CRUSHED WINGS an Award Winning film ‒ to be released in 2021 ‒ is the first drama film of its kind on Female Genitle Mutilation (FGM or khatna, khafz, and khafd in India)– and is set to force our eyes open to the harsh reality of this brutal, increasingly widespread cultural ritual.

Independent production company Cam Buddha Films is making waves in the industry with the introduction of their film Crushed Wings. Shot in hauntingly stunning locations across England, India and Nepal, this visually enchanting film follows the tragic journey of Ria growing up in a village somewhere in Asia, undergoing a brutal backstreet FGM procedure at age seven. Over 200 million women alive today have been forced to undergo this practise and the number of women dying as a result of mutilation is expected to increase significantly over the next 15 years. Based on the collective real-life experiences of survivors, the film boldly shines a spotlight on the realities of FGM and its consequences, forced marriage and honour killing at the hands of Ria’s community.

After discovering that no film had been made about the practice, even not in the million dollar industry of Bollywood, I knew my next feature had to tackle FGM – the team is headed by award-winning director and producer Lalit Bhusal who launched the project after carrying out extensive research that involved interviews with FGM survivors, as well as a trip to India to study the experiences within the Bohra community. On hearing about the suffering many girls endure as a result of cutting, Lalit set his sights on producing a film that would be a voice for these women, with the ultimate goal of challenging the outdated attitudes that keep the damaging tradition alive.

Behind the scenes, dozens of local and international artists have come on board to assist the project voluntarily. The cast features established and aspiring actors – Oznur Cifci takes the lead as Ria, delivering a spell-binding performance as the ill-fated heroine, alongside talented method actor Nisaro Karim who portrays Ria’s aggressive husband countering protective father Bhasker Patel, and co lead actress Tania Staite who emerges as guardian angel in Ria’s life. Hibo Wardere, a FGM survivor, activist and public speaker, also made a mentionable contribution to this film. Parts of the film will be used i.a. by the NHS for training purposes.

Soon the enticing scenes of this ground-breaking film can be viewed on VOD-platforms worldwide, hoping to raise awareness and to enhance the understanding on abusive cycles which have been passed on through generations, victimising millions of women even today.

A FEW FACTS AND FIGURES

At least 200 million girls and women alive today living in 30 countries have undergone FGM. There are an estimated 3 million girls at risk of undergoing FGM every year.

If trends continue, the number of females undergoing FGM will rise significantly over the next 15 years and so will the number of women and girls dying from this practice.

Covid-19 paradigm shift: from existing to Living

2021 is soon drawing to a close. The Covid-19 virus that brought the world down to its knees two years ago, has lost intensity but is refusing to go. New variants are being reported every now and then. Will we overcome this battle or do we need to learn to co-exist with the Virus, only time can tell. That being said, I’d like to share with you the top five lessons this pandemic has taught me.

1. Don’t let life rush you unnecessarily. Live each day.

We often get so caught up in our day to day life and associated problems, that we forget to live. It will not be incorrect to say that many of us start to lead a mechanical life (as pseudo robots). We need to constantly remind ourselves that every moment spent worrying endlessly (about things outside our control) is moment wasted. We are never going to get this time back. Quoting the Bible (Matthew 6:34), “So don’t worry about tomorrow, for tomorrow will bring its own worries. Today’s trouble is enough for today”. This verse reminds us to live in the here and now; no wonder it is called the present (read gift).


2. You are far more stronger than you think you are.

When the life is sailing smooth, we seldom can assess our own abilities/courage. It is only during tumultuous times that our abilities and true courage is put to real test. In the summer of 2020, when the death rate due to Covid-19 (across the world) was at its peak, I was observing all precautions (of social distancing and sanitizing well) and hoping that God spares me. In the middle of May ’20 when I was planning to get vaccinated (as slots for my age had become available), destiny had other plans. Just a day before my scheduled vaccination date, I came out Covid-19 positive. By grace of God and the sound medical advice of my family doctor, I was able to fight the daemon and emerge victorious in about 4-6 weeks, and that too all alone (away from family). The aftermath (read side effects) took even longer to subside. That being said, given the comorbidities that I suffer from, I was certain that if I was infected, I won’t survive. Little had I known that I was undermining my own (and my immune system’s) abilities to fight adversity, me recovering was a stark evidence of the same.


3. Keep a Plan “B” in place for your career.

Covid-19 not only took lives, it became the reason for so many businesses to shut down. Companies (both big & small) shutting down operations, had a direct and adverse impact on the workforce that suddenly left them jobless. In India, people were dying not only because of Covid-19 but unfortunately due to starvation too. Just like project planning wherein we ensure that we have a Plan B to rescue us should Plan A fail, we must apply the same strategy to our career. Given the changing and uncertain times not having an alternative source of income can turn disastrous.


4. Save for the rainy days.

Almost everyone would have heard this piece of advice from their elders. Yet many of us choose to ignore this sound advice until it’s too late. Make saving a habit very early in life; those savings can help you get out of the deepest pit. In the Internet Age where flaunting on Social Media has become a fad, unconsciously we try to copy the lifestyle of celebrities and fashion influencers. Don’t dwindle your earnings by buying things to impress people who do not matter. Learn to differentiate between your wants and needs.

5. Count your blessings as opposed to shortcomings. Be thankful.

It is easy to point a finger towards the sky and blame God and Destiny for the mishaps in life. It takes courage to own up to the poor/bad choices that lead you to the trouble in the first place. When I was fighting Covid-19, being able to breathe without external aid (read Oxygen cylinders) was a blessing. While there were people dying due to paucity of Oxygen supply in the hospitals, here I was breathing on my own. So often we take such simple things for granted. Only during adversity, are we reminded to be grateful for things we have. Each day we need to make a conscious choice between being grateful for what we have over grumbling for what we don’t.

Stay home. Stay Safe. Stay healthy.

