Spread of SARS-COV2 1st wave from Wuhan and 2nd wave from other countries resulting in endangering India

The start of SARS-COV2 in Wuhan is a controversy as we are not aware the origin of SARS-COV2. We came to know it got spread through a seafood market in Wuhan, China and the other myth is the deployment of American soldiers into Chinese territory who according to Chinese bought the SARS-COV2 virus to experiment on the Chinese through a war between the American soldiers and the Chinese soldiers and the other myth is that the SARS-COV2 virus leaked in a lab just 2 km from Wuhan seafood market and the other myth is that it is a bio-engineered weapon manufactured to bring the world economy down and mainly targeted towards America.

A controversial virus that has many origins that we are not aware of. First, it began spreading among Chinese people in Wuhan then it started engulfing America, Russia, Europe, Saudi Arabia, France, and other countries of the world. The reason behind the spread of the pandemic is that we allowed flights knowingly to fly over even after start of the pandemic thus endangering our societies which was not healthy from our Governments just because of saving some few NRIs and their sons and students flying from all over the countries and some rich kids have even booked chartered flights to fly back to India thus endangering India knowingly or unknowingly and spreading the virus among the Indian nationals.

After returning back to India, some were stamped for quarantine or home quarantine, but did not follow as per instructions and were found in the roads without safety precautions leading to the spread of SARS-COV2 1st wave and endangering our country. It seems we are careless about ourselves as well as other’s lives no matter they live or die and as far as SARS-COV2 2nd wave is concerned, the same is repeated bringing in international passengers without hesitation that India is a safe place no matter what happens to India but nothing should happen to NRIs and International Passengers and sacrifice as many Indian nationals for the sake of NRI’s and Indian foreign nationals.

Why Indian flights were allowed to fly back NRI’s and Indian nationals back to India after the start of the pandemic during the lockdown is a big controversy that we might not be aware of? We have sacrificed many Indians at the cost of flying back International Passengers which again gave rise to conflicts, controversies, and contradictions among Indian nationals as if we are solely responsible for the spread of SARS-COV2 which is not at all healthy engulfing the peace of India just for a few NRI’s, International Tourists, International Students, and International Businessmen. India must not be jeopardized at any cost be it the spread of bio-engineered viruses. Stay Home. Stay Safe. Be United.

धोखा देकर उनके बलोचिस्तान को फिर से गुलाम बना दिया

हिन्दुस्तान और पाकिस्तान के पहले 11 अगस्त 1947 को बलूचिस्तान आजाद हुआ था। 

जैसा की हम सभी जानते हैं कि भारत और सनातन धर्म इस सृष्टी के आरंभ से ही है! ईरान, अरब, अफगानिस्तान, बलूचिस्तान और पाकिस्तान इत्यादि सभी भारत के हिस्से थे। ‘अखंड भारत’ का यथार्थ दुनिया के प्राचीन भौगोलिक स्थिति से आसानी से देखा जा सकता है!

बलूचिस्तान में माता सती के 51 शक्तिपीठों में से एक शक्तिपीठ हिंगलाज माता का है। बलूचिस्तान में भगवान बुद्ध की सैंकड़ों मूर्तियां पाई गईं। यहां किसी काल में बौद्ध धर्म का अच्छा प्रभाव था। बलूचिस्तान भारत के 16 महा-जनपदों में से एक जनपद संभवत: गांधार जनपद का हिस्सा था। चन्द्रगुप्त मौर्य का लगभग 321 ईपू का शासन पश्चिमोत्तर में अफगानिस्तान और बलूचिस्तान तक फैला था। 

वर्ष 711 में मुहम्मद-बिन-कासिम और फिर 11वीं सदी में महमूद गजनवी ने बलूचिस्तान पर आक्रमण किया। इस आक्रमण के बाद बलूचिस्तान के लोगों को इस्लाम कबूल करना पड़ा। 

अकबर के शासन काल में बलूचिस्तान मुगल साम्राज्य के अधीन था। आइनअकबरी के मुताबिक, 1590 में यहां के ऊपरी इलाकों पर कंधार के सरदार का कब्जा था, जबकि कच्ची इलाका मुल्तान के भक्कड़ सरदार के अधीन था।

अंग्रेजो का बलूचिस्तान पर कब्जा :-

बलूच राष्ट्रवादी आंदोलन 1666 में स्थापित मीर अहमद के कलात की खानत को अपना आधार मानता है। प्रथम अफगान युद्ध (1839-42) के बाद अंग्रेंजों ने इस क्षेत्र पर अधिकार जमा लिया। वर्ष 1876 में रॉबर्ट सैंडमेन को बलूचिस्तान का ब्रिटिश एजेंट नियुक्त किया गया और 1887 तक इसके ज्यादातर इलाके ब्रिटिश साम्राज्य के अधीन आ गए।

अंग्रेजों से बलूचिस्तान की आजादी का संघर्ष :-

अंग्रेजों ने बलूचिस्तान को 4 रियासतों में बांट दिया- कलात, मकरान, लस बेला और खारन। 20वीं सदी में बलूचों ने अंग्रेजों के खिलाफ संघर्ष छेड़ दिया। इसके लिए 1941 में राष्ट्रवादी संगठन अंजुमानइत्तेहादबलूचिस्तान का गठन हुआ। वर्ष 1944 में जनरल मनी ने बलूचिस्तान की स्वतंत्रता का स्पष्ट विचार रखा। बाद में अंजुमन को कलात स्टेट नेशनल पार्टी में बदल दिया गया।

1939 में अंग्रेजों की राजनीति के तहत बलूचों की मुस्लिम लीग पार्टी का जन्म हुआ, जो हिन्दुस्तान के मुस्लिम लीग से जा मिली। दूसरी ओर एक ओर नई पार्टी अंजुमनवतन का जन्म हुआ जो भारतीय राष्ट्रीय कांग्रेस के साथ जुड़ गई।अंजुमन के कांग्रेस के साथ इस जुड़ाव में खान अब्दुल गफ्फार खान की भूमिका अहम थी।

मीर यार खान ने स्थानीय मुस्लिम लीग और राष्ट्रीय मुस्लिम लीग दोनों को भारी वित्तीय मदद दी और मुहम्मद अली जिन्ना को कलात राज्य का कानूनी सलाहकार बना लिया और यही पर बलोचो ने सबसे बड़ी गलती कर दी जिसकी कीमत वो आज तक पाकिस्तान की गुलामी करते हुए चूका रहे है

8 मई 1947 को वीपी मेनन ने सत्ता अंतरण के लिए एक योजना प्रस्तुत की जिसका अनुमोदन माउंटबेटन ने किया।  ब्रिटेन के तत्कालिन प्रधानमंत्री एटली ने इस योजना की घोषणा हाउस ऑफ कामंस में 3 जून 1947 को की थी इसीलिए इस योजना को 3 जून की योजना भी कहा जाता है। इसी दिन माउंटबेटन ने विभाजन की अपनी घोषणा प्रकाशित की। उस दौरान पाकिस्तान के साथ विलय के लिए किसी भी प्रकार का करार पास नहीं हुआ था। अंत में यह निर्णय हुआ कि बलूच एक आजाद मुल्क बनेगा कलात के खान ने बलूची जनमानस की नुमाइंदगी करते हुए बलूचिस्तान का पाकिस्तान में विलय करने से साफ इंकार कर दिया था यह पाकिस्तान के लिए असहनीय स्थिति थी। 

