Pandemic & pay cut

When the words pay cut are uttered everyone is in defensive mode or upset which is understandable as it’s hard earned money. However, situation today is beyond one individual. It’s the greater good of the greatest number. There should not be under utilization of care funds collected and instead again cut salaries of Government employees and doctors is a looming thought. I submit this that for the preparation phase in the face of the pandemic a lot has been spent. With decreased sources of revenue to the Government, considering even deferring the tax payments and the fledgling burden on the healthcare system the salary cut is inevitable.

Let’s consider the private sector from a doctor’s perspective; corporate hospitals are in loss mandated by heavy rents, electricity bills, maintenance and above all the lack of the patients. Hence, the management can’t afford to pay salary and further down the lane it will only get worse. Not just in medical profession pay cut should be done in all cadres and professions in the face of this pandemic; provided that food and healthcare for all is taken care of in reality by the Government. Might be a few things have opened since the lock down was uplifted but I don’t think economy has improved that much. Now with the free treatment for BPL card holders and contemplated rebates for even APL card holders even in private hospitals following annexing as COVID-19 care centers and the only disease being encountered is COVID-19 it’ll be tough a time for any management to generate revenue & pay for their employees.

Industrial revolution will take a backseat; others like tourism, entertainment and textile industries all already completely shut down and will take years to recover. This will only set the premise for anarchism and difficult situations will ensue amongst people with dire consequences. Rural economy which is independent of western influence might develop and prosper but still chances are it will be crippled due to lack of laborers compelling people to do farming on their own for sustenance and not at a global level.

It is imperative that we all come together as human beings and support various Governments with non-partisan stance and allow a mandatory salary cut regardless of public and private sectors wherever feasible which can be given to the Government to make necessary arrangements to address the current situation effectively; at the same time making healthcare free for all; with a reasonable sustenance pay to even private sectors which are completely shut. Now is not the time for blaming. Whole world is at loss, so collectively if we try together we can mitigate the disaster.

Is Sharia really Allah’s law?

Muslims in non-Muslim countries world over cry, off and on, for imposition of Sharia, the Allah’s law. They shout that government may change, but Allah’s law will never change. Let us examine Sharia critically to understand its genesis and divine sanctity.

Islamic ‘Sharia’ came into existence during eighth and ninth centuries. Traditional theory of Islamic jurisprudence recognizes four sources of Sharia: the Quran, Sunnah (authentic Hadith), Qiyas (analogical reasoning), and Ijma (juridical consensus). 

Different legal schools, of which the most prominent are Hanafi, Maliki, Shafi’i, Hanbali and Jafari, developed methodologies for deriving Sharia rulings from scriptural sources using another process known as Ijtihad (discretionary judgment by a Mujtahid (authority in Islamic laws)

If Quran 24:58 hints of three times prayer a day, why Muslims pray five times a day like Zoroastrians of the then Persia? Is it Sharia? Quran has no mention of the word ‘Sharia’. Quran also does not speak of ‘Mufti’, ‘Alim’, ‘Maulana’ or ‘Mujtahid’.

When analogical reasoning, juridical consensus, discretionary judgment of personalities however wise they are/were, play/played important role in Sharia formulation, it no longer remains Allah’s law. It becomes oft repeated logical fallacy of “I touch the table, the table touches the ground. So I touch the ground”.

Corruption in India and solutions

Corruption in the Indian society has prevailed from time immemorial in one form or the other. The basic inception of corruption started with our opportunistic leaders who have already done greater damage to our nation. People who work on right principles are unrecognized and considered to be foolish in the modern society. Corruption in India is a result of the connection between bureaucrats, politicians and criminals. Earlier, bribes were paid for getting wrong things done, but now bribe is paid for getting right things done at right time. Further, corruption has become something respectable in India, because respectable people are involved in it. Social corruption like less weighing of products, adulteration in edible items, and bribery of various kind have incessantly prevailed in the society.

The term “corruption” has always been considered under voodoos and conspiracies. Corruption in India is an issue that adversely affects it’s economy of central, state and local government agencies. Not only has it held the economy back from reaching new heights, but rampant corruption has stunted the country’s development. India continues to be among the most corrupt countries in the world. According to Corruption Perception Index (CPI) 2019, which ranks 180 countries, awards India a score of 41, rendering it the 80th most corrupt country in the world.  Developed nations like Ghana, Morocco have also achieved the same score.

Causes of corruption in India

There are abundant reasons for the cause of corruption in India. The primary reasons being lack of effective management in organisation. Due to mismanagement, there is a weak control on various departments and their working. This uncontrolled and unsupervised administration gives way to rise in corruption in small scale, which results in large scale corruption. Besides, appointment of inefficient managers, supervisors and executives at various levels of hierarchy also leads to mismanagement. Secondly, lack of support for good leaders. Due to fewer good leaders, they find hard to eradicate corruption from the society. But due to lack of support and cooperation from important sections of the society, good leaders are often defeated and suppressed. Lack of proper vigilance systems in the country. Here, some officials are tempted to get illegal money, thereby leaving corrupt people without any penalty or punishment. Finally, lack of economic stability which leads to unemployment and changes in standard of living. It develops a feeling of insecurity in the minds of affected people which are taken advantage by corrupt people.

Consequences of Corruption in India

Hindrances for Development- Corruption leads to loss of wealth and prosperity which is a great loss for the future of India. For the past ten years, India has shown growth in corruption rate, where the country has lost billions and billions dollars of money in various scams, which are tax payer’s money. Many developmental projects are taking unnecessary delay for their completion due to corruption. This leads to backwards in every field like sports, technology, medicine, research, economy, defence, and infrastructure.

Obstacles for Business- Corruption in public services sector carries high risks for conducting good businesses. Companies are likely to unwanted red tapes, petty corruption, bribes for finalizing any procedures or deals. Payments to expedite public services, such as police protection, water supply, and government assistance will be a headache. Likewise, irregular payments to government officials even for applying business license are proving to be a major hindrance for business. Companies personally feel bad, when they have to bribe officials even for getting a water or electrical connection.

Backwardness and Poverty- Due to corruption in India, the Indian government is unable or lacked the will to eradicate poverty. While the rich are becoming richer, the poor are becoming more poorer. Despite the announcement of rehabilitation and monetary packages, corrupt people in various government departments and contractors, suck the fund through various means leaving very little for the end users.

Brain Drain and Loss of Talent- Corrupt government employee and mediators offer jobs to unskilled and incapable candidates by taking bribe leaving the management with poor decision making. When good employees in private sectors also face harassment due to government policies and corruption in India they move to foreign countries. This is a tremendous loss for the country as a developing nation without the contribution of talented and creative people can never grow.

Loss of Faith in Judicial System- There is a high risk of corruption in India while dealing with India’s judiciary, particularly in lower court levels put the common man in great stress. With bribes often exchanged in return for favorable court decisions leads to people to lose faith in judiciary. Besides, prosecution of office abuse by public servants is tough, as it requires authorized by a minister prior to launching an appeal. Such a legal hurdle hinders the judicial process. Besides, delaying the allotment of judges and creation more courts leads to delay in justice. When it comes with resource shortages negatively impact the efficiency of the court system; the current backlog of cases runs into crores.

Loss of Natural Resources- India is abundant in natural resources, but corruption in India leads to loss the precious resources. Widespread problems in the illegal mining of sand, results loss revenue also severely disturbing water resources in the country. Bribery in the mining industry is common, leading very huge revenue for the government. This mainly due to the fact that there is a lack of oversight and transparency, for example, it is estimated that nearly half of the iron ore exported from the state of Goa has been mined illegally.

Solution

The first and foremost solution is to change the government processes. If the members of the government and procedures are transparent one can reduce corruption drastically. Besides, provision related to the electing of the people representatives must be stringent that if there is any case filed against a person then he would not be eligible for election. In India there is already a provision that no person as a criminal shall be allowed as a Member of Parliament or member of legislative. This would be effectively offered a first step towards zero corruption.

Secondly, offering direct connectivity between government and public. This can reduce corruption by increasing direct contact between government and the governed. E-governance could help a lot towards this direction. Thirdly, everyone should be a responsible citizen, it is essential that every citizen should perform his/her duties faithfully and to the best of their abilities. Every citizen should personally strive hard to eradicate corruption. Responsible citizens should report cases of corruption to the vigilance department immediately without delay. Besides, they should follow up the cases of corruption as a mere reporting of the evil practice is not sufficient for effective eradication.