Anti Conversion Laws (A Socio legal perspective)

Introduction:
The constitution of India guarantees every one of its citizens the right to profess, practice and propagate a religion under article 25. Article 26 of the Indian constitution gives the right to every religion to manage its own affairs. So, in this case, is conversion legally bound within the purview of the Indian constitution? If yes, what are the problems that the society would face and if no, what is the loss for the society? This is the issue which currently needs to be discussed from both social perspective and from legal perspective. If the laws are for efficient administration of a territory then how would these help in dealing with sensitive issues such as conversion?

Where does the problem start?:
As long as the people want to convert from one religion to another religion with utmost trust in that religion with a prime aim to attain salvation, then there is absolutely no problem in conversion. When this conversion happens to let the religion meddle with the political system of the country, then it becomes wrong. When seen in an illustrious manner, imagine, if a person gets converted from one religion named ‘A’ to another religion named ‘B’ under the guidance of a spiritual master of the religion ‘B’, then there is no objection.

But if the spiritual master takes advantage of the spiritual mentality of that person and if he wants that person to vote for a particular candidate in an election or if the spiritual master wants that person to join in a rebellion against the integrity of the nation or if the master uses this same undue influence over that person to degrade other religion causing religious tensions in the region becomes an issue which cannot be justified by any prevailing law of this territory. When these kinds of conversions happen, then it is legally not bound as the sole intention of the person who converts the other guy is to possess an undue influence over him. Converting a poor from one religion to another by giving money or an asset to him doesn’t also pave way for a religion to be called as a moral one as the intention of the person who convert matters. If the thought of gaining undue influence over another person arises, then that conversion is not bound legally and morally.

The basic difference between a political party and a religious institution is that a political party is not religion biased and a religious institution is. A political party speaking to uplift a particular religion in a biased manner by degrading or defaming other religions could not be accepted and in the same manner a religious institution interfering in political ideologies must not be entertained as the primary ideology behind religion is to attain salvation and not to attain political power. A prayer hall is to pray and not to pass degrading, defamatory comments on other religions or to incite violence in the form of religious clashes. This would never be wanted by the people of this country as one of the fundamental structures of the constitution is the secular aspect of our country which shows us as a unique democratic tolerant nation.

A constitutional view:



Some people may argue that conversion is bounded within the purview of our constitution as article 25 gives the freedom of practicing any religion as per the will of a person. What we must know is that no fundamental right is an absolute right and it has its own reasonable restrictions. Article 25(1) is clearly using the words ‘subject to public order, morality’. So, the right to religion is subjective to public order and morality. Article 19(1)(a) gives every citizen of this country the fundamental right to freedom of speech and expression. It is also subjected to reasonable restrictions. One of it is the fundamental right of one citizen must not deprive the fundamental right of another citizen unless accepted by law. So, when Article 25 read with article 19(1)(a) of the constitution in the perspective of conversion, no person has the right to convert another person by hurting the sentiments of other religion or by deceiving him in order to gain an undue influence over that person. Article 26 deals about the rights of the religion to manage its own religious affairs. Some religions have conversion as a part of their religion to make many people to walk on the path of their religious head. This can be done constitutionally if this article is invoked only on the thoughts as above mentioned. There is no test to determine whether to find the conversion is legally bound or not. If it is morally not right, then it would lead to unconstitutionality as article 26 of one person must not forcefully interfere with article 25 of another person with the help of the right given under article 19 of the deceiver.

Work of legislature:
The duty of the legislature is to find a way to determine a test for finding the legal validity of a conversion. It is not right from the part of the constitution and from the side of the state to stop a heartful conversion without any political disturbance as aforesaid. Any forced conversion or a conversion which is not bound by law must be stopped by the government to save the democratic setup from it not turning into an aristocratic rule. Anti-conversion laws are already under motion in states like Uttar Pradesh and it is highly necessary for other states to follow such a pattern in implementing strict laws against the offenders.

Conclusion:
It maybe religiously right to convert according to some religions but in a setup like ours whenever there is a collision between the religion and the law, it is always the constitution which prevails as it is otherwise known as the supreme law of the land. In the case of Indian Young Lawyers association Vs. state of Kerala, the Honourable Supreme court agrees with this view of viewing socio legal issues. Anti-conversion laws are a must to this nation in order to retain the democratic setup and not to get into a semi aristocratic setup under the shadow of democracy in the upcoming future. It is also needed to balance and maintain our culture and heritage by viewing secularism in the way it ought to be viewed for achieving an idealistic nation.

26/11 हमला: पहला विदेशी नागरिक जिसे भारत में दी गई फांसी

नई दिल्ली,(प्रीतम शर्मा): देश की आर्थिक राजधानी कही जाने वाली मुम्बई या यूं कहें सपनों की नगरी मुंबई में हुए आतंकवादी हमले ने ना सिर्फ पूरे देश को दहला दिया था बल्कि पूरे विश्व को भयभीत भी कर दिया था। मुंबई में हुए इस आतंकवादी घटना में 26 से लेकर 29 नवंबर के बीच कुल 166 बेगुनाह लोग मारे गए और वहीं करीब 300 लोग घायल हुए थे।

मुंबई हमले के पीछे कोई और नहीं बल्कि पड़ोसी देश पाकिस्तान का हाथ ही था। आतंक का गढ़ कहा जाने वाला पाकिस्तान अपने नापाक मंसूबे से देश में इस तरह के जघन्य अपराध को अंजाम देकर पूरे इंसानियत को शर्मशार करने का काम किया था। मुंबई हमले का मास्टरमाइंड कोई और नहीं बल्कि आतंकी संगठन लश्कर-ए-तैयबा का हाथ था.