4 अगस्त 1947 को लार्ड माउंटबेटन, मिस्टर जिन्ना जो बदकिस्मती से बलू‍चों के वकील थे, सभी ने एक कमीशन बैठाकर तस्लीम किया और 11 अगस्त को बलूचिस्तान की आजादी की घोषणा कर दी गई। 

जिन्ना की सलाह पर यार खान 4 अगस्त 1947 को राजी हो गया कि ‘कलात राज्य 5 अगस्त 1947 को आजाद हो जाएगा और उसकी 1938 की स्थिति बहाल हो जाएगी।’ उसी दिन पाकिस्तानी संघ से एक समझौते पर दस्तखत किया गया। इसके अनुच्छेद 1 के मुताबिक ‘पाकिस्तान सरकार इस पर रजामंद है कि कलात स्वतंत्र राज्य है जिसका वजूद हिन्दुस्तान के दूसरे राज्यों से एकदम अलग है। 

लेकिन अनुच्छेद 4 में कहा गया कि ‘पाकिस्तान और कलात के बीच एक करार यह होगा कि पाकिस्तान कलात और अंग्रेजों के बीच 1839 से 1947 से हुए सभी करारों के प्रति प्रतिबद्ध होगा और इस तरह पाकिस्तान अंग्रेजी राज का कानूनी, संवैधानिक और राजनीतिक उत्तराधिकारी होगा।’ 

अनुच्छेद 4 की इसी बात का फायदा उठाकर पाकिस्तान ने कलात के खान को 15 अगस्त 1947 को एक फरेबी और फंसाने वाली आजादी देकर 4 महीने के भीतर यह समझौता तोड़कर 27 मार्च 1948 को उस पर औपचारिक कब्जा कर लिया। पाकिस्तान ने बलूचिस्तान के बचे 3 प्रांतों को भी जबरन पाकिस्तान में मिला लिया था। इस समझौते कोस्टैंडस्टिल समझौता भी कहा जाता है। बलूच इस निर्णय को अवैधानिक मानते हैं, तभी से राष्ट्रवादी बलोच पाकिस्तान की गुलामी से मुक्त होने के लिए संघर्ष छेड़े हुए हैं

बलूचिस्तान पाकिस्तान के 4 प्रांतों में से एक है। यह पाकिस्तान का सबसे बड़ा राज्य है जो लगभग 44% हिस्से को कवर करता है। बलूचिस्तान को ‘ब्लैक पर्ल’ या ‘काला मोती’ भी कहा जाता है. तेल, गैस, तांबे और सोने जैसी प्राकृतिक संपदाओं की यहां भरमार है।

बलोचो को आजादी की जंग

पहली बगावत निसार खान और अब्दुल करीम खान ने कर दी। 1948 में बलूच राजकुमार अब्दुल करीम खान के नेतृत्व में विद्रोह की शुरुआत हुई और गोरिल्ला पद्धति से पाकिस्तानी सेना के खिलाफ सशस्त्र संघर्ष किया गया। 1958-59, वर्ष 1958 में स्वयं खानकलात ने पाकिस्तान से छुटकारा पाने केलिए विद्रोह का बिगुल बजाया! खान-ए-कलात के गिरफ्तार होते ही पुरे बलोचिस्तान में हिंसा फ़ैल गयी!

खान-ए-कलात के समर्थन में ज़रक्जई कबीले के सरदार बाबू नवरोज़ ने सशस्त्र विद्रोह शुरू किया! टिक्का खान ने कुरान पर एतबार दिखला कर नवरोज़, उसके बेटों और भतीजों से आत्मसमर्पण करवा लिया! नवरोज़ के बेटों और भतीजों को हैदराबाद जेल में फांसी पर लटका दिया गया जब कि नब्बे वर्ष की आयु में नवरोज़ की मृत्यु भी हैदराबादजेल में ही हुई! टिक्काखान ने ज़राक्जई, अचकजई, मर्री और बुगती कबीलों पर भीषण अत्याचार किये! बलोच  इतिहासकारों केअनुसार टिक्काखान ने एकहज़ार से अधिक बेगुनाह बलोच नागरिकों की हत्या की!  1962-63 में तीसरा विद्रोह व 1973-77 चौथा विद्रोह खासा गंभीर रहा! इन्हें भी पाकिस्तानी सेना द्वारा निर्दयता से कुचल दिया गया!

मौजूदा संघर्ष का दौर 2003 से शुरू हुआ। इसमें सबसे प्रमुख संगठन बलूचिस्तान लिबरेशन आर्मी को बताया जाता है जिसे पाकिस्तान ने प्रतिबंधित घोषित कर रखा है। मर्री, मेंगल, बुगती और ज़राक्जई कबीलों और पख्तूनों द्वारा शुरू किया गया असहयोग आन्दोलन शीघ्र ही सशस्त्र संघर्ष में बदल गया! बलोचिस्तान पीपल्स लिबरेशन फ्रंट के बैनर के नीचे मीर हज़ार मर्री के नेतृत्व में यह बहुत बड़ा विद्रोह साबित हुआ! इसमें लगभग 25-30,000 हज़ार की संख्या में सशस्त्र बलोच विद्रोहियों ने पाकिस्तान के दांतों से पसीने निकल दिए!पाकिस्तान ने इस विद्रोह में लगभग 20,000 बलोचियों को शहीद किया! इतनी बड़ी संख्या में अपने ही देशवासियों की हत्या किये जाने की यह अपने किस्म की अनोखी मिसाल थी!

नवाब अकबर शाहबाज खान बुगती (12 जुलाई 1927–26 अगस्त 2006) बलूचिस्तान को पाकिस्तान से अलग एक देश बनाने के लिए संघर्ष कर रहे थे। वे चौथे गवर्नर भी थे! 26 अगस्त 2006 को बलूचिस्तान के कोहलू जिले में एक सैन्य कार्रवाई में अकबर बुगती और उनके कई सहयोगियों की हत्या कर दी गई थी बड़े पैमाने पर मानवाधिकार का हनन हुआ। मानवाधिकार समूहों के मुताबिक वहां फर्जी मुठभेड़ों में लगातार मौतों और लापता लोगों की तादाद आज भी बढ़ रही है।  

बलोचो को एक और बड़े नेता मीर हजारा खान बजरानी मर्री कबीले से संबंध रखते हैं। उनके विरुद्ध पाकिस्तान की आईएसआई ने लगातार मोर्चा खोल रखा है। एक और बलूच नेता गुलाम मोहम्मद बलूच, जिन्होंने बीएनएम का गठन किया था, ने बलूचिस्तान की आजादी के लिए अपनी अंतिम सांस तक संघर्ष किया।

आंदोलन उस वक्त और  तेज हो गया, जब बेगैरत पाकिस्तान ने ग्वादर बंदरगाह चीन के हवाले कर दिया। बलूच लोगों अपनी ही सरजमी के लिये हुये ईस समझौते से बाहर रखा गया है। नापाक पाकिस्तानियों  ने बलूच लोगो से बहुत बड़ा धोखा किया जिससे ईन लोगों की आर्थिक दशा बहुत ही खराब है।

साछरता दर 20% भी नहीं, पीने का पानी 10% लोगो तक, ईनकी खनीज संपदा का 10% हिस्सा भी ईन पर खर्च नही होता, 60% जनता भुखमरी की शिकार, सड़क, बीजली, इन्फ्रासट्रक्चर 10% भी नहीं,स्वास्थ्य सुविधाएं 5% भी नहीं और विकास के चिन्ह आपको कही नही दिखाई देंगे। अत: स्पष्ट है कि बलूचिस्तान में आज भी लोग बुनियादी सुविधाओं से दूर हैं। 

