Delusional bongs as usual: Killing of Bangladeshi Hindus in Bangladesh

Bangladesh war of independence officially lasted for nine months from 26 March 1971 to 16 December 1971. The war ended with surrender of about 93000 Pakistani troops before Indian Army and Bangladesh Mukti Bahini on 16 December 1971.

As per different sources about 30 lakhs of Bangladeshi were killed in the hands of Pakistani Army and their local collaborators like Razakar, Al Badr and Al Shams etc. during that nine months period. This figure did not include the number of rape, arson, loot, and destruction of properties.

What people of Bangladesh and Bongs of West Bengal don’t know or don’t like to know is the fact that out of those 30 lakhs killed, 25 lakhs were Bangladeshi Hindus alone. In other words, Bangladesh was created on the dead bodies of Hindus. I have never heard any Bangladeshi leader mentioning this point. Leaders and intellectuals of West Bengal have not been any better.

Pakistani administration then and now overtly claimed that government of India had instigated the Hindus of East Pakistan to revolt against Pakistan. But covertly they thought that by diverting the political crisis of East Pakistan towards Hindu genocide there, they could inflame the passion of Islam and keep the country united.

In reality, Hindus of East Pakistan had no socio-political standing after its creation in 1947. On the contrary they were constantly been persecuted as ‘Malaun’ (meaning ‘accursed’). This derogatory term has been reserved for Hindus of East Pakistan and Bangladesh. East Pakistani Hindus were continuously leaving that country for India. Even after the independence of Bangladesh, this picture has not changed. A substantial number of Hindus in East Pakistan / Bangladesh was converted to Islam also. Nobody cared to know that figure.

In 1951, Hindus constituted little more than 22 per cent of East Pakistan’s population and now it is around 10 percent only. Professor Abul Barakat of Dhaka University, in his 2016 book, said that there will not be any Hindu in Bangladesh after 30 years. He estimated that between 1964 and 2013, about 11.3 million of Hindus had left Bangladesh due to religious persecution and discrimination.

On the contrary, Muslim population in West Bengal was little more than 19 per cent in 1951 and now it is about 33 per cent. The political clout Muslims of West Bengal is palpable, but Hindus of East Pakistan / Bangladesh always lived like Jews in Hitler’s Germany. The situation is no different now.

It is very strange to note that Hindu Bengali intellectuals of West Bengal never looked Eastward across the border to know about the plight of Hindus in East Pakistan and Bangladesh, least to talk of organizing any protest in India for the cause of those unfortunate Hindus. Hindus of East Pakistan / Bangladesh remained in their blind spot. Tarasankar Bandyopadhyay to Srijato via Satyajit Ray and Amartya Sen, the same trend has been going on.

“अवमानना (Contempt), न्यायालय की अवमानना व सर्वोच्च न्यायालय”

दोस्तो जैसा कि आप इस तथ्य से अवगत हैं कि 27 जून 2020 को श्री प्रशांत भूषण ने अपने ट्विटर अकाउंट से एक ट्वीट सुप्रीम कोर्ट के खिलाफ और 28 जून 2020 को दूसरा ट्वीट मुख्य न्यायाधीश एस ए बोबड़े के खिलाफ किया था!

श्री प्रशांत भूषण की ओर से किए गए दो अलग-अलग ट्वीट पर स्वत: संज्ञान लेते हुए सुप्रीम कोर्ट ने उनके खिलाफ अवमानना (Contempt) की कार्रवाई शुरू की थी और 22 जुलाई को सुप्रीम कोर्ट की ओर से प्रशांत भूषण को इस मामले में नोटिस जारी किया गया था!

विदित हो कि 28 जून को चीफ जस्टिस एस ए बोबड़े की एक तस्वीर सामने आई थी. इसमें वो महंगी बाइक पर बैठे नज़र आ रहे थे, इस तस्वीर पर श्री प्रशांत भूषण ने टिप्पणी की थी कि CJI ने सुप्रीम कोर्ट को आम लोगों के लिए बंद कर दिया है और खुद बीजेपी लीडर की 50 लाख रुपये की बाइक चला रहे हैं! उन्होंने अपने दूसरे ट्वीट में पिछले 4 चीफ जस्टिस पर लोकतंत्र को बरबाद करने में किरदार निभाने का आरोप लगाया था!

चलिये इस वाद में क्या निर्णय हुआ इस पर अतं में चर्चा करेंगे पहले ये जानने का प्रयास करते हैं कि “अवमानना (Contempt) का क्या अर्थ होता है व “न्यायालय की अवमानना” का अपराध क्या होता है और सर्वोच्च न्यायालय किन प्रावधानों के तहत अपराधी को दण्डित कर सकता है!

अवमानना (Contempt)का अर्थ:- वह बात या कार्य जिससे किसी का मान या प्रतिष्ठा कम हो या कोई ऐसा काम या बात करने की क्रिया जिससे किसी का मान या प्रतिष्ठा घटे, अवमानना कहलाता है!

दूसरे शब्दो में कहे तो अवमानना से अभिप्राय “बात न मानने की क्रिया या जानबूझकर आदेश का उल्लंघन या अपमान या तिरस्कार से!
West’s Encyclopaedia of American Law”. The Free Dictionary.com. के अनुसार “An act of deliberate disobedience or disregard for the laws, regulations, or decorum of a public authority, such as a court or legislative body.”

Individuals may be cited for contempt when they disobey an order, fail to comply with a request, tamper with documents, withhold evidence, interrupt proceedings through their actions or words, or otherwise defy a public authority or hold it up to ridicule and disrespect.

न्यायालय की अवमानना :-
Contempt of court is behavior that opposes or defies the authority, justice, and dignity of the court.

न्यायालय अवमान अधिनियम 1971 की
धारा 2 (क) के अनुसार “न्यायालय अवमान” से सिविल अवमान अथवा आपराधिक अवमान अभिप्रेत है अर्थात अवमान (Contempt) दो प्रकार के होते हैं 1- Civil(दीवानी) व आपराधिक( Criminal)!

धारा 2(ख) के अनुसार “सिविल अवमान” से किसी न्यायालय के किसी निणर्य, डिक्री, निर्देश, आदेश, रिट या अन्य आदेशिका की जानबूझकर अवज्ञा करना अथवा न्यायालय से किए गए किसी वचनबन्ध को जानबूझकर भंग करना, अभिप्रेत है;

धारा 2(ग) के अनुसार “आपरािधक अवमान” से किसी भी ऐसी बात का (चाह बोले गए या लिखे गए शब्दों के द्वारा या संकेतों के द्वारा या
दृश्य रूपणो द्वारा या अन्यथा) प्रकाशन अथवा किसी भी अन्य ऐसे कार्य का करना अभिप्रेत है
:-(i) जो किसी न्यायालय को कलंकित करता है या जिसकी प्रवृति उसे कलंकित करने की हैं अथवा जो उसके प्राधिकार को अवनत करता ह या जिसकी प्रवृति उसे अवनत करने की है; अथवा

(ii) जो किसी न्यायिक कायर्वाही के सम्यक् अनुक्रम पर प्रतिकूल प्रभाव डालता है, या उसमें हस्तक्षेप करता है या जिसकी प्रवृति उसमें हस्तक्षेप करने की है; अथवा

(iii) जो न्याय प्रशासन में किसी अन्य रीति से हस्तक्षेप करता है या जिसकी प्रवृति उसमें हस्तक्षेप करने की है अथवा जो उसमें बाधा डालता है या जिसकी प्रवृति उसमें बाधा डालने की है

धारा 2(घ) के अनुसार “उच्च न्यायालय” से किसी राज्य अथवा संघ राज्यक्षेत्र के लिए उच्च न्यायालय अभिप्रेत है और किसी संघ राज्यक्षेत्र में न्यायिक आयुक्त का न्यायालय इसके अन्तर्गत है।

नूराली बाबूल थानेवाला विरूद्ध के एम एम शेट्टी AIR 1990 S.C. 464:-सर्वोच्च न्यायालय के द्वारा यह निर्धारित किया गया कि “Breach of an undertaking given to a Court by a person in civil proceedings, on the faith of which the Court sanctions a course of action is misconduct and amounting to contempt of court.

अमर बहादूरसिंह विरूद्ध पी. डी. वासनिक व अन्य 1994 Cri.L.J 1359 =1994(2) Bom CR 464 (Bom) it is held that “Where action of contemnor is wilful, deliberate and in clear disregard of Court’s order, it amounts to civil contempt”.