Thirdly, government and vigilance agencies should always keep a check on their source of income and bank accounts for the leaders and their associates. If any suspicious transactions are found they must be reported to the judicial system. Besides, if any leader is not performing his duties properly, then he/she should be sacked from the position. Top government post and position should be based on performance. Government should do performance appraisal of leaders regularly.

Finally, leaders need to take strong and effective decisions. All those who are granted powers and authority through election should fulfill their promises and pledge given to people. They should strive hard to eradicate corruption from government administrations. Remove unwanted hindrances and even laws which help the corrupt to escape punishment.

Love Jihad- A planned catastrophe

Love

A strong attraction and a sense of personal engagement that comes from the heart, not the mind. Love is an emotion that doesn’t need to be told or is shown. The feelings of the person you love become your feelings. You can feel the sorrow and happiness of the person without saying, that’s love. Love is even possible with any item, place, or animal.

It’s not possible for any poet or writer to put love in words and present it to anyone. You can only feel it. One gets self-satisfaction and happiness by keeping the head in his mother’s lap, that’s also a form of love.

Jihad

The second word used in this compound word is Jihad, which is an Arabic language word that means to try or struggle for a laudable objective. This objective can be to eliminate the evils within oneself, fight against the evils of society, and become a better man.

But the use of the word Jihad in this compound is wrong in the same way as the word “Bhakt” in “Andh Bhakt”. Where the “Bhakt” in Hinduism refers to the creature who has affection, passion, faith, and loyalty to God, Jihad is for those who believe in Allah and His Messenger, directly or indirectly.

What is Love Jihad?

This concept became the center of attention in Kerala for the first time in India in 2009 and later in Karnataka. For the past several years, there has been a flood of incidents of forced religious conversion by physically exploiting Hindu girls by hiding their names and identities, talking about befriending, loving, and marrying. In these incidents, it is common for girls to be physically tortured or killed directly if they do not convert.

Call it love jihad or something else, but the truth is that love is being professed for the conversion of girls and killing them if they fail.

Reason for Love Jihad

If we believe in some facts and Organizations, the cause of Love Jihad can be to increase the community of Islam, jealousy towards other communities, or can be for wealth. A similar case was registered in Meerut, Uttar Pradesh, in which a Muslim youth murdered his wife and daughter after getting married. It was also an incident of forced religious conversion of his wife and daughter. And you also have seen what happened in the case of Nikita Tomar.

But if anyone wants to know my opinion, then I’ll tell all Muslim brothers that after making human beings, Allah ordered the angels to prostrate. Then how can he order to kill a human being himself? The foundation of Islam is on Humanity but because of some illiterate and goth people, Islam is being maligned all over the world.

Thinking of pseudo-liberals until this happens to their sisters-

The leftist or so-called intellectuals, pseudo-secularists and pseudo-liberals are strongly opposed to the ordinances and proposed laws being brought by various state governments against conversion for marriage or greed or cheating.

They have their own arguments of protest like – this is a violation of the right to love of two mature/adult people, it is against privacy, it is contrary to the original section of the constitution, some people are talking about Article 25, some people are talking about love. They are telling jihad beyond the fabric of the mind and the truth.

How this catastrophe can be cured?

Love is a selfless pleasant feeling. If selfishness comes somewhere, there is no love there. If you insist on religious conversion or you demand money, then it is a fraud and swindle in the name of love. It doesn’t matter in love that whoever you are, whatever you are, wherever you are, the lover will always love you unconditionally and will always wish you well.

I think those who commit such misdeeds by hiding their name, hiding their identity, are just criminals because it can’t be a house of love, the foundation of which is gag and deceit. These people surely deserve punishment.

The cabinet, headed by Yogi Adityanath of Uttar Pradesh, has approved the Prohibition of Unlawful Religion Conversion Act. States like Madhya Pradesh, Haryana, and Assam are also moving in this direction. This is satisfactory news for a large section of society. And according to me, it’s okay to do all these things because God forbid if all this happens to your sister or daughter in the future, then you must have some judicial way to punish the criminals.

Evil doesn’t increase when bad people increases, evil increases when good people do not stand against it.

प्राण व दैहिक स्वतंत्रता अनुच्छेद 21


वसुधैव कुटूंबकम!

सर्वे भवन्तु सुखिनः सर्वे सन्तु निरामया,
सर्वे भद्राणि पश्यन्तु मा कश्चिद् दुख भागभवेत।

सर्वेशां स्वस्तिर्भवतु। सर्वेशां शान्तिर्भवतु।
सर्वेशां पुर्णंभवतु। सर्वेशां मङ्गलंभवतु।

आप सोच रहे होंगे कि मैं ये संस्कृत के श्लोक क्यों लिख रहा हूँ, पर जरा ध्यान से इन श्लोको को अपने मस्तिष्क मे केंद्रित कर सूछ्म विवेचना किजीये और विचारिये कि आखिर ईनके द्वारा किस विषय की ओर आपका ध्यान आकृष्ट कराया जा रहा है…

जी हाँ, हमारे सनातन धर्म की यही तो मौलिक सुंदरता है कि वो संपूर्ण चराचर जगत के एक परिवार के रूप मे प्रतिष्ठित करता है, वो सभी के लिये खुशी, निरोगी, अभावरहीत व शांतिपूर्ण जीवन की कामना करता है।

हमारे सनातन धर्म की मूल भावना “जीयो और जीने दो” तथा “सभी जीवो को अपना जीवन अपनी ईच्छा से जीने का अधिकार है” में निहित है।

मर्यादा पुरुषोत्तम भगवान श्री राम ने भी अपने संपूर्ण जीवन काल मे प्रत्येक जीव के प्राण व दैहिक स्वतंत्रता को अमुल्य व सर्वोपरि मानकर प्रतिष्ठित किया फिर चाहे सुग्रीव को किष्किंधा का नरेश बनाकर उनकी पत्नि से उन्हे मिलाना रहा हो, माता सिता को रावण के कैद से मुक्त कराना रहा हो या फिर विभिषण को लंका का जीता हुवा राज्य प्रदान कर शांती व स्वतंत्रता का स्थापना करना हो।

भगवान श्रीकृष्ण नें कुरुक्षेत्र की रणभूमि मे अर्जुन को महान उपदेश देते हुये कर्म व धर्म के प्रभाव से संपूर्ण संसार को परिचित कराया और एक सामाजिक परिवेश में प्रत्येक जीव के प्राण व दैहिक स्वतंत्रता के महत्व को स्थापित किया।

महर्षि वाल्मिकी, महर्षि वेद व्यास, महर्षि वशिष्ठ, महर्षि विश्वामित्र, महर्षि जैमिनी, महर्षि पतंजलि, महर्षि कणाद, भगवान बुद्ध, भगवान महावीर स्वामी, आचार्य चाणक्य, गुरू नानक देव, स्वामी रामाकृष्ण परमहंस, स्व स्वामी दयानंद सरस्वती, स्व सरदार वल्लभ भाई पटेल, सर्वोच्च बलिदानी भगत सिंह, अमर बलिदानी चंद्रशेखर आजाद स्व स्वामी विवेकानंद, स्व लाल बहादुर शास्त्री, स्व डॉ अब्दुल कलाम व प्रधानमंत्री श्री नरेंद्र दामोदरदास मोदी ईत्यादी सभी के “सबका साथ सबका विकास व सबका विश्वास” की मूल भावना को अनुच्छेद 21 ही प्रतिष्ठापित करता है।

यही कारण है कि सनातन धर्म की सार्वभौमिक ईसी मूल भावना को अनुच्छेद 21 के माध्यम से हमारे महान संविधान नेें हमारे देश के नागरिको को प्राण व दैहिक स्वतंत्रता का मूलभूत अधिकार दिया है।

