Fearing drop in supply of fake news as fact checking site ties up with media groups

Fact checking website OpIndia has decided to tie up with various media outlets for its regular supply of fake news. News network AntiTV, online news portal Voyeur, left leaning Crawl.in, Squint and some other media groups have inked a deal with OpIndia to provide the site its staple diet.

Among these outlets AntiTV had the first-mover advantage but rest have made a mark for themselves in fake news vertical in a very short space of time. Opindia CEO Rolls Royce Singh said that though these groups were already providing material for daily production, both sides have decided to formalize this arrangement. The development completes a full circle as the media outlets who were earlier accusing Opindia of riding piggyback on their lies to attract traffic are now looking to benefit from Opindia’s ability to attract more eyeballs than MSM.

However, insiders tell a different story. They say that media groups had threatened to halt production of fake news, sending shivers down OPIndia’s editorial team as they had grown complacent regarding regular traffic of lies by media groups. A senior editor in the fact checking site told Faking News on conditions of anonymity that this agreement is fallout of this fear of the editorial staff of OPIndia.

6 questions to Arvind Kejriwal on AAP MLAs being disqualified for holding Office of Profit

My intention is to use the philosophy of KISS – Keep it simple and short.

AAP had won too many seats (67 out of 70) and most were new comers or jumping ships from other parties. Keeping this strange group together (without any long term party loyalty) and keeping them on tight lease was always going to be a tough game.

Thus after winning in Feb 2015, one of the first decision the party took to keep its MLAs happy – to appoint them as Parliament Secretaries. The chosen ones were allowed to have almost ministerial powers, office, car services on job, etc. Everyone knew that appointment was illegal and will not last a legal test of any kind. However the larger feeling may have been of arrogance to ‘see when it comes’ and whether at all it comes to legal issues/court case. The power of 67 MLAs is too much to bear for some and in case of a new party, probably it was a tad too much to handle.

The issue came to light and one fine gentleman and lawyer Mr. Prashant (AAP has issues with this name- another being lawyer Prashant Bhushan) went to President of India to complain. Mr President sent the matter to the Election Commission for review and notices were issued to MLAs by the EC. AAP did not bother too much about the EC and went to court. Delhi High court hit a six on the yorker ball from AAP and all appointments were declared Null and Void ab initio.

This was a tight rope walk, and AAP started to feel the heat on the subject. All concentration and propaganda now changed from the initial claims of public service and started to focus on delaying tactics for EC to somehow pass the 5 years. It actually kind of worked as EC took about 2 years to decide on the issue but finally the MLAs are disqualified. Now AAP is crying foul.

Let us look at their reactions:

1. EC is Modified – the statement is laughable and rules have been followed; they were free to approach court and court also pronounced this to be legal.

2. President is Modified – No comments on such low level remarks. (Mr President – we apologize to you for such low level cheap politics and spoiling/involving the name of the President of India)

3. Other states also appointed such ranks – Parliament, state assemblies and Union Territories have the right to review the purview of office of profit and can make laws that will bring some ranks out of this purview. This route has been taken by many state assemblies and such appointments were made. However as the interpretation is subjected to legal review, most of these appointments have been cancelled by the courts. In other states, the appointments were made after the law was cleared in assembly, the membership of the MLAs remained intact and this is as per the prevalent laws.

4. AAP also tried to make such rule/law basis retrospectively in June 2015 – this law was cancelled by the President and this can be a matter of debate on constitutional levels whether this was right or wrong. President order is final and members remain disqualified and they can cry victimhood all they want

Hope I have cleared some of the issues for public domain. Now the public questions to be answered by AAP if they happen to come across this article:

Q1 – Why it was required for these MLAs to be given any appointment? Could they not have done the same job as MLAs?

Q2 – AAP party policy and illegal appointment has cost these seats to these MLAs. What will be the moral equivalence from the party top leadership to these MLAs who apparently have not been caught with any mal-intent but lost their seats ONLY due to following party order.

Q3 – As the so called appointment was to ensure better public service (there must have been a vision document for such planning), how it was fulfilled when the High court had cancelled the appointment? Does AAP confirm that such jobs have been left unattended? If they have been otherwise fulfilled and completed, pls use loop options and ask Q1 again.

