‘Parties are openly violating the law by using symbols as their trademark to sell their ticket’

Have recognised political parties in India been illegally using election symbols all this while? Are they actually authorised to use election symbols reserved for them during and beyond the period of the elections?

These are some of the key questions raised in a public interest litigation plea filed in the Lucknow Bench of the Allahabad High Court last week. Hearing the PIL, filed by Lucknow-based advocate Shraddha Tripathi, a Division Bench of Justices Devendra Kumar Arora and Ritu Raj Awasthi on May 27 issued notices to the Union Government and the Election Commission.

The court, however, said it did not propose to issue notices to other respondents in the prayer, the political parties — BJP, Congress, SP, BSP and the CPI.

In her petition, Ms. Tripathi sought interim relief praying that the court refrain the recognised political parties from the use of reserved symbols as they violated the Election Symbols (Reservation and Allotment) Order, 1968.

She contended that a “symbol” was “reserved” for a recognised political party exclusively to be “allotted” to “contesting candidates set up by it” during a notified election and in the area where the elections are notified. A candidate cannot use a reserved symbol before he/she files his/her nomination papers, she said.

In her petition, Ms. Tripathi submitted that under Clause 4 of the 1968 Order, “Allotment of symbol is made in every contested election to a contesting candidate in accordance with the provisions of this order and different symbols shall be allotted to different contesting candidates at an election in the same constituency.”

However, she claimed, parties had been openly violating the law and were using symbols as their “trademarks” like “business houses” to “sell their tickets” in the name of reserved symbols.

This discriminated against the Independent candidates, and “violates the doctrine of Free and Fair elections and Article 14 [Right to Equality],” Ms. Tripathi said.

The petitioner also contending that the norms allow the symbols to be used exclusively by the “contesting candidates,” for a specific period during notified elections, not before or after.

“Recognised political parties have been misusing the symbols for their private purposes as their trademark. But the law prescribes that the symbols may be reserved in the name of parties but are allotted to the contesting candidates, only for the period of notified election, and not to any association [party],” Ms. Tripathi said.

Ms. Tripathi had earlier sought information from the EC through a Right to Information (RTI) query if there was a provision allowing parties to use the symbol beyond the period of notified or contested election.

“There is no information available as to whether the symbol reserved for a political party can be used or not beyond the period of notified or contested election,” the EC response said. The Hindu has a copy of the RTI reply dated May 25.

The case is likely to be listed next on July 15.

Publish In India

Education is central to the development of Human Capital. Higher education, in particular has been regarded as a form of investment. Growth economists have captured the essence of higher education as something which can spur economic growth. Over the past few decades or so, owing to brain drain, we have lost a good number of academicians to other countries. Lack of infrastructure coupled up with lack of government’s focus in the past had contributed to this brain drain. This resulted in the lack or rather absolute absence of Indian contribution towards academic research (basic sciences, medicines, management etc.).

Further, this has also resulted in the gradual erosion of academic capabilities of individuals in terms of contributing towards research. This has formed a vicious cycle of lack of academic credentials. The number of research publications from India in comparison to other developed economies is again in a very sad state. This is further deteriorated with instances of academic plagiarism [1] and scientific misconduct [2].

Again to be called a superpower in the future, one cannot ignore academics. The only way, the Indian academics can find its lost glory, if more and more publications start coming from India and that too of superior quality. With the success of #MakeInIndia campaign, can we have something along the same lines? Let us call it #PublishInIndia.

Even though it could sound too naïve, we can have the following roadmap for the same, addressing both short term and long term solutions and if implemented properly, can yield better dividends.

Short term solution: A lot of distinguished faculties having Indian roots, achieved a lot in academics, and also want to return to India post retirement should be the first targets. Lucrative salaries should be offered to them, so they can happily return to India and assume the position of Professor Emeritus in some Indian Institute. If they have some research articles in the pipeline, and then they should be asked to use Indian affiliation to get the articles published. This will give a short term up-thrust to publications from India. But this model is definitely not sustainable in the long run.

Long term solution: As I mentioned earlier, Indian academicians also lack the basic knowhow to contribute towards research. These faculties hired from other foreign universities should also be used to nurture the required talent through conducting several workshops. This will yield a long term solution and will also give a major boost to #PublishInIndia campaign. Further, India needs to open up to form foreign collaborations at a greater scale.

Another dimension of this long term solution could be to develop journals that can match the likes of Nature, Science, Harvard Business Review etc. Once the first objective of nurturing Indian talent is achieved, this could also be achieved as consequence of the same by incentivizing top researchers to be on the Editorial Board.

In the current, some B-schools or some other institutions are trying to follow this model but with very limited success. To make this model successful, it requires a great push from the government.

Maria Toorpakai Wazir is not just a sportsperson, but also a ray of hope for girls in Pakistan. She showed guts to stand against Taliban, Mullahs without running away from her nation, and has set an example for girls in her country to follow. But, why is it that the western media and the UN do not appreciate her work and her father’s courage with awards, rewards, and recognition?

Dressed and behaved like a boy because girls are forced to live a miserable life

Maria and author Katharine Holstein have recently released a book about Maria’s life. Book is titled-“A Different Kind of Daughter: The Girl Who Hid From the Taliban in Plain Sight.” It highlights the world-class athlete’s struggle in her life and also discusses her efforts to change her future with her own hands.

“At a young age, girls in Pakistan are forced to wear Burkha. They cannot see the world, they cannot see the beauty outside, and do you think this is life?”-asked Maria during her recent interaction with Fareed Zakaria on his show GPS.

Maria Toorpakai Wazir’s home is in Pakistan’s South Waziristan region. The area is often referred as the most dangerous place on this planet because it is in the stronghold area of Taliban and other Islamic extremists.

When Maria was just four years old, she burnt all her girly dresses, wore her brother’s clothes and cut her hair short. Her father was surprised because of this incident and started calling her-Changez Khan.