ग्वादर पोर्ट डेवलपमेंट के नाम पर इस भरपूर संपदा पर चीन ने अपना आधिपत्य स्थापित कर लिया है। इसी क्षेत्र के चगाई मरुस्थल में 2002 में एक सड़क परियोजना शुरू की गई, जो चीन के साथ तांबा, सोना और चांदी उत्पादन करने की पाकिस्तान की योजना के अंतर्गत की गयी  है। इससे जो भी लाभ होता है उसका 75 फीसदी चीन ले लेता  है और 25 फीसदी पाकिस्तान पर ये बलूचिस्तान को इसमें से कुछ भी नहीं देते। 

ग्वादर बंदरगाह की सुरंग: चीन सामरिक दृष्टि से भारत और अन्य देशों से निपटने के लिए एक 200 किमी लंबी सुरंग ग्वादर बंदरगाह के पास बना रहा है। सच्चाई ये है कि, यह बलूचिस्तान के विकास नहीं, भारत पर दबाव बनाने की चीन व पाकिस्तान की ही मिलीजुली रणनीति का एक हिस्सा है। यह सुरंग अरब सागर में बलूचिस्तान के ग्वादर बंदरगाह को चीन में काशघर से जोड़ेगी। पाकिस्तानीयों ने जिस प्रकार बलोचो की आजादी छिन ली उसी प्रकार ठिक वैसे ही जुल्म ढा रहे हैं जैसा कभी वो पूर्वी पाकिस्तान यानी आज के बंग्लादेश के लोगो पर ढाते थे!

Homage: A letter to 2020

Dear 2020,

Hi. How have you been doing? Not asking. Just contemplating how have you been to us, the human race. Whatever you did through your lifetime, it deserves accolades. You were just on target with your plans and unarguably conquered our plans. So, this is a tribute to your infamous doings, can’t say wrong or right. We’ll probably get to know by 2021.

When you were born on 1st Jan, it was a joyous occasion. We warmly welcomed you and were all excited to see you grow. We all made plans with you, for you, of you. Be it going on a long relaxing vacation or experiencing a sports paradise (IPL, T20 Cricket World Cup, Olympics, European Cup). Even Donald Trump was not grumpy at the start of this new decade. But, little did we know that you too had plans. Actually, it’s our fault. We were inconsiderate and didn’t ask you about what you want; your plans; your ambitions. Now, you being a Gen-Z, started to lose your temper and showed emotions aggressively.

To begin with, even as an infant, your rage was astonishing. You lit up the whole of Australia through forest bushfires, and simultaneously India, through CAA- NRC protests/riots. We Indians, looking at this kind of the beginning of the year, immediately got sceptical that our Rahu & Ketu are not favourable. We declared to our subconscious that you would not be a regular life. Instead, you’d be special.

As you grew and hit adolescence, you became more self-obsessed and yearned for more attention, although it is very much evident at this age. Again, it was our shortcoming that we didn’t take you seriously, and maybe that’s why you got so upset with the human race. We never thought, even in our wildest dreams that your reaction to this ignorance would be so unprecedentedly flabbergasting. You just injected a tiny non- living gene into the earth’s atmosphere and the whole humanity stood still. Wow! Your ancestors would have been so proud as you achieved what they too wished but couldn’t accomplish. Also, you’d be happy to know, even Kabir Singh got gobsmacked by your rage.

You went into adulthood peacefully and happily, as that uncalled strike to us was nowhere slowing down. And while this ‘inflicted’ pandemic was going on as you planned, you continued to work from home. You took away some of our beloved personalities; the economy came to ground zero levels, subsequently shutting down businesses and increasing unemployment. You literally handicapped us physically, mentally & emotionally throughout those months of house arrest.

The teeny-weeny gene that you poured on us, created a sea of uncertainty. And you messed up this already messed up sea by dumping huge amount of political, economical and humanitarian debris, such as Beirut explosion, racial prejudice(George Floyd case), the migrant crisis, rising income inequality etc.

Now, your life is coming to an end, just a few breathe short. But still, you seem unfulfilled. Although, I must appreciate the arc you have given to the Indian chapter of your life. You commenced your India journey through massive protests over a bill, and it seems pretty evident that you’d finish it off through massive protests over a bill. Commendable!

Despite all this, you know why we still stick with you? Of course, we don’t have any choice per se, but to put it out in a more tacit way, we do have a soft corner for you, since you taught us some important lessons that we shall be forever indebted to you. In retrospect, the lesson- ‘Change what you can, accept what you cannot’ is exactly you have been teaching us. Also, you taught us the immeasurable value friends & family carry in our lives; you taught us that it’s okay to be selfish; you taught us to take a pause, step back and realise what social injustice is happening around; but most importantly, you taught us to not take this planet for granted. At all!

Have a good last few days 2020. You were truly one of a kind. Take a bow. And yes, we won’t miss you. Or will we? Well, it depends on your soon to be born child…and his child…and his child…and…you got it, right?

Why India has communal problem

It is a fact that before 1947, the indigenous Muslim people of today’s Pakistan were not the main support base of Indian Muslim League. The main support base of Indian Muslims League was concentrated in UP, Bihar, and Bengal with Jinnah from Bombay. It is funny to recollect that Muslims of Bihar, UP, Delhi, and Bombay and Madras Presidencies were hardcore and violent supporters of Muslim League (to create Islamic Pakistan), though they knew that their area would never be included in Pakistan. Very few Muslims of those areas were supporters of Indian National Congress.

Based on 1941 census report, it can be estimated that there were about 20 millions of Muslims in United Province (present UP), Bihar, Delhi, Central Province (present MP), Madras and Bombay Presidencies during 1947. Barring exceptions, all of those 20 million were staunch supporters of Indian Muslim League.

Following partition of India during August 1947, only around 3 millions of Muslim League supporter from above stated areas migrated to Pakistan who later became known as Urdu speaking ‘Mohajir’. But rest 17 millions of hard core believers in ‘two nation theory’ and ‘theocratic Islamic state’ did not migrate and stayed back in India with their inflamed Islamic ego.

The first Prime Minister of India, who was a classic case wishful thinker, offered those 17 million hard core supporters of Indian Muslim League a secular India. Most of those Indian Muslims became Congress supporters and overt believers in ‘secularism’. This was an impossible development as per the history of Islam. Nehru never learned from his vast knowledge of history that those 17 millions of Indian Muslims would never be able to reconcile with secular India against the teaching of Islam.

All of India’s current Islam/Muslim related problems can be traced back to the descendents of those 17 millions of Indian Muslim League supporters. One can add to this the present day Islamists of Assam, West Bengal, Karnataka, Gujarat, Telengana and Kerala etc..

So, future of India was messed up just after 1947. Dr Ambedkar was an exponent of complete exchange of population in the event of partition. But Nehru and Congress could neither save non-Muslims of Pakistan (and Bangladesh), nor could Indianise the descendants of Indian Muslim Leaguers. Gradually with development of leftist, liberal and secular Indian Hindus, who have been supporting Islamist cause, the situation has turned for the worse now.

And the communal problem of India goes on.

What’s the solution for Kashmir?

After world war 2, Jews started fleeing from all over Europe for a homeland within Arab and Palestine dominated region because that was the same land from which Jews were driven out.

In 1947 UN proposed Arab – Jewish partition of Palestine between Palestine and Israel where 53% of the land was for Jews and 47% of the land was for Palestinians. But the idea of a Jewish homeland didn’t go well with Arab countries. After two big wars in 1948 and 1967 between Israel and Arab countries, Israel ends up recapturing more land defeating some big powers like Saudi Arabia and Egypt.