धारा 12 (1) से 12(5) तो दण्ड का प्रावधान किया गया है और धारा 12(1) निर्धारित करती है “इस अिधिनयम या किसी अन्य विधि में अभिव्यक्त रूप से जैसा अन्यथा उपबिन्धत है उसके सिवाय “न्यायालय अवमान सादा कारावास से, जिसकी अविध छह मास तक की हो सकेगी, या जुमार्ने से, जो दो
हजार रुपए तक का हो सकेगा, अथवा दोनों से दण्डित किया जा सकेगा :

परन्तु न्यायालय को समाधानप्रद रूप से माफी मांगे जाने पर अभियुक्त को उन्मोचित किया जा सकेगा या अधिनिर्णित दण्ड
का पिरहार किया जा सकेगा।

अत: न्यायालय की अवमानना का अभिप्राय एक प्रकार से “न्यायालय का अपमान करने का अपराध होता है”!

सि.पी. सिंह विरूद्ध राजस्थान 1993 Cr. L. J. 125, में स्पष्ट किया गया कि “ दण्डित करने की शक्ति का उपयोग न्यायालय के अधिकारी के विरूद्ध उन मामलो मे किया जाना चाहिये जिसमे जानबूझकर (deliberately) न्यायालय के आदेश का उल्लंघन किया गया है या जानबूझकर किसी निर्देश का पालन नहीं किया गया है!

सर्वोच्च न्यायालय के अधिकार:-

संविधान का अनुच्छेद 129 सर्वोच्च न्यायालय को स्वंय की अवमानना के लिए दंडित करने की शक्ति देता है। इसके अनुसार उच्चतम न्यायालय अभिलेख का न्यायालय (कोर्ट ऑफ़ रिकॉर्ड) होगा, और इसलिए ऐसा न्यायालय होने के नाते इसमें कोर्ट ऑफ़ रिकॉर्ड की सभी शक्तियाँ निहित होंगी, जिसमें स्वयं के अवमान के लिए दंडित करने की शक्ति भी शामिल होगी।

अनुच्छेद 142 (2) अवमानना के आरोप में किसी भी व्यक्ति की जांच एवं उसे दंडित करने के लिए सर्वोच्च न्यायालय को सक्षम बनाता है। यह प्रदान करता है कि उच्चतम न्यायालय, किसी भी व्यक्ति को स्वयं की अवमानना के लिए दंडित और उस अवमान के लिए अन्वेषण (काँच छाँट विच्छेदन ) तो कर सकता है, लेकिन उच्चतम न्यायालय की यह शक्ति, संसद द्वारा बनाए गए किसी भी कानून के प्रावधानों के अधीन होगी।

अनुच्छेद 215 सभी उच्च न्यायालयों को स्वंय की अवमानना के लिए दंडित करने में सक्षम बनाता है।

दिल्ली ज्यूडिशियल सर्विस एसोसिएशन बनाम यूनियन ऑफ इंडिया’ और सीके दफ्तरी बनाम ओपी गुप्त जैसे मामलों में सर्वोच्च न्यायालय यह कह चुकी है कि संविधान के अनुच्छेद 129 और 215 के तहत मिले उसके अधिकारों में न तो संसद और न ही विधानसभाएं कटौती कर सकती हैं।

न्यायालय की अवमानना अधिनियम 1971को वर्ष 2006 में धारा 13 के तहत ‘सत्य की रक्षा’ को शामिल करने के लिए संशोधित किया गया था।

इस संशोधन के अंतर्गत दो बिंदु जोड़े गए और कहा गया कि अवमानना के मामले में मुजरिम की सच्चाई और नियत को भी ध्यान में रखा जाए।
संशोधन के अनुसार

A)Notwithstanding anything contained in any law for the time being in force (a) no court shall impose a sentence under this Act (Contempt of Court, Act, 1971) for a contempt of court unless it is satisfied that the contempt is of such nature that it substantially interferes, or tends substantially to interfere with due course of justice; and

B) the court may permit, in any proceeding for contempt of court, justification by truth as a valid defence if it is satisfied that it is in public interest and the request for invoking the said defence is bonafide.”

In Shanti Parva Chapter 109 S. 9,4 and 5 of Mahabharat it is said that “To tell the truth is righteous. There is nothing higher than truth. But where falsehood prevails as truth, truth should not be said there. There, again where truth passes for falsehood, even falsehood should be said.”

सिक्किम हाई कोर्ट के पूर्व मुख्य न्यायाधीश व केंद्रीय प्रशासनिक पंचाट (कैट) के अध्यक्ष श्री प्रमोद कोहली के अनुसार
“सुप्रीम कोर्ट के फैसले पूरे देश पर लागू होते हैं और सभी अदालतें और कार्यपालिका उन फैसलों को मानने के लिए बाध्य हैं। अवमानना का कानून अगर न हो तो कोई भी सुप्रीम कोर्ट या दूसरी अदालतों के फैसले नहीं मानेगा।”

दिनांक 30.05.2019 को दिये गये एक विस्तृत फैसले में, माननीय दिल्ली उच्च न्यायालय की खण्डपीठ ने टी. सुधाकर प्रसाद बनाम आंध्र प्रदेश सरकार वाद में माननीय सर्वोच्च न्यायालय के फैसले [2001 (1) एससीसी 516] तथा इस विषय पर अन्य निर्णयों का संदर्भ दिया और यह माना कि “सिर्फ न्यायाधिकरण के पास इस अवमानना ​​मामले को सुनने और तय करने का अधिकार क्षेत्र है।”

सुखदेव सिंह बनाम ऑनरेबल सी. जे. एस. तेजा सिंह एवं अन्य AIR 1954 SCR 454 के मामले में यह साफ़ किया गया था कि “संविधान के अनुच्छेद 129 से यह पता चलता है कि सुप्रीम कोर्ट के पास कोर्ट ऑफ रिकॉर्ड की सभी शक्तियां हैं, जिसमें खुद की अवमानना के लिए दंडित करने की शक्ति भी शामिल है। वहीँ, अनुच्छेद 142 (2) एक कदम आगे बढ़कर उच्चतम न्यायालय को किसी भी अवमानना की जांच (Investigation) करने में सक्षम बनाता है।”

उच्चतम न्यायालय द्वारा वर्ष 1954 में तय किये गए इस मामले से इन दोनों अनुच्छेदों 129 व 142(2) के बीच की दुविधा को दूर करने मे सहायता मिलती है!

यह तथ्य अपने आप में पूर्णरूपेण तार्किक साबित होती है कि “उच्चतम न्यायालय द्वारा स्वयं की अवमानना के लिए दंडित करने की शक्ति, एक संवैधानिक शक्ति है, और इस तरह की शक्ति को एक विधायी अधिनियम द्वारा समाप्त नहीं किया जा सकता है और ना ही ईस शक्ति को सीमित किया जा सकता है।

सुओ मोटो कंटेम्प्ट पिटीशन (क्रिमिनल) नंबर 2 ऑफ 2019 RE. विजय कुर्ले एवं अन्य के मामले में सर्वोच्च न्यायालय ने यह साफ़ तौर पर देखा है कि – उच्चतम न्यायालय की स्वयं की अवमानना के लिए दंडित करने की शक्ति, संसद द्वारा बनाये गए 1971 के अधिनियम के प्रावधानों के अधीन नहीं है।

विदित हो कि मार्च 2019 में वकील मैथ्यूज नेदुम्परा को अवमानना का दोषी ठहराने के आदेश पर जस्टिस आर. एफ. नरीमन और जस्टिस विनीत सरन के खिलाफ ‘घिनौने और निंदनीय ‘आरोपों के लिए27 अप्रैल 2020 को न्यायमूर्ति दीपक गुप्ता और न्यायमूर्ति अनिरुद्ध बोस की पीठ ने विजय कुरले (राज्य अध्यक्ष, महाराष्ट्र और गोवा, इंडियन बार एसोसिएशन), राशिद खान पठान (राष्ट्रीय सचिव, मानवाधिकार सुरक्षा परिषद) और नीलेश ओझा (राष्ट्रीय अध्यक्ष, इंडियन बार एसोसिएशन) को अवमानना का दोषी ठहराया।

प्रवीन सी शाह विरूद्ध के. ए. मोहम्मद व अन्य (2001)8 SCC 650. में सर्वोच्च न्यायालय ने निर्धारित किया कि “Purging oneself of contempt can be only by regretting or apologising in the case of a completed action of Criminal Contempt. if it is a case of civil contempt, by subsequent compliance with the orders or directions the contempt can be purged of. There is no procedural provision in law to get purged of contempt by an order of an appropriate court.”

बार काउंसिल आफ ईण्डिया विरूद्ध केरला उच्च न्यायलय (2004) 6 SCC 311, the ratio in Pravin C. Shah (supra) was affirmed by this Court. It was held that the Court has the power to punish under Article 129 of the Constitution of India and can punish advocate.