अनुच्छेद 21 के द्वारा प्रदान किये गये “प्राण व दैहिक स्वतंत्रता (Life and Public Liberty) अधिकारो में व्यक्तिगत स्वतंत्रता का अधिकार , मानव गरिमा के साथ जीवन यापन का अधिकार, शिछा का अधिकार, जीविकोपार्जन के साधन का अधिकार, मानव सम्मान (Reputation) का अधिकार, लिंगभेद से बचाव की अधिकार, रोटी, कपड़ा व मकान प्राप्त करने का अधिकार, अन्य जीवों को जीने का अधिकार प्रकृति व वनों को संरछण का अधिकार तथा हवा व जल का प्रदुषण से बचाव का अधिकार ईत्यादी भी सम्मिलित है।

अनुच्छेद 21 स्थापित करता है “No person shall be deprived of his life or personal liberty except according to the procedure established by law” अर्थात “विधि द्वारा प्रतिस्थापित कार्यवाही के बीना किसी व्यक्ति को उसके प्राण व दैहिक स्वतंत्रता से बाधित नही किया जा सकता”।

ये अनुच्छेद 21 अपने अंदर अनुच्छेद 14 व अनुच्छेद 15को समाहित किये हुये है अनुच्छेद 14 जहाँ स्थापित करता है। “भारत के सभी नागरिक विधी को समछ बराबर है वहीं अनुच्छेद 15 राज्य को अपने किसी भी नागरिक से ” जाती, लिंग, वर्ण, जन्म स्थान, भाषा या भेषभूषा के आधार पर भेदभाव करने से रोकता है”।

ईलाहाबाद(अब प्रयागराज) उच्च न्यायालय ने रामजी सिंह @ मुजिब भाई v/s उ. प्र. राज्य (Civil Misc.Writ Petition No. 38985/2004 AIR 2009) मे निर्णय देते हुये कहा कि अनुच्छेद 21मे उद्धृत “Person” शब्द ना केवल जीवित व्यक्ति को अपितु कुछ परिधि तक मृत व्यक्ति का भी प्रतिनिधित्व करता है। यहि कारण है कि जब आतंकवादी या अपराधी मारे जाते हैं तो भारतीय सेना व पुलिस उनके मृत शरीर का अंतिम क्रिया कर्म उनके धर्म/ मजहब के अनुसार कर देते हैं।

मेनका गाँधी V/S यूनियन आफ ईण्डिया (1978 AIR 5971978 SCR (2) 71 केस में अपने सुविख्यात निर्णय को पारित करते हुये सर्वोच्च न्यायालय के न्यायधिश श्री पी एन भगवती जी ने कहा था कि राज्य किसी एसी विधिक प्रक्रिया को प्रतिस्थापित नही कर सकता जो Arbitrary, unfair व unreasonable हो। अनुच्छेद 21 एसा करने से राज्य को स्पष्ट रूप से रोकता है!Justice Bhagawati ने Just, Fair व Reasonable जैसे तिन कारक बतलाये जिन्हें किसी विधिक प्रक्रिया को स्वरूप के गठन समय ध्यान मे रखना चाहिये ताकी किसी भी प्रकार के अन्याय की संभावना ही ना हो।

फ्रांसीस कोर्ली मूलीन V/S (प्रशासक) केंद्रशासित प्रदेश दिल्ली और अन्य (1981 AIR 746) मे आदरणीय न्यायालय ने स्पष्ट किया की “प्राण का अधिकार (Right to Life) में निम्न अधिकारो का समावेश होता है :-
मानव गरिमा के साथ जीवन यापन करने का अधिकार
पर्याप्त पोषण, वस्त्र व छत्रछाया प्राप्त करने का अधिकार
पढ़ने, लिखने व स्वंय को अभिव्यक्त करने का अधिकार
एक स्थान से दुसरे स्थान पर भ्रमण का अधिकार ईत्यादी

ओमप्रकाश चौटाला v/s कवर भान (2014) 5 SCC 417 मे सर्वोच्च न्यायालय ने स्पष्ट किया है कि, “सम्मान (Reputation) किसी व्यक्ति के जीवन का एक महत्वपूर्ण भाग होता है, यदि सम्मान पर चोट पहुँचती है तो वो व्यक्ति स्वंय को अधमरा महसूस करता है”!अत: यह स्पष्ट है कि अनुच्छेद 21 व्यक्ति के सम्मान को भी संरछण प्रदान करती है।

ईसी प्रकार मैक्स आफ बांबे V/S M/s. ZY AIR 1977 Bom 406 मे न्यायालय द्वारा यह निर्धारित किया गया कि एक व्यक्ति को केवल ईसलिए नौकरी के लिये चिक्त्सकिय आधार अयोग्य घोषित नही किया जा सकता कि वो एड्स पाजीटीव है।

विशाखा V/S राज्य सरकार ( राजस्थान) (1977) 6 SCC 241 में सर्वोच्च न्यायालय ने “Gender Equality” के बारे स्पष्ट करते हुये निर्धारित किया कि ” Right to Life” under Article 21 along with other fundamental rights are guaranteed to us by constitution amptitude to cover gender equality including the right against sexual harassment”.

चमेली सिंह v/s राज्य सरकार (उ.प्र.) 1995 SUPP (6) SCR 827 मे पहली बार न्यायालय के द्वारा “Right to shelter” को स्थापित किया गया! न्यायालय ने स्पष्टतया कहा कि ” किसी भी व्यक्ति को Shelter प्राप्त करने के अधिकार से अवश्य ही वंचित नही किया जा सकता”!

एम सी मेहता v/s यूनियन आफ इंडिया 1987 AIR 1086 मे न्यायालय ने ये निर्धारित किया की अनुच्छेद 21 के अंतर्गत कई प्रकार के अधिकारो का समावेश है और वे केवल मानव जीवन तक सिमित नहीं है वरन जंगली जीवों, जंगल, तालाब, प्राचीन धरोहरो, पारिस्थितिक तंत्र, अप्रदुषित जल, वायु व भूमी के अधिकारो तक विस्तृत हैं।

मोहिनी जैन v/s राज्य सरकार (कर्नाटक) 1992 AIR 1858 में न्यायालय ने यह निर्धारित किया कि 14वर्ष की आयु तक हर नागरिक को “Free Education” प्राप्त करने का अधिकार है।

24अगस्त सन 2017 को ” Right to Privacy” को भी अनुच्छेद 21 की परिधि में सम्मिलित कर लिया गया अब ईसे भी मौलिक अधिकार के रूप मे वैधता प्राप्त हो चुकी है।

अर्नव मनोरंजन गोस्वामी v/s राज्य सरकार(महाराष्ट्र) 2020 वर्तमान समय मे महाराष्ट्र सरकार व रिपब्लिक टी वी के मुखिया श्री अर्नव मनोरंजन गोस्वामी के मध्य छिड़ा युद्ध जब से ( श्री अर्नव गोस्वामी को, सन 2018 मे एक आर्किटेक्ट स्व श्री अन्वय नाईक व उनकी माता जी के आत्महत्या के सिलसिले मे बंद हो चुके केस को पुन: जिंदा कर 2020 मे गिरफ्तार किया गया!) मुंबई उच्च न्यायलय से होता हुवा सर्वोच्च न्यायालय में पहुँचा तब से “Personal Liberty” की चर्चा एक बार पुन: जोरो पर है।

सर्वोच्च न्यायालय के न्यायधीश श्री डी वाई चंद्रचूड़ व श्रीमती ईंदीरा बनर्जी के डिवीजन बेंच ने श्री अर्नव मनोरंजन गोस्वामी जी के अवैध गिरफ्तारी पर मुंबई उच्च न्यायालय के द्वारा दिये गये निर्णय को चुनौती देने वाली याचिका पर सुनवाई करते हुये कहा कि:-

“It would be travesty of Justice if personal liberty of a person is curtailed like this”.

उन्होंने राज्य सरकार को सचेत करते हुये कहा कि:-
“If state government target individuals they must realise then that there is apex Court to protect the liberty of citizens”.

एक कदम आगे बढ़ते हुये डिवीजन बेंच ने कहा कि “We are seeing case after case where High Courts are not granting bail and failing to protect personal liberty of people”.

“Courts must be alive to the need to safeguard the public interest in ensuring that the due enforcement of criminal law is not obstructed. The fair investigation of crime is an aid to it. Equally it is the duty of courts across the spectrum – the district judiciary, the High Courts and the Supreme Court – to ensure that the criminal law does not become a weapon for the selective harassment of citizens.”