पहला विदेशी नागरिक जिसे दी गई फांसी

आपको बता दें कि आतंकी कसाब ने जब इस जघन्य कृत्य को अंजाम दिया था तब उसकी उम्र महज 21 साल ही थी। अजमल कसाब स्वतंत्र भारत में पहला विदेशी नागरिक है जिसे फांसी दी गई। आधिकारिक सूत्रों के अनुसार, उस वक्त के तत्कालीन राष्ट्रपति प्रणब मुखर्जी द्वारा 5 नवंबर को अजमल कसाब की दया याचिका खारिज किए जाने के बाद ही उसे फांसी देने की प्रक्रिया शुरू कर दी गई थी।

इसके लिए एक विशेष टीम का चयन किया गया, जिसे 25 वर्षीय अजमल कसाब को गुप्त तरीके से पुणे की यरवडा केंद्रीय कारागार लाने और यहां फांसी देने तथा उसे दफ्न करने की जिम्मेदारी सौंपी गई थी। ऐसे में कसाब को चोरी छिपे फांसी देने के लिए मुम्बई के आर्थर रोड जेल से पुणे लाया गया। राष्ट्रपति कार्यालय से मिली फाइल पर उस वक्त के तत्कालीन केंद्रीय गृहमंत्री सुशील कुमार शिंदे ने 7 नवंबर को हस्ताक्षर कर दिया, जिसके बाद अगले ही दिन उस फाइल को महाराष्ट्र सरकार के पास भेज दिया गया।

बेहद ही कम लोगों को थी कसाब के फांसी की जानकारी

अजमल कसाब को 21 नवंबर की सुबह फांसी दी जाने वाली है इस बात की जानकारी बेहद ही कम लोगों को थी। जिन अधिकारियों को इस बात की जानकारी दी गई थी उनमें महाराष्ट्र के तत्कालीन पुलिस महानिदेशक संजीव दयाल, मुम्बई के पुलिस आयुक्त सत्यपाल सिंह, यरवडा जेल के प्रमुख मीरान बोरवंकर मुख्य रूप से शामिल थे। इसके अलावा राज्य में कानून-व्यवस्था एवं खुफिया विभाग के बड़े अधिकारियों, मुम्बई सीआईडी और पुणे के कुछ बड़े पुलिस अधिकारियों को भी इस बात की जानकारी दे दी गई थी।

कसाब को 12 नवंबर को दी गई फांसी की जानकारी 

आपको बता दें कि महाराष्ट्र में नागपुर केंद्रीय कारागार के अलावा पुणे स्थित यरवडा जेल में ही दोषियों को फांसी दिए जाने की सुविधा उपलब्ध है। ऐसे में मुम्बई से पुणे की दूरी कम होने के कारण अजमल कसाब को पुणे लाया गया और फांसी देने के लिए एक विशेष जल्लाद को बुलाया गया। जानकारी के मुताबिक जेल के अधिकारियों ने कसाब को 12 नवंबर को बताया कि उसे फांसी दी जानी है। महाराष्ट्र के तत्कालीन मुख्यमंत्री पृथ्वीराज चव्हाण के अनुसार यह जानकारी सामने आई कि अजमल कसाब को मुम्बई की आर्थर रोड जेल से 19 नवंबर को एक विशेष विमान द्वारा पुणे के यरवडा जेल लाया गया।

कसाब की आखिरी इच्छा 

फांसी दिए जानेंसे पहले जैसा कि हमेशा से होता आया है कि दोषियों की अंतिम इच्छा पूछी जाती है। ऐसा ही अजमल कसाब के साथ हुआ। अजमल कसाब से उसकी आखिरी इच्छा पूछी गई। तब उसने बताया कि उसकी कोई आखिरी इच्छा नहीं है। पर हां उसने यह जरूर कहा कि उसके फांसी दिए जाने की जानकारी उसकी मां को दे दी जाय। इसके अलावा उसने यह साफ कर दिया कि वह फांसी से पहले किसी भी तरह का कोई बयान जारी नहीं करेगा ना ही उसकी कोई अंतिम इच्छा थी।

The Punjab Chief Minister Navjot Sidhu visited Kartarpur Sahib Gurudwara on 20th November and called Pakistan Prime Minister Imran Khan his ‘big brother’. While interacting with the CEO of Kartarpur project, Sidhu made a remark that Imran khan is his ‘big brother’ 

Imran Khan is none other than Pakistan’s prime minister who decided inhuman attacks on Hindus in Pakistan. Pakistan also regularly attacks our Indian army. This is an insult to the jawans and Hindus of Pakistan! 

In this article, we will examine some events done by Pakistan and also took place in Pakistan.

  1. 1. An angry mob of 1,500 Pakistani Muslims, led by an Islamic cleric, attacked and burned the Samadhi of Hindu Saint Shri Paramhans Ji Maharaj in Teri village in Khyber Pakhtunkhwa, Pakistan on December 31, 2020.
  2. 2. A convoy of Indian paramilitary forces was attacked in Indian-controlled Kashmir in February 2019, killing at least forty soldiers. Jaish-e-Mohammad, a Pakistani militant group, claimed responsibility for the attack, which was the deadliest attack in Kashmir in three decades. The next week, India claimed it had carried out airstrikes against a terrorist camp in Pakistan. An air strike by Pakistan in Indian-administered Kashmir was retaliated by India the next day. During the exchange, Pakistan shot down two Indian military aircraft and captured an Indian pilot; he was released two days later.

Here are just two incidents, but there are a lot more! After such brutal attacks on India and Hindus, Sidhu calls Pakistan’s PM Imran khan his ‘big brother’! 

In addition, Navjot Sidhu claimed that Pakistan is better than South India. This was a failed attempt to divide the country!

The best thing he could do if he loves Pakistan so much is to leave India! Get out of here! There should be no place for anti-nationalists in this country! Such sick people shouldn’t be allowed to live in our country.

The hashtag #GoBackStalin has been trending on Twitter with more than 807,000 tweets when touring the Ramanathapuram, Coimbatore district of his home state.

Why is it trending?

Tamil Nadu CM M.K.Stalin tours Western belt which is locally known as the ‘Kongu Belt’ is an AIADMK stronghold and largely voted against the ruling DMK. Coimbatore, being the second-largest city and industrial hub of Tamil Nadu is situated in this region. There are allegations of Tamil Nadu’s western belt being ignored by the ruling DMK, hence, TamilNadu Chief Minister who is touring the region is facing the anger of angry netizens.

However, this region is allegedly allocated far fewer vaccines than Chennai. Coimbatore is also now the city with maximum COVID-19 cases in Tamil Nadu. Leaders of BJP and AIADMK, have been pointing out the huge spike in deaths and cases in Coimbatore.