Maria was good enough to understand the difference between clothes but was unaware regarding the trouble that was approaching her, just because she was born as a girl. With time, perhaps, Maria had realized that she can get freedom and participate in sports only if she starts living like a boy. This is the reason, she started acting and behaving like boys. She competed with boys and won her first weightlifting championship.

“I can be equally good as boys in sports. I wanted to have the kind of freedom that boys have, so I decided to put on my brother’s clothes. I was forced to live as Changez Khan and behave as a boy to participate in my favorite sports,”- said Maria Toorpakai Wazir.

Young girls are not allowed to go to school and girls/women’s participation in sports is considered un-Islamic.  Other girls from Maria’s neighborhood were not even allowed to go out of their house alone. But, with her parents’ support, today, Maria Toorpakai Wazir has managed to show the world that even a girl can prove herself to be world’s best squash player.

She lived as a boy until she was twelve years old. People realized that Maria was a girl only when she started playing squash.

“I had freedom, fun, and amazing life while I was dressed up like a boy. But, when people realized that I am a girl, they started treating me very badly. I have lived a life of a boy and life of a girl in Pakistan. I have seen huge differences, and I feel that Pakistani society is unjust to women. I feel that girls should get equal opportunities. Currently, their lives are just wasted,”-said the young sportsperson from Pakistan.

Maria’s father Shamsul Qayyum Wazir faced several threats because of his wife and daughter

Shamsul Qayyum Wazir is Maria’s father and a member of South Waziristan’s prominent political family. Shamsul believed in offering equal rights to girls and boys in his house and this is the reason he often faced ire from elders in his family. He was even denounced by his elders and was tagged mentally ill because of his stance.

Shamsul once again attracted ire when he allowed his wife Yasrab Nayab to complete her education after marriage. Maria’s father survived several attacks on his life because he never forced his wife to wear a burqa.

After tolerating several murder attempts on his life, Shamsul was forced to leave his ancestral house in order to offer a better life to his family which consists of two daughters and four sons. Along with the usual school education, Shamsul also taught them surahs from Quran. He had future plans for both, his sons and daughters right from their childhood days.

People started forcing Maria’s father to keep her inside the house like other girls. Mullahs used to talk about her in the mosque claiming that allowing girls to play sports is not Islamic. But, in spite of all this, he allowed his daughter to pursue her dream.

Malala makes it in headlines as Pakistan’s voice in spite of the fact that she is too scared to go to her country. Maria lives in Pakistan as well as Canada and is not scared to go to her country in spite of threats from radical outfits. Maria and her father’s fight against radical Islamists cannot be termed as anything lesser than Malala’s fight. It is just that Maria’s father does not cash-in on his daughter’s popularity. He can easily start collecting donations in his daughter’s name and open two-three private schools like Malala’s father in order to claim fame.

Pakistan’s number one squash player has taken several initiatives and urged the Pakistani government to promote sports among girls. But, her work is never highlighted much by mainstream media. On the other hand, Malala makes it in headlines even if she walks from one lane to the other in the UK.

Anyway, libtards and the UN won’t ask Maria to give speeches because she would definitely criticize Taliban, Mullahs, and Pakistan. She would perhaps urge the UN to look into the condition of girls in Pakistan. On the other hand, Malala talks nonsense that every progressive liberal intellectual is habited to hear.

Africa can learn from India to shape its future

Africa is the youngest continent on Earth, with a median age of less than 20 years, presenting it with either a choice of its unemployed youth getting embroiled in terrorism, joining rebel groups and crime or contributing handsomely to their countries by a demographic dividend in form of mass development and economic growth. Africa can learn from India to shape its future.

An impressive aspect of Africa is that it’s a land rich in minerals (90% of world’s cobalt, 90% of platinum, 50% of gold, 98% of chromium, 70% of tantalite, 64% of manganese and 33% of uranium) with the virgin preserved environment. It is also the world’s 2nd largest and 2nd-most-populous continent. It accounts for about 15% of the world’s human population.

But it unfortunate that the decolonisation process is still going on in many countries of Africa, with pulls & pushes from France (in Francophone countries), the West (US and EU in some English speaking/ Christian countries) and Saudi Arabia/ Iran in Arabic/ Muslim countries – while the role of UN Peacekeeping missions is benign, but often foreign Government’s interventions have proven destructive – case in point being fall of Muammar Gaddafi roiling Libya in a civil war (just like Iraq, with fall of Saddam Hussein).

I would aspire to shape Africa’s future by looking at the glass half full – I suggest below few solutions – political, social and economic.

The world has seen 30-year miracles – the way Japan, then ASEAN nations, recently China and now how India is developing exponentially. They were able to do so on back of not only demographic dividend but also capacities in export-driven IT/ Manufacturing and FDI (Foreign Direct Investment) flows in stable political and macro-economic regimes. Africa has a chance to pick the best of worlds and make a quantum leap towards development.

Political: For one, I would model the African Union (AU) on the lines of ASEAN (Association of South East Asian nations). It is the unsaid rule of world order that without interference of an outside force, the nation state, as defined in current terms, won’t face an existential issue. Many African countries want to create a United States of Africa. Not only will this provide much needed political & macro-economic stability, but will also serve as a unifying force for a continent which was arbitrarily divided in countries over a map on a piece of paper, by colonial powers. Defence costs of African countries will also come down with a common Army.

The vital inspiration of political future of African countries lies in the developed countries themselves – EU nationals can trade and travel seamlessly between its member nations, US-Canada have open borders – such top down thinking needs to pervade AU in shunning outside interference (when not needed) and uniting the continent on lines of democracy with strong governance provided by independent Institutions like Legislature, Judiciary and Media. (The sad part is that some of these developed nations which have connected seamlessly with each other to enable each other’s development, are the one’s usually obstructing the same path for African and Asian nations).