Pertinently, the Court also noted,

“Doors of courts cannot be closed in such cases and courts should remain open for all cases of deprivation of personal liberty and such deprivation cannot be even for one day.”

यहि नही डिवीजन बेंच ने स्पष्ट किया कि “If we don’t interfere in this case today, we will walk on a path of destruction. If left to me, I won’t watch the channel and you may differ in ideology, but constitutional courts will have to protect such freedoms…”

तो इस प्रकार हम देखते है कि आज के परिवेश मे जबकि आर्थीक, धार्मीक, सामाजिक, वैचारिक व राजनितिक वैमनस्यता अपने चरम की ओर अग्रसर है तब प्रत्येक न्यायालय का यह कर्तव्य बन जाता है कि वो प्रत्येक नागरिक के प्राण व दैहिक स्वतंत्रता की रछा करे।

2020: An unprecedented, unpredictable, and uncertain year

The clock is eternal with time always on the move. The year 2020 began like any other with the clock ticking from 2019 to 2020 at the midnight. However, there is something unique about the leap year 2020 with the first two digits matching the second two. Lucky are those born or living in 2020 because the last such leap year with repeating digits was 1616 and the next will be 2424. The number 2020 had a cache, was rhythmic to our ears, and as if we were going to be blessed with the 20-20 vision. Who could have imagined that the “unique 2020” would ironically turn into the most “unprecedented, unpredictable, and uncertain 2020” of historic proportions, perhaps not even worth remembering and writing about?

As the world was celebrating the arrival of the New Year in their own way in different time zones, who knew what was brewing inside China, a “closed” country with unambiguous ambitions to rule the world. Then, unexpectedly, the World Health Organization got a wind of the cluster of atypical pneumonia cases in Wuhan on January 1 while the world was still immersed in welcoming the New Year. Who knew that the little-known coronavirus will create havoc of unprecedented magnitude globally in the months to come; COVID 19 with potentially life-threatening consequences becoming the most common but dreaded phrase in every household? Subsequently, almost everything, every event, and everywhere in 2020 became the dark and stark examples of unpretentious uncertainty and unpredictability. Who knows how historians would characterize the uncharacteristic 2020?

As we are getting closer to the end of the year, we review what makes 2020 unique with many unprecedented happenings with a continuing theme of coronavirus pandemic bringing the world to the knees. The last such pandemic was between 1918 and 1920, a deadly outbreak of influenza infecting over a third of the world’s population and ending the lives of tens of millions of people (est. 20-50 million). A hundred years later, the pandemic, COVID-19, has caused over 60 million confirmed cases (of the nearly 8 billion people globally) and more than 1.4 million deaths according to WHO at the time of writing this piece. These are perhaps modest in straight comparison with the numbers in 1918 but mindboggling considering how far we have come with the huge scientific and technological advances globally. We mostly focus on the U.S. (with an occasional comparison with India), which added political uncertainty and unpredictability to an already unprecedented pandemic.   

CORONAVIRUS PANDEMIC: Our first “unprecedented” point is the nightmare we have lived through every day fearing infection and facing uncertainty worse than ever before. Just imagine that the United States, the world’s most powerful and developed, and the oldest thriving democracy, has been brought to her knees by this coronavirus. The number of deaths (~ 265,000) and nearing 13 million cases with positive infections are astounding and unprecedented. As a comparison, India, with nearly 3.5 times the population of the U.S., has nearly one-half of U.S. deaths (~135,000) and two-third (~9.2 million) infections. Every other country has suffered from a large number of deaths. 

Thanksgiving in the U.S. (at the end of November) is a traditional day for the families to get together and offer their gratitude for what they have. It is like Diwali and other festivals being celebrated by families in India. This year, the most unexpected action was a strong recommendation to restrict travel and family-together on Thanksgiving Day. There was a suggestion of observing ‘Thanks-giving’ as ‘Thanks-living’ fearing more infections post-Thanksgiving. In contrast, India imposed fewer restrictions and now post-Diwali there is a hike in the number of infections and deaths. The bottomline is that the pandemic still rules the world.

The leadership styles of Modi and Trump certainly contributed to India doing better than the U.S. in the number of deaths and infections. Modi addressed the nation multiple times during the peak months of COVID 19 about the need for sanitization, masking, and social distancing (SMS). He took an unprecedented action of shutting down one of the world’s largest train networks causing unimaginable inconvenience and economical consequences. He led the nation by example and good behavior which, we now know, made the difference. Trump, on the other hand, was slow to impose travel restrictions, never observed and promoted SMS, and in most public appearances he minimized the fatal nature of COVID-19. In fact, the U.S. under his leadership had no comprehensive public health policy; it was rather ridden with politics so much so that the States with leadership from his Republican party cared less about SMS. The coronavirus was politicized to the hilt in the U.S. elections.

While, there are positive and encouraging signals of the vaccines, with efficacy as high as 95%, the pandemic appears to be returning globally with vengeance. What was a wave of infections and death in the spring is now turning into a tsunami? The world at a standstill with complete shutdowns in the Spring paralyzed the economy, education, and employment opportunities to unprecedented levels. Going forward, it is unpredictable if the resurgence of COVID 19 will cause the winters even darker with people already experiencing fatigue, isolation, and fear of the uncertainty.

THE ELECTIONS: India’s election in the State of Bihar led to the incumbent party leadership being reelected. However, the U.S. Presidential election between incumbent Trump and former Vice President Biden, the most contentious in recent history, led to the defeat of the incumbent. What made this election unprecedented? Both candidates were older than any of the previous contenders for the White House; attracted the highest number of voters including the absentee ballots than ever before and fought a bitter fight in their own style. Some voted for the better of the two evils while others were simply seeking “change” from Trump’s legacy of total lack of decency, diplomacy, and direction for the country. Yet there was another group who would swear for and support Trump for his outspoken politics against issues such as immigration, environment, and the promise of making America great again at the expense of losing long term friends and global alliances.

Trump’s allegations of totally unfounded conspiracy and election rigging were part of his campaign style. He was totally consumed with electioneering but disengaged with the pandemic as a major public health issue for the U.S. and the world.  While the deaths and infections kept mounting, Trump was in total denial as if the coronavirus cares about his win or defeat. He refused to use a mask himself and held election rallies without the mask and social distance. In fact, Trump had no shame in ridiculing the essential safety measures of social distancing and face masks used by his rival, Biden, in election rallies. President’s messaging was unprecedented in failing to acknowledge and express sympathies for thousands of families who lost their loved ones. It is conceivable that some people voted against Trump because of his total lack of empathy for the dead due to coronavirus while others gave sympathy vote for Trump following his own infection.

The only silver lining in the months leading to the election was Trump’s focus on the development of vaccines to fight the evil coronavirus. While it was politically motivated to win the election, he committed Federal resources and kept the pressure for the “good” news of vaccine development with lightning speed. Trump unhesitatingly defied science and badmouthed scientists if it served his political ideology and hope for the return to the White House for the second term. In retrospect, Trump’s failed leadership in acknowledging the deadly nature of the invisible corona and claiming it “going away” may also have led to his defeat at the polls.

We are thankful for the vaccine development at an unprecedented speed bringing hope. However, unfortunate for Trump politics that the announcement came only after he lost the bid for the second term. The election was unprecedented in that over 153 million voters took part demonstrating an extraordinary level of engagement. While this reaffirms the strong American democracy, it also manifests an unprecedented division among people. Some of the polarization is understandably due to the political ideologies but the more damaging may be the people who resonated with Trump’s style, persona, temper, tone, and tenor. Only time will tell how well and how soon those people will heal from the deep wounds in their minds.  Historians and researchers will be busy for years to analyze the unprecedented experiences of the Presidential election during a pandemic.  

POST-ELECTION SAGA: The state of Bihar in India already has the Chief Minister back to work within days after the election results. But, the U.S. is in a long drawn political and legal battleground because President Trump has not conceded more than 3 weeks since the polls. It is just another example of unprecedented 2020. Trump’s campaign challenged election outcome in dozens of cities claiming fraud and irregularities but faced an unprecedented number of courts denying such claims for the lack of evidence. For example, Pennsylvania’s state and federal judges swiftly and pointedly rejected the Trump legal team’s arguments – at times eviscerating it for not presenting facts to back up the allegations calling it “unprecedented” and pointing out,  “The Campaign’s claims have no merit.”