In addition to this when asked about it by a BJP spokesperson, the DMK spokesperson replied by saying “if people of Coimbatore are struggling and crying in pain, then go and WhatsApp it to Modi”. this careless response added fuel to the wrath of the people.

Whenever Prime Minister Modi visited Tamil Nadu, we have seen the hashtag #GoBackModi trending nationally in protest of his visit. But this is the first time a protest against Chief Minister Stalin has become a national trend ranking #1.

During The second wave of corona in India, Tamil Nadu has been in the top 3 nationally in terms of corona impact. Notably, overall Active cases in the state are over 310, 000, while cases in capital city Chennai have been reducing, it is the second-largest district Coimbatore that is seeing a spike. Coimbatore, the Western district is now witnessing over 4,700 daily cases. Evidently, people from the western belt and opposition see it as the failure of the DMK Government.

Taking back Three-Farm Laws- A progressive step for Democracy?

The opposition parties in India are happy and contented because they have a feeling that Prime Minister Modi has yielded to agitating farmers by repealing farm-laws. They are hailing that the “democracy” won.  However, repealing farm-laws is an indication that Indian democracy is progressing at a glacial-pace. The prime minister said his party was not able to communicate to farmers effectively on farm-laws. However, in India, people got accustomed to socialism and welfarism promoted by the state rather than by any entrepreneur-ship.

The good opportunity of farm-reforms is lost. For another quarter century, the laws may not see the light. None of the parties venture to bring them back in the near future. The Congress party was at the forefront in saying that farm laws were for benefiting Corporates like: Ambani and Adani. This is the Left narrative, to which the opposition Congress hooked on to. The farming community in India, as a whole, missed the bus.

The agitating farmers, from the beginning, were changing the goal-post. First they said— to fix the minimum support price (MSP). Next, they sought the repeal of three-laws. They never had come to a middle-path in between, when a group of ministers started talking to them. They were intransigent all the while making all talks fail. The farmers demanded the P.M. to speak with them directly. Now, that the P.M. spoke directly and also obliged to their demand. Now, do they relent? Stop the agitation? No. The farmers’ unions under the banner of Samyukt Kisan Morcha announced they would continue with their pre-planned protests on November 22, 26 and 29 at various locations.

What is the use of rollback? They now have several demands: legalising MSP, dropping cases registered against protesting farmers, compensation for the deceased, withdrawal of draft Electricity Amendment Bill, Land at Singhu border to build a memorial for the farmers died in the agitation, resignation of the Union MoS home Ajay Mishra etc. This is how agitators at the end of the day make demands. This is the reason for the slow progress in democracy. No wonder China is pacing fast! None in the opposition tried to convince the farmers regarding their benefits. They said discussion and debates had not taken place in the parliament. Hence, do not support the Govt.’s move. Would any debate in the parliament ever amicably happen to settle things? In debates, opposition opposes, simply because the Govt. proposes. Did the opposition do any constructive discussion at any time? Or any deliberations? On many of the Modi government’s reforms the opposition did not cooperate with? They always tried to scuttle.  

The opposition found fault with labels like: terrorists and Khalistanis to the protesters by some of the cadre and leaders of the ruling. There is an element of truth on what they labelled as. For, in such prolonged/ continued agitations, there is a likelihood of some infiltrators of the kind mentioned entering in. They try to instigate and cause trouble, using farmer-protest to their advantage. Now, that is all put to rest by the prime minister. All ends well, that ends well. 

The repeal of laws has something to do with Utter Pradesh and Punjab elections, is the opinion doing rounds in the opposition camp. But a handful of farmers cannot make a difference in the biggest state like Utter Pradesh. As far as Punjab is concerned, the BJP has no big stakes. In India, there have been slogans like Jai Jawan and Jai Kisan. Indians give love and respect to both Jawan and Kisan. Prime Minister Modi embodies all of India.

That is, he represents: Jawans, Kisans, Corporates, Common Citizens and the underprivileged. He carries with him all sections in the society.  Hence, he showed concern for the farmers, who have been agitating so long. The further continuation of farmers-protests would defame India and its international image as the largest democracy. The international media is giving much coverage to farmers’ protests, damaging India’s credentials. Hence, the action of rollback of farm-laws, shows magnanimity on the part of the prime minister. At a later date and time, after intense debates and discussions things could be set-right again for the smooth passage of laws by this government. ISIS and it’s worrisome influence over Indian Muslims: A situation hard to tackle right now

Recently, India faces threat from most of it’s neighbors and the recent Afghanistan situation turning into an uncontrolled international mess is certain to influence Muslims across the Indian subcontinent. People, specially from a radical specific community always approach violence as a means of expression and domination turning demographics and even ideological changes at times.

ISIS has a clear agenda to stir up India’s harmony and to participate in communal tensions in India to use it as a religious benefit and give a successful try to it’s befitting terrorist activity they want to carry out in sensitive locations such as in the valley of Kashmir or in national capital as well.

The recent magazine- “THE VOICE OF HIND” published a cover page titles “It is TIME to BREAK the FALSE GODS” with a clear agenda to influence Muslim mobs to continue violence in Indian subcontinent and beyond, establish Islamic superiority by means of violence (jihad) and it shows vandalized murthy of Lord Mahashiv from a temple in India. The more threat exposed as shaheen bagh was not successful but after PM Modi repealed the Farm laws, people are again talking of coming out on streets and do protest where ‘p’ clearly doesn’t stands for peace.

It is believed to be a direct call from the Islamic terrorist organizations from territories of Afghanistan and beyond to go completely out on streets and do jihad and a call to coerce non-muslims to convert as they might destroy their religios places. A fiasco, as many call it but people of Afghanistan has made their stand clear on the situation of Kashmir as well. Not just ISIS or new militant-coup Government but the response of India’s stand on Kashmir was also firm. Indian political leaders made it clear that India, in whatsoever condition is not going to slip it’s claim from State of Kashmir.