Social: Thinking of Africa – what comes to mind is extreme poverty, dictatorships, underdevelopment and mal-nourishment, child trafficking, AIDS, neo-colonialism, genocide and all such ills which make it to the bottom of all Global Human indices. Making full use of the demographic dividend would, first of all, necessitate capacity building in science and innovation with concurrent commodification and commercialisation of knowledge. It would also mean imparting skill based training in industrial tools, software, foreign languages, accounts, taxation, commerce and other fields which lead to professional and vocational employment in manufacturing and services companies.

Africa could take a leaf out of India and Philippines which developed offshoring industry on the back of a population which speaks English. It can do the same with its English, French and Arabic speaking populations.

Africa should aspire to create a welfare state on the lines of the European nations but pass-through of subsidies and cash transfers would meet the huge wall of corruption. It could take a solution for this from India, (which is trying bold financial inclusion) – open zero balance accounts like the 250 million Jan Dhan accounts in India and deposit targeted subsidies.

India’s RTI (Right to Information) Act is an example of empowerment of Africans to curb prevalent red tape and corruption in the continent.

Economic:

Examples to follow for Africa should be:

  • China – manufacturing, exports, infrastructure (highways, railways and airlines)
  • US – cutting-edge Technology, Stock markets, Financial sector (in contrast to Zimbabwe who has seen a run on the Zimbabwean Dollar), Agriculture – modern farming with huge land tracts generating robust output (in case of countries with small land holdings, cooperatives may be the solution), drip irrigation, bio gas plants and organic fertilisers
  • Europe – a robust Media, Judiciary, world class infrastructure, benefits of welfare state, seamless intra and inter nations connectivity, common currency
  • India – democracy (be it a messy one like Indian democracy)

Instead of exporting raw materials to manufacturing super powers like Germany, Japan and China and then importing finished goods (resulting in loss of Forex earnings), African nations should create incentives to create manufacturing in their own countries, like tax free conclaves, simple land acquisition laws, transacting Government business online, speedy approvals as well as fast and easy availability of power and water.

There are green shoots indeed visible in some African nations – the rapid development of world class infrastructure in Nigeria or the tremendous success of mobile wallets in Kenya (where 80% of all transactions are currently electronic). The development of technological domain would necessitate laying of Optic fibre and imparting of IT know how, which should give exponential returns through international trade, given the central position of Africa on the world map.

Africa can leverage its huge Oil and mineral reserves to generate profitable projects, but keeping in mind the case of Venezuela, where an overly Oil-dependent economy lies currently in ruin (with falling Oil prices) because it didn’t diversify and re balance its economy in time. While it has been a recipient of multilateral assistance in form of loans from World Bank or IMF (International Monetary Fund) – in the long term, however, Africa should strengthen the African Central Bank and African Investment Bank, both working under the aegis of AU.

However, it is the virgin environment, which is so critical for Africa to preserve, in the developmental process. Flora and Fauna is the mainstay of African economy, and it should only be consolidated. With signing of the Paris Accord for restriction on greenhouse gas emissions, availability of ample round-the-year sunshine in Sahara, regular cross-ocean windy domains, Africa would do better by setting up huge capacities in Solar, Wind and other renewable energies. Africa can even prove to be a leader in environmental preservation by adopting nature-sensitive methods for modern industry (under discussion since many decades), like Environmental Accounting and Auditing.

The most vital opportunity in front of Africa is to adopt Best-practices from developed nations and customised solutions from developing countries, wherein it can straight away jump to latest technologies, bypassing the defects of obsolete systems and processes – For example, it may adopt Euro VI vehicle emission norms, jump to 4G telecom networks, manufacture ioT (Internet of Things) white goods and even participate in early development and adoption of robots/ AI (Artificial Intelligence).

Another way could be to create capacities in manufacturing and services and then based on its strengths, enter into FTA’s (Free Trade Agreements) with regional trade blocs. This would solve the problem of high custom duties, which foster corruption and hinder creation of a consumerist society and globally-linked supply chains, so vital to create a manufacturing and services driven economy.

As a scene in the Hollywood blockbuster movie Blood Diamond showed – in a completely burnt and abandoned village, the last man standing amidst wanton destruction by Diamond mafia, innocently says to the protagonist – “Thank God they only found diamonds here, not Oil, else what would have happened”!

It doesn’t have to be this way – The opportunity for the cradle of civilisation lies in turning its vast environmental and human treasure into economic success, made a reality by the will of its leadership on back of strong and independent institutions working in a truly democratic framework. That would be the right learning from India and certainly make this an African century!

A Bubble We Chose to Ignore – Academics In India

I read an article that less than 8% of Indian engineers are employable in their respective fields.
I am not going to talk about that. I am going to counter the probable argument that would be placed that they are employable in IT/ITeS sectors.
During IT boom, organisations witnessed a massive resource crunch.This led to myriads of engineering colleges mushrooming every corner of the country. Those colleges assured the students a free pass to any IT/ITeS company. The governments allowed, if not encouraged, ‘Management Quota’ where one can pay to get a seat, if unable to meet the qualification criteria.
They preferred taking in students that couldn’t clear the entrance tests through the infamous management quota. Facing pressure from the parents, many students joined such colleges against their will and ability. Money started pouring in.
They expanded their business by opening arts, science, and business schools. But the employers are as strict as they were before. the interim ebbs in economies rubbed salt to the sore. Many students had to struggle to get a decent paying job to achieve break-even. This resulted in less preference to such colleges. Now, such colleges are under financial stress. As a norm, the first ax fell on the teachers’ pay. There are rumors that many are not paid for almost a year.
So, quality teachers are becoming rare. The vicious cycle is expanding. We have an academic bubble that had busted with a loud noise but we chose to ignore it.