Trump created another unprecedented challenge by not allowing the Federal resources for the transition team and the security briefings to President-elect Biden. It was a move to undermine democracy and risking national security. Finally, more than three weeks later, Trump signed off on both counts but still not conceded. Equally unprecedented and a move to undermine democracy is that the Republican leadership in the House and Senate turned their blind eye the other way. They should have recognized the legitimate win of President-elect Biden but they have not done it.

WHAT NEXT? The election is over; the vaccines are in the final stages of approval, and Biden’s transition team is finally at work. The uncertainty of election outcome created by Trump’s uncanny lack of wisdom is now a certainly of Biden taking oath on January 20, 2021. Trump’s legacy and his style of governance with Twitter will soon become extinct, and with the clock ticking without interruption, we will be welcoming 2021 in about a month.  With all that being the signs of hope, we can neither ignore the despair of 2020 nor wipe it from our memories. What we can agree on is that 2020 has been a year of unprecedented uncertainties with coronavirus not differentiating who and where we are, and unpredictable trials and tribulations on daily basis. However, we cannot let our guards down in 2021 until everyone gets vaccinated to develop herd immunity globally.

Biden as President will face enormous challenges such as people’s mental, physical, and economic wellbeing, small businesses collapsing, and the stimulus bill to recover the economic challenges. He must work harder to unify the divided country and offer hope while COVID is still raging. The logistics of vaccine distribution and vaccination will be enormous tasks from day one. It appears that while Trump is still the President, he is doing nothing in the interest of the nation. He has spent more time on the golf course and maneuvering the unfounded legal fights than governing and policy issues facing the nation.

The year 2021 awaits all world leaders working diligently to keep China under check against viruses and pandemics as well as thwart China’s ill-gotten dream of becoming a threat to democracy globally. A strong India-U.S. alliance and global partnerships are strategically important for geopolitical reasons, rebuilding devastated economies and restoring certainty and predictability caused by COVID-19. We will be fortunate if most people are vaccinated by the end of 2021 and the world returns to the “new normal” way of life which everyone is talking about.

Mr. Ahmad Patel, they missed you!

Death absolves the mortals of ignominy on earth, at least this is what the scriptures on Hinduism have to offer as a philosophy of death for the one who dies. With this impression of belief in mind I offer my deep condolences to the grieving family of Ahmad Patel who died due to complications arising due to Covid-19.

But before you believe otherwise, this write up is not yet another obituary towards him on the lines of so many already crowding the web and print platforms. Rather this write up is about making sense out of the many obituaries floating all over onto his death. On a different note, Off late, I have been able to experience the power of usage of words and sentences like never ever. The astute use of sentence and words can present exactly same piece of information, emotions, news, experiences in such a way so that the readers may end up grieving, laughing, lacerating, sympathizing or scorning the subject of the article. Let me demonstrate classic scenario through the different obituaries which they wrote in the fond memory of their Ahmad Bhai!

Here you go! A Woman and fiction writer in the garb of journalism, writes an eulogy on NDTV-

  • [What she writes]– “The first and second UPA governments were entirely his creations, though he never joined Manmohan Singh’s cabinet.”

[How I read this]– So far, the world believed that Antonio Maino was the conjurer behind the puppet called Manmohan Singh and his government. But here comes the revelation that even that puppet show was managed and being played not by the conjurer himself, but job was relegated to assistant juggler. Worst is, even the assistant juggler was reluctant in joining the podium of the show at the end. In nutshell, one could only imagine the extent of degeneration this whole nexus has been able to bring into the office of highest executive for the country. A person who fought his last election in 1990, with no accountability to the electorate, almost equivalent to a warden of a privileged family, who managed connections and corporates had effectively architected the formation of cabinet which governed this country for 10 years.

  • [What she writes]– “Patel was a “politician’s politician” with a huge network of relationships across party lines, corporates and the media.”

[How I read this]– He was “politician’s politician” as she has to celebrate but what she writes in the same breath is not to be missed. According to her he was such because of his connection in corporate and media. When I illustrate this, let me clarify that there is nothing unprecedented for a party of having a person like Patel was. In fact, persons like him are indispensable in political party given the kind of resource party need to manage their affairs now a days. But the origin of discomfiture arises when you juxtapose two information which are- her claim that he had huge network in corporate and media and he alone being the architect of United progressive alliance government. this is where the alarm is, a guy with no adherence to ideology (across the article he has been unanimously described as the loyalist to Gandhi clan from Indira to Antonio to Vinci who Mr. Patel regrets of not being into his good book) having no accountability to electorate directly( he was made to be the member of upper house) , being a minion to a family has been made so powerful that he managed everything good bad ugly for the elected goverment.

  • [What she writes]- “Patel was genuinely unassuming and used to say with pride that he had worked with all generations of the Gandhi family

[How I read this]– Now read between the lines, his source of pride was his service to Gandhi family and not his adherence to ideology and not Congress(I) as a political party. This very assertion about Mr. Patel’s pride by the boogey journalist tarnishes and further puts a question mark over the rich tribute towards his contribution for nation if there was any( given I know little about him and as they suggest too that he was more a back room manager than a front row politician) .

Though there are other piece of excitement she has added but let’s move to one more tribute(in the interst of plurality of the articles) which is posted on NDTV by a senior journalist who has poured his bleeding heart out for Mr Patel. let’s call him “A”

  • [What he writes]- “Yet, for the ten years that the UPA was in power, he was one of the most important people in India; his influence was exceeded only by Sonia Gandhi and during UPA I, at least, by Manmohan Singh.”

[How I read this]- He further accentuate the over arching power and impact Mr. Patel had over the highest decision-making body in the country. Arguably he did not have enough political might within him to have such an influence over the elected government. Rather he derived his power from a family and scion which itself had not constitutional validation. So, short version is he was a bridge between Gandhi Scion, corporate and an elected government which proved more accountable to the family than to the nation.

  • [What he writes]- “To have been part of Rajiv’s team was a huge advantage in the early Sonia years because she took it to mean you were committed to the core Congress values of liberalism and secularism.

[How I read this]- These sentences are more intriguing in more than one way. This is where you will almost miss the trickery of a word juggler of the league Mr “A” belong to. Please, probe for the way as to how he furnished congress a certificate of being the flag bearer of liberalism and secularism, that too under the guise of writing obituary for Mr. Patel. Mr. “A”, it is to remind you that a family managed hypocrisy, circus and scam called congress( congress of post-independence) imposed emergency which effectively killed the soul of democracy, it dragged the political opponent and journalist into the jail, it divested the executive and judiciary in one go, so effectively Congress is the pallbearer and not a torch bearer of liberalism in true sense but not you Mr. “Word piper”.

Secondly, the architect of worst massacre which congress sponsored and actively participated in 1984, one who was chief executive of Bofors scam and presided over a lame duck government which allowed Warren Anderson of Union Carbide to escape the culpability for the genocide has secularism as value within his structure, isn’t it Mr. “A”. On a different note, Mr. “Word Player” estimates the merits for selection of Mr. Patel into the proximity of Mrs. Maino as he was from Rajiv Gandhi Coterie. With insinuation like this he absolved Rajiv Gandhi from the heinous crimes he committed against the citizen, country and humanity all together, all under the garb of writing the obituary for Mr. Patel.

There are many more citation and memory which Mr “A” has quoted but I request the readers to get through the admission which he has made on behalf of congress and Mr.Patel who is no more. But in the interest of time, let me pull a few samples from the “Stamped from USA” Bag piper Mr “B’s” condolences which he has written for Mr. Patel. It is lying for you on India Today.

[What he writes]- “In 1989, he lost a Lok Sabha election, losing again in 1991. Gujarat and indeed India, was changing as the rising tide of Hindutva rhetoric swept away Muslim political representatives (Gujarat has not had a single Muslim MP since 1989).

[How I read this]-For Mr “B”, It was as if Mr. Patel was so diligent for his constituency and he built towers of work, but it is rising Hindutva tide which did him in and he lost twice. It is for all to see that Mr “B” lives in regression where he believes that the readers are as naïve as they were a decade ago. We all know that congress ruled Gujrat since independence and effectively it is they and their representatives who are responsible for what Bharuch was till 1990 and for all of us to know how Bharuch was which Mr. Patel represented twice. It riddled with water and health issue along with myriad other issues which contributed into its backwardness. But instead of blaming that for the defeat which is self-inflicted almost,  the “Durbari” Journalist attributes rising Hindutva for two consecutive defeat of the departed soul.