Many recent radical activities after the fall of previous Afghanistan government were seen as many Hindus and Sikhs were killed in Kashmir Valley by terrorists to disrupt longstanding attempts of peace in the valley.

काशी विश्वनाथ का केस: हिन्दू के लिए क्या है इस केस का महत्त्व

काशी विश्वनाथ केस– जब अब काशी विश्वनाथ का केस आगे बढ़ रहा है, तो कुछ लोग पूछ रहे है की हिन्दुओ के पास इतने हजारो मंदिर है इतने ज्योतिर्लिंग है तो काशी विश्वनाथ में ऐसा क्या है, हिन्दू तो किसी और मंदिर से भी काम चला सकते हैं। उनके लिए ये पोस्ट पढ़ना जरूरी है, और काशी के लोगो के लिए भी जो वहाँ रहते तो है लेकिन उन्हें ये नहीं पता की काशी कितना महत्वपूर्ण स्थल है।

काशी का महत्त्व – काशी के पाँच कोश (1 कोश = 3 .08 km, 5 कोश = 15 .375 km ) का क्षेत्र चारो दिशाओ में अविमुक्त क्षेत्र कहा गया है पुराण में। जिसका रिफरेन्स आप को आगे मिल जायेगा। अविमुक्त मतलब जो सांसारिक बंधनो से मुक्त हो जाये। ऐसा माना जाता है पुराण और साश्त्रो में यहाँ तक की शिवपुराण में लिखा है की इस क्षेत्र को भगवान शिव ने स्वयं बनाया है। और प्रलय आने तक सृष्टि में प्रथम शहर ये था, और आखरी शहर भी यही होगा। 12 ज्योतिर्लिंग जिसमे से 5 ज्योतिर्लिंग स्व्यंभू ज्योतिर्लिंग है उनमे सबसे पहला ज्योतिर्लिंग आदिविश्वेश्वर ज्योतिर्लिंग है, जहाँ भगवान शिव ने प्रथम बार धरती पर लिंग के रूप में स्थापित हुए,और जी हाँ जो आज के समय में आप काशी विश्वनाथ जी का नाम सुनते है वो ज्योतिर्लिंग नहीं वो रानी अहिल्या बाई होलकर द्वारा स्थापित लिंग है जिसका नाम काशी विश्वनाथ रखा गया। आदिविश्वेश्वरनाथ अपने मूल स्थान पर है, जहाँ आज ज्ञानवापी मस्जिद है। इसलिए ये हमारे लिए अति महत्वपूर्ण है। पुराण में ये भी कहा गया है की जिसे काशी में मृत्यु मिलेगी या जो काशी के दर्शन करेगा उसे मोक्ष मिलेगा, इसलिए भी यह हिन्दुओ के लिए अति महत्वपूर्ण स्थल है। इसलिए यह 5 कोश का क्षेत्र और आदि विश्वेश्वरनाथ ज्योतिर्लिंग का क्षेत्र का उपयोग और महत्वपूर्ण अभी कुछ सालो से नहीं सदियों से हिन्दुओ के लिए रहा है।

  • Chapter No. 16, Page No. 242, Verse No. 25 (हिंदी अनुवाद / सारांश ) प्रकृति शक्ति के रूप में है , भगवान शिव यहाँ है, भगवान ने सृष्टि की रचना अपने पाँव के निचे की है , और भगवान ने अपने क्रियान्वन के लिए 5 कोश के क्षेत्र की रचना की है, जो की प्रलय आने तक समाप्त नहीं होगा, इसलिए इस क्षेत्र को अविमुक्त क्षेत्र कहा गया है। जब पुरे संसार में जमीन नहीं थी , पानी नहीं था , भगवान ने अपने रहने के लिए जगह का निर्माण किया हे कुम्बज किसी को भी इस गुप्त बात के बारे में नहीं पता है। यह बात उसे मत बताना जो आस्तिक न हो। यह क्षेत्र केवल धर्मदर्शी ,श्रद्धालु , त्रिकाला , यजना , शिव भक्त, शाक और मुमुक्ष के लिए है।
  • Chapter No. 99, Page No. 923, Verse No. 09 (हिंदी अनुवाद / सारांश ) हे भगवान यहाँ के पांच कोश के अविमुक्त क्षेत्र में ऐसा कोई हिस्सा नहीं है जहाँ भगवान शिव ने लिंग के रूप में उत्पति ली थी उसके प्रभाव से वंचित हो।

सनातन संस्कृति का मुख्य उद्देश्य है जीवन मरण के चक्र से ऊपर निकलना और मोक्ष प्राप्त करना जिसका मार्ग काशी है इसलिए यह जगह हिन्दुओ के लिए अति महत्वपूर्ण है .आर्टिकल 25 और 21 के तहत हिन्दुओ का धार्मिक अधिकार है इस 5 कोश के क्षेत्र को फिर से रिस्टोर किया जाए। आपने मंदिर तोड़ दी मस्जिद बना ली उससे आप का हक़ नहीं बन जाता जिसकी पूजा सनातन संस्कृति को मानने वाले आदि अनादि काल से करते आ रहे है। श्री विष्णु शंकर जैन जी ने कोर्ट में माँ श्रृंगार गौरी जी की तरफ से केस फाइल की है इसकी वजह यह है की माँ माँ श्रृंगार गौरी भगवान शिव की आदि शक्ति है उनको अर्धनारीश्वर भी कहा जाता है , और बिना माँ श्रृंगार गौरी के पूजा अर्चना के आप के बाबा विश्वेश्वरनाथ के दर्शन पुरे नहीं होते। माँ श्रृंगार गौरी आज भी मस्जिद के पश्चिम दिशा में है जिसकी पूजा की जाती है। स्कन्द पुराण के चैप्टर न. 99 -100 में लिखा हुआ है की माँ श्रृंगार गौरी के पूजन के बिना आप के दर्शन विश्वेश्वर महादेव का पुरा नहीं होता यही बात Chapter 100, Page No. 1007, Verse No 61-70 और काशी खंड Chapter No 100 में उल्लेखित है की माँ श्रृंगार गौरी की यात्रा हर तृतीया के अमावस्या को निकाली जानी चाहिए। इसलिए हमारे धर्म , विश्वास , आस्था के हिसाब से यह केस और स्थान अति महत्वपूर्ण है।