An Open Letter to Aakar Patel

As per Aakar Patel’s article of 12th June instant in The Times of India, Hindutva parties (Read BJP) have only three agenda- Ram Temple at Ayodhya, Uniform Civil Code and withdrawal of Article 370 from J&K and all three agenda are negative. In fact he describes Hindutva itself as negative. Let us examine.

  1. Ram Temple- The one man jury of Aakar Patel says the land belongs to Muslims. Same thing was written by many ‘eminent’ historians though they failed toargue this in the Allahabad High Court. Some of them had not even visited Ayodhya, may be Patel has. He should have provided the evidences to the Court , if he did not, he can still make them public if he has any. In his words a court case for reclaiming your property by a Hindu is negative but not on the part of other religions.
  1. Universal Civil Code- This in enshrined in our Constitution. JL Nehru had promised to the Parliament that he will bring Muslims under such a law. This law will instantly bring justice and equality to millions of Muslim women. But it is negative because it is asked for by a Hindu Party. As per this logic most countries, including USA are having negative and religious agenda. And, countries having different laws for different religions exude positivity.
  2. Article 370 – Patel believes demand to bring the entire country under one constitution, too is negative. Though it is felt that removal of this article will ensure faster economic growth of J&K.

He also has mentions beef ban. This ban is in place since progressive, liberal and secular Nehru’s time. Now, when BJP is in power he suddenly finds it negative for the reasons best known to him.

Patel also wants Hindus to fix quotas for Dalits and Adivasis. Next, he may ask Hindus to be large hearted and allow Muslims and Christians job quota well above their proportions? His progressive mind thinks that only quotas can improve peoples’ lives. Though we know that even after more than half of a century of having quotas, we find that only a handful have benefited from them. Besides, why should Corporates compromise on talent to please Aakar Patel?  It is like the ideology of the leftists- to help a few keep a large number of people unemployed. No big business house will invest in India if such reservation laws are enacted.

Patel also wants Savarnas to marry in lower castes. But such marriages happen naturally and not to set examples. Marriage is not short-lived affair in India. Inter-caste and inter-religion marriages are on the rise already. Hope, he will personally set an example when a situation comes.

Next in the wish list is that Hindus should pay taxes honestly (others can be dishonest). But tax planning is legal and tax evasion is not religion or geography specific. Hope, he is not amongst those who get upset when foreign funded NGOs are asked to file their accounts, after all, most NGOs are being run by Hindus.

He also says Hindus are spending less on philanthropy these days without backing up the claim with any data. Whenever, there is a natural calamity, all- including Hindus come out to support generously.

Patel says Hindutva itself is negative without advancing any arguments in support of this claim. Perhaps, he is not aware of the glorious past of this ancient land nor does he know that people of different faiths were allowed to live here peacefully and even practice their religions.

Basically, this man’s only problem is that he does not want a government at the centre whose DNA is not anti- Hindu. Only he can answer why? His views are shared by many of our ‘liberal’ Hindus who only find faults with Hindutva and never have any issue with some other religion.

Whatever Patel’s views, he has cleared mine about him.

Top Jammu School Caught Publishing Fake CBSE Results For Admissions

If you belong to the state of Jammu & Kashmir, you would definitely know how famous the name “Heritage Public School” is. It is no doubt one of the top CBSE affiliated school of Jammu city.

Now what if I tell you that this famous school is publishing fake CBSE results of its 12th class students in leading local and national newspapers?

Here is a screenshot of the advertisement this school published in local newspaper named “Daily Excelsior” on 8th June 2016. Edition – Jammu & Delhi.

Now any normal person who would have read this advertisement would have gone on to believe such a good results being advertised and would have surely sought admission for its own ward this year or in near future.

But wait! This advertisement is fake, fabricated, misleading, illegal, unlawful and opposed to public policy. All this is done mere to attract more students and new admissions.

Let us check the result of few 12th class students from CBSE official site itself:

These were not just 2 examples but result of entire 12th class list published in newspaper is wrong. You can check the results of other students as well. I have provided the roll no’s below.

Upon contacting the school principal, Surprisingly there was a very rude behavior and “JO KARNA HAI KAR LO” attitude.

Further a very interesting claim was made by the school that all other schools in Jammu and rest of India also are doing this, so we too did it and so is legal.

Will ordinary citizens of our country be continued to feed up with fake advertisements? Will administration come up to take penal action against such high profile school / schools with political nexus?

The readers are free to corroborate the truth in this post but the fact of the matter is that many schools have been misleading innumerable number of desperate parents and students across India by projecting fake results.

The Great Indian Dream

It’s that time of the year when dreams of a few thousand are realized. And those of a few hundred thousand shattered. Declaration of results – from the Class XII boards to competitive exams like IIT-JEE and CPMT invariably throws up two types of stories in newspapers. First are the exhilarating success stories of toppers – images of garlanded youngsters being fed sweets by beaming parents. The second are heart rending tales of suicides by students who felt they didn’t ‘make the grade’.

An unusual twist in the first type this year was the bizarre story of toppers in Bihar who weren’t even properly aware of the subjects they were supposed to be studying and topping in.

All of the above, including the Bihar story, point to serious flaws. Not only in our education system, which is marred by a huge demand and supply problem. But the basic flaw in our thinking as a society and as parents, which exacerbates this problem of scarcity. Undoubtedly, a seat in a premium engineering college is a worthy goal to be coveted and strived for. And there’s nothing wrong with parents nurturing and enabling such aspirations of their children. Problems occur when aspirations become obsessions, to the extent that failure to obtain the desired results becomes equated with abject failure in life.

Thus we have a parallel education system in the form of coaching classes – cramming factories dedicated to the great IIT or Medical dream. The pressure cooker environment that hapless children exist in during those critical years is illustrated by this poignant prayer scribbled by a child on the walls of a temple in the ‘Coaching Centre’ town of Kota.