Israel knows that the land, where Palestinians are living, is the land that traditionally belongs to Jews.

On 28 May 2020, Netanyahu said he will annex the west bank also soon but due to some reasons he pushed back that plans.

In the same way, the whole land of Jammu and Kashmir Traditionally and according to the instrument of accession only belongs to India from ancient times. Due to some huge political blunders, we have lost our land to Pakistan and China.

Moreover, Article 370 and 35A has created a lot of mess in the state of Jammu and Kashmir. Those articles provided a way for separatists and Pakistani terrorists and also made the Muslims in Kashmir lean more towards Pakistan than India.

As the articles are now scrapped, the only way to solve this issue is by recapturing the land like Israel is doing or slowly pushing Pakistan back. It will provoke war but Pakistan is in a very weak condition to afford a war and China will never fight from the side of Pakistan. Although China will strictly oppose the move and by hook and crook, it will try to defame India in the International community.

Kashmir issue is not something which can be resolved with peace and moreover establishing peace with Islamic countries is near to impossible. There are many talks and ceasefire agreements signed between Pakistan and India yet nothing worked and in the future also no talks will work. That’s is why BJP is not at all interested in dialogues with Pakistan. These 60 years Congress has just fooled Indians in the name of peace for their Muslim vote bank.

And as far as Aksai Chin is considered, it will take time to regain but it’s not impossible. In recent time, our Indian army has already captured “Black Top” from China and 3 years back we pushed China back in the Doklam standoff.

We Indians just need a leader like Netanyahu and attitude like Israel to make these all things possible and I also believe that the Indian army is strong and capable enough to recapture our lost land.

Should large corporate houses be allowed to promote banks?

RBI’s internal working group (IWG) recently released a report in November 2020, reviewing the extant ownership guidelines and corporate structure of Indian private sector banks. The group comprised of five members, two from RBI’s central board and three officials from RBI. The bone of contention is the recommendation that large corporate/ industrial houses may be allowed as promoters of banks. This is subject to necessary amendments to the Banking Regulation Act, 1949 and strengthening of the supervisory mechanism for large conglomerates, including consolidated supervision. IWG also recommends that well run, large Non-Banking Financial Companies (NBFCs) with an asset size of over Rs 500 billion with over 10 years of experience, including those which are owned by a corporate house, may be considered for conversion into banks.

This recommendation by IWG is a significant departure from RBI’s stance on this topic. Currently, large corporate/ industrial houses are, similar to financial investors limited to 10 per cent holding, subject to the prior approval of the RBI. In the past, several large corporate houses in India had applied for banking license but had either backed out or were denied. RBI Governor Shaktikanta Das has clarified that the IWG acted ‘independently’ and allowing corporates to promote banks is not (yet) RBI’s view. RBI will take a view on this matter only after perusing public comments and suggestions, that may be submitted till January 15, 2021.

Several experts, including former RBI Governors, Deputy Governors and also Chief Economic Advisors fear that this could open a pandora’s box of problems. It can be noted that as per the report, all experts that it consulted except one, were of the opinion that large corporate or industrial houses should not be allowed to promote a bank.

What is the apprehension?

Interestingly the report itself highlights the relatively weak corporate governance culture in corporate houses relative to international standard and that it will be difficult to ring fence the non-financial activities of the promoters with that of the bank. Consequently, stress in non-financial activity may spill over to bank. The corporate houses may either provide undue credit to their own businesses or may favour lending to their close business associates. Not just group companies but debtors, vendors as also cross lending between banks owned by corporate houses. For e.g., they may influence lending by the bank, to finance the supply and distribution chains and customers of the group’s non-financial businesses, thereby creating unreported risk to the bank. There are various ways of circumventing the regulations on connected lending and due to complex structures of entities, cross holding of capital, the disbursal/ diversion of funds to group concerns is difficult to monitor. Broadly, the main concerns of allowing large corporate houses to own banks relate to conflicts of interest, governance issues and concentration of economic power.

Furthermore, it is difficult to prevent influence of corporate houses on the Board in such banks, especially in the context of proposed concentrated promoter shareholding up to 100 per cent vis-à-vis the principle of diversified shareholding. It is a huge jump from the existing 10 per cent limit.

Banks are highly inter-connected entities; via a network of interbank loans as well as impact on depositor “trust” in the banking system. Since banks are allowed to take retail deposits, unlike most of the NBFCs, retail depositor’s hard-earned money is at stake. The banking system of any country is built on an edifice of trust that depositors have in their banks. The confidence that money is safe, keeps depositors away from withdrawing their funds unless they really need it.  Given that banks operate on mismatched asset liability duration in near term, any panic reaction by depositors, could lead to a run on the bank and can be highly destabilizing for the banking system at large due to the inter-connectedness. That is why RBI does not let a bank fail and may use tax payers’ money to bail out failed banks.

Fit and proper

One of the major concerns that arise in context of corporate governance in banks is the type of people who control the bank. The degree of onus on the bank promoters and management should be several notches higher than other commercial enterprises. Caeser’s wife must be above suspicion. As the major shareholders/ promoters, act as trustees, it is necessary that they must be ‘fit and proper’ for the deployment of funds entrusted to them. Assessing ‘fit and proper’ status of the promoters and its large number of group entities is very difficult to articulate and very difficult to put objectively. It is not a given that the regulator will be able to withstand the political pressure at all times.

What is the problem that we are seeking to solve? Is getting credit a problem in India?

India’s ease of doing business ranking on the criterion of getting credit is a respectable 25 out of 190 nations. Fueled by the Pradhan Mantri Jan Dhan Yojana, over 80 per cent Indians have bank account. The initiatives taken by the RBI and the Government of India in order to promote financial inclusion have considerably improved the access to the formal financial institutions.

Lending in India can be broadly classified into three categories- corporate, retail and MSME. Corporate lending is fairly well covered by the Indian Banks. If lending and coverage to retail and MSME is an issue, that is largely due to the presence of a large informal sector, that banks are not able to assess (underwrite) or lend and collect (high operating cost). It is unclear how giving banking license to industrial houses will increase the lending appetite.

What is needed to plug the funding gap of retail and MSMEs is to address the information asymmetry that impedes the access to credit for micro and small enterprises. We need to focus on infrastructure development i.e. account aggregators. India needs a robust Public Credit Registry (PCR); a repository of all credit related information that would give a fillip to lending to MSMEs. Higher digitization, leading to higher formalization, higher financialization (higher savings) and democratization of data and lending would lead to easier, faster and higher lending to MSMEs.

NBFCs are comparatively less complex than banks. NBFCs have limited loan products mostly term loans and do not offer revolving working capital or non-fund facilities and therefore camouflaging is comparatively difficult. If this recommendation goes through, most of the new Banks will be existing NBFCs that will transition into Banks, who will for the medium term stay with their known lending area as they focus on liabilities and regulatory compliance. All major corporates/ industrial houses have an NBFC and will convert the NBFC into a Bank instead of a fresh Banking license. NBFC transitioning to bank will actually impact their ability as they start focus on building liability franchise, branch network, priority sector lending and other regulatory compliance.

Are Banks capital starved?