Q4 – They are free to explore all legal options and go to public with their complaints. However in case of the elections for these seats – will they confirm to use the same candidates for the re-election? This is morally binding on them. Only this will clear their intentions once and for all.

Q5 – Will they acknowledge if the majority of the seats are lost in the new elections, that their policies are being rejected by the public at large?

Q6 – Will Mr Kejriwal resign owing to the moral responsibility of losing these seats (in case of elections and losing these seats)? He has a right to continue as the Chief Minister but then should stop lecturing on being different than other political parties.

There can be many questions but I am sure answers to above 6 should be enough to clarify the intentions of the AAP for the public.

What I intend to highlight is AAP has probably done more damage to Indian politics than other parties as AAP came as breath of fresh air with fresh ideas and morals but faded to same old Indian politics and its compulsion to remain in power

Why have ‘liberals’ reduced themselves to being anti-nationals?

“Pakistan did not kill my father, war killed him”… remember this forgettable quote by a young ‘liberal’ from Delhi? Well it so happens that her mentor went a step further and tweeted this:

Even though it was appalling, still it made me think twice about the definition of the word “liberal” which I was taught during school days. Does being a liberal means you need to continuously poke your own country, its culture, its organizations? Calling spade a spade is justified but denouncing your own army and indirectly calling it a loser. Is this a new mantra we need to learn to be classified as a “liberal”?

With these disturbing thoughts, I searched for the meaning of this world and to my surprise it was same as what i was taught as a kid:

“open to new behavior or opinions and willing to discard traditional values.”

Dictionary says you need to discard traditional values but unfortunately many of our front runners in the Indian leftist version of liberalism have replaced “traditional values” with “nationalistic values”. Whatever is national, whatever invokes nationalism, discard it and that’s how you join the left-liberal gang.

Way back in April 2016, a directive from HRD ministry was sent out to all educational institutions instructing them to host tri-colour as a mark of respect to the national flag. Panelists on various new channels debated against this directive and some even went on to the extent of saying that this will provoke nationalistic extremism.

The totally heart wrenching moment was when during one such heated debate Major General G.D. Bkashi broke down into tears. Leftist liberals must have celebrated that moment as a victory of their version of liberalism over nationalism, but the fact remains that, the moment an army veteran broke down to tears due to a debate over tri-color, we as a society should have pondered over the most pitiful political discourse which our country was heading into.

End of the day its us, the ordinary citizens who are to be blamed for promoting such a narrative. Why on earth should nationalism be even a agenda driven by political parties during an election? Why must we, the voters, let political parties tell us what nationalism is? And above all, why must a right-winger’s nationalism be different from the liberal’s nationalism, especially in a country where the problems at the grass root level are still prominent?

Nationalism being dragged into the mainstream political discourse is simply due to the inability of the ruling party to defend themselves on the count of solutions they have offered for tackling social and economic issues. On the other hand, opposition has nothing to offer when it comes to social issues.

Quite evidently they don’t have much of a leverage in tackling these issues given their track record of past 70 years, so obviously they don’t want to go deep into any constructive discussion around the prominent problems of our society. They are simply afraid of the rhetoric they may have to face if they ever touch these sensitive topics. So for the sake of opposition they simply oppose whatever is thrown at them by the ruling party which in this case is Nationalism.

Everyday a new term is being coined by liberals, the most absurd one being “Hyper Nationalism” which it seems, has been picked up from an English grammar example of a superlative adjective. I’m pretty sure that there is a term “Moderate Nationalism” as well to fill up for comparative adjective and the famous example of “Moderate Nationalism” for Liberals I am sure is “bharat tere tukde honge inshaallah…inshaallah”.

Institutional weakness in Indian foreign policy establishment

Recently, two small but important news brought my attention to Indian foreign policy making institution and their framework of working. First was, covert meeting of India’s top official- NSA with his Pakistani counterpart. This news got leaked in media later. The other news got my attention was low count of IFS officers; total strength of IFS cadre (as on 19th November, 2017) is 941; whereas China has close to 4000 and the United States has 20,000 working officials and diplomats.