This is especially sad in today’s environment where liberalized economy and globalization has resulted in opportunities galore. Thirty years ago, job prospects available for my generation restricted our aspirations to a handful of conventional streams. And most of us from that generation probably still suffer from the hangover of those times, thus harbouring the same ambitions for our children. We don’t realize how much the world has changed for the better from our times. At least in terms of the wondrous opportunities available to our children. The chart below is an illustration, and this itself is by no means exhaustive.

There is therefore a need for adequate mechanisms for counselling parents and children at a suitably early stage, to expose them to the plethora of education and career options available. This needs to be coupled with ascertaining each child’s interests and aptitude, and charting out a viable path customized for him or her. Such mechanisms are already available in the higher ends schools in bigger cities, where ironically the parents and children already have a higher awareness level. There is an urgent need to take this awareness to parents and children in smaller towns and cities. Only then will we possibly be able to stop this mad rush for marks and seats in a handful of domains, and prevent young lives being sacrificed at the altar of parental ambitions limited by lack of knowledge.

Inaction of HRD on Core Issues : Reforms Need of the Hour

It has been 2 years since Narendra Modi took oath as the PM of India. Amongst many achievements of the government it has most importantly filled people of India with immense pride and installed a sense of confidence. And one of the key ministries of the government is HRD ministry as many in BJP-RSS see HRD ministry as a way to create a more right leaning ecosystem. But unfortunately the minister of HRD Smt. Smriti Irani has been in the media limelight more than any other minister of the government for the wrong reasons. From the issue for IIT veg-nonveg to agitation in Hyderabad University to the latest JNU controversy, Irani has been in the eye of the storm for a good part in last 2 years.

All that notwithstanding, how has the minister performed? As they say proof of the pudding is in the eating. Recently Anand Ranganathan published a very detailed article on the performance of the ministry and pointed out many areas where the ministry has not performed well.

But for many BJP core voters & well wishers, most important work for HRD ministry was to repeal the Right to Education Act 2009, which was brought in by UPA or to amend it. Another important point was to bring in a new Education policy which was stated to be put forward at the 2 year mark by the minister herself. 26th may 2016 came and went, still no sign of any new education policy.

One of the reasons why many want RTE to be done away with is that it is making it difficult for majority ( read Hindu’s) to run schools due to the provision of 25% reservation for EWS (Economically weak students). Not that we don’t want EWS to study but 25% quota is not a small number but without any economic support from government many schools are being closed due to this.

“One of the fundamental provisions of RTE is a minimum 25% quota for economically weaker section (EWS) students that all private schools run by the majority (Hindus) have to provide. In theory, the concerned State Governments are supposed to reimburse the private schools for these EWS students.”

This is one of the many short comings of RTE as highlighted in the article. There have been number of protests against RTE by various organisations running chain of schools across India. If this type of quota was to be done it should have been done for all schools and not just for schools run by certain community.

All said and done Irani as HRD minister has not been able to make sure that certain core issues be perused while on other hand, political parties like AAP are changing Education policies to suit their political ideology. They had in 2015 made a list of recommendations for many college boards under DU giving prominent positions to journalists who favor them. And when questioned those journalists are justifying this as correct due to ideological differences as they don’t want people from RSS to get prominent position in educational institutes.

Many supporters of BJP-RSS argue that we don’t have a ‘Right-Wing’ ecosystem. But unless certain core issues are followed up with same energy are other core issues are taken up by the government, this change will never happen. Many wrongs in the education sector need to be corrected. Many historical facts are to be highlighted including the pre & post independence struggle where prominence has been given to only certain few.

Smriti Irani by all means is an able leader but she can take a leaf from government of Rajasthan which is trying to amend certain regulations of RTE under CM Vasundhra Raje and hopefully we expect Irani to unveil new education policy in coming months. Raje has done many core reforms and is leading the charge on reforms when it comes to states as per this article. But on RTE many state governments have varied views, while the governments of Rajasthan and Gujarat are seeking amendment; the government of Maharashtra is hell bent to implement RTE in its current form.

Education is one of the key areas where the government needs to take charge and make concrete changes which can have long lasting benefits as we are one of the youngest countries in the world with large number of youth. With the right Education policy we will be able to create sustainable development for coming years as well as create a line of thought which isn’t socialist or regressive in nature as has been happening over the past so many years.

With UP election coming in 2017, we may have a cabinet reshuffle. If this is true, it’s about time Prime Minister Modi takes a call on non-performing ministers and gets a more ability oriented administration in place. We didn’t vote for a make-shift government on cultural and core issues but for a strong government which can peruse all those important issues thereby preventing mishaps like those in Kairana, UP.

भारतीय बुद्धिजीवियों की जड़ता (ओबसेशन) – प्रोफेसर कपिल कपूर जी के व्याख्यान का हिंदी अनुवाद

पहला भाग

आज हम भारतीय बुद्धिजीवियों की जड़ता (ओबसेशन) पर चर्चा करेंगे।

आज के युग में अगर कोई अखबार पढ़े (खासकर अंग्रेजी अखबार ) या टीवी चैनल्स की खबर सुने तो वो पायेगा कि हमारे बुद्धिजीवी हर समय हमारे जीवन, हमारे समाज, हमारी जीवन पद्दति में कमियां निकालते रहते हैं।

किसी भी समय हम इस देश के बारे में कुछ अच्छा नहीं सुनते। हम यही सुनते रहते हैं कि गरीबी बहुत है, जातिवाद बहुत है। जाति आधारित भेदभाव बहुत है। स्त्रियों के साथ बहुत धक्का (भेदभाव) होता है, बुरा बर्ताव होता है। कोई कानून व्यवस्था नहीं है। अभिव्यक्ति की स्वतंत्रता कम होती जा रही है। ना खाने की स्वतंत्रता है, ना बोलने की स्वतंत्रता है। जो कोई कुछ खाना चाहता है चाहे वो गौमांस हो या कुछ और, उसको खाने की आज़ादी होनी चाहिए।

