achieve more with less.

Till the time Six Sigma, yellow belt, green belt,  lean and other quality management tools were used in manufacturing and production, the world looked like going towards efficiency however when the same tools get used on humans to measure their efficiency or utilization then we have pressed the madness button. Can you believe that we have progressed (or shall say regressed) so much that we are trying to measure utilization level of an employee using the same tools that measures utilization of a car engine. Well I call that an insult to our Neo-cortex.

It is a Global reality

My profession allows me to interact with senior leadership of my organization and even when I was working for IBM I had some good fortune to spend time with some top leaders. Although I want to state to you upfront that I did have some wonderful people managers for whom I mattered more than numbers, however by and large I did come across a pool of number crazy leaders who was ready to sacrifice people if they miss their annual targets (important here to note that by sacrifice I do not necessarily mean layoffs, it can be in forms of warnings or a bad appraisal or on promotions or on increments etc) and when I came to know that in USA more than 70% employees are found disengaged (as per Gallup Survey) or around 58% managers admitting that they never got any management training (Study by Career Builder) or around 58% of employees stating that they trust strangers but not their Bosses (Harvard Business Review survey), there was hardly anything else left to convince me that what I was experiencing was not anything unique, it is a global reality. By now many of you might be thinking, why should I worry about some data generated in USA, it is a fair enough question. So now lets look at what’s happening here, as per a survey conducted in 2018 it was shown that Employee’s lifestyle habits are costing Bangalore’s most cherished IT industry a loss of whopping Rs 24,000 crore every year ( that is 7% of total Bangalore IT sector revenue) and the primary reasons have been stated as poor emotional and mental state of people. As I said before “ It is a Global reality”.

The challenge lies before the 21st century business leaders to come out of this conundrum and make a clear demarcation in their mind about who comes first “People” or “Numbers”. If you select people you lose numbers and if you choose numbers you lose people which eventually hits your number later on . If you are still perplexed about this then please read on.

Are we following a Malpractice?

I always used to think whether business has been carried on like this in every century, and that question lead me to Mr. Jack Welch.  The great downfall of General Electric’s whose stock once rose to $59.44 USD in 2000 from a mere $2.24 in 1985 primarily under the number comes first champion and the manager of 20th century Mr. Jack Welch, is a shining example in front of all of us. In his book “Winning” Jack Welch wrote “ It sounds awful, but a crisis rarely ends without blood on the floor. That’s not easy or pleasant. But sadly, it is often necessary so the company can move forward again” – This pretty much sums how Jack Welch ran GE. However now everyone has started realizing that the same principle of prioritizing numbers before people, annual layoffs to balance the books, incentivizing people to hit numbers, Rank and yank people, Shareholder supremacy etc which saw the rise of GE in short time is also responsible for the fall of GE in the long term. GE suffers a slow death as we speak with its stock choking at $11 USD now. At the same time, we have Costco, Southwest airlines, Virgin, TATA, Google, Apple, Ford, Amazon etc etc who understands the importance of Vision, values and people in business and they outperform their rivals in the infinite game of business.

The success of Jack Welch inspired a lot of CEOs to follow in his footsteps and the concept of favouring numbers over people to gain in business quickly keeping up with annual mission statements and financial targets gained steam so fast that in no time we saw these practices became a normal way of life for corporates. Very few realized at that very moment that what worked in 20th century might not work in 21st century, what worked for short term will not work for long term. As the famous statement made by Herb Kelleher of Southwest Airlines goes “Business of business is people” or Virgin’s Richard Branson saying “take care of your staff and they will take of your clients and business” … all these statements point towards the same direction and that is long term sustainable business strategy.

Very important here to note that I am not a biased critic of Jack Welch and I do recognize and appreciate a lot of good work done by him but in this context, he did propagate an evil practice which has continued to plague business in 21st century. Although numbers are very important in business, just like fuel in a car, it keeps the engine running but whenever leaders come to a point where they have to choose between numbers and people, the great ones always chose people even if they had to suffer financial loss for the time being. Favouring numbers over people for sure will get you your financial goals and your balance sheet will look clean quarter on quarter however it will create trust deficit among employees and customers and over a period of time your business will collapse, in short it has a direct impact on longevity of your business. In 1958 the average lifespan of an organization was 61 yrs and we have brought that number down to 18 yrs in 2018.  if only statistics can lie. Off course disruptive technologies also play a key role here however we cannot deny the employee disengagement stats and hence the losses incurred shared earlier in this article. This simply tells us that we cannot follow this malpractice anymore. 

A ray of Hope

The fundamental mistakes of bringing in the evil practices of 20th century putting a blind faith of GE model needs to be corrected if we have to raise and develop more healthy and sustainable workplaces. A workplace where people feels valued and respected and secure. Numbers can provide us a target or goal to aim at, missing it should not be the end of the game since business unlike cricket or football does not end on time, its purpose is continuation and continual improvement.