यहाँ लिखी हुई सारे तथ्य सुप्रीम कोर्ट ने नोट किया है। सारे तथ्य लिखित ,रिकार्डेड और इसके ऊपर कोर्ट द्वारा Judicial Pronouncement पहले से है। सारे तथ्यों की Authentic Legal Value है। Indian Evidence Act के Section – 57 के तहत ऐतिहासिक किताबो की Legal Value होती है , और कोर्ट उसकी Judicial Notice ले सकता है। (अयोध्या केस में भी ऐसे बहुत से किताबो को सीधे सुप्रीम कोर्ट में दोनों पक्षों द्वारा दाखिल किया गया था , जब इसपे विवाद उठा तो सुप्रीम कोर्ट ने Detailed Order पास कर के ये बाते बतायी थी )

1193 में प्रथम बार कशी विश्वनाथ मंदिर को मो. बिन गौरी के कमांडर कुतबदीन ऐबक द्वारा तोड़ा गया था। फिर 1585 में राजा टोडरमल जो की अकबर के 9 रत्नो में से एक थे उन्होंने इसको बनवाया।फिर औरंगजेब ने 1669 में फरमान जारी कर के काशी विश्वनाथ मंदिर को ऐसे ध्वस्त करवा दिया।

औरंगजेब का फरमान

सबसे पहली बात ये फरमान आज के समय में आया कहाँ से ? यह फरमान The History of India, as Told by Its Own Historians By : Henry Miers Elliot & John Dowson के 8-Volume के किताब के Volume-7 से लिया गया है। इनके पास में औरंगजेब की Original फरमान सुरक्षित थी। इन्होने Volume-7, Page No-183 पर उस फरमान को कोट किया है।

“On the 17th Zi-l kada 1079 (18th April 1669), it reached the ear of His majesty, the protector of the faith, that in the provinces of Thatta, Multan and Benaras, but specially in the latter, foolish Brahmins were in the habit of expounding frivolous books in their schools, and the students and learners, Mussulmans as well as Hindus, went there, even from long distances, led by desire to become acquainted with the wicked sciences they taught. (Emphasis added to show cause)”The “Director of the faith” consequently issued orders to all the governors of provinces to destroy with a willing hand the schools and temples of the infidels; and they were strictly enjoined to put an entire stop to the teaching and practicing of idolatrous forms of worship. On the 15th Rabi-ul Akhir (2/09/1669) it was reported to his religious Majesty, the leader of the unitarians, that, in obedience to the order, the Government officers had destroyed the temple of Bishwanath at Benaras.”

अगर आज के डेट में Archeological Survey न भी हो तो इसके साक्ष्य मौजूद है की वहाँ मंदिर थी जिसे तोडा गया है। सुप्रीम कोर्ट ने और इलाहाबाद कोर्ट ने ये बात दीन मोहम्मद के केस(जिसे मै आगे बताऊंगा ) 1942 SCC OnLine Allahabad/ Page No. 56 के Paragraph-5 में ये HOLD किया है की यहाँ मंदिर तोड़ी गई है और Paragraph-16 में HOLD किया है की यह वक्फ सम्पति नहीं है।इसके बाद जब काशी विश्वनाथ एक्ट आया तो उसको सुप्रीम कोर्ट में चैलेंज किया गया जिसमे जस्टिस रामास्वामी ने कहा है की यहाँ पर मंदिर थी जिसे तोड़ा गया है।

1669 के बाद काशी विश्वनाथ का क्या हुआ?

Anant Sadashiv Altekar जो की historian, archaeologist, and numismatist थे और Head of the Department of Ancient Indian History and Culture at Banaras Hindu University थे। बाद में इन्हे काशी विश्वनाथ से जुड़े एक केस में गवाही के रूप में लाया गया था। इन्होने History Of Benaras में लिखा है की

“1669 के बाद जो मस्जिद का पूर्व का भाग है वहाँ 125 फुट का हिन्दू मंडप है, और वो हिन्दुओ के अधिकार में है, जो पार्ट मंडप का मस्जिद के आँगन तक है वो भी हिन्दुओ के अधिकार में है. मस्जिद के पश्चिम भाग में माँ श्रृंगार गौरी की पूजा होती है, और जो प्राचीन मंदिर था वो आज भी मस्जिद के अंदर है और उसके चिन्ह और अवशेष आज भी मिलते है।”

‘इसके बाद 1777 -80 में अहिल्या बाई होल्कर जी ने मंदिर का निर्माण करवाया जिसे काशी विश्वनाथ मंदिर का नाम दिया गया। इसके बाद 1809 -10 में ज्ञानवापी के पुरे क्षेत्र को हिन्दुओ ने फिर से कब्ज़ा कर लिया 30-12-1810 को वाराणसी के DM Watson ने President Council को पत्र लिखा की “Suggesting the handover the Gyanwapi Area to hindus forever”

इसके बाद 1822 में Benares Illustrated Book by James Prinsep ने लिखा है की “हिन्दू आज भी मस्जिद के चौखट पर पूजा करते है और मानते है की उनके देवता आज भी उस स्थान पर अदृश्य रूप में मौजूद है। “M.A. Sherin ने भी अपने किताब में लिखा है की ” उस स्थल पर मंदिर के ध्वस्त अवेशष आज भी नंगी आँखों से देखे जा सकते है “

दीन मोहम्मद केस

इसके बाद बनारस के रहने वाले दीन मोहम्मद ने Civil Suit कोर्ट में दाखिल किया। Civil Suit 62 of 1936 में किया की जो सेटलमेंट प्लाट -9130 को (वास्तविक काशी विश्वनाथ का पूरा एरिया Revenue Record में 9130 के नाम से जाना जाता है. ) वक्फ प्रॉपर्टी declare किया जाये और उन्हें नमाज पढ़ने का पूरा अधिकार दे दिया जाये। दूसरा पक्ष इस केस में ब्रिटिश सरकार थी , हिन्दुओ ने जब इस केस में पक्ष बनने की बात की तो उसे हाई कोर्ट और सुप्रीम कोर्ट में ख़ारिज दिया गया। ब्रिटिश सरकार ने लिखित रूप में कोर्ट में हलफनामा दायर किया और