कहने का अर्थ है कि आप भारतवर्ष के बारे में बुरी बातें सुनते रहते हैं। अगर आप ध्यानपूर्वक विश्लेषण करें, तो इस प्रकार की ज्यादातर आलोचना एक ही समाज की तरफ केन्द्रित है: हिन्दू समाज की तरफ। यह तथ्य हम सभी को ज्ञात है मगर हम इसे स्वीकारने को तैयार नहीं हैं। इस प्रकार की आलोचना मुख्यत: हिन्दू समाज की तरफ लक्षित (टार्गेटेड) है क्योंकि हिन्दुओं की आलोचना करना आसान है।

आप देखिये हमें बताया जाता है कि हिन्दू विचारधारा बहुवादी (pluralistic) है और बड़ी सहिष्णु है। अगर किसी भी हिन्दू को कोई बात बुरी लगे तो उसे बोला जाता है कि अरे तुम्हे गुस्सा नहीं होना चाहिए!! तुम तो बड़े सहिष्णु व्यक्ति हो!!

लेकिन समझने वाली बात है कि इस सहिष्णुता और बहुवाद का असल में कोई सम्मान नहीं है।

सन २००४ में पहली इंटर-फैथ (बहु-पंथ) कांफ्रेंस भारत में आयोजित हुई थी।  उस समय तमिलनाडू की मुख्यमंत्री, सुश्री जयललिता ने पंथ-परिवर्तन पर प्रतिबन्ध लगा दिया था।  तब उस बहु-पंथ कांफ्रेंस में ईसाई धर्म के एक बड़े बिशप ने कहा था कि “हम सभी पंथों का सम्मान करते हैं मगर हम किसी भी पंथ को मानने की स्वतंत्रता का भी सम्मान करते हैं।  इसलिए हम पंथ-परिवर्तन पर प्रतिबन्ध का विरोध करते हैं”। मैंने उनसे पूछा था कि महोदय अगर आप मेरे पंथ का सम्मान करते हैं तो आप मुझे पंथ परिवर्तन करने को क्यों कहते हैं? इस बात का उन्होंने कोई जवाब नहीं दिया।

तो आज का मेरा पहला मत यह है – हम हर दिन बुरे समाचार सुनते रहते हैं। यहाँ तक कि कुछ लोग इस स्थिति में पहुँच जाते हैं कि वे टीवी पर समाचार सुनना बंद कर देते हैं या अखबार पढना बंद कर देते हैं। मैं खुद कुछ समय पहले इस स्थिति पर पहुँच चुका हूँ। आप सुबह तरोताज़ा उठते हैं और तभी इस तरह की खबरें आपके सामने आती हैं – तीन बलात्कार, चार खून, घर वापसी, यह राजनीतिज्ञ ऐसा है, वो ऐसा है – ऐसी खबरें सुबह सुबह पढ़कर आदमी खुद ही गन्दा महसूस करने लगता है। इसलिए मेरी सभी युवा लोगों को सलाह है – और यह सलाह हमारे शास्त्रों से आती है – सुबह सुबह कोई सहस्रनाम पढ़ा करो, कोई चालीसा पढ़ा करो – क्योंकि जब आप अच्छे शब्द सुनते हो, अच्छे शब्द उच्चारित करते हो, तो इन शब्दों की कम्पन आपको आंदोलित करती है।

ओबसेशन क्या है? ओबसेशन है – बार बार एक ही विचार का आना और आपकी विचार प्रक्रिया में एक ही विचार का हावी होना। अब आते हैं कि भारतीय बुद्धिजीवियों का ओबसेशन क्या है? ऐसे कौन से विचार हैं जो उनकी विचार प्रक्रिया में हावी रहते हैं?

पिछले करीब २०-३० सालों से भारतीय बुद्धिजीवी, खासतौर पर शहरों में रहने वाले बुद्धिजीवी को अपनी ही संस्कृति की बुराई करने में बड़ा मज़ा आता है – “हम बड़े ख़राब हैं, हमारे यहाँ कुछ भी ठीक नहीं है, हम बड़े बैकवर्ड हैं”।

अंग्रेजी शब्द “इंटेलेक्चुअल” पश्चिम में एक सम्मानित शब्द है। इस शब्द का प्रयोग विचारवान व्यक्ति के लिए किया जाता है। यह उस व्यक्ति के लिए प्रयोग होता है जो अपनी स्मरण शक्ति और बुद्धि का प्रयोग कुछ नए विचार उत्पन्न करने के लिए अथवा तर्क करने के लिए प्रयोग करता है। “इन्टेलेक्ट” बुद्धि का वो हिस्सा है जहाँ जानकारियां इकटठी होती हैं और उन जानकारियों पर विचार कर, निर्णय लिया जाता है या किसी नतीजे पर पहुंचा जाता है।

हमारा शब्द क्या है?

बुद्धि के लिए हमारे शब्द बड़े अलग हैं और उनकी महत्ता अलग है।  इसलिए यह बड़ा आवश्यक है कि हम उन शब्दों को अन्य भाषाओँ में प्रयोग न करें जिनका समानार्थक शब्द अंग्रेजी या अन्य भाषाओँ में नहीं है। यह शब्द Non-Translatables हैं अर्थात हमारे कुछ शब्द ऐसे हैं जिनका अनुवाद नहीं हो सकता। जैसे आत्मा का अनुवाद soul किया जाता है मगर soul का वो अर्थ नहीं है जो आत्मा का है।

“इन्टेलेक्ट” के लिए हमारा शब्द है “बुद्धि”।  हमारे सिद्धांत में “बुद्धि” का तीसरा स्थान है (पश्चिम में इसका पहला स्थान है)।  हमारे सिद्धांत में प्रज्ञा के चार घटकों में बुद्धि का तीसरा स्थान है।