SUO MOTU CONTEMPT PETITION (CRL.) NO.1 OF 2020 अवमानना मामले (Prashant Bhushan Contempt Case) में न्यायमूर्ति श्री अरुण मिश्रा, न्यायमूर्ति श्री बीआर गवई और न्यायमूर्ति श्री कृष्ण मुरारी की पीठ ने प्रशांत भूषण को सजा सुनाते हुए एक रुपये का जुर्माना लगाया!

फैसले के अनुसार प्रशांत भूषण को 15 सितंबर तक जुर्माना नहीं दिए जाने की स्थिति में 3 महीने की जेल हो सकती है! इसके साथ-साथ उन्हें तीन साल के लिए वकालत से भी निलंबित किया जा सकता है! प्रशांत भूषण ने 1 रूपया जमा करा दिया!

अदालत ने 14 अगस्त को सजा सूनाते हुये सर्वोच्च न्यायालय ने कहा था कि प्रशांत भूषण ने पूरे सर्वोच्च न्यायालय के कार्यप्रणाली पर आक्रमण किया है और अगर इस तरह के आक्रमण को सख्त तरीके से नहीं लिया जाता है तो इससे राष्ट्र की प्रतिष्ठा और ख्याति प्रभावित होगी।

सर्वोच्च न्यायालय ने अपने फैसले में कहा था कि लोगों का न्यायपालिका के प्रति भरोसा और न्याय प्राप्त करने की क्षमता ही न्यायपालिका की बुनियाद है। न्यायपालिका की बुनियाद को प्रभावित करने की कोशिश की जाएगी तो इससे लोगों का न्यायपालिका के प्रति अनास्था पैदा होगा।

प्रशांत भूषण ने न सिर्फ झूठे आरोप लगाए बल्कि न्याय प्रशासन के वैभव पर अवांछनीय आक्रमण किया। इस तरह का अटैक न्यायपालिका के प्रति आम लोगों के बीच अनादार का भाव पैदा करता है और इस हरकत को नजरअंदाज नहीं किया जा सकता है। सर्वोच्च न्यायालय ने इस मामले में प्रशांत भूषण के उस दलील को खारिज कर दिया था कि उन्होंने लोकहित में स्वस्थ्य आलोचना की थी।

निष्कर्ष:-
उपर्युक्त विवेचना से स्पष्ट है कि न्यायालय का अपमान करके व्यक्ति केवल न्यायालय या न्यायधिश की गरिमा व गौरव को ही नुकसान नहीं पहुँचाता अपितु वह जनता के हृदय मे न्यायिक प्रणाली व प्रक्रिया के विरूद्ध अविश्वास का वातावरण तैयार करता है जो जनता के न्यायपालिका पर किये जाने वाले भरोसे को छति पहुँचाता है! न्यायालय की अवमानना आम जनता के न्यायिक प्रक्रिया पर किये जाने वाले भरोसे का अपमान है और एक जघन्य अपराध है!” Contempt of court is an offence which constitutes, Scandalising Court or Judge, undermining people’s confidence in administration of justice and bringing or tending to bring the Court into disrepute or disrespect.”

इसलिए, अदालत के लिए केवल एक आवश्यकता यह है कि उसके द्वारा ऐसी प्रक्रिया का पालन किया जाए, जो न्यायसंगत है, न्यायपूर्ण है और न्यायालय द्वारा तय किए गए नियमों और उस पर व्यक्त किये गये जनता के भरोसे के अनुसार है।

Poor farmers fight to remain poor and vocal minority support in the guise of activism, democracy, politics, and hypocrisy

I join many in imploring and appealing to the farmers to come to an agreement and government to be big hearted to arrive at such a resolution asap. Others who claim this is a right to dissent you are doing a great disservice to the farmers in pandemic period as well as the country in the grab of activism, democracy and for some of you it is shear politics and hypocrisy. We will get into the details and getting the exact data is such a challenge, but order of magnitude is accurate.

We will get into the facts first.

a) India is 94th country in world hunger Index. Though we produce twice the amount of wheat, rice and chenna than what we consume, we have less than one tenth of other nutrients like fruits, vegetables, and others. The lack of nutrients is pervasive across the population including middle class and rich and every region.

b) India has close to 50+ crore people dependent upon $450billion dollar (15% of GDP) (2.25 Lakh crore rupees) agriculture economy that mainly focusses on the wheat, rice and chenna. Though we produce more wheat and rice, sadly, we import $80 B agricultural products from outside for a sparse nutrient we get. For example, India import pulses from Canada to the extent of $6B and unlike India this 6B worth pulses is produced in a single season by less than 20000 farmers. Same goes for 4000 farmers producing cheese for 700M worth of business for New Zealand. Same story goes for  palm oil imports from Malaysia.

c)Now if we can produce all we need to improve the hunger Index as good as China, the Agri business will be of the order of $1 Trillion (~5 Lakh crore) and doubling of Indian formers income as well as improving the hunger index.

d) Improving the hunger index improves health index and reduces the co-morbidities and overall wellbeing of the country

e) The small agricultural economy, the government subsidises, and support prises various ways and means at least 100B and that will continue irrespective of the laws. This is a worldwide phenomenon and India is not alone.

Committee after committee have explained the details and by the time, they are even read the numbers become stale. So, my research cannot produce a single paper that can summarise this after peer review but give or take these numbers are of the ballpark.

We even to reach the reasonable food index, we need to produce twice what we produce and if we can do it internally the opportunity for farming is of the order of 600B for farmers at field level and another 200 B for storage, distribution, and sales. The farming will always be done by farmers and distribution which is now spotty will be picked up the corporates.

Then why we are not going in for it? One of the main structural reason for the failure to achieve this growth is that agri business is it steeped in market practices that were set by Ala-ui-din Khilji for his garrisons to be paid cheap, carried by British for its soldiers and hardened during the famine in 1960. What the current laws makes is like what was in 1980s for the BSNL (then department of telephone) service to get a telephone and buy Vespa scooter. We waited for 10 years to get a scooter and telephone line. The current structure in various ways control the production, distribution to produce more of what we do not need and where do not want. Less than 0.0001% of the farmers benefit from this and incidentally 20% of them are in Punjab as they garner most of the subsidies /support. So, we can understand the reason for the opposition from Punjab.

Most of our political parties understand this and that is the reason the Congress, DMK, NCP all called out in their political manifesto though they oppose the laws. Let us investigate the specific of the laws and see why protest is three-fold

  1. The changes introduced will take away the comfort of well entrenched Mandis, farmers as it will introduce competition. Many of the 40 thousand Mandi based Punjab will lose their pro-eminent position exactly same way the Vespa dealer lost their pre-eminence. However, they will survive this and use the new opportunity to flourish by doing what they do best – being entrepreneurial. These new law provides a liberation that is similar to 1992 liberalisation of PV Narasima Roa. Imagine a young farmer can produce corn in Ramanathapuram then he can displace the canola import from Canada or Malaysia. He becomes powerful in the locality than say most likely a mandi owner from an entrenched political party.  The real benefit is that  most farmers and consumers will have diversity of products and services at a much cheaper rate.  To give a personal anecdote my own house is built where once cashew tree used to be and our policies led to import of the cashew than producing it locally in Pondicherry. Same goes for a piece of barren land where we had produced peanuts is no longer used.
  2. The laws will shake up a bit from the comfort zone, but the opportunities will arise like what happened after the 1992 liberalisation. This uncertainty is a concern for the farmers and as far as I can read the laws it has better market and government controls than the farmers wants us to believe.
  3. The farmers who protest needs to be protected against the change in short term and  be assured that they will be taken care until they ease into the new system well – however agreeing to their demands like repealing are great disservice to the 50 Crore farmers. These 50 thousand do not represent the 50-crore people and entire nation.
    1. The repeal of laws benefits these protesters in a narrow sense for the day but not the country’s 50 crore people as well as public and economic growth.
    1. The other ask is their need to repeal the stubble burning. Ask a Delhi person how they feel?     1. The corporate buying directly is not going to harm the farmer as they can produce what is sold and needed than what the Mandis want. Also, it is extremely unlikely the current farmers can create cold storage and distribution that TATAs can do.

So, based on the analysis I think the protest is justified to the extend that its immediate impact needs to be eased and supported. But for the greater good we need these reforms to move it from archaic practice from the days of Sultanate to a protected but market economy.

As to the vociferous support that the protest gets from many can be ascribed to unfortunate trend to be activist and even anarchist for many. I saw a photo of a young woman who did candle vigil in Jalander saying do not sell to corporate ironically in GAP sweater, latest iPhone and UK imported Louis Phillipe dress.