  • Paragraph -2 में यह लिखा की यह परिसर वक्फ प्रॉपर्टी नहीं है। (यहाँ आप को जान लेना चाहिए की किसी Valid मस्जिद होने के लिए कोई भी स्थान वक्फ संपत्ति होना चाहिए )
  • Paragraph -11 में लिखा है की यहाँ की मूर्तिया मुगलकाल के पहले से यहाँ है।
  • Paragraph -12 इस सम्पत्ति का मालिक औरंगजेब नहीं था। और इस्लामिक law के मुताबिक यह अल्लाह को Dedicate नहीं किया जा सकता। दावेदारों की ओर से सात, ब्रिटिश सरकार की ओर से 15 गवाह पेश हुए थे। सब जज बनारस ने 15 अगस्त 1937 को मस्जिद के अलावा ज्ञानवापी परिसर में नमाज पढऩे का अधिकार नामंजूर कर दिया था।दीन मोहम्मद इससे खुश नहीं हुए और फिर उन्होंने हाई कोर्ट में Suit दायर किया जिसका Appeal No -466 of 1937 जिसका फैसला आया 1942 SCC OnLine Allahabad/ Page No. 56 के Paragraph-5 में ये HOLD किया है की यहाँ मंदिर तोड़ी गई है। और Paragraph-16 में HOLD किया है की यह वक्फ सम्पति नहीं है.और नमाज पढ़ लेने से किसी स्थान पर आप का उस पर हक़ नहीं हो जाता। आप पूरा केस यहाँ पढ़ सकते है – t.ly/axHU

काशी विश्वनाथ एक्ट -1983

जो की उत्तर प्रदेश सरकार द्वारा पास एक्ट है। Section 4, Sub clause 9-“‘Temple’ means the Temple of Adi Vishweshwar, popularly known as Sri Kashi Vishwanath Temple, situated in the City of Varanasi which is used as a place of public religious worship, and dedicated to or for the benefit of or used as of right by the Hindus, as a place of public religious worship of the Jyotirlinga and includes all subordinate Temples, Shrines, sub- shrines and the ashthan of all other images and deities, mandaps, wells, tanks and other necessary structures and land appurtenant there to and additions which may be made there to after the appointed date.Section 5 – Declares that ownership of the Temple and its endowment shall vest in the deity of Sri Kashi Vishwanath. “Temple” has been defined under Section 4(9)

मुस्लिम पक्षकार बोलते है की यह केस Places Of Worship ACT 1991 के वजह से बाहर होना चाहिए , लेकिन तर्क यह है की यह एक्ट आने से पहले ही वहाँ की संपत्ति भगवान की मान ली गयी है। ब्रिटिश सरकार द्वारा, उत्तर प्रदेश सर्कार द्वारा और सुप्रीम कोर्ट द्वारा। तो उस पर पूरा हक़ भगवान विश्वेश्वरनाथ का पहले से ही है 1991 का एक्ट तो बाद में आया।इसके बाद काशी विश्वनाथ एक्ट को मुस्लिम पक्षकार द्वारा चुनौती दी गयी पहले हाई कोर्ट में फिर सुप्रीम कोर्ट में गया जिसमे कोर्ट के Judgement Citation 1997 Of 4 SCC Page No 606 के Paragraph-1 में वह सब लिखा है जो इतिहास मैंने आप को शुरुआत से बताई है। इसके बाद वह अविमुक्त क्षेत्र है और उसमे हिन्दुओ का क्या विश्वास है यह सब जस्टिस रामास्वामी ने अपने judgement में व्रिस्तृत रूप से समझायी है। जिसे आप यहाँ पर पढ़ सकते है। — t.ly/nikTऔर इस एक्ट के Constitutional Validety को uphold किया है.Places of Worship Act के तहत यह prove होता है की 1947 में काशी विश्वनाथ परिसर का धार्मिक स्वरूप मंदिर का था और यह हिन्दुओ की जगह है। इसलिए कोर्ट ने Archaeological Survey of India को वहाँ फिर से जांच करने को कहा है।

Archeological Survey के Direction के Page No. 11 के Paragraph 5 में लिखा है की “The purpose of the archaeological survey shall be to find out as to whether the religious structure standing at the present and disputed site is a superimposition, alteration or addition or there is structural overlapping of any kind. If so, then what exactly is the age, size, monumental and architectural design or style of the religious structure, and what material has been used for building the same”

अब मुस्लिम पक्षकार इसे रोकने में लगे है और 1998 से यह केस मतलब 23 साल से हाई कोर्ट में अटका हुआ था, किस समाज और धर्म के लोगो में इतना सयम है की वो इतनी शांति से इंतजार करे। और सच की जब भी बात होती है मुस्लिम पक्षकार 1991 Places of Worship Act की आड़ ले लेते है और कोर्ट से स्टे ले ले रहे थे। इतना समय बर्बाद करने का मतलब क्या है? सीधे और साफ़ बात यह है की ये आज भी औरंगजेब को अपना शहंसाह/ बादशाह /पूर्वज मानते है और उसके किये गए फैसले को किसी भी तरह बनाये रखना चाहते है। नहीं तो मुस्लिम पक्षकार के खड़े होने का कोई मतलब बनता ही नहीं है। पर याद रहे यहाँ बाबा आदि विश्वेश्वरनाथ साक्षात रूप में विद्यमान है, और हर दशा में चाहे आप जो भी कर ले अंत में जीत उनकी ही होगी।

Civil Society isn’t enemy while not free from subversion, suborn, division & manipulation

IAS-turn-Civil Society activist Aruna Roy published a column titled “Civil Society is not enemy” on dt. 18.11.2021 in The Print and on dt. 19.11.2021 in The Indian Express questioning the constitutional rationality of former IPS and IB-Director and now National Security Adviser to government of India with cabinet minister rank Mr. Ajit Doval, who is incidentally her batch mate, advice, which she quoted in her column and I too quote “The new frontier of war, what you call the fourth-generation warfare, is the civil society. Wars have ceased to become an effective instrument for achieving their political or military objectives. They are too expensive and unaffordable and, at the same time, there is an uncertainty about their outcomes. But it is the civil society, that can be subverted, that can be suborned, that can be divided, that can be manipulated, to hurt the interests of a nation. And you are there to see that they stand fully protected” to newly trained IPS in their passing out ceremony.