The foreign policy has got major attention since the Modi regime took over in Delhi. And India has witnessed successes on various fronts from bilateral to multilateral; but still over-reliance on older template of foreign policy making, lack of innovative thinking and elitist mentality have limited the impact of policy changes taken by the government.

While the foreign policy experts In India have remain engaged in debate over the Government stand on critical diplomatic issue. There is very less discussion about the existing weaknesses in policy making establishments and how it has been one of the reasons for India punching below its weight in post cold war era.

First institutional fallacy is, recruitment of IFS cadre. One exam for IAS, IPS, IFS and many more CLASS A services. The problem with this mode of recruitment is still counting diplomacy as generalized officer job. And still very less indication that, it will change in near future. Only debate on lateral entry erupts from time to time; with no concrete approach.

And also at the time when India aspiring for greater role at global stage, the less number of officers limit the choice of India to engage with world at multiple levels at one time. The other point, I have come across the leathery of our MEA officials at diplomatic missions as told by many friends, the apathy of officials towards their own fellow-citizens shows only their elitist bureaucratic mentality.

Secondly, think-tanks in India has become the armchair for retired officials with very fewer opportunities for the younger generation. Experience should be respected but not at cost of innovative and fresh perspectives which younger lot brings to the table. Neither they have any cooperation with academia, media except lobbying for their corporate group.

Third issue is, while cooperative federalism has become the buzzword; it reflects very less in foreign policy formulation. And state only plays their role to show their antagonistic stand. As we have seen how West Bengal government has become roadblock in India’s relationship with Bangladesh over Teesta river.

The fourth issue is, lack of expertise. We as a nation still believe in generalized officers. An ambassador to Nepal can be sent to negotiate WTO issues to Geneva in no time. Similarly, not emphasizing on role of language is also limiting our approach to engage and understand the diplomatic culture of various other nations.

Similarly, in the era when economic interdependence has become the true pillar of international relations, and Geo-economy is getting prominence over Geo-politics; less coordination between India’s private sector and government is hampering our prospects world over and have led to delivery-deficit on various projects, Indian commit with other nations.

Finally, the lack of coherence between foreign Ministry and Media.The recent example is covert meeting of NSA’s of India and Pakistan in Bangkok ;which later leaked in Indian media. while government needs to be more open to media unlike era of cold war; Media should also leave its habit to sensationalize news and propaganda news by covering only few countries and complicating the government’s stance on delicate issues of diplomacy and restrict its sphere to maneuver.

Our diplomacy in recent times has proved its metal again on critical issues like Doklam and winning ICJ seat in United Nations. But it is also necessary to not lose clout in our periphery at the same time and only treat neighbours as strategic backyards. World’s fastest growing economy and aspiring global power needs to have strong institutional framework which can support India’s current “multi-alignment” foreign policy.

Understanding Narendra Modi’s media strategy for 2019 Lok Sabha elections

Many media persons, especially group of 5-star journalists like Rajdeep Sardesai, Barkha Dutt, Shekhar Gupta, Punyaprasun Bajpai, Nidhi Razdaan etc. have been critical of Prime Minister Narendra Modi about ‘lack of access’. They say that Modi chooses to keep media away from him and he don’t like to be questioned on government policies like Demonetisation, GST, or speak on intolerance issue.

We shouldn’t forget that media is the 4th pillar of democracy. During the era of previous Congress governments, some media enjoyed the access to government officials or Ministers but they deliberately ignored to question the government. Now their approach has changed.

I think it is fair on part of media to expect access to government to question them on serious issues of the country. But Narendra Modi is not known to play by others’ rules. However, in last few days, we have seen that Prime Minister Modi appeared for Interviews on ‘Zee News’ first and then ‘Times Now’.

So what made him give gave back to back 2 media interviews within a couple of days? Why he decided to come forward and speak-up? Isn’t it something strange? Yes, it is.

There is complete tectonic shift in NaMo Strategy to encounter challenges he is expecting to pop up during 8 state assembly elections in 2018 and subsequently 2019 General Election. There will be no disagreement that the way Modi had used Social Media for 2014 election campaign nobody ever did. Because back then he did not expect much from the mainstream media.