Opposition politicians have political reasons to play into anti-Modi, anti-corporate jingoism but that is greater hypocrisy opposing what is in their manifesto. Also, some of the politicians are beneficiary of the current structural inadequacies and that is a personal interest subverting the greater good. Media take the position to inflame for breaking news TRP than true analysis of the issue as well they tend to be left leaning and anti-government by nature in democracy. Someone like Canadian PM who leaves no opportunity to call India out in subsidiary battle in WTO plays to his Sikh ridings as well as the need to protect the pulse export from his country. So, everyone is fighting to keep farmer poor in the guise of democracy, activism, and sheer hypocritic.

As far as I can see it is good for the country with minor discomfort. I again implore everyone including the protesters to see the basic truth of the issue and resolve this peacefully. Please know we recognise you were instrumental in green revolution and entrepreneurial and you can bring another change.

Government should work towards peace by providing short term assistance in easing into the new law. It is a duty of all of us to see this as an opportunity it provides to country as a whole and stand up for what is good for the country and millions of poor farmers and country. If there are factual demerit that can be highlighted but blinding supporting protesters is just hypocrisy.

Difference between love marriage and love Jihad & Uttar Pradesh prohibition of unlawful conversion of religion ordinance, 2020

We shall have to understand the actual status, meaning, scope and intention of the activities behind these two love actions.

Before dealing with the aforesaid two words/Activities we shall have to discuss in detail in respect of the act/ offence of “Impersonation or False Personation or Fake Identification, Do you know, what is the meaning of impersonation?

“Impersonation means to assume character or appearance of; pretend to be:”

In other words it must be said that “The crime of pretending to be another individual in order to deceive others and gain some advantage is impersonation.”

Under New York law, Criminal impersonation is committed when an individual “impersonates another and does an act in such assumed character with intent to obtain a benefit or to injure or defraud another”(N.Y. Penal Law § 190.25 [McKinney 1996]).

“किसी का नकली वेश धारण करना रूपारोप करना”

Chapter XI Section 205 of IPC 1860 deals with the definition and punishment for False personation as follows:- “Whoever falsely personates another, and in such assumed character makes any admission or statement, or confesses judgment, or causes any process to be issued or becomes bail or security, or does any other act in any suit or criminal prosecution, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both”. It is Non-cognizable, Bailable and triable by Magistrate (FC).

Section 416 in The IPC 1860 read as “Cheating by personation”—A person is said to “cheat by personation” if he cheats by pretending to be some other person, or by knowingly substituting one person for another, or representing that he or any other person is a person other than he or such other person really is.

Now Let us go through the real story of a Shooter: – This is a real story of a national level shooter most popularly known as “Tara Sahdev” from Ranchi, Bihar.

As per the article published on the portal of INDIA TV on 26 August 2014:-

“Tara said she met Ranjit on shooting grounds where he came to see her practice every day. Gradually they started meeting outside and decided to get married. The couple got married on July 7 this year. She further said that Ranjit did not disclose that he was a Muslim and instead faked his identity. The real name of Ranjit is “Rakibul” and he is Muslim.

“She further revealed “On the first night of the marriage, he called 20-25 Hajis. They forced me to convert into Islam”. According to Tara, Rakibul kept her under confinement for one month and forced her to convert into Islam. Tara alleged that Rakibul made her starve and even changed her name to “Sara”, to which she protested strongly. He threatened to beat me and even said that he will shoot me if I refuse to convert into Islam.

I was forced to speak ‘qubool hai’ three times and also to say I am not a Hindu as I have changed my religion. “He tortured me mentally and had sex with me on a gunpoint,” she said. Later on, Tara decided to report her saga to family.

Meanwhile, Deepak Ambastha, DCP, Ranchi said that a case has been filed against Rakibul and the truth will come out very soon.

Now my Friends, I have a question and be pleased to lit the Fire and make me understand that:-

“Whether the marriage of Tara and Ranjit (Rakibul) Is a love marriage or Love Jihad.”

Answer:- as per my opinion,  It is very clear that on the Part of Tara Sachdev it was a Love marriage because she loved a person whose name was Ranjit and he was Hindu by religion. She believed the contemporary status of Ranjit (original name Rakibul). BUT as far as  Rakibul’S (Fake Ranjit) part is concerned “it was nothing but a Love Jihad”. Rakibul purposely and deliberately represented himself a Hindu person named as Ranjit. He concealed his original identity of a Muslim person whose name is Rakibul. And on the first night of the marriage, he called 20-25 Hajis. They forced Tara to convert into Islam”. Afterwards he started to administer his all cruel and brutal torture activities against Tara to convert her in to Islam.

So it is crystal clear that “whatever has been done by Rakibul (a Muslim person) was nothing but an offence of false personation and Cheating by personation which is now known as forceful and unlawful conversion i.e. alleged Love Jihad.

“In June 2018, Jharkhand High Court granted divorce in alleged love jihad case in which accused lied about his religion and forcing the victim to convert to Islam after marriage.” as published as “Jharkhand love jihad case: Former national shooter Tara Shahdeo granted divorce from Raqibul Hassan”. DNA India. 27 June 2018.

Now we shall deal with love marriage and Love Jihad under the light of the Judgement of Division bench of (HHJ Mr. Pankaj Naqvi,J.  and HHJ shri Vivek Agarwal,J) High Court Allahabad delivered in the case of Crl. Mis. Writ Petition No- 11367 of 2020 Salamat Ansari & 3 Others V/s. State of U.P. & 3 Others on 11/11/2020.

In Para No.5 it is observed by the Hon’ble Court that “We do not see Priyanka Kharwar and Salamat as Hindu and Muslim, rather as two grown up individuals who out of their own free will and choice are living together peacefully and happily over a year. The Courts and the Constitutional Courts in particular are enjoined to uphold the life and liberty of an individual guaranteed under Article 21 of the Constitution of India. Right to live with a person of his/her choice irrespective of religion professed by them, is intrinsic to right to life and personal liberty.

The aforesaid observations are clearly and specifically made for LOVE MARRIAGE and obviously, if, before the solemnisation of his marriage with Priyanka Kharwar, If :-

1-Mr. Salamat Ansari has represented him as Mr. Salamat Ansari;

2-He is a Muslim by religion;

3-Priyanka Kharwar will have to convert herself by accepting Islam;

and despite knowing the aforesaid facts Priyanka Kharwar accepts Mr. Salamat Ansari as her husband and it is nothing but a LOVE MARRIAGE. And off course the Article 14, 15, 19 and 21 of the Constitution of India are present to protect their personal liberties and fundamental rights.

But what about those cases in which a Muslim person solemnised his marriage with a Hindu girl by making false personation that:-

1:-  He is Rahul, Ranjit or Ramesh etc.

2:- He is Hindu by religion;

And after marriage started to torture her in order to convert her as Muslim by disclosing his original name and religion. If Hindu girl refused to accept the Islam, she has been tortured in most of the cases till her death. The Hon’ble High Court has not made any observation on this issue.

AND hence in order to “Stop this process of forceful conversation” Yogi Adityanath government has brought an ordinance which is known as “Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020”.  

That Uttar Pradesh is not the first state who has brought this ordinance as before it :-

In 1967, Odisha was the first Indian state to pass a law against religious conversion, known as “the Freedom of Religion Act”, which had similar provisions.

Madhya Pradesh followed with its own anti-conversion law in 1968. Arunachal Pradesh enacted a similar law in 1978. In 2002, Tamil Nadu passed the Tamil Nadu Prohibition of Forcible Conversion Act, primarily directed at Christian missionaries.

The Relevant provisions of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020 (UP ordinance No. 21 of 2020) are as follows:-

Permeable :-  “An ordinance to provide for prohibition of unlawful conversion from one religion to another by misrepresentation, force, undue influence, coercion, allurement or by any fraudulent means or by marriage and for the matter connected therewith or incidental thereto”

Section 3 deals with the prohibition on unlawful conversion by means as mentioned in permeable;

Section 4 deals with the competency of a person to lodge the FIR against such conversion that contravene the provisions of Section 3.

Section 5 deals with the punishment for contravention of provisions of Section 3.

1 to 5 years of jail term with a minimum fine of Rs 15,000 for forced conversion;

2-10 years of prison with a minimum fine of Rs 25000 for conversion of minors and women from SC/ST community;

For forced mass conversions, the bill provides for a jail term of 3-10 years and Rs 50,000 penalty;

Section 6 deals with the provisions to declare the marriages void which is done for the sole purpose of Unlawful Conversion or vice-versa;

Section 7 says that all the offences under this Ordinance shall be cognizable and non-bailable and triable by the Sessions Court;

Section 8 makes it mandatory to Person who desires to convert to some other religion needs to provide a declaration in the form prescribed in Schedule-I at least sixty days in advance either to the District Magistrate or Additional District Magistrate. Religious convertor who shall perform the act of conversion will also have to give one month’s advance notice in the form prescribed in Schedule -II TO District Magistrate or Additional District Magistrate regarding where the said ceremony would take place;

Section 9 provides that “The converted person shall send a declaration in the form prescribed in Schedule-III within 60 days of the date of conversion, to the District Magistrate in which the converted person resides ordinarily”.