Recently, even in the pandemic, India’s top private banks have raised substantial capital to prepare for any surge in bad loans that may follow the Covid-19 crisis. Over the last few months, most major private banks (for e.g. ICICI Bank Qualified Institutional placement- QIP Rs 150 billion, Axis Bank QIP Rs 100 billion, Kotak Bank QIP Rs 74.42 billion) have raised capital following stress tests conducted internally and those mandated by the RBI. As a result, the tier-1 capital ratio and the common equity tier-1 ratio have risen to near 15-year highs, suggesting these lenders are better prepared to deal with upcoming stress. PSU Banks are struggling to raise capital– but for a reason and they would need government support.

Supervision

The other major concern posed by the mixing of banking and commerce include overburdening the supervisory resources. It will no doubt be necessary to significantly scale up the supervision capacity before considering large corporate houses to promote banks. Tracking of money trail is basically an investigative function and not a supervisory function. We need to keep in mind that RBI is a regulatory body (a watchdog); it is not an investigative agency (a hound dog). It would be unfair to expect RBI to play detective and monitor banks aggressively.

Any further banks going down would hamper public confidence

The banking sector already suffers from such challenges as financial distress and corporate governance due to doubtful credibility of third parties such as auditing firms and credit rating agencies, oversight by banks and inadequate diligence. It is extremely difficult to track complex money trail. India has witnessed various frauds in the banking space, that has led to banks being shut down or bailed out, which does not inspire confidence. Most frauds in recent times such Punjab National Bank (Nirav Modi), Infrastructure Leasing and Financial Services (IL&FS), ICICI Bank (Chanda Kochar), Yes Bank, Laxmi Vilas Bank have come to light after several years of deflecting RBI- this when there was no direct corporate house involvement. Let us take a look at some of these frauds.

A handful of PNB staffers issued fake Letter of Undertakings (LoUs) in excess of Rs 138 billion, over the years, in favour of two jewellery groups led by Nirav Modi and his uncle, Mehul Choksi. They received credit from oversees banks to fund their business/ imports. The LoUs were issued for a period of one year, for which RBI guidelines lay out a total time period of 90 days from the date of shipment. This guideline was ignored by overseas branches of Indian banks. They failed to share any document/ information with PNB, which were made available to them by the firms at the time of availing credit from them.

Nirav Modi got his first fraudulent guarantee from PNB on March 10, 2011 and managed to get 1,212 more such guarantees over the next 74 months. PNB employees misused the SWIFT network to transmit messages to Allahabad Bank and Axis Bank on fund requirement. While all this was done using SWIFT passwords, the transactions were never recorded in the bank’s core system — thereby keeping the PNB management in the dark for years.

In 2019, former vice-chairman of IL&FS, Hari Sankaran, was arrested for granting loans to entities that were not creditworthy and thereby causing loss to the company and its creditors. The first forensic audit report of IL&FS found multiple instances of potentially irregular transactions involving amount over Rs 130 billion, all with the knowledge of the top executives of the group companies.

In another instance, Chanda Kochhar abused her position in ICICI Bank to dispense Rs 18.75 billion in loans to Videocon, which then allegedly invested a part of this money in companies held by Deepak Kochhar. The loans in question were allegedly sanctioned by ICICI between June 2009 and October 2011.

Yes Bank CEO Rana Kapoor was involved in illegal gratification amounting Rs 50.5 billion along with several irregularities in distributing bank loans to corporate entities, by misusing his official position, creating shell companies for laundering money, defaults, and creating tainted assets.

Laxmi Vilas Bank had to be bailed out when its gross NPAs, which were 10 per cent in 2018, increased to 15.3 per cent in 2019 and are 25.4 per cent in 2020.

Conclusion

Internationally, most banking jurisdictions require banks to be widely held to avoid concentration of control in the interest of governance and financial stability. In the United States, commercial enterprises are not allowed to own a bank due to the concept of separation of banking and commerce. As far as fulfilling need of capital is concerned, it is not difficult to attract capital from sources other than corporate houses, for well governed banks. With well- developed equity market in India, well governed banks have been successful in raising capital from public. We must act on the side of caution; a liberal policy could put a lot of political pressure on RBI to grant license to industrial houses, which may lead to dilution of standards and build-up of systemic risks progressively.

परिवाद/Complaint/FIR, पुलिस व सामान्य नागरिको के अधिकार

जब रिपब्लिक टीवी के मुखिया अरनव गोस्वामी को महाराष्ट्र पुलिस ने गिरफ्तार किया था इंटीरियर डिजाइनर अन्वय नाइक की आत्महत्या के मामले में तब दो तथ्यों पर विशेष रूप से चर्चा हो रही थी:-

1 परिवाद (कम्पलेंट)।
3 प्रथम सूचना प्रतिवेदन (FIR)।

अब प्रश्न ये है कि क्या ईन विधिक शब्दावली से भारत की आम जनता परिचित है? क्या सामान्य नागरीको को पुलिस स्टेशन में फरियाद (परिवाद) दाखिल (पंञ्जीकृत) करने संबंधित विधायिका द्वारा उनको दिये गये  अधिकारों का ज्ञान है

उत्तर आपको मायूस ही करेगा अत: आइए हम थोड़ा ज्ञान की आदान प्रदान कर लेते हैं..

सर्वप्रथम हम देखते हैं कि परिवाद (Complaint) क्या होती है, उसके मुख्य कारक क्या है और प्रथम दृष्टया परिवाद कैसे सही साबित होती है।

परिवाद को साधारण शब्दो में परिभाषित करे तो हम कह सकते हैं कि “किसी घटित अपराध के संदर्भ में किसी ज्ञात या अज्ञात व्यक्ति के विरूद्ध, पिड़ीत व्यक्ति के द्वारा लिखित या मौखिक रूप से किया गया अभिकथन/कथन ही परिवाद कहलाता है।

अपराधिक प्रक्रिया संहिता १९७३की धारा 2(घ) के अनुसार:

परिवाद से इस संहिता के अधीन मजिस्ट्रेट द्वारा कार्रवाई किए जाने की दृष्टि से मौखिक या लिखित रूप में उससे किया गया यह अभिकथन अभिप्रेत है कि किसी व्यक्ति ने, चाहे वह ज्ञात हो या अज्ञात, अपराध किया है, किंतु इसके अंतर्गत पुलिस रिपोर्ट नहीं है।

(स्पष्टीकरण-ऐसे किसी मामले में, जो अन्वेषण के पश्चात् किसी असंज्ञेय अपराध का किया जाना प्रकट करता है, पुलिस अधिकारी द्वारा की गई रिपोर्ट परिवाद समझी जाएगी और वह पुलिस अधिकारी जिसके द्वारा ऐसी रिपोर्ट की गई है, परिवादी समझा जाएगा)।

परिवाद के मुख्य कारक:

1:- अपराध का घटित होना!

2:- अपराधी!

3:- पिड़ीत पक्ष/परिवादी/फरियादी!

4:- प्रथम दृष्टया साक्ष्य!