[What he writes]- “His wasn’t the politics of threat and intimidation but of genuinely cultivating people and friendships, of negotiation not confrontation.

[How I read this]- Here, he tricks fully trying to compare the style of working which Mr. Patel had with insinuation towards BJP whom he attributes of doing the politics of threat and intimidation. Mr. “B”, how you described Mr. Patel indicates clearly that he was a backroom manager for Gandhi Family. He did everything good bad and ugly for them. Hence it does not make any sense for what your instrument are, be it threat or intimidation, nothing makes a backroom job so shiny irrespective of the instrument through you carry it out.

There are other articles by so many journalists around. They have fond memories with “Back room manager” and “minion of Gandhi family” as they claim themselves though they do it through different words. This itself shows the kind of privileged relationship they enjoyed during the scam riddled regime. Through these obituaries and condolences one can easily see as to why these power brokers who used to enjoy the access to power corridors are so unnerved as they miss the absence of jugglers and conjurers in current regime.

Is this a right time to reclaim Bharatavarsh being Atmanirbhar on the occasion of Sri Rajiv Dixit’s birth anniversary?

The real hero of Hindustan who became the revolutionary for Swadeshi movement of independent Bharat. The fearless hero who did the strong determination to fight against Black Britishers who were ruling at that time. The fearless hero who dedicated his entire life to create social awareness about corruption across country, the fearless hero who gave a tight slap to slave British education system by bringing bright light on the face of Indians to see the glory of Gurukul Sanatanam education system. The fearless hero who strongly condemned the false allegation of feminism and liberalism  preachers who used to blame our country in comparison with west, by uttering rich history of Bharat-women prominent Bharat. The fearless hero who exposed the antinational works of famous Bollywood celebrities and cricketers with facts and evidence, The fearless hero who promoted the Indic Ayurveda treatment (Swadeshi Chikitsa) and also gave so much advice about healthy life. The fearless hero who demonstrated the model to bring back the black money to bharath, The fearless hero who exposed the reality of foreign companies which are looting our money. Yes, He is non-other than Dr. Rajiv Dixit Bhai.

Indeed if we look at the journey of Rajiv Dixit ji, we come to know that it was a great journey rather than a long. He was doctorate and scientist at the CSIR (council of science and research). Being in a high profile job, he could have enjoyed his life very well in any rich countries but he sacrificed his life to bring awareness among the people against loot of multinational companies, antinational works of Bbollywood celebrities and cricketers, corruptions (especially in politics), benefits of Swadeshi products and Ayurveda. He initiated the ‘Azadi Bachao Andolan’ (save freedom movement) in the early 1990s to protect Bharat companies at a time when foreign invading companies were increasing and oppressing our nation companies.

He served as the national secretary of Bharat Swabhiman Andolan which has led by Baba Ramdev. He collected more than 50000 documents of our freedom fight from the library of London, British house of commons and Indian parliament. He exposed the lies of British favoring speeches from Nehru to Manmohan Singh who claimed that Britishers improved our country, They did hard work for the betterment of poor people. He used to challenge that British favoring agenda by asking unanswerable questions like if Bharat is a poor country, why those Islamists, Portuguese, Britishers and other invaders have come to loot here? He gave the evidences against Britishers with the British documents only. He proved that the main reason for poverty in our country was the loot of first white Britishers and then the continuation of the loot by black Britishers. 

He was totally against corruption in politics and wanted to fight against each corrupt political leader. He explained in his speeches how value of Indian rupee devalued when in 1947 it was ₹1=1$ and ₹1=1 Britain pound, We can verify this on google. Since 1998 he knew about the black money in Swiss bank and he had a mission to bring back these black money as a national property to Bharat. In regard to give strong fact for the corruption, he explained how rich our country’s geographical features are for agriculture than any other countries, how rich our heritage to be proud to live a worthful life, how rich our environment is to live healthy and do works efficiently. Even though we are having all capabilities, poverty and unemployment are increasing due to corruption. Now, the present PM Modiji is fulfilling majority of his election manifesto thus bringing the hope to get the black money out soon.


He also exposed the real faces of Bollywood celebrities and cricketers that how they are misleading the countrymen by advertising the foreign company products that too of smoking and drinking products (especially for the promotion of IPL matches). The Bollywood is attacking our sacred culture by making vulgar songs and scenes in their films. He was very furious about these people who put the black mark in the sacred land of worshiping women. He also used to tell how our culture taught us to respect women, the higher level position of women unlike in west countries which consider women as lustful thing. He also exposed the reality of European intellectuals Plato and Aristotle who gave teachings like women have no soul, she should go out together with man (of any age), she can’t go alone. In one of his speech, he felt very sad about cricket. Because, during the tough time of Kargil war in the country, majority youths of Bharat were very busy in watching cricket worldcup match without having concern about country’s security. Only after the lose of Bharat in  worldcup, they all started to thinking about Kargil war.

He totally disagreed with slavery like British education system. He exposed the agenda of Christians in establishing British school education system and how they had destroyed the Gurukul Sanatan education. After the practice of 70 years of British education, a considerable improvement is happening in bringing back the great Sanatanam education system under the leadership of PM Modiji. The new National Education Policy encourages the use of mother tongue as we have seen in it’s explanation.

If Rajiv Dixitji was alive today, he would be happy about the present state of our country in the world. Bharat got a visionary leader who is working day and night to reclaim the glorious Bharat that is what Rajiv Dixitji was fighting for. Modiji also determined ‘Atmanirbhar Bharath’ as a goal of all Indians. So this is a right time to reclaim Bharathavarsh being Atmanirbhar on the occasion of Sri Rajiv dixit’s birth anniversary and also death anniversary.

Rajiv dixit ji is not alive today. But his ideals, thoughts and deeds will never die. It will take lives in many forms. All speeches and books of him are available. We can learn more about his vision through those speeches and books. After coming to know about this great patriot nationalist, the real question arises is what if we’re really following his swadeshi ideal? What if we really becoming true Indian in wearing swadeshi clothes, in using swadeshi medicine, in using swadeshi vehicles, in using swadeshi toothpaste-brush-soap, in using swadeshi electronic devices. We can’t ignore this daily products as the swadeshi movement starts from using small small swadeshi products. If the answer to the above questions is no, We should be sorry for ignoring this great ideal. Is this a great reward given to this great soul? The left out works of Rajiv Dixit ji has again started with the Modiji’s determination of Atmanirbhar Bharat. We all should stand firm and unite in this determination. Unite, rise and win.

Crisis of nationalism in India 2020

Nationalism isn’t just a term for Indians it is a mutual feeling of love that united us originated from the pain and suffering faced by our ancestors who yielded their life freeing one human from the bondage of another human. When we speak about our national history thousands of names bring tears to our eyes because the selflessness those young had cannot be forgotten by our hearts. They understood the true meaning of Nation for them Nation is something which liberates a man from slavery gives them an identity of being a free man but nowadays the term Nation and it’s feeling of patriotism limits itself to such a lower standard where one man abuses a foreign nation and blames his minorities” is called a Nationalist instead of looking for solutions of the problem we attempt to move the fault on the different shoulder this driving Indian nation towards blind Nationalism aka Jingoism.

India is witnessing the cult of cultural nationalism where minorities confronted outrages, abuse due to their disparities in character which we seen from 1984 in Delhi mid-90s in Kashmir 2002 in Gujarat and 2020 Delhi were ideological contrasts blinded the entire country and divided it citizens on communal bases which is contrary to the idea of Bharatvarsh where all races were welcomed regardless of their differences.

In the efforts of imitating the west, we created new problems for our nation despite being the largest democracy we became so intolerant towards other opinions that truth is often projected as a conspiracy against the nation and those who are vocally stamped as anti-national. The brotherhood of India is corrupted by our fear which never existed outside but within our mind. We need to safeguard the integrity of this nation without compromising with the core values on which this very nation was formed. If we don’t do that, it will be betrayal to thousands of mothers who sacrificed their children in the name of the Nation. Indian patriotism ought not to be restricted to a specific limit but to enlighten the whole world by guiding the west towards love and cooperation between people. We must preserve the true values of Indian nationalism which is selflessness and fellowship until Indians acknowledge the necessity for the restoration of true core values Indian society will remain in a vulnerable state.