Section 10 says that If any institution or organization violates the provisions of the ordinance, they shall be subjected to punishment as provided under Section 5 and the registration of the said institution or organization shall stand cancelled;

After going through the aforesaid provisions of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020 (UP ordinance No. 21 of 2020) it can easily be found by a prudent person that “this ordinance is complying with the orders of Hon’ble Allahabad High Court. This ordinance is constitutional, legal and valid ordinance and it is establishing the soul of Articles 14, 15, 19 and 21 of the Constitution of India.

Hindavi Swaraj: A misnomer

History books are replete with the term Hindavi Swaraj ever since it came to be coined by Shivaji in his early youth. His connotation of the term was both Dharmic and moral but same cannot be said of the so called Maratha Confederacy which came into being in 1740s as a superior power in India. For the Confederacy, it was a ruse at most to galvanise the Maratha people in their predatory campaigns across the length and breadth of the country from Bengal to Rajputana, from Sringeri to Punjab. The conduct of this Confederacy has been generally wiped under the carpet in the post modern narrative being woven even as we debate the character of this Confederacy, it’s leading generals, leaders, their aims, pursuits, their isolation in 1761 so on and so forth. This is an attempt to set the record straight with genuine references on the conduct of Maratha Confederacy during the period 1770-1790, when the Scindia and Holkar ruled the roost in North.

Marathas to their credit had resurrected their power from the disaster of 1761 at Panipat, they lost their flower of chivalry on that one single day like never before in their history of warfare. It was a crippling blow but to great resourcefulness of Mahad Ji Scindia and Holkar they rebuilt the Marathas into the same once formidable power it was prior to 1761. However, it must be noted that the post 1761 was a predatory power lusting for the spoils rather than any empire building or even a semblance of righteousness which the word when coined by Shivaji was meant to be. It was out an out depredation which led to their isolation in 1761 & continued later with the British rising. Most native rulers moved to the British sanctuary to avoid their lust for spoils, their incredible rapaciousness in fleecing the underdog. Their favourite play was internecine wars between the rival claimants of the throne, but in many cases it was simply the greed for wealth.

The man who brought back Marathas to prominence was Mahad Ji Scindia, son of Rano Ji from his one of his concubines, she was either a low born or she was an attendant (ref : NG Rathod, Mahadji Scindia) Rano Ji had lost all his sons in the ill fated Panipat and fate placed Mahad Ji as the sole heir to the appendage of Scindia in North. Marathas had recouped with Madhav Rao and Mahad Ji along with Tuko Ji Holkar. They did a fine job as power brokers, regents, Vakils, Naibs but nothing remotely resembling as Empire Builders of a Hindavi Swaraj !

Marathas versus Jats

Mahad Ji came up North after the tempestuous Jawahir Singh Of Bharatpur died in 1768. Nawal Singh was not a match for Mahad Ji even as Scindia took up the cause of Shah Alam II, Marathas had acted as escorts of the Mughal Emperor from Allahabad to Delhi to be rewarded as Vakil I Mutaliq & Amir ul Umra by the Emperor for his services rendered to the Mughal Crown. After the defeat of the Jats, Marathas wanted to take on Najib-ud-daullah Ruhela, the Doab Ruhelas, who had taken possession of former Maratha territories as also Delhi but mutual feud between Scindia and Holkar along with Ramchandra Ganesh put paid to their grand scheme. In fact, Ganesh wanted to support the Ruhelas to crush the Jats and take back Maratha posessions. War indemnity was fixed at ₹65 lakhs by Marathas on the Jats for fighting for their fiefdom to be paid in 3 years and additional ₹ 11 lakhs every year as tribute at start of fourth year. Meanwhile, Marathas could not extract a pice from the Ruhela who refused to pay if Marathas could not extract War Indemnity from the Jat Raja. Soon after Najib died without paying anything and sending Marathas on a wild goose chase against the Jats. All the while Holkar was making deals with the Bangash to make him Mir Bakshi of the Mughal Empire without paying anything to the Peshwa, Hindavi Swaraj? Scindia as Escort to Shah Alam II

Both Holkar and Scindia interests lay in amassing personal fortune not building the so called Hindavi Swaraj. Scindia sent a secret letter to Shah Alam II to escort him to Delhi at a price from Allahabad, Shah Alam sent Saifuddin as his emissary to Mahad Ji, the price was fixed at ₹25 lakhs as escort fee, 50% of nazar of the newly appointed functionaries and the honour of being the Vakil i Mutaliq and the Mir Bakshi of the Mughal Empire. The antagonism between the disparate forces of the Maratha Confederacy kept boiling into plots and counterplots by Scindia, Holkar, Ramchandra Ganesh & Visa Ji Krishna who finally reigned supreme after Peshwa appointed him as the commander of Maratha Confederacy in North, Visa Ji later amassed immense wealth in North and returned to play power politics after death of Madhav Rao and murder of his successor along with Raghunath Dada in Poona. The entire edifice was built upon Maratha Nation not Hindavi Swaraj where amassing personal fortune was most important endeavour. (Ref: JN Sarkar, Fall Of Mughal Empire, vol III)

Marathas in Rajputana

Marathas as usual were interested in amassing personal fortune and 18 century Rajputana provided ample opportunities when almost all principalities were involved in feuds and internecine rivalry. Haras were first to fall in the trap with Holkar espousing cause of one against the other, Bundi paid the price of this. They had supported Madho Singh in Jaipur against Ishwari Singh, took the spoils as the monkey doing the balancing act between two cats. Scindia had taken up the claim of Ram Singh son of Maharaja Abhay Singh against Vijay Singh, son of Maharaja Bakht Singh who was ruling Marwar. Jayappa Scindia was killed by Rathores for claiming Chauth by the dint of his sword. Mahad Ji came as Tax Collector of Shah Alam II to collect from Jaipur, was repulsed at Lalsot, Tonga. He barely escaped Lalsot, thanks to inactivity of Sawai Pratap Singh of Jaipur, who was happy with Scindia leaving his territories. Scindia did succeed in defeating both Jaipur and Jodhpur by breaking the unity of these two powerful states of Rajputana.

But didn’t live long enough to enjoy the fruits, in fact the rapacity of Maratha Confederacy led the Rajputs into the safety of British Company. Their conduct in Malwa disenchanted the local Rajputs who had supported Marathas in their early raids against the Mughals. The Khichis of Raghogarh put the Marathas in a quandary, they defeated the Maratha general Khande Rao and forced him to leave their territory. Mahad Ji enraged sent a much larger force which though won the battle but Khichis made the route to Deccan their depredation ground.(Ref; Raghuvir Singh, Anarchy in Malwa, 1740-1840, JN Sarkar, History of Aurangzeb, vol III)

Never did Marathas ever behave in the defence of Dharma nor did they ever espouse the cause of Hindavi Swaraj. They were merely Carpetbaggers who led their mercenaries to the highest bidder, Mughals, Ruhelas, Rajput rivals, Jats. They definitely were the paramount power for some time but their actions and conduct does not qualify as Empire Building or a Hindavi Swaraj!

Right care, at the right time

While my grandmother was denied a bed in National Heart Institute, Delhi due to unavailability, another person (patient) was denied treatment for a cardiac arrest unless “full” payment is deposited.

Doctors take pledge to treat their patients and this pledge is taken by their own choice of getting into this noble profession. They do deserve the praise that they are getting today as COVID 19 is an extraordinary situation. COVID-19 is not a seasonal or an every year disease like dengue, viral, etc that we are used to in our lives here in India and have a standard medical procedure for the cure. These are unprecedented times, but not unanticipated ones. As our ever increasing wants and greater need to subdue nature is anything but steps in the direction where we find ourselves today.

COVID-19 does not seem to disappear anytime soon, atleast until we have a vaccine or herd immunity.
Therefore, we should take this situation as an opportunity to mend our ways of living as individuals, government should invest more in health infrastructure not just for now, but a sustained roadmap be prepared for an efficient health system and to restructure the fallacies coming out to be more visible today, internationally – the priority of the world should be to work out a vaccine dissemination plan for the whole world. The vaccine is in the process of development. This spread between vaccine development and when it is ready should be used to strategise how it shall be made accessible to the whole world.