5:- अपराधी के द्वारा किये गये अपराधिक कार्य में उसकी नियत/मंशा/motive/आशय का शामिल होना।

एक परिवाद (Complaint) को पूर्णता प्रदान करने के लिये उपरोक्त कारको( Factors) का पाया जाना अति आवश्यक है।

1:- अपराध:- अपराधिक प्रक्रिया संहिता की धारा 2(ढ) के अनुसार अपराध” से कोई ऐसा कार्य या लोप अभिप्रेत है जो तत्समय प्रवृत्त किसी विधि द्वारा दण्डनीय बना दिया गया है और इसके अंतर्गत कोई ऐसा कार्य भी है जिसके बारे में पशु अतिचार अधिनियम, 1871 (1871 का 1) की धारा 20 के अधीन परिवाद किया जा सकता है, अर्थात कोई भी एसा कार्य जो वर्तमान समय मे लागू किये गये किसी अधिनियम के किन्हीं प्रावधानों के अंतर्गत दण्डनीय घोषित किया गया है उसे “अपराध” कहते हैं।

2:- अपराधी:- अपराधिक प्रक्रिया संहिता की धारा 2(ढ) में परिभाषित अपराध (अर्थात किसी दण्डनीय किसी कार्य का लोप )को करने वाला व्यक्ति अपराधी कहलाता है! साधारण शब्दो में यदि हम कहे तो अपराधिक कृत्य को करने वाला व्यक्ति अपराधी कहलाता है।

3:-परिवादी:- वो व्यक्ति जो किसी ज्ञात या अज्ञात व्यक्ति के द्वारा किये गये अपराधिक कृत्य से पिड़ीत होता है, तथा उचित कार्यवाही हेतु लिखित या मौखिक रूप से फरियाद/अभिकथन पुलिस स्टेशन के किसी भारसाधक अधिकारी या मजिस्ट्रेट के समछ करता है, परिवादी या फरियादी कहलाता है।

4:- प्रथम दृष्टया साछ्य:- से तात्पर्य यह है कि परिवाद में दिये गये तथ्यों, परिस्थितियों व अपराधी द्वारा पिड़ीत या पिड़ीता के प्रति अपराध घटित होने से पूर्व या पश्चात मे किया गये व्यवहार से अपराधिक कृत्य  घटित होना स्पष्ट रूप से प्रलछित होता हो उसे प्रथम दृष्टया साछ्य कहते हैं।

उदाहरण के लिये:- “अ” व “ब” दोनो मित्र है। पैसे के लोन देन को लेकर दोनो मे झगड़ा होता है! “अ” “ब” को पैसे ना लौटाने के कारण गुस्से में मारने की धमकी देता है। फिर वो एक दुकान से एक धारदार हथियार खरिदता है और दो दिन बाद उसी घातक वस्तु से “अ” “ब” के सिर पर वार करता है। उस प्रहार से “ब” तत्काल जमीन पर गिर जाता है और उसकी मृत्यु हो जाती है।

यहाँ पर परिस्थितियों व “अ” के व्यवहार का उसी प्रकार वर्णन यदि परिवाद मे लिखित या मौखिक रूप से किया जाये तो प्रथम दृष्टया साछ्य प्राप्त हो जाता है कार्यवाही करने के लिये।

5:- अपराधी के द्वारा किये गये अपराध में उसका अपराधिक आशय भी शामिल होना चाहिये तभी उसके द्वारा किया गया कार्य अपराध की श्रेणी में आता है इसिलिये कहा है कि “Actus Non Facit Reum Nisi Mens Sit Rea” which explains that for any act to be illegal in nature it must be done with a guilty mind.

उदाहरण के लिये:- “अ” रोज नदी के किनारे निशाना लगाने का अभ्यास करता है! नदी के किनारे झाड़ियों पर रखे डब्बो पर वो निशाना लगाता है क्योंकी इन झाड़ियों के पीछे कोई नही पाया जाता! अब “अ” रोज की भाँति निशाना लगाता है परंतु इस बार गोली झाड़ियों के पीछे बैठे “ब” को लग जाती है और उसकी मृत्यु हो जाती है।

अब यहाँ पर अपराध तो हुवा पर ये एक दुर्घटना थी, क्योंकी गोली चलाते वक्त “अ” को ये पता नही था कि “ब” झाड़ी के पीछे छिपा है अत: “अ” का आशय (Intention) केवल निशाना लगाना था “ब” कि हत्या करना नहीं अत: यहाँ अपराधिक कार्य घटित हुवा परंतु उसके पिछे का आशय अपराधिक नहीं था।

चलिये उन अधिकारों की चर्चा करते हैं जिनके द्वारा हम प्रथम सूचना प्रतिवेदन (FIR) किसी पुलिस स्टेशन में दाखिल कर सकते हैं

अपराधिक प्रक्रिया संहिता 1973 के अध्याय 12 में पुलिस को सूचना (इत्तिला) और उनकी अन्वेषण करने की शक्तियां को प्रदान करने वाले प्रावधान दिये गये हैं जो निम्नवत हैं:-

धारा 154. संज्ञेय मामलों में सूचना (इत्तिला)-(धारा 2 (ग) के अनुसार “संज्ञेय अपराध” से ऐसा अपराध अभिप्रेत है जिसके लिए और संज्ञेय मामला” से ऐसा मामला अभिप्रेत है जिसमें, पुलिस अधिकारी प्रथम अनुसूची के या तत्समय प्रवृत्त किसी अन्य विधि के अनुसार वारण्ट के बिना गिरफ्तार कर सकता है)

(1) संज्ञेय अपराध के किए जाने से संबंधित प्रत्येक इत्तिला, यदि पुलिस थाने के भारसाधक अधिकारी को मौखिक दी गई है तो उसके द्वारा या उसके निदेशाधीन लेखबद्ध कर ली जाएगी और इत्तिला देने वाले को पढ़कर सुनाई जाएगी और प्रत्येक ऐसी इत्तिला पर, चाहे वह लिखित रूप में दी गई हो या पूर्वोक्त रूप में लेखबद्ध की गई हो, उस व्यक्ति द्वारा हस्ताक्षर किए जाएंगे जो उसे दे और उसका सार ऐसी पुस्तक में, जो उस अधिकारी द्वारा ऐसे रूप में रखी जाएगी जिसे राज्य सरकार इस निमित्त विहित करे, प्रविष्ट किया जाएगा:

अर्थात धारा 154(1) समान्य नागरिकों को विभिन्न परिस्थितियों के अंतर्गत (FIR)/ प्रथम सूचना प्रतिवेदन संबंधित पुलिस स्टेशन में लिखवाने का अधिकार प्रदान करता है।

धारा 154 (2) समान्य नागरिको को धारा 154 (1) के अधीन अभिलिखित इत्तिला (FIR) की एक प्रतिलिपि, इत्तिला देने वाले को अर्थात FIR लिखवाने वाले को  तत्काल निःशुल्क देने का  प्रावधान करता है।

धारा 154(3) समान्य नागरीको को अधिकार देते हुए प्रावधानित करती है कि “यदि कोई व्यक्ति जो किसी पुलिस थाने के भारसाधक अधिकारी के धारा 154(1) में निर्दिष्ट इत्तिला को अभिलिखित करने से इंकार करने से अर्थात FIR ना लिखने से व्यथित है तो एसी परिस्थिति में इत्तिला (सूचना) का सार लिखित रूप में और डाक द्वारा संबद्ध पुलिस अधीक्षक को भेज सकता है जो, यदि उसका यह समाधान हो जाता है कि ऐसी इत्तिला से किसी संज्ञेय अपराध का किया जाना प्रकट होता है तो, या तो स्वयं मामले का अन्वेषण करेगा या अपने अधीनस्थ किसी पुलिस अधिकारी द्वारा इस संहिता द्वारा उपबंधित रीति में अन्वेषण किए जाने का निदेश देगा और उस अधिकारी को उस अपराध के संबंध में पुलिस थाने के भारसाधक अधिकारी की सभी शक्तियां होंगी।

अपराधिक प्रक्रिया संहिता में धारा 155(1) से लेकर 155(4) तक असंज्ञेय मामलों के बारे में इत्तिला और ऐसे मामलों का अन्वेषण से संबंधित प्रावधानो का निरूपण किया गया है! 