I find hardly any difference between Stalin and most of the CEOs, one killed his own generals, the best ones following a loss and that weakened his own army allowing Germans to attack and cause damage, the CEOs on the other hand sacrifices own employees if the numbers are not met end of year making his own organization weaker and spreading fear among the survivors who eventually will leave the sinking boat well before time. I have even seen some CEOs are so crazy on meeting the financial targets that they are even okay to lose a customer… In this 21st century we can no longer follow the outdated and shallow principles of numbers. If we can offer a good quality of life and support to our employees and customers – numbers will eventually follow.

Thankfully the business world is not a gloomy dark place and there are some companies which stayed on the right track and few new ones also who has learnt from others. When you look at their performance for 4 yrs or 5 yrs you might not get impressed but when you step back and look at the wider curve you can clearly see that they have a worthy vision and their focus on their vision and people has clearly paid them rich dividends. Here are a few for your information. I am sure you all will find he rest. Our job as 21st century leaders should be to take this ray of hope and paint our offices with a culture where People actually gets this feeling every single day that a fictitious number does not define him.

Are we in a trap?

Addressing a dignified person as “Tu”, “Tera” in public; suggesting publicly an aged veteran politician that something may happen to him any moment, he should read Geeta now; asking somebody in public, “if you find your son hanging what will you do?”; lynching people for smallest of reasons; even MPs rushing to the Speaker and destroying documents in an unruly manner, and so on; the list is never ending. These are common news these days. Media enjoys this type of masala as it gives increased revenue.

People are very busy in social media as well by supporting one side or the other. The kind of language used these days, one can easily judge the mental state of the people. When educated people and public figures get involved in behaviours like this they find supporters, then it inflicts the society and it becomes a problem. We are witnessing this of late very often.

This is a deterioration of the society and it allows to form a culture. People exhibit this type of behaviour out of frustration. But why the gradual surge of frustration of people?

Ted Robert Gurr, the author of Why Men Rebel, had pointed out that deprivation occurs when your value expectations exceed your value capabilities. The perceived discrepancy between value expectations and value capabilities is viewed as relative deprivation. Values include welfare, security, self-actualization, and so forth. The intensity of this relative deprivation, or in other words, the perceived discrepancy between value expectations and value capabilities, leads to frustration which is potential for aggression and collective violence. 

Probably, in our case, the perceived discrepancies are getting widened and intensified of late and that’s why we are witnessing aggression in people behavior all across. It is imminent when people start losing jobs, incomes become uncertain, rules and regulations are framed which they feel won’t benefit them.

They easily succumb to the pressure of venting out their frustration by behaving violently or speaking in abusive and disparaging language, may be for smallest of reasons.  

It may be a traffic jam preventing me from reaching an appointment, a college rule prohibiting me from taking a particular course, an amorous neighborhood dog interrupting my sleep, a long queue delaying me from paying a bill, or a slow driver obstructing a narrow road, is enough to trigger my anger, which can lead to aggressive and violent public behavior. That’s why using abusive language in public, assaulting and even public lynching have become order of the day. The culture has deteriorated to such a level where a sensible person has to think twice before opening his / her mouth.

Culture percolates down from top, not the other way round. The practices – habits – behavior – personality exhibited by the public figures influence the common people; people try to follow them, even if the exhibits are questionable.

Everybody wants to be successful, that is again a natural human trait. Although definition of success differs from individual to individual, we always tend to measure ones success by ones money/wealth. Moreover, money gives advantages to acquire power. So, money and power are two toxic components and peoples’ life revolves around this.

But, ground reality is, everybody cannot make money and cannot have power. The people who have started the sprint, but, struggling to get to the destination are frustrated and they are unconsciously behaving in a way which is disgraceful to the society. So, abusing somebody, talking disrespectfully to people publicly, boasting of power, exhibiting wealth are the order of the day. People in this sprint do not hesitate to commit crimes to achieve something. Many cannot handle failure and end up committing suicide.

We have lost the art of sportsman spirit in the society, wherein, a sportsman plays a fair game, accepts victory or defeat gracefully, and move on to prepare for the next game. It is missing badly these days and trouble starts here.

Nobody is winning in this game, everybody is a loser. I hope people introspect and find out ways to come out of this trap. Doing the right practices is the best thing, because, practices become habits, habits become behavior, behavior becomes personality and collective personalities of people form the culture of the society.

Kerala Police Act 118 A, an abominable technique to keep our mouth shut!

The Kerala police Act 118 A authorizes the police to arrest and remand the people who criticize without any fact checks. The aim of 118 A is to prevent cyber bullying and unhealthy criticism but it can be misused extensively. Criticism plays a major part in democracy and all the citizens of India have the fundamental right to express their opinions. This underdeveloped reform creates a colossal risk of denial of our fundamental right to freedom of expression. Even the opinion in the editorial page of newspapers might have to be terminated as those are also under the risk of being a crime by the Kerala Police Act 118 A. 

  The Police Act 118A is not yet enacted but once it is enacted, we cannot criticize anything happening around us. It is not just about criticizing, any media which is produced in a satiric manner are vulnerable to this act. The present laws when enforced to it’s best can serve to solve the problem of unhealthy criticism and cyber bullying. A new law is superfluous. If it is necessary, a new section in 119 can be framed in order to prevent the violent arguments against women and children. A person’s dignity always has a value but to save that dignity by thwarting criticism is nonsensical. This law must not be enacted.