Incidents mentioned in the beginning are the trigger of my thoughts for writing this. It is the side that need wide circulation and utmost importance. As emphasising on good things may not bring change where we lack, looking on this dark, sad, negative side of our health infra. would help us in policy restructuring.
Our health policy focus should first be of saving a patients’ life. Person dying due to complications, critical diseases require medical sciences analysis. However, if a patient die due to denial of admission to a hospital is a legilsative – executive policy loophole. Therefore, our aim should be to zero down on death due to lack of hospital admission.

Following are some suggestions which government may work upon –

1. Like a good samaritan law for individuals, there can be a similar law for the hospitals, as well. Hospitals should not be reprimanded for providing care to a critical patient by the family later on. Maybe some application can be signed by the family for the same.
If it is already there, then it should be implemented in spirit, than only in letter. As news articles show family of patient thrash doctors, medical staff deteriorates the doctor-patient relationship.
To instil confidence, care and security in our medical system shall be the duty.

2. Every hospital very well know what facilities they lack. However, a list of the same facilities available in the nearby hospital should also be available with them. So that rather than denying admission, hospitals provide the advise and recommend another nearby hospital to the family for the patient.
In other words, admission should not be denied , except for lack of the required facility in the hospital, for which recommendation of nearby hospital equipped with the same facility be provided to the patient/patient’s family.

3. Essential/life saving  equipment should be available in every hospital. Other major equipments that are expensive, but equally important should be made available in atleast 1 hospital within 1 km to 5 kms range.

4. Denying care for lack of money where that care can be a matter of life and death, the care shall be provided.

While life is more important than money, one cannot discredit the role of money in getting efficient and better facilities. Therefore while hospitals should not deny admission for lack of money with a person. For hospitals to continue to provide efficient and state of art health care, they require funds and they are to be paid for their services. Which is also how the whole world functions.

We do have health insurance policies, however not everyone subscribes to it. For which behavioural change in people and the importance of a health insurance should be widely disemminated and be taken up as a campaign. While at the same time survey from households who are not covered under any health scheme of govt or under any public or private health insurance, be taken and their reasons for the same be assessed. After which they can be better addressed.

The economically weak class is well covered under the Ayushmann Bharat Scheme.

For those who are capable to pay, must develop the disciplined financial behaviour where they are able to pay. But imagine someone with ₹30000 – ₹40000 income and has to shell out ₹80000 for a surgery, might face liquidity crunch and would either delay the treatment or take a loan at high interest rate. A layaway plan (a system of paying a deposit to secure an article for later purchase) on a pilot basis by private hospitals can be tried targeting such customers. Hospitals may provide a free health check up half yearly or annually and discount on bills or lab tests. This can aim for the class that is capable of paying, sometimes not immediately though or because of the sudden/unaccounted high cost.

5. Every state shall have an app/website, providing the list of hospitals in every city and the facilities available in every hospital. Number of beds available, specialised doctors and their timings. Hospitals running out of beds should be updated on the app in every 30 minutes. So that the family can save the critical time and reach the right hospital. If we can have apps that deliver our food, groceries and also inform of the unavailable stock in the inventory, if the hotel we book provide us full view of the room on our phone, infact for buying a home we are informed of its amenities. Then hospitals are for care of people. People should have a right to right information at the right time.

Moreover if people would be able to review the services of hospitals on such an app. It would lead to a competition to provide better services sometimes at competitive cost too.

For not abiding by the above provisions, following procedure may be followed –

  1. The hospital personnel shall be suspended until further inquiry, who deny admission for grounds other than mentioned above.
    If further such cases come from the same hospital decision should be taken to cancel the license of that hospital

2. Instead of a lump sum compensation, the family who lost their member due to such negligible behaviour or because of denied admission or for not getting any recommendation as mentioned above shall be provided for a lifetime of compensation in case the member was sole bread earner and had minor children. If not then the owners of the hospital shall make sure that another family member gets an employment, until then they should continue to get compensation.

The latter two points points can be improved, as the aim is not to discourage capable members of the family from getting employment and to become dependent on the compensation.

Ultimately in the health infrastructure time is of critical importance, followed by right care. To aim for futuristic technologies, we must be able to solve classical problem that our hospitals are ridden with.

Farmers protest heading towards a disastrous end

Recently I saw a tv debate where a congress youth politician gave a theory on how the BJP lead government by bringing three farm bills is indirectly trying to kill MSPs and APMC Mandis. His theory was something like this:

According to the current bills, there will be no fees/cess/mandi charges levied on the sale/purchase in the trade areas outside the APMC mandis but these charges will be applicable within the Mandi premises. See, to understand the evil plot of the government you have to think about a few years in the future. In a condition like this no body will go to the APMC Mandis and they will automatically die out by themselves. Moreover, the government is not assuring MSPs in the trade areas outside APMC Mandis. This means that the farmers would receive a price less than what they deserve and they would be on a mercy of a few private players. That is why these are anti-farmer laws“.

You must have also heard theories like this on television and on other social media platforms. They look quite convincing on the first glance. But there are major flaws in the inferences drawn. Once I mention a few points that are not being mentioned in theories like these, I am confident all my readers will agree with me.

Let me ask you a very basic question, what does the government do with the crops procured at the MSP from farmers? MSP is one part of the transaction, i.e. the procurement process. What is the other part? It is not like the government is buying the crops at MSP and just keeping it in the store house. Is it? The other part of the transaction is PDS, the Public Distribution System i.e. the subsidized and free ration for poor. Have you heard PDS or public distribution system or National Food Security Act 2013 in the last few weeks?

As per the National Food Security Act of 2013, two thirds of the India’s total population is covered under this right to food act. The government is legally obliged to fulfil this food requirement, its not a choice or an option for the government, the government has to do it. How will the government of India arrange wheat/rice and other grains for more than 800 million people without APMC Mandis? Do the people floating these theories think that the government of India is so naive that it would buy grains from the private players at a higher price than the price they would have got if they bought from the farmers in an APMC Mandi?

MSP and PDS are two parts of the same transaction. They have to be looked in tandem, either both of them stay or both of them go. That is the only reason why you haven’t heard of PDS in the current discussions. Every politician, every media house, every intellectual knows this for a fact that no government irrespective of the party, be it Congress or BJP or anyone else, can not, I repeat can not get rid of the PDS; not now, not in five years, not in a decade, not until there are poor people in India. If poor exist only as a phrase to be used in election campaigns, subsidized ration and PDS stay, if PDS stays APMC Mandis stay because they are the only means the government can control the prices. In an entirely private setup where the government can not set a minimum price, it would go bankrupt in an attempt to provide subsidized grains. By the way, one of the biggest reasons why BJP is winning elections back to back is its corruption free (almost) Public Distribution and Direct Benefit Transfers schemes, it would never let go of these two things. Its another thing that whenever BJP wins some people claim that it was because of polarization. Please have a look at the two links to know how BJP is winning elections.

Moreover, why would farmers switch to the private players if they are so happy with the Mandis? If private players won’t pay as desired by the farmer, why won’t the farmer go back to the Mandi? And if farmers continue selling their produce within the Mandis, there won’t be the issue of Mandis getting extinct. Would it?

The hypothetical theory presented by certain people has no logical base. This is fear mongering and fake news paddling at its best.

It does not matter how long these people block the roads in the name of a protest, the government is not going to remove even a single dot from the bills, forget abrogating the entire bills (the government might append some regulations in the bills for added safeguards but the law would remain as-is).

Why?

Simply because they can’t and they shouldn’t. If they do it even once, for every other bill they plan to enact in the near future there would be a massive protest and the government will then have to change or repeal it. If the government caves in this pressure, then if anybody would want to get rid of a law, he/she would just need to muster enough crowd and block a few roads in and around Delhi for a few weeks, and that’s all. In short he/she just needs a lot of money. Now imagine, what all things we could do walking on this path. Moreover, you don’t even have to imagine, just look before 2014 what all things we achieved using the exact same strategy.

Moreover, if the laws and acts are going to be decided by protests, why do we need a parliament? Indian Constitution provides ample options to the state government to challenge the bills enacted by the central government in the court of law. Why are the state governments not challenging the bills in the legal way? Do they not have lawyers? Or do they already know that they will lose? And if they are going to the court then why the need of protest? Political mileage, is it?

What we are witnessing now in the name of protest and demonstration is a mockery of democracy and nothing more than that.

I know for certainty that this is neither a coalition government nor a weak, feeble, stupid government. It will not fall in this loop, the government did not move an inch on 370 or CAA or demonetization or any thing else and it would not budge in this case too.

The more pressing concern now is, how is this going to end?

The supreme court in a three judges bench passed a judgement on Oct 7, 2020 in the context of Shaheen Bagh protest. It clearly deemed the protests blocking roads illegal and asked the administration to take actions to clear the blockades. You can read the complete judgement here. The important point #19:

19. We have thus no hesitation in concluding that such kind of occupation of public ways, whether at the site in question or anywhere else for protests is not acceptable and the administration ought to take action to keep the areas clear of encroachments or obstruction.