The certain sections of mainstream media had put their all energy and resources to demonize Narendra Modi, the then Chief Minster of Gujrat for 2002 Gujarat riots. Then congress government used all of its channels in media to create the image of “Narendra Modi” as “Anti-Muslim”, “Mass Killer”, “Demons” in the minds of Muslims.

In 2004 generals elections, Congress emerged as largest party with 145 seats against 114 seats in 1999 general elections. BJP got 138 seats (only 7 less than congress) with a loss of 44 seats against 182 seats in 1999 general elections. If we observe closely, Congress had won 31 seats out of 44 seats lost by BJP.

Due to demonization of Narendra Modi for 2002 Gujarat riots, Congress benefited hugely and they returned to power in 2004. Nobody can deny that media had a big and vicious role in this mass propaganda. Although BJP was only 7 seats less than Congress, it couldn’t managed to get alliance partners.

Obviously, almost all the Indian political parties are angels of “secularism” and they didn’t want a “blot” on their image, so they find better to alliance with congress under UPA umbrella. During 2004-2014 Congress governments, many journalists and media group got huge rewards for their loyalties. Then, media lobby started getting stronger enough to play big role of Power-Brokers or negotiators in 2G spectrum case (as per Nira Radia tapes).

The previous governments were used to take media journalists on official foreign visits to different countries and their all the expenses were taken care by the government. Of course, then journalists would have much enjoyed it. Who wouldn’t like to visit different different countries free of charge?

Since Narendra Modi sworn in as Prime Minister on 26th May 2014, he stopped taking media delegation on official foreign visits. I’m sure many journalists have wouldn’t have liked it and found it step-motherly treatment by the Modi government. Many media group may have approached him for interviews but he didn’t entertained them. The only interview he had given was to Times Now’s Arnab Goswami in 2015. After that no interview for 3 years. So, why did he appear for 2 interview back to back within interval of couple of days?

Because, Narendra Modi decided to play on front-foot for upcoming elections. As per poll analysts, in first phase of Gujarat poll, Congress was ahead of BJP but when Narendra Modi started campaign. In second phase with 38 rallies, BJP came back to the track. In Gujarat elections, Congress also benefited by playing caste politics.

If we observe, Narendra Modi wasn’t happy after Gujarat victory while addressing BJP karyakartas at BJP Delhi HQ. He clearly mentioned that the some unsocial elements had tried to bring poison of casteism back to Gujarat and that these elements will continue to do so. The way he had closed his address with slogan of “Jitega bhai jitega Vikas hi jitega” energetically, it was clear that he won’t bow down to Congress’s dirty politics.

Rahul Gandhi has given full support to Gujarat MLA Jignesh Mewani to instigate ‘Dalits’ against BJP government and paint Narendra Modi as “Anti-Dalit”. The trailer of the same we have seen during violent protest in Pune & Mumbai during “Bheema-Koregaon” incidence. Then, “Yuva Hunkar Rally” by Jignesh Mewani in Delhi, but fortunately it got flopped.

Very recently, you might have heard about “different plate” controversy for vegetarians & non-vegetarians at IIT Bombay hostel. The media tried to use prestigious “IIT” institution to score a goal (to create tensions between vegetarians and non-vegetarians, and then dalits-upper castes) but couldn’t succeed. Have you ever thought why Gujarat MLA who won recently, is roaming all over India? Who is funding him? Republic TV has exposed that congress was arranging for Jignesh Mewani’s conferences and his visits. Why he is visiting important educational institutes of India instead if working for his own constituency? He is doing so, because his masters have instructed to do so.

In 2018, there are 8 state elections with 4 big states i.e. Karnataka, Rajasthan, Madhya Pradesh and Chattisgarh. 4 out of this 3 states are ruled by BJP. Now, if we closely analyse, 282 seats won by BJP in 2014 general elections, 204 seats were from Maharashtra, Uttar Pradesh, Rajasthan, Madhya Pradesh, Gujarat, Chattisgarh and Bihar. Out of these 7 states, 3 are ready for assembly poll in next few months and then Maharashtra in 2019. It is very much important for BJP to secure their old forts i.e. Rajasthan, Madhya Pradesh and Chhattisgarh if they want to enter 2019 battlefield confidently. If BJP loses any of these states, Congress and its affiliated media will leave no stone unturned to project it as “descending Modi popularity” or end of Modi wave.