प्रज्ञा क्या है – जिसके द्वारा हम ज्ञान प्राप्त करते हैं। इसके चार घटक हैं:

  • इन्द्रियां:
    1. कर्मेंद्रियाँ (Senses of Action)
    2. ज्ञानेन्द्रियाँ (Senses of Acquiring Knowledge)
  • मन (Mind)
  • बुद्धि
  • चित्त

कई बार हमारी आँखें खुली हैं, पर हम नहीं देख पाते, या कोई कुछ बोल रहा है, पर हम नहीं सुन पाते। ऐसे में हम क्या कहते है? माफ़ करना, मैंने ध्यान नहीं दिया……माफ़ करना मैंने देखा नहीं।

ऐसा क्यों होता है? ऐसा इसलिए होता है क्योंकि हमारी इन्द्रियां काम नहीं करती जब तक उनके पीछे “मन” न हो।

मन का मुख्य कार्य है – फोकस करना, केन्द्रित करना।

बुद्धि का मुख्य कार्य है – निर्णय करना, आंकना

जैसे जब तक रेडियो को आप प्लग न करो, तब तक वो निर्जीव ही है।  जब आप रेडियो प्लग करते हैं, तब कम्पन की ध्वनि आती है जो अस्पष्ट होती है; आप उसका नॉब घुमाकर सेट करते हैं……एक ख़ास चैनल आ जाता है, वहां आप थोड़ी देर रुकते हैं, वहां कोई बेकार भाषण आ रहा है।  आप आगे बढ़ते हैं और फिर किसी चैनल पर आप रुक जाते हैं। आप क्यों रुके? आपको एक पुराना गाना अच्छा लगा। पहले आप नहीं रुके थे, अब आप रुक गए। यह निर्णय किसने लिया? यह निर्णय बुद्धि ने लिया।

अब आप कह रहे हो कि यह गाना अच्छा है।  क्यों अच्छा है? आपको अच्छा लगा। आपको क्यों अच्छा लगा? यह अनुभव आपको प्रज्ञा के किस स्तर पर हुआ?

यह अनुभव बुद्धि के स्तर पर नहीं होता है। यह अनुभव एक अलग स्तर पर होता है।

आपकी इन्द्रियों, मन और बुद्धि से होते हुए पिछले कई अनुभव, बूँद बूँद कर के आपके चित्त (conscience) के भाग बनते हैं। जिस तरह का अनुभव आपके चित्त में जाता है, उसी से आपके व्यक्तित्व का निर्माण होता है।

कुछ मनुष्य दयालू होते हैं, कुछ क्रूर होते हैं, कुछ मस्त मौला होते हैं, कुछ दुखी रहते हैं। इसलिए कई समाज इस बात पर बल देते हैं कि आपका अनुभव विवेक और बुद्धि से छनकर आना चाहिए। छोटे बच्चों को कुछ अनुभवों से दूर रहना चाहिए, और उन्हें कुछ अनुभवों को हासिल करना चाहिए। जैसे हमारे समाज में छोटे बच्चों को श्मशान घाट नहीं ले जाया जाता। उन्हें वो अनुभव नहीं दिलाना चाहिए।

अब ज़रा बुद्धिजीवी शब्द पर आते हैं। जहाँ पश्चिम में “intellectual” एक सम्मानसूचक शब्द है, हमारी संस्कृति में “बुद्धिजीवी” एक अपमानजनक शब्द बन गया है। हमारे यहाँ बुद्धिजीवी का अर्थ है: जो बुद्धि बेचकर जीविका कमाता है। जहाँ भी उसे पैसा मिल जाये, जहाँ भी कुछ सुविधा मिल जाये, उसी के अनुसार बात करता है। काफी समय तक भारतीय बुद्धिजीवी के लिए सबसे बढ़िया फायदे का सौदा था- अमेरिका जाने का टिकट। इसके अलावा किसी समिति की सदस्यता भी दूसरा बड़ा फायदे का सौदा था – कभी शिमला में मीटिंग, कभी ऊटी में, कभी कहीं और। उनका स्वाभाव तंजौर की गुड़िया जैसा है। तंजौर की गुड़िया – जो गोल पैंदे की गुड़िया होती है; जैसी हवा चलती है, वो गुड़िया उसी तरफ झुक जाती है; उसी तरह हमारा बुद्धिजीवी भी हवा के साथ अपना रुख बदल लेता है।

हमारी व्यवस्था में intellectual के समान प्रयोग होने वाले शब्द थे: ऋषि, मनीषी, पंडित या विद्वान मगर intellectual शब्द के सबसे करीब आता है शब्द – ऋषि। ऋषि त्याग का जीवन व्यतीत करते थे। वे भौतिक सम्पदा के पीछे नहीं रहते थे, और इस कारण वे इस जगत से अलग थे। वे सन्यासी थे और इसलिए भारतवर्ष में हमारे जो सभी विचारक या महापुरुष हुए हैं वे सभी सन्यासी ही थे। उदाहरण के लिए, माधवाचार्य (१३ वी शताब्दी) जो दर्शन शास्त्र के एक अनोखे विद्वान थे और दर्शन शास्त्र के एक महान ग्रन्थ, “सर्वदर्शन संग्रह” के रचयिता भी थे।  बहुत छोटी आयु में उन्होंने अपनी माँ से कहाँ था कि “मुझे विभिन्न विचारों के अध्ययन में बड़ी रूचि है। मैं अपने जीवन को ज्ञान प्राप्ति में समर्पित करना चाहता हूँ। क्या आप जानते हैं उनकी माँ ने क्या कहा? उनकी माँ ने कहा “तुम्हे संन्यास लेना पड़ेगा”।

इसी तरह आदि शंकराचार्य ने ५ साल की आयु में सभी वेद ग्रंथों का अध्ययन कर लिया था।  उन्होंने अपनी माँ से कहा कि मुझे भी सन्यास ग्रहण करने की अनुमति दें। कहने का अर्थ हैं कि सन्यासी का एक ही ध्यय होता है – ज्ञानार्जन।