Even though the governments can take actions to clear the blockades, they won’t.

Politics!

Punjab’s Chief Minister Captain Amarinder Singh came on record and called it a national security issue but Congress’ national leadership at the very same time keeps fueling the agitation. INC has absolutely nothing to lose, they are already at their very worse in terms of electoral performances, if this gamble pays for them it is a win-win for them. (I am going to write a separate article on why the CM said so, he was a member of the high powered committee that framed the three ordinances. Just a hint for now: MSP is available for only 22 crops in India, around 90% farmers haven’t even used this facility till date).

Arvind Kejriwal and his party has a readymade template for issues like these, Delhi police takes orders from the center; he has successfully used it in the past and will use it now. If the center uses the force, he will say the center is fascist and is trying to crush the protest by force and if the center doesn’t, then why didn’t center clear the roads before things went out of hand? In addition to this, Mr. Kejriwal and his deputy has already started the political games, they have already started targeting Captain Amarinder Singh, if this gamble pays for them it is a win win for them in the 2022 Punjab elections.

Unless something is done, this year is going to end exactly like it started with massive riots. People would tolerate blockades for a while, and then people supporting the bill would come on streets and get the blockaded cleared by themselves. Of course it would be very easy to put all the blame on some Kapil Mishra and of course it is just normal to call BJP anti-minority. No body asks what events lead to 2002, everybody just blatantly says riots happened. Twenty years down the line, no body would ask why riots in 2020 happened, everybody would blatantly say riots happened. And BJP was responsible for them!

6 दिसंबर 1992 के बिना भव्य राम मंदिर निर्माण की कल्पना क्या संभव थी

6 दिसंबर 1992 की वो शुभ तारीख… जिसने बदल कर रख दिया इतिहास, हर धुरी बदल गयी यानी उस दिन हर तरफ जय श्री राम के नारों के अलावा कुछ नजर नही आ रहा था। चारों तरफ धूल ही धूल थी ओर धूल में भक्ति का सरोबार चरम पर था। किन्तु यहाँ कोई आंधी नहीं चल रही थी, लेकिन यह शुभ कार्य किसी आंधी से कम भी नहीं था। अपार जनसैलाब था। इससे कोई फर्क नहीं पड़ रहा था कि भीड़ हजारों में थी या लाखों में। हां, एक बात जो उस पूरी भीड़ में थी, वह था-जोश और जुनून। इसमें रत्तीभर भी कमी नहीं थी। ऐसा लग रहा था-जैसे वहां मौजूद हर व्यक्ति अपने आप में एक नेता था। ‘जय श्रीराम’, ‘रामलला हम आएंगे, मंदिर वहीं बनाएंगे’, ‘एक धक्का और दो. जैसे गगनभेदी नारों के आगे आकाश की ऊंचाई भी कम पड़ती दिख रही थी, 6 दिसंबर के भोर का अरुणोदय, लाखों युवाओं को तरुनोदय दे रहा था। अरुणोदय के दौरान फूट रही सूर्य की किरणें किसी नवोदित सन्देश को समेटे थीं, जिसकी जानकारी सिर्फ सूर्य भगवान को ही थी।

सब यह क्यों हो रहा था, ओर कहाँ हो रहा था, क्योंकि जुल्मो ओर आक्रांताओं के विरोध की लड़ाई थी, प्रभु भगवान श्री राम के अस्तित्व की लड़ाई थी,

जी हाँ हम बात कर रहे हैं 06 दिसम्बर 1992 अयोध्या की घटना की। वही अयोध्या, जिसे राम की जन्म स्थली कहा जाता है। वही राम, जिसे ‘मर्यादा पुरुषोत्तम’ भी कहा जाता है। और वही राम, जिनके राज में कभी किसी के साथ अन्याय नहीं हुआ। इसलिए ‘रामराज्य’ को किसी भी शासक के लिए कसौटी माना जाता है।

यहां बात इन्हीं राम और उनकी अयोध्या की हो रही है। इतिहास को बदलनेवाली यह घटना अयोध्या में 6 दिसंबर, 1992 को घटने जा रही थी, ओर आने वाले समय मे भव्य राम मंदिर की नींव रखने जा रहा थी। इसका अंदाजा शायद बहुतों को नहीं रहा होगा। लेकिन कुछ बड़ा होने जा रहा था, ऐसा वहां के माहौल को देखकर समझा जा सकता था। सुबह तीन-साढ़े तीन बजे से ही सरयू में डुबकियों का शोर गूंजने लगा था, कंपकंपाते होंठ से सिर्फ रामधुन और जय श्रीराम के नारे लग रहे थे। अरुणोदय की किरणें जैसे-जैसे सूर्योदय की ओर जा रही थीं, वैसे-वैसे लोगों के पग रामलला के दर्शन की ओर बढ़ रहे थे।

तभी वहां मौजूद कार सेवकों के साथ लोगों की बड़ी संख्या बाबरी ढांचे के अंदर तक चली गयी थी किंतु 6 दिसंबर की कहानी पहले ही रामभक्तों के द्वारा लिखी जा चुकी थी, वैसे तो बात करे गुस्सा तो 1990 से ही लगातार था किंतु शुरुआत बहुत पहले की थी एक ऐसा राष्ट्र जो विगत 800 वर्षों से निरन्तर आक्रमण पर आक्रमण झेलता रहा। उसके धार्मिक केन्द्रों को ध्वस्त कर दिया गया। सांस्कृतिक जीवन मूल्यों को नष्ट-भ्रष्ट करने की कोशिश की गई। राष्ट्र के स्वाभिमान का मान मर्दन करने के लिए आस्था केन्द्रों पर प्रहार हुए थे, भगवान श्रीराम के जन्मस्थान पर बने मन्दिर को बाबर के सेनापति मीरबाकी ने 1528 में तोड़कर ढांचा खड़ा कर दिया। हिन्दू समाज तब से लेकर आज तक अनेक लड़ाईयां लड़ चुका था  चार लाख से अधिक लोग बलिदान हो चुके हैं लेकिन उस स्थान पर क्षण मात्र के लिए भी हिन्दू समाज ने अपना दावा नहीं छोड़ा। यह मात्र मन्दिर मस्जिद का विवाद नहीं था। यह राष्ट्र की अस्मिता का प्रश्न था, मजहबी पूजा स्थल के रूप में इस्लाम के लिए उस स्थान का कोई महत्व नहीं है और न ही मस्जिद इस्लाम का अनिवार्य अंग है, लेकिन भारत व हिन्दू समाज के लिए श्रीराम के जन्म स्थान का क्या महत्व है, यह भारतीय संस्कृति को जानने वाला कोई सामान्य व्यक्ति भी बता सकता है।

इसलिए वो घड़ी 6 दिसंबर आई थी, बाकी 6 दिसम्बर की कहानी 1990 से लिखी जा चुकी थी बाकी उस दिन से पहले 30 नवम्बर को ही कारसेवकों का आना प्रारम्भ हो गया था 3 दिसम्बर तक अयोध्या में सिर्फ रामभक्तों का जमावड़ा देखने को मिल रहा था, 4 दिसंबर को अयोध्या के राष्ट्रीय राजमार्ग कारसेवकों के सिवा कुछ और नहीं दिख रहा था। एक तरफ जहां देशभर से कारसेवक आ रहे थे, वहीं सर्वाधिक कारसेवक उत्तर प्रदेश से आ रहे थे। राष्ट्रीय राजमार्ग थम-सा गया था। गले में भगवा पट्टी और माथे पर भगवा साफा बांधे हजारों लोग पंक्तिबद्ध कतार में दिख रहे थे। हनुमानगढ़ी, कनक भवन, वाल्मिकी मंदिर, छोटी छावनी से लेकर सैंकड़ों मंदिरों में भक्तों की भीड़ उमड़ पड़ी थी। वैसे तो 6 दिसंबर 1992 के दिन की शुरूआत साल के बाकी दिनों की तरह सामान्य ही थी, लेकिन भगवान राम की जन्मस्थली पर मंदिर निर्माण के लिए सांकेतिक नींव रखने के इरादे से अयोध्या पहुंचे हजारों लोगों ने का उलास चरम पर था पूरी धार्मिक नगरी अयोध्या राम का नारो से गूंज रही थी 6 दिसंबर के सूर्योदय के गर्भ में सच में इतिहास छुपा था जिसकी जानकारी दोपहर 11-12 बजे के बीच दुनिया को पता चल गयी।