The hate and greed lying within made us so ignorant that we are denying the universal brotherhood due to selfishness and this notion of jingoism leading us towards catastrophe nothing else. It is always a valuable exercise to freshly imagine what our country means to us, but in doing so we would do well to remember that when it comes to divisions of race, ethnicity, and religious belief, the unforgotten is the destroyer of nations.

गुपकार गैंग द्वारा रोशनी एक्ट की आड़ में किया गया 25000 करोड़ रुपए का घोटाला!

इतिहास गवाह है कि महाराज हरि सिंह की महत्वाकांक्षा और उनके द्वारा जम्मू-कश्मीर रियासत के लिए हिंदुस्तान को अपना देश स्वीकार करने में किए गए विलंब ने खूंखार लूटेरों को मौका दिया और उन्होने हिंदुस्तान में बैठे अपने शुभचिंतकों की सहायता से गिलगिट-बल्टिस्तान सहित जम्मू-कश्मीर के आधे हिस्से पर अवैध रूप से कब्जा कर लिया, जिसे हम आज POK को नाम से जानते हैं।

हिंदुस्तान के प्रति वैमनस्यता रखने वाले यहीं नहीं रुके। उन्होंने जम्मू-कश्मीर का जो भाग हिंदुस्तान के हिस्से में आया उसे भी एक सुनियोजित षड्यंत्र के माध्यम से संविधान के अनुच्छेद 370 व 35अ (Article 370& 35A) का सहारा लेकर एक विशेष राज्य का स्तर प्रदान कर हिंदुस्तान से लगभग अलग कर दिया। इस विशेष राज्य का स्तर प्राप्त होते ही जम्मू-कश्मीर का अलग झण्डा, अलग संविधान व अलग निशान बन गया जो कहने को तो भारतीय संविधान की परिधि में ही था, परंतु पूरी तरह स्वायत्तशासी स्थिति में था।

इसी व्यवस्था का लाभ उठाकर 2001 से 2007 के बीच गुपकार गैंग वालों ने मिलकर जम्मू-कश्मीर को जहाँ से मौका मिला वहाँ से लूटा, खसोटा, बेचा व नीलाम किया और बेचारी जनता मायूसी के अंधकार में मूकदर्शक बनी देखती रही।

इसी लूटपाट का प्रत्यक्ष उदाहरण है: रोशनी एक्ट

जम्मू-कश्मीर में गुपकार गैंग का एकाधिकार होने के कारण संपूर्ण व्यवस्था पर उनका नियंत्रण था। इसका फायदा उठाकर सरकारी जमीनों पर बड़े पैमाने पर इन्होंने कब्जा किया। 2001 में फारूख अबदुल्ला जम्मू-कश्मीर के मुख्यमंत्री हुआ करते थे और केंद्र मे भाजपा की सरकार थी और अटल बिहारी वाजपेयी प्रधानमंत्री थे।

फारूख अबदुल्ला व केंद्र के बड़े नेताओं की परिचर्चा के बाद जम्मू-कश्मीर राज्य के सरकारी जमीनों पर अवैध कब्जे से निपटने के लिए यह निर्णय लिया गया कि अवैध कब्जा करने वालों से कानूनी लड़ाई लड़कर समय, सामर्थ्य व पैसा बरबाद करने के बजाय उनके अवैध कब्जे को वैधानिकता प्रदान कर दी जाए। इसके एवज में उनसे जमीन की कीमत वसूली जाए और इससे प्राप्त राशि से जम्मू-कश्मीर में बिजली की व्यवस्था को सुदृढ़ किया जाए।

अत: सन 2000 में बजट प्रस्तुत करते हुए तत्कालीन वित्त मंत्री यशवंत सिन्हा ने सद्भावपूर्वक एक योजना का प्रस्ताव रखा जिसे ‘रोशनी योजना’ के नाम से जाना जाता है। इसमें प्रस्ताव दिया गया कि सरकारी जमीनों पर अवैध कब्जा करने वाले लोगों से से सन 1990 में जो जमीन का बाजार मूल्य था वह वसूल कर उनके अधिकारों को वैधानिकता प्रदान कर दी जाए।

यहीं पर तत्कालीन वित्त मंत्री यशवंत सिन्हा मात खा गए। वे प्रस्ताव सन 2000 में प्रस्तुत कर रहे थे और जमीनों का बाजार मूल्य सन 1990 का पकड़ रहे थे।

इसी प्रस्ताव के अंतर्गत मौका पाते ही आज के गुपकार गैंग के मुखिया फारूख अबदुल्ला की बाँछे खिल गई और उन्होंने तुरंत ‘The Jammu and Kashmir State Land (Ownership to the Occupants) Bill’ जम्मू-कश्मीर के विधानसभा में पेश किया जो 9 नवंबर 2001 को तत्कालीन गवर्नर गिरीश चंद्र सक्सेना की मंजूरी मिलते ही ‘The Jammu and Kashmir State Land (Ownership to the Occupants), Act 2001’ के रूप में सामने आया।

13 नवंबर 2001 को सरकारी राज-पत्र में इसे प्रकाशित कर दिया गया। चूँकि ये ‘रोशनी प्रस्ताव’ के नाम पर पारित किया गया था, अत: इसे ‘रोशनी अधिनियम’ के नाम से भी जाना जाने लगा।

इस अधिनियम की प्रस्तावना को कुछ यूँ गढ़ा गया था: बिजली परियोजनाओं के लिए वित्त उत्पन्न करने के लिए सरकारी जमीनों के कब्जाधारियों के स्वामित्व का अधिकार देने के लिए एक अधिनियम।

ऊपर से तो सबकुछ अच्छा था, परंतु इसमें दिए गए प्रावधानों को लूट-खसोट करने हेतु अपनी इच्छा से प्रयोग करने की पूरी खुली छूट गुपकार गैंग के लोगों के पास थी और यहाँ से जो लूटपाट का धंधा शुरू हुआ वो 2007 तक जारी था।

सबसे पहले ये देखिए कि ‘Jammu and Kashmir State Land (Ownership to the Occupants) अधिनियम’, सन 2001 में लागू हुआ। परंतु अवैध कब्जे को वैधानिकता प्रदान करने के लिए जमीन की जो रकम वसूल की जा रही थी वो सन 1990 के बाजार दर पर थी। और इस प्रकार फारूख अबदुल्ला की पार्टी के सभी बड़े नेताओं, रिश्तेदारों, कार्यकर्ताओं ने भारी मात्रा मे जमीनें हथिया ली।

इस अधिनियम की धारा 12 उपधारा 4 (Section 12 subsection 4) मे कृषि भूमि से संबंधित प्रावधान दिए गए हैं जो यह कहते हैं कि किसी व्यक्ति के कब्जे मे कृषि योग्य भूमि है तो उसे बगैर किसी मूल्य के उसे दे दी जाएगी और उसके बदले मे केवल 100 रुपए वसूल किया जाएगा राजस्व दस्तावेजों (Revenue Records) को दुरुस्त रखने के लिए। अब ये पूरा प्रावधान ही वैधानिक निषेध के नियम 13(4) के विरूद्ध निर्धारित किया गया है। इस प्रावधान का उपयोग करते हुए करोड़ो की कीमत वाली कृषि योग्य भूमि को बिना किसी मूल्य के मालिकाना हक प्राप्त कर लिया गया, लूटेरों के द्वारा।

2001 मे लागू किए गए अधिनियम की धारा 8(b) के अनुसार केवल 10 kanals जमीन का स्वामित्व प्रदान किया जा रहा था, परंतु 2004 में इसमें संशोधन किया गया और इस सीमा को बढ़ाकर 100 Kanals कर दिया गया।

2004 मे गुपकार गैंग की दूसरी सबसे बड़ी भागीदारमहबूबा मुफ्ती के अब्बा मुफ़्ती मोहम्मद सईद की सरकार थी और उन्होंने भी ये मौका हाथ से नही जाने दिया। 27 फरवरी 2004 को ‘Jammu and Kashmir State Land (Ownership to the Occupants) अधिनियम’ में संशोधन किया गया, जिसे दिनांक 19 मार्च 2004 को तत्कालीन गवर्नर श्रीनिवास कुमार की मंजूरी मिलने के पश्चात सरकारी राजपत्र मे प्रकाशित कर लागू कर दिया गया।

इस प्रकार जो अवैध कब्जे की तय सीमा 1990 तक थी, 2001 के अधिनियम में उसे उस संशोधन के जरिए 2004 तक बढ़ा दिया गया। अर्थात जो निवासी 2004 तक सरकारी जमीनों पर अवैध कब्जा करके बैठे थे वे सभी पात्र कर दिए गए इस अधिनियम के द्वारा वैध स्वामित्व प्राप्त करने के लिए।

फिर 2007 मेंकांग्रेस की सरकार बनी और गुलाम नबी आजाद मुख्यमंत्री बने। घोटालों पर तो हमेशा कांग्रेस के नेताओं का एकछत्र राज रहा है, तो फिर कांग्रेस यहाँ कैसे पीछे रहती!