अपराधिक प्रक्रिया संहिता की धारा 156(1) से लेकर 156(3) तक संज्ञेय मामलों का अन्वेषण करने की पुलिस अधिकारी की शक्ति के प्रावधानों का निरूपण करती है। 

धारा 156(3) के अनुसार “धारा 190 के अधीन सशक्त किया गया कोई मजिस्ट्रेट पूर्वोक्त प्रकार के अन्वेषण का आदेश कर सकता है।

अब जरा धारावों 154, 155 156 में दिये गये प्रावधानों को संयुक्त रूप से देखते हैं:-

अब यदि “अ” अपने साथ हुए किसी अपराध की FIR लिखवाने संबंधित पुलिस स्टेशन में जाता है।

क:- वो लिखित मे परिवाद (अभिकथन) या ईत्तिला देता है।

ख:-भारसाधक पुलिस अधिकारी (Sr. Inspector of Police) धारा 154(1) के तहत FIR दाखिल/लिखने से इनकार कर देता है।

ग:- अब “अ” धारा 154(3) के प्रावधानों का लाभ उठायेगा और अपनी लिखित इत्तिला (परिवाद) को संबंधित पुलिस अधिछक (SP), पुलिस कमिश्नर (CP)या सहायक पुलिस कमिश्नर(ACP) को डाक द्वारा या स्वंय हाथोहाथ दे सकता है! 15 दिन प्रतिछा करने के बाद यदि उस परिवाद (इत्तिला) पर कोई कार्यवाही नही होती

तब 

घ:- “अ” धारा 156(3) के प्रावधानों का लाभ उठाते हुए सीधे संबंधित मजिस्ट्रेट के पास लिखित रूप में अपना परिवाद (इत्तिला) दाखिल कर पुलिस द्वारा FIR दाखिल कर जाँच व अन्वेषण कर रिपोर्ट सौपने की मांग कर सकेगा।

हमारे देश के नागरिको (खासकर ग्रामीण समाज के लोगों) के मस्तिष्क में पुलिस अधिकारियो की वही छवि आज तक बनी हुई है जो कभी अंग्रेजो के ज़माने के जालिमो की होती थी, इसीलिए वो पुलिस अधिकारियो के सामने अपने अधिकार की बात भी नहीं कर पाते। FIR लिखवाना तो दूर की बात है वो पुलिस स्टेशन में आज के दौर में भी कदम रखने से डरते हैं। अपने क़ानूनी अधिकारों को जानना और उसका सदुपयोग करना हर भारतीय का अधिकार है और ये अधिकार उनसे कोई नहीं छीन सकता! हमारे संविधान का अनुच्छेद १४, १५, १६, १९ व् २१ हमारे अधिकारों की न सिर्फ घोषणा करते हैं अपितु उनकी पैरवी भी करते हैं।

For civil society, it’s time to introspect or get lost

(For Indian civil society, it is high time to introspect and gets themselves corrected or get lost for generation/s, if not for ever).

Today morning, as soon as I read a news story (in Times Now news portal) with title “PM Modi’s efforts are not ‘cosmetic or showmanship’, says Ratan Tata”, it comes to my mind or I can say as I apprehend that his name (Ratan Tata) will soon be added with Ambani and Adani list of name calling by forces inimical to present regime in Raisina Hill including civil society members forgetting their(entrepreneurs) contribution to India’s international image and national wealth creation as if to be an entrepreneur in order to provide employments, get revenue for governments -major part of which governments of all shades use in populist schemes for known vote-bank politics- and build national image is curse when all over the world entrepreneurship is encouraged and promoted with incentives.

How many Indians know, he is the same Ratan Tata, who within half decade of taking charge of Tata Steel, could manage the company to be cheapest steel producer in the world without compromising quality? How many Indians know Ford Chairman, who in 1999 mocked Ratan Tata saying ‘If you don’t know selling car, why entered the sector?’ when latter requested former to rescue his car business, had traveled to Mumbai to request Ratan Tata to rescue debt-trapped iconic Land Rover and Jaguar. And how many Indians know developing country’s Tata Steel buying developed country UK’s Corus PLC which is four times bigger than former in 2006, and refused to Jamshedji Tata’s technical support to build Tata Steel in British India in 1903.

Tragedy is: those in the Indian civil society, who criticize industrialists/entrepreneurs, have never praised them for their good works. If industrialists are rich they have got the same through managerial skills. India has adopted market economy like several rich nations where Ambani, Adani and probable Tata critics have got their education. And they (critics) get their liberal thoughts and criticism skills studying in industrialists built universities. Unfortunately, instead of ferreting out sustainable allegations against industrialists’ wrong doings, the critics are found concentrated in unsuitable criticism. Have anybody ever read or heard the above aspects (credible works of Indian entrepreneurs) being highlighted by Indian civil society’s loudmouths?

After the Sino-Indian forces bloody skirmish in mid-June 2020 at the LAC in Ladakh, the entire civil society missed no opportunity to dress down Modi government, and one even went on with unsavory mocking of “How about a surgical air strike in Tibet on Chinese troop establishments to avenge the death of our 20 brave jawans including a commanding officer? After all our motto is ‘ghar me ghus kar marenge’. Or is all our bravado only for Pakistan?”And provoked the government to go for war against China despite acknowledged fact that precious ten years (2004 to 2014) during UPA regime was lost without adding single gun to armed forces armory. None from civil society was found writing on Chinese encroachment of 640 SqKM during UPA regime and earlier poor infrastructure and connectivity to India’s border regions, and Chinese irritation for present government’s push to build infrastructure in border area despite financial constraint and inhospitable weather. We read rims of columns and civil society criticism against Modi government’s procurement of 5th generation Rafale fighter planes alleging corruption despite Supreme Court’s finding of no irregularity in the deal, but no column and analysis worth reading about pathetic depletion of armory vis-à-vis our dreaded inimical neighbours. 

After Justice Ranjan Gogoi’s participation in the senior Supreme Court judges’ presser on 12 January 2018, ostensively promoted and prompted with physical presence by some vested interest from civil society, they (latter) themselves propagated that Modi government would not promote Justice Gogoi who was in the line of next Chief Justice of India. But, when the government respected the tradition and precedent, and went ahead appointing Justice Gogoi as CJI, refusing to be another Indira Gandhi, there was no word of praise.

Now, on daily basis, we read rims of columns written by civil society members on farmer agitation at national capital border. We read and see Delhi CM participation in this agitation and tearing of Fam Bills in Delhi Assembly, but none of them has highlighted that the same CM’s government was the first which notified the bill in state gazette for implantation on 23 November. Has anybody read any column that criticized desecration of The Father of Nations statue in front of Indian Embassy in Washington by supporters of Farm Bill agitation and surface of Khalistani protagonists in the agitation site?  Punjab CM Captain Amerinder Singh has been regularly saying that a political party and its CM are getting fund and hobnobbing with secessionist Khalistani respectively, and Dainik Bhaskar got in front page news on the issue, yet no civil society member is ready to acknowledge the same.

A week back, I was reading a column of a nonagenarian and prominent journalists and media analyst who is now senior media adviser of a leading English newspaper The New Indian Express. The entire column was packed with lies. Among others, he mentioned that 60,000 farmers had committed suicide in Maharashtra alone in 2019. But, my search found 2808 farmers had committed suicide in 2019. Yes, farming is a nature based profession and farmers are exploited by middlemen including politicians. They deserve attention and support of government and civil society. But, will the wrong fact support their cause? How could these aspects as narrated above not come to the mind of civil society members?