सुबह के 10 बजते ही विहिप के अध्यक्ष और जन्मभूमि आन्दोलन के प्रणेता अशोक सिंहल मंच पर थे उपस्थित कारसेवकों को अपील कर रहे थे जैसे ही घड़ी की सूई ने 11 बजने का इशारा किया अचानक हजारों कारसेवक बाबरी ढाँचे के परकोटे की ओर कूद पड़े। श्री सिंहल जी माइक से आग्रह करते रहे, लेकिन रामभक्तों के मन में प्रज्ज्वलित राम ज्वार बाबरी ढाँचे पर फूट पड़ा देखते-देखते कुछ रामभक्तों ने ढांचे के गुम्बदों पर चढ़ कर भगवा ध्वज फहरा दिया और जय श्रीराम के नारे लगाने लगे। कंटीली तारों से लहू लुहान रामभक्त बाबरी ढांचे को ध्वस्त करने पर उतारू हो गए। यह देख कुछ लोग शान्त थे, लेकिन अधिकांश लोग रोमांचित ओर खुश थे वहां जो घट रहा था वह अविस्मरणीय, अद्भुत और अकल्पनीय था। रोकने वाले कार सेवकों को रोकते रहे, पर कारसेवक ढांचे को तोड़ते रहे। साधु-संत, बूढ़े-जवान सब उस घट रहे इतिहास का साक्षी बनना चाह रहे थे। पुलिस भीड़ को तितर-बितर कर रही थी। इस बीच पता चला कि मुख्यमंत्री कल्याण सिंह ने प्रशासन को सख्त निर्देश दिए थे कि चाहे जो मजबूरी हो, लेकिन कार सेवकों पर गोली नहीं चलेगी यह राम भक्ति से बढ़कर कुछ बड़ा नही था यहाँ तो यह भी दिख रहा था कि कई पुलिस वाले भी जय श्री राम के नारे लगा रहे थे।

11:25 बजे पहला गुम्बद टूटने लगा। वह कौन-सी अदृश्य शक्ति थी, वह कौन-सा अदृश्य साहस था जो  ढाँचे को तोड़ रहा था इसे कोई नहीं देख पा रहा था। डेढ़ से दो घंटे में पूरा ढांचा धूल-धूसरित हो गया। तत्काल पूरे उप्र में कर्फ्यू लगा दिया गया। इसी बीच पुजारियों ने रामलला को गुलाबी चादरों में लपेटकर उन्हें उचित स्थान पर स्थापित कर दिया। ढांचा तोड़ते समय अनेक लोग घायल हुए, कई लोगों की मृत्यु भी हुई लेकिन कारसेवक अपने काम से डिगे नहीं। क्या इस ऐतिहासिक क्षण की कल्पना, जिसमें कार सेवकों ने बाबरी नामक ढांचे को कुछ ही घंटे के भीतर ध्वस्त कर दिया और इस घटनाक्रम में कई कारसेवक शहीद भी हो गए? वास्तव में, यह कई सौ वर्षों के अन्याय से उपजे गुस्से का प्रकटीकरण था। इसमें 1990 का वह कालखंड भी शामिल है, जब तत्कालीन मुलायम सरकार के निर्देश पर कारसेवकों पर गोलियां चला दी गई थीं, जिसमें कई निहत्थे रामभक्तों की मौत हो गई थी।

शाम होते होते कल्याण सिंह जी ने अपना मुख्यमंत्री पद से त्याग पत्र दे दिया, 

आज के समय मे राम मंदिर भव्य निर्माण कार्य शुरू हो गया है यह क्या आज कल्पना कर सकते है क्या 6 दिसम्बर 1992 के बिना यह सब कैसे सम्भव था,अयोध्या में भूमिपूजन होने के साथ राम मंदिर पुनर्निर्माण कार्य का शुभारंभ हो गया। प्रस्तावित राम मंदिर पत्थर और सीमेंट का एक भवन न होकर भारत की सनातन बहुलतावादी संस्कृति की पुनस्र्थापना का प्रतीक है- जिसे सैंकड़ों वर्षों से विदेशी आक्रांता नष्ट करने का असफल प्रयास कर रहे थे।

06/12/92 : हिंदुत्व की प्रबल पराकाष्ठा

अयोध्या की हर एक गली से उस दिन बस ये ध्वनियां ही सुनाई दे रही थी, हर एक कारसेवक के मन में एक अलग ही शक्ति का संचार हो रहा था और सब रामभक्त स्वयं को उस महान क्षण का गवाह बनते देख रहे थे।

एक महान आंदोलन जिसने भारतीय राजनीति की पूरी दिशा और दशा ही बदल दी, उस आंदोलन की पराकाष्ठा का समय अब आ चुका था।
लाखों की संख्या में कारसेवक बिना थकान और भूख प्यास की चिंता किए हुए इमारत की तरफ बढ़ने लगे, कुछ कारसेवक उस इमारत पर चढ़ गए और आखिरकार उस इमारत के गुम्बदों को ढहा दिया गया।

ये मात्र एक इमारत का विध्वंस नही था अपितु ये तो 800 वर्षों से गुलामी कालखंड का विध्वंस था,
ये विध्वंस था उस तथाकथित सेक्युलर सोच का जिसने हिन्दूओं को हमेशा कमजोर समझा,
ये विध्वंस था उस राजनीति का जिसमें सदैव अल्पसंख्यकों को वरीयता दी जाती थी,
ये विध्वंस था स्वयं हिन्दूओं की सहिष्णु प्रवृत्ति का।।

उस दिन इस देश ने हिन्दूओं की वास्तविक शक्ति का प्रदर्शन देखा और देखा कि यदि हिन्दू एकजुट हो जाए तो कोई भी शक्ति हिंदूओं पर गलत तरीके से शासन नही कर सकती। उस दिन इस देश ने आराध्य प्रभु श्रीराम के प्रति भक्ति के महासमुद्र को देखा, जहाँ हर एक कारसेवक प्रभु श्रीराम के लिए अपना गिलहरी सा योगदान दे रहा था। उस दिन इस देश ने देखा कि अब कांग्रेस जैसे मुस्लिम सेक्युलर दल के सामने एक हिंदूवादी दल भाजपा का उदय हो चुका है। उस दिन देश ने वास्तव में महसूस की संघ और विहिप की मजबूत उपस्थिति और शक्ति।

लेकिन इस देश का दुर्भाग्य देखिए कि प्रभु श्रीराम को अपने भवन के लिए 28 वर्षों का इतंजार करना पड़ा और ये 28 वर्षों का इंतजार एक सर्वश्रेष्ठ उदाहरण है विश्वास और भक्ति का क्योंकि आपको पता होगा कि विहिप के द्वारा इन 28 वर्षों से लगातार पत्थर तराशने का कार्य हो रहा है, विहिप की तरह करोडों रामभक्तों को विश्वास था कि एक ना एक दिन ये स्वप्न जरूर पूर्ण होगा।

आखिरकार 05 अगस्त 2020 को भारत के इतिहास का वो महान क्षण आ ही गया जिसका इंतज़ार वास्तव में 492 वर्षों से हो रहा था, जब देश के यशस्वी प्रधानमंत्री जी के द्वारा प्रभु श्रीराम के मंदिर का भूमिपूजन शिलान्यास हो रहा था, वो क्षण वास्तव में एक अद्भुत क्षण था, हर कोई उस क्षण में एक विशेष आत्मानुभूति को महसूस कर रहा था और हर कोई याद कर रहा था उस 06 दिसंबर के दिन को।

Anil Vij COVAXIN incident proves the authenticity of vaccine trials

Haryana Minister Anil Vij tested positive for COVID19, 15 days after volunteering for COVAXIN phase 3 trials. He was admitted to civil hospital in Ambala Cantt. This incident resulted in spreading of misinformation and incomplete information about vaccine on social media platforms.

Thankfully, Bharat Biotech maker of COVAXIN issued a statement and clarified soon. “Covaxin clinical trials are based on a 2-dose schedule, given 28 days apart. The vaccine efficacy will be determined 14 days post the 2nd dose. Covaxin has been designed to be efficacious when subjects receive both doses. The phase-3 trials are double-blinded and randomized, where 50% of subjects (participants in the trial) receive vaccine and 50% of subjects receive placebo” said Bharat Biotech.

This incident proves that COVAXIN trials is absolutely authentic and as per scientific norms. The phase 3 trials are indeed double blinded and randomised where it’s not known that subject is given vaccine or placebo. And, that’s the scientific process and perfectly okay.

We don’t know that whether minister was given vaccine or placebo and we should not demand to know until final results are unbounded. And that’s science.

We should be patient and restrain from spreading misinformation related to vaccine on social media. Governments and social media companies must ensure that misinformation related to vaccine is removed from social media platforms.

Let’s be patient, hope for the best, believe in official sources, fact-check everything before believing and not spread fake information.