एक बार फिर ‘Jammu and Kashmir State Land( Ownership to the Occupants) अधिनियम’ में संशोधन किया गया और इसकी सीमा 2007 तक बढ़ा दी गई। अर्थात अब जिन लोगो ने 2007 तक अवैध कब्जा किया था उन्हें भी वैधता प्रदान की जाने लगी।

सबसे महत्वपूर्ण बात ये है कि इन 2007 में किए गए संशोधन को अवैधानिक व मनमाने तरिके से विधायिका की सहमति के बिना सरकारी राजपत्र में प्रकाशित कर लागू कर दिया गया। यह असंवैधानिक कार्यवाही है। यह आब्जर्वेशन जम्मू कश्मीर उच्च न्यायालय ने जनहित याचिका संख्या 19/2011 में निर्णय पारित करते हुए अपने निर्णय (Judgement) के पैरा संख्या 17 में वर्णित की है।

इस प्रकार 2001 से लेकर 2007 तक जबरदस्त तरिके से सरकारी जमीनों की लूटमार होती रही। गुपकार गैंग के सदस्य अपनों को कौड़ियों के दाम में करोड़ों की सरकारी जमीनों का स्वामित्व देते रहे।

इस घोटाले के संदर्भ मे एक जनहित याचिका (PIL No. 19/2011) जम्मू व कश्मीर उच्च न्यायालय में प्रस्तुत की गई गयी तथा पुन: 31 मार्च 2013 को CAG ( Comptroller and Auditor General of India) के द्वारा इस करोड़ों के रोशनी जमीन घोटाले पर प्रस्तुत किए गए रिपोर्ट का उदाहरण देते हुए 13 मार्च 2014 को अर्जी ( IA No. 48/2014 & CM Nos. 4036, 4065 of 2020) प्रस्तुत कर प्रार्थना की कि इस घोटाले की जांच CBI द्वारा कराई जाए।

जम्मू-कश्मीर उच्च न्यायालय केमुख्य न्यायाधीश गीता मित्तल व न्यायाधी राजेश बिंडले के डिवीजन बेंचने उपरोक्त जनहित याचिका में प्रस्तुत किए गए अर्जी (IA No. 48/2014 & CM Nos. 4036, 4065 of 2020 In PIL no. 19/2011) पर सुनवाई करते हुए 9 अक्टूबर 2020को अपना निर्णय दिया। इस निर्णय के द्वारा रोशनी जमीन घोटाले की जांच CBI को देते हुए न्यायालय ने आदेश दिया कि:-

1: कमिश्नर/ सरकारी राजस्व विभाग के सचिव, रोशनी अधिनियम के अतंर्गत सरकारी जमीनों से जुड़ी समस्त जानकारियों (जैसा कि आदेश मे वर्णित है) को अधिकारिक वेबसाइट व NIC के वेबसाइट पर प्रकाशित करें।
2: CBI जांच के बाद विधि के अनुसार केस रजिस्टर करेगी और यदि अपराध हुआ हो तो जांच करने व दण्डित करने की कार्यवाही करे।

3: CBI निदेशक के सामने Anti Corruption Beuro अपना Closure Report प्रस्तुत करे (जिसे उसने 4 जुलाई 2019 को Spl. Judge (ACB, Jammu) के सामने FIR no. 6/2014 मे प्रस्तुत किया था) और साथ में उस Closure Report पर पारित किया गया आदेश भी प्रस्तुत करे।

4: CBI प्रत्येक आठवें सप्ताह मे अपना प्रतिवेदन (रिपोर्ट) न्यायालय के सामने प्रस्तुत करे।

इसके अतिरिक्त भी कई आदेश पारित किए गए, परंतु सबसे बड़ा जो आदेश व निर्णय उच्च न्यायालय ने लिया है वो
निम्नवत है:-

1:-उच्च न्यायालय ने Jammu and Kashmir State land ( vesting of Ownership to the Occupants) Act, 2001 को पूरी तरह असंवैधानिक घोषित करने के साथ-साथ इसमें समय-समय पर किए गए समस्त संशोधनो(amendments) को अमान्य व अवैधानिक तथा संविधान के अनुच्छेद 14 व 21 का विरोधी घोषित कर दिया है।

2:- The Roshni Rules 2007 के अंतर्गत पारित किए गए सभी आदेश को पूर्णतया अवैधानिक व शून्य घोषित कर दिया।

3:-Section 6 of the General Clauses Act, 1897 would also not aid the beneficiaries.

आदरणीय उच्च न्यायालय ने इस अधिनियम को ‘स्वंय के लिए लूट’ अर्थात ‘Loot to Own’ की नीति बताते हुए इसकी कटु शब्दों में निंदा की और टिप्पणी करते हुए कहा कि ‘ये लूटेरे अपने नापाक मंसूबो को आसान बनाने के लिए किसी कानून को बनाने के लिए प्रेरित कर सकते हैं (Para No.2 Judgement)।

उच्च न्यायालय ने स्पष्ट शब्दो मे इस लूट-खसोट की भयावहता को अपने शब्दों में प्रकट करते हुए कहा कि ‘राष्ट्रीय व जनता के हितों की कीमत पर सरकारी खजाने और वातावरण को असहनीय क्षति पहुंचाने वाली, बगैर मौद्रिक (या अन्य) प्रभावी आकलन के अपराधिक कार्यों को वैध बनाने वाली, राज्य के किसी ऐसी विधायी कार्यवाही के संपर्क में हम नहीं आए।

आदरणीय उच्च न्यायालय ने आदरणीय सर्वोच्च न्यायालय द्वारा (1997) 1SCC 3880 MC Mehta v/s Kamalnath दिए गए आकलन को प्रस्तुत किया जिसमें ये कहा गया कि ‘हमारी कानून प्रणाली अंग्रेजी आम कानून पर आधारित है जो सार्वजनिक न्यास के सिद्धांत को अपने विधिशास्त्र के एक भाग के रूप मे शामिल करती है। वे सभी प्राकृतिक संसाधन जो जनता के उपयोग और आनंद के लिए प्रकृति द्वारा प्रदान किए गए हैं, राज्य उन सभी का न्यासी होता है। जनता वृहद स्तर पर समुद्र के किनारों, बहते पानी, हवा, जंगल और प्राकृतिक रूप से नाजुक भूमि की लाभार्थी होती है, ये संशोधन जनता के उपयोग के लिए हैं जिन्हें व्यक्तिगत स्वामित्व मे बदला नहीं जा सकता।

राज्यपाल ने तत्काल प्रभाव से उच्च न्यायलय के आदेश का पालन करते हुए Jammu and Kashmir State land (vesting of Ownership to the Occupants) Act, 2001 को असंवैधानिक घोषित कर दिया।

गुपकार गैंग के सबसे बड़े मुखिया फारूख अबदुल्ला (जो चीन से सहायता लेकर अनुच्छेद 370 को बहाल करने की योजना बना रहे थे) की जांच-पड़ताल शुरू हो चुकी है।

बड़े-बड़े नाम उजागर होने वाले हैं। CBI के अलावा केंद्रीय गृह मंत्री अमित शाह की नजर इस पर बनी हुई है।