Ajit Doval’s above quoted statement can be divided into two parts. Part one reads: The new frontier of war, what you call the fourth-generation warfare, is the civil society. Wars have ceased to become an effective instrument for achieving their political or military objectives. They are too expensive and unaffordable and, at the same time, there is an uncertainty about their outcomes. And Part two reads: But it is the civil society, that can be subverted, that can be suborned, that can be divided, that can be manipulated, to hurt the interests of a nation. And you are there to see that they stand fully protected.

Also NSA says about Fourth-generation Warfare, shortly called 4GW. The simplest definition of 4GW includes ‘any war in which one of the major participants isn’t a state but rather a violent non-state actor. Fourth-generation warfare has often involved an insurgent group or other violent trying to implement their own government or reestablish an old government over the current ruling power’. Currently, India has several insurgent groups or violent non-state actors and it looks like it’s some civil society members are facilitating them. When Ajit Doval says “But it is the civil society, that can be subverted, that can be suborned, that can be divided, that can be manipulated, to hurt the interests of a nation”, he accepts Civil Society has a major role in democratic governance (means civil society is not enemy); but at the same time, that can be subverted, suborned, divided and manipulated to hurt the interest of a nation, and therefore “You(IPS) are there to see that they stand fully protected.”And it is also the job of IPS to find out who, when, where and how Civil Society is subverted, suborned, divided and manipulated apart from supervising law and order in the society. Protecting civil society members from subversion, suborn, division and manipulation is the new frontiers of war.

I don’t know whether Indian Civil Society is subverted, suborned, divided and manipulated or not, but I know there are a large number of influential black sheep in Indian civil society having direct link with inimical elements abroad who have been relentlessly working against national interest by way of engaging themselves in creating political instability and disharmony among communities, castes, regions, languages, etc.

On 13 January 2018, four senior most judges including one who later became Chief Justice of India(CJI) called for a press conference in New Delhi –the first of its kind in India’s judiciary history- when they were supposed to be in CJI chamber for their morning tea together as per the age-old convention, and made some allegations against the then CJI over his style of functioning. Factually, this was an in-house crisis of apex court which is autonomous organ of Indian governance system. When this issue brought to notice of executive, it told ‘Indian Judiciary is mature enough to take care of any difference within it.’ Though the revolt did not impact the judicial functioning later and things got normalize in no time, there were several issues in which some members of Civil Society had a dubious connections.

In the presser, one senior journalist, who was the head of Editor Guild of India and having dubious journalistic distinction, and a senior SC lawyer, who allegedly violated FCRA norms to get foreign donation, were spotted prompting judges standing behind them while they were addressing press. Soon later, a senior disgruntled politician and former Cabinet Minister of Finance and Foreign Affairs in Chandra Shekhar and Atal Bihar Vajpayee governments, whose son was a minister in 2018, call for revolt of senior leaders and ministers in the ruling party and coalition government. It is a different matter altogether that no minister resigned including his son responding the call.

All the above discussed people are now prominent members of India Civil Society. Are they don’t know that after two and half decades of unstable coalition governance and policy paralysis which severely impacted national security, economy and social stability accompanying unprecedented corruptions, for the first time the people of India chosen a government with absolute majority to govern with stability? Additionally, they propagated ‘this is the government of 31% (as per 2014 GE vote share) Indians’, who voted for it, without accompanying information that the previous government for ten years (2004-14)had less than 30% voters’ votes, and its PM was never elected. What for the above listed activities of prominent Civil Society members? Should IPS officers not watch who, when, where and how Civil Society is subverted, suborned, divided and manipulated, and for what? Here the author of “Civil Society is not enemy” should not forget that IPSs use to take oath with “I, …., do swear/solemnly affirm that I will be faithful and bear true allegiance to India and to the Constitution of India as by law established, that I will uphold the sovereignty and integrity of India, and that I will carry out the duties of my office loyally, honestly, and with impartiality. (So help me God !)”

Before concluding, I would like to bring to the notice of my fellow Indians that I am in India where Civil Society members such as:

Painter could paint nude pictures of his mother land and majority community deities with vulgar captions and majority community people were asked to accept the same as master art pieces to get certificates of secular. During high days of such controversy, I asked one certified secular ‘Can you host these nude and vulgar pictures in your house portico, lobby, drawing room, etc.’, he told me ‘these are actually honeymoon room materials with captions san deities’ names’. Can social harmony in any country be maintained hurting religious sentiment of majority community? Here, one should not forget that religion as an issue is as old as human civilization, and world’s 93% population adhere to at least one religious identity.

Here, in my India, civil society activist refuses to read the government laws but fights and instigates people against the law (CAA-ABP debate); vegetarian-Gandhian historian eats beef to celebrate his visit to a state ruled by a party he does not like; film star born, brought up, gain popularity living his whole life in India but says he was very comfortable in Pakistan, which is known all over the world as manufacturer and exporter of terror, during his few days stay there; internationally reputed people tweet fake news in order to instigate gullible farmers for violence in none other than nation’s pious Republic Day in national capital; etc. etc. ……. there are hundreds of examples. And here civil society members (professors, writers, etc.) prefer to be fans of pop star and porn star than economists with proven caliber (Ref: Farm Laws tweet) because they are from West where evangelist-cum-inside trader convict George Soros promised to fund billion dollar to remove his branded nationalist government in India.

Are the above narrated civil society activities not facilitating violent non-state actors? If yes, should NSA mandated to protect national security not advice his subordinate officers to remain vigilant?