Civil society highlights recently coined “Love Jihad” while silent about exploitation of innocent girls. Is this silent not promoting social discords? How could people bear the loss of their near and dear to some frauds who are exploiting immature teenage love at first sight? So far civil society has not come out with a solution for this social problem though does not waste a minute to blame the government which is constitutionally duty bound to maintain law and order supported by legislative means.

Now, West Bengal CM and Trinamol Congress supremo Mamata Banarjee using divisive slogan “insider vs outsider” as her party’s prime theme in upcoming Assembly election. If national parties are outsiders, why Ma-Mati-Manush’s Didi has a prefix “All India” to her party name “All India Trinamol Congress”, and nominates her party candidates to contest in other states? Now, she is in back foot for her desire to build her political dynasty installing her nephew as next head of party replacing her which is vehemently opposed by her party sitting MPs, MLAs and workers. Following her footstep, Odisha CM Naveen Patnaik started criticizing national parties though his regional party Biju Janata Dal does not have “All India” prefix. But, Indian civil society has overlooked all these divisive activities in WB and Odisha apart from long two decades uninterrupted rule of Naveen Patnaik which is not at all good sign for healthy democracy.

In their utter hate-Modi mindset, the civil society is missing two important issues which could be epoch making development for Indian democracy. They are: dynasty politics and the constitutional restriction for two term tenure or age limit for head of the government. The dynasty politics and unlimited tenure of PM and CM are the biggest dragger of India’s healthy democracy. Modi is dead against dynasty and has already imposed 75 age limit to the post of ministers in his cabinet and for Lok Sabha speaker. Modi being a bachelor and not promoting his family members -like unmarried Mamata Banarjee and Mayawati promoting their nephews to be their successors- can be used by civil society to promote non-dynasty democratic politics. And now Modi is in his second term and about to reach 75 ages just one year after GE2024. This is the right time for civil society to campaign for either two terms PM or no PM beyond 75 and get this done through Modi instead of campaigning to somehow satisfy their inferiority complex. This is possible provided the civil society members have no vested interest in dynasty politics and in more than two terms PM.

पाखंड पर टिकी राजनीति!:- 2019 से पहले के चुनावों के दौरान मंदिरों में जाने, ललाट पर टीका लगाने एवं दतात्रेय गोत्र का पाखंड करने के बावजूद राहुल कहीं भी कांग्रेस को विजय नहीं दिला पाए। इन तथ्यों को जानते हुए भी केरल में कांग्रेस कार्यकर्ताओं द्वारा बीच सड़क पर आम जनता के सामने गाय के बछड़े की हत्या कर उसका मांस पकाकर खाया गया। ऐसी 2017 की निकृष्टतम/बर्बरतम घटना पर मौन धारण करने वाली प्रियंका वाड्रा 2022 में उ.प्र.के विधानसभा चुनावों को ध्यान में रखकर सोशल मीडिया पर वायरल हो रही गाय की लाशों की तस्वीर देख कर उ.प्र. के मुख्यमंत्री को अवगत करवाया कि मृत गायों की यह तस्वीर उत्तर प्रदेश के ललितपुर की है।

वाड्राईन ने आगे लिखा कि उन्हें इस बात की जानकारी नहीं है कि गायों की मृत्यु कैसे हुई। फिर भी वह इस निष्कर्ष पर पहुँची हैं कि संभवत: गायों कि मृत्यु भुखमरी से हुई है। कुछ समय बाद पता चला कि ख़बर फ़र्ज़ी (फ़ेक) है, और ऐसा कुछ हुआ ही नहीं। इसके बाद उ.प्र.के आधिकारिक फैक्ट चेकिंग हैंडल आई.पी.आर.डी ने ललितपुर गोशाला के मुख्य पशु चिकित्सा अधिकारी के हवाले से ट्विटर हैंडल पर बताया कि ललितपुर गोशाला के आस-पास गाय की कोई लाश नहीं मिली है।

उ.प्र.विधानसभा चुनाव को ज्यादा समय नहीं बचा है। इसलिए कांग्रेस का गाय के प्रति स्नेह और समर्पण बढ़ना स्वाभाविक हैं। क्योंकि उ.प्र.में कांग्रेस के पास वाड्राईन के अलावा मुख्यमंत्री उम्मीदवार भी नहीं है।

ऐसी स्थिति में गौ- प्रेम का पाखंड करती वाड्राईन फ़ेक न्यूज़ के फेर में उलझ कर रह गई!

Breaking News: “Indian Institutes of Victimology” to prepare our youth for the 21st Century

As per the new liberal, social justice enabled ‘No Education Policy,’ a new series of IIVs is going to be set up in all State Capitals of India, to prepare our youth in the avant-garde studies and reap its emergent economic possibilities by way of job-orientedness and 100% placement.

That, this news has been cheered and praised by even the opposition parties in India – including leftists, Dravidians and other seculars such as muslim leaguers and congress – gives the hope that India is on the right track towards equitable development, as per ‘Amnesty International.’ The famous magazine ‘India Today,’ in its editorial, has projected that by 2025, the job opportunities for Graduate Victims will skyrocket and would outstrip the demand in the farming sector.

Accenture reports that, export of well-qualified Victimologists is likely to increase by 200% in 3 years. KPMG and Deloitte&Touche estimate that 90% of the world’s Victimologists requirements is likely to be outsourced to India in the next 7 years.

This grand IIVs intitiative is about studying in depth, the new Science of Victimology – its causes, its current state, its prospects – primed across Inder-disciplinary studies.

As per the new age mantra of ‘I am a Victim, therefore I am!‘ the youth will be trained thoroughly in the culture of self help and self reliance in terms of ‘Whatever goof-up, fraud or massacre that I commit, cannot be blamed on me, because I am a victim’ – so that the whole world can excel at victimhood everafter.

To startle with, various branches of Victim Studies would include:

Farmvictimhoodology, Islamic Victimology, Evangelical Victimology, Wokeology, Intolerance studies, Gender victimologies, Castetude, Brahmical Oppressionolgy, Patriarchics, Studies on the burdonsome ethics, Humanlefts, Critical Victimhood Theory, Lost Racistics – epistemological victimhoodology, Colourfulvictimistics, Postmodern Prepast Victimistics, Environmental Victimology and last but not the least, Science-Technology-Victimhood studies. At higher levels, Intersectional Victimologies will be pursued.

Interconnects with IT in terms of Virtual Victimology is a greenfield area for IT experts in India. To tap into it and suggesting an exciting way forward, NASSCOM has published a whitepaper. As per NASSCOM, not the AI sector, but AV – Artificial Victimology is slated to grow by 400% quarter-over-quarter. To prepare for this future, NASSCOM is setting up an Institute for higher learning, for taking Victimological Machine Learning (VML) to the masses.

MVRD (Ministry of Victim Resources Development) clarifies that, there won’t be an entrance test for aspiring professional victims to get into these premier IIVs – institutes of lower learning. The person who applies last will get first preference. Special concessions will be given to the academically challenged or alternatively assessed applicants and also to minorities of all hues, especially to LGTBQABCD++. Any abject failure in non-victimology world will be considered as a positive qualification for victimology – and vice versa.

Physically, the candidates will be examined only for the quality & quantity of the produce of the lacrimal glands and the storage capacity of tears in them. The more they secrete the product and translate that into copious amounts of atrocity literature & victimhood studies, the better will be their chances into the exalted IIVs.

As per MVRD, in future, at least one paper on ‘Victim Studies’ will be made mandatory for ALL students at the graduate level so that our youth become literate about Victimhood praxis. Efforts are on to reverse integrate Victimology studies right from the Kindergarten level.