आज भी कुछ वास्तविक सन्यासी हैं। आपको तीन ऐसे लोग मिलेंगे जिनके विचार आपको सुनने चाहिए – एक हैं मोरारी बापू – उनको आप ध्यान से सुनिए। वे एक महान विचारक हैं। जिस तरह से वे रोज़मर्रा की घटनाओं को एक दृष्टिकोण देते हैं, वह आपको एक नया परिप्रेक्ष्य देगा। दूसरे हैं स्वामी अवधेशानन्द – जो जूना अखाडा के महामंडलेश्वर हैं। सातवीं शताब्दी में आदि शंकराचार्य ने १० अखाड़े स्थापित किये थे। ये अखाड़े विभिन्न साधुओं के समूह हैं जिनके कुछ साझा सिद्धांत हैं। ये साधू नग्न रहते हैं – इन्हें नागा साधू भी कहते हैं। ये साधू हिमालय में रहते हैं और सिर्फ कुम्भ या ऐसे किसी मुख्य अवसर पर समतल देश में आते हैं। ये साधू ज्ञानार्जन, ध्यान, योग साधना में पूरी तरह संलग्न रहते हैं। वे अपने शरीर को अनेक चरम अवस्थाओं को सहन करने के लिए तैयार करते हैं।

तीसरे हैं महाप्रज्ञ जी – जैन मुनि। उन्होने अपना शरीर छोड़ दिया है, मगर उनके विचार ज़रूर सुने।

एक बात और – एक सन्यासी किसी भी जगह दो दिन से अधिक नहीं रुकता। ऐसा इसलिए है, कि अगर आप किसी जगह ज्यादा रुकेंगे तो उसे आप साफ़ करने लगेंगे, फिर वहां आप बैठने की व्यवस्था करेंगे और एक तरह से गृहस्थ जीवन का आरम्भ हो जायेगा। इसलिए सन्यासी सदैव चलते रहते हैं, किसी स्थान पर ज्यादा दिन नहीं रुकते। इसे परिव्राजक परम्परा कहा जाता है।

ये सन्यासी प्राकृत भाषा के विशेषज्ञ होते हैं। प्राकृत ऐसी भाषाओँ को कहते हैं, जिन्हें विभिन्न भाषाओँ के लोग समझ लेते हैं। करीब २० अलग अलग भाषाओँ के लोग जिस एक भाषा को समझ पाएंगे उसे प्राकृत कहते हैं।

दुख की बात यह है कि ऐसे कई सन्यासियों के बारे में बहुत कम लोगों को पता है। आदि शंकराचार्य का नाम कम ही लोगों ने सुना है, एक और महान सन्यासी थे – रामानुजाचार्य, उनका नाम तो और कम लोगों ले सुना होगा, और हेमचंद्राचार्य – तो मुश्किल से किसी ने यह नाम सुना होगा। गुरु गोरखनाथ का नाम भी कुछ लोगों ने सुना होगा – उन्होंने नाथ सम्प्रदाय स्थापित किया था। कणफटा योगी – ऐसे योगी आपको नाथ सम्प्रदाय में मिलेंगे। गुरु नानक, गुरु गोबिंद सिंह और गुरु अर्जुन देव – इनके भी नाम स्मरणीय हैं।

यह सभी ऋषि, सन्यासी, गुरु आदि ज्ञानार्जन की परंपरा को आगे बढाने वाले हैं। यह सभी लोग महान विचारक थे एवं ज्ञान की ख़ोज में थे। यह लोग सही अर्थों में “इंटेलेक्चुअल”  (intellectual) हैं। पतंजलि की शब्दावली का प्रयोग करें तो यह लोग “शिष्ट” थे। शिष्ट अर्थात सुसंस्कृत व्यक्ति (Cultured person)।

हमारी संस्कृति में शिष्ट किसको कहा गया था? ऐसा व्यक्ति जिसकी कुल भौतिक सम्पदा केवल एक छोटे मटके में रखा अनाज हो। शिष्ट अर्थात ऐसा व्यक्ति जो बिना किसी पूर्वाग्रह, किसी लालच या मंतव्य के, अपने आप को ज्ञानार्जन में खपा दे, और किसी भी एक क्षेत्र में उत्कृष्टता हासिल करे।

आज के युग में ऐसा कोई व्यक्ति मूर्ख माना जायेगा। आज “शिष्ट” कौन है? जिसकी भौतिक सम्पदा अपार हो।

आज जब हम “इंटेलेक्चुअल” शब्द का प्रयोग करते हैं तो हम मोरारी बापू या स्वामी अवधेशानंद की बात नहीं कर रहे होते। आज इस शब्द का प्रयोग उन लोगों के लिए होता है जो अखबार में लेख लिखते हैं, टीवी पर आते हैं, और जो खुद ही मान लेते हैं कि वे इस समाज के बौद्धिक लीडर और वे ही इस समाज को एक नया प्रारूप दे रहे हैं।

अब ज़रा आते हैं “बुद्धिजीवी” शब्द पर – इस शब्द से किन लोगों को संबोधित किया जाता है?

नई परिभाषा के अनुसार बुद्धिजीवी ऐसे लोग हैं जिनकी पढाई लिखी अंग्रेजी माध्यम में एवं अंग्रेजी शिक्षातंत्र में हुई है। इस अंग्रेजी शिक्षातंत्र के उत्पाद ऐसे लोग हैं – जिन्हें (अगर हमारा बहुत सौभाग्य हो तो) हमारी संस्कृति से कोई सरोकार नहीं, उसका कोई ज्ञान नहीं। ऐसे लोग जिनमे (अगर हमारा बहुत दुर्भाग्य हो तो) हमारी संस्कृति के प्रति घृणा और तिरस्कार का भाव हो।