Narendra Modi has sensed that he will have to play the same role as M. S. Dhoni played in 2011 Cricket World Cup final to make India win. He understands that he can’t just rely on spokesperson, karyakartas and netas. He will have to come forward now and counter the fake news spread by some media channels against his governments and fake numbers of unemployment projected by Rahul Gandhi. Many of the scheme started by Modi government is not possible to finish in 5 years and they need at least 10-15 years. Modi very well knows that if Congress returns to centre, very first job they will do is of scrapping of development initiatives stated by him, like they had done in 2004.

But, it will be interesting to see how Narendra Modi uses media platforms to counters fake propaganda against his government. Anyway, he had promised to give his report card of 5 years governance during 2014 campaign. And, Modi has started giving his report card.

EC Disqualifies 20 MLAs Of AAP For Holding Office Of Profit. Time For Kejriwal To Introspect

The Election Commission has disqualified 20 MLAs of AAP  for holding an office of profit. This has raised serious questions over the fate of 20 AAP MLAs as these MLAs were appointed to the post of parliamentary secretaries. It seems these 20 MLAs of AAP have put not just  the political future of AAP but also the political career of Kejriwal as well on the stake. According to a report by Ex CJI Venkatchaliya in 2003, the number of ministers in states was fixed to not more than 15%. But because of some special provisions for Delhi, this number was fixed to 10 %. It means only 7 ministers can be appointed in Delhi including Chief Minister.

AAP won 67 seats out of 70 seats in Feb 2015. And they made a government with 6 ministers. But after some time Morality, ethics and values have been overpowered with greed and ambition of newly elected team of MLAs. Because of tremendous pressure from his MLAs, Kejriwal appointed 21 out of them as parliamentary secretaries and gave them same power as ministers. And remaining MLAs were made happy by a 4 times hike in their salary. AAP has lost all its core foundation values within a span of 1 year.

Let me be clear, Parliamentary secretary is not even a word mentioned in any of the assembly laws for Delhi, that’s why there is no provision regarding their salary, benefits, and facilities. But they all were given government offices, government cars, ACs, Laptops, Mobile phones, and many more facilities. On asking, these 20 MLAs straightaway refused that they haven’t been given any direct monetary benefits.

Before this incident, EX CM of Delhi Sahib Singh Verma had 1 and Sheila Dikshit had 3 parliamentary secretaries but Kejriwal appointed 7 times more. That’s Kejriwal for you. He has emerged as a superhero in political corruption. He even increased the marketing budget by 16 times from 33 crores to 526 crores.

More precisely It was in 1915 when the first case of Office of Profit came into the picture. In 2001 Sibu Soren was disqualified from the upper house because he was heading Swayat Parishad of Jharkhand at the same time. Jaya Bachchan was disqualified because of office of profit in UP. Anil Ambani was disqualified earlier as well. To keep the power in her hands Sonia Gandhi was heading NAC in 2004 but because of a complaint in 2006 she had to resign from this post and she was disqualified from Loksabha too. She fought another election same year. Immediate after this incident 55 posts were kept outside of the office of profit provision. According to the article 104 of India constitution, there is a provision of punishment and heavy fine in such cases but that doesn’t seem possible in India.

Most of the sports bodies are being headed by ministers and that is a total waste of our money.

Kejriwal will still have the majority even after the disqualification of 20 MLAs but what about his claims of being the most honest Politician in India? Let see if Kejriwal want to go to court or he want to fight this in front of people during re-elections.

Though India and Pakistan were born at midnight almost like twins, India has endured as an elegant example of a country that upholds the principles of democracy, Justice and secular values. On the other side, our twin brother Pakistan has sucked himself into a country of religious bigotry, Junta rule, terror and mayhem causing misery to his own people and to India as well. However, an unprecedented event took place in the post-Independent Indian History.

This respectable status of Indian justice system was demolished by its own Jury overnight. The presser that was convened by the quartet of Judges lead by Justice Chelameswar on 12th January 2017 has stained the face of Bharat Mata like an Ink-attack, and shocked its intellectual citizenry into disbelief.

Hon’ble Justice Jasti Chelameswar, no doubt had acted in haste in mobilizing his 3 other senior brothers and came out openly in his residence lawns, sitting pretty, briefing the press live on Indian TV Channels. Justice Chelameswar’s main allegation against the Chief Justice had been ‘the allocation of some sensitive cases to Juinor Judges.’ During the presser itself, they hinted that one such sensitive case in question was the ‘the Justice Loya case’. From this, it is amply clear that an anti-Modi faction tactically lured the Judges and drew them out in public to refer the “Judge Loya” case.

Justice Chelameswar lead quartet had committed a grave impropriety by questioning the CJ’s roster of cases in the Supreme Court. He did cast aspersions on his brother Judges and victimised them publicly without any evidence or past history of indictments against any Judges. The allegation against the CJ lacked rationale and showed pure hypocrisy.

“What is sauce for the goose must be the sauce for the gander as well” is it not true?

When the rebel Judges quartet started to claim that the Chief Justice is also a Judge but only ‘the first among the equals’ then the same parallel will equally apply to the rebel Judges as well. The four Judges were senior most Judges, but then only a step senior to the rest of 21 Judges. And they have further exposed themselves to the embarrassing hypocrisy. Their act implies that the 4 Judges appeared to be questioning the integrity of the rest of 21 Judges of the Supreme Court. This is like doubting the umpire’s ability even before he raises his finger declaring the batsman out.

This allegation of the 4 Judges has equally created another tricky assumption, that is, ONLY the 4 Judges are honest and in a manner placed themselves very high implying that they are the ONLY honest and highly truthful Judges when compared to the rest of the 21 Judges of the SC.

So, the presser has turned out to be a pure subterfuge act.

“Honesty is a belief and cannot be proved, while ‘corruption’ has to be proved with all possible evidence.”

But the 4 Judges have declared that they are above the rest of 21 Judges, including the CJ, and their plan or integrity cannot be questioned, as they are above scrutiny.

The next plot, that the nation had to witness in utter disbelief was the CPI head, Mr D Raja entering the residence of Justice Chelameswar, that too hiding and entering from the back door, immediately after the presser. By this act, the seniormost Supreme Court Judges have sent a clear message to the nation that the “Urban Naxalite Intelligencia” is directing the Judicial process and they want the outcome of some of the sensitive cases in their own liking.

The Urban Naxal coterie has been the mouthpiece of the “insurgent Naxal groups”, that are waging an armed war against the nation. This coterie was active ever since Sri Narendra Modi took charge of the nation in 2014. So, Justice Chelameswar’s timid excuse of Democracy in danger’ for his open presser, was ridiculous and the nation has realised that the 4 rebel Judges are in fact have set a dangerous ‘precedence’ for the future collapse of our Democracy and Secular values.

It’s clear now, that the conspirators behind the presser were the villains of Mr Modi, BJP, Right Wing groups and the enemies of our nation, to say precisely. Their aim was to give nationwide publicity to the Justice Loya case. Hitherto it was being discussed in a limited area of Social Media with one story having published in the Caravan Magazine.

Within a couple of days after the presser, the Supreme Court Bar Council declared “truce”. However, it was an “uncanny truce”. If such a trues was possible, then the learned Judges ought to have not come out in open but would have tried their best to resolve it by exhausting all possible avenues, within the precincts of the Supreme Court complex.

Justice Arun  Mishra went emotional with tears rolling down. Finally, on 16th January, the bench hearing the Justice Loya case pleaded the CJ to post the case before another ‘appropriate bench’. This is what the Leftist lobby wanted and this is exactly what they got in return. They succeeded in the emotional blackmail of the Supreme Court Judges, the highest justice platform in India.

It appears that there was a tactical understanding between the Advocate Dushyant Dave and our Naxalite advocate Sri Prashant Bhushan. If we go through the conversation between Tehseen and the anchors of Times Now,  we can hearTehseen clearly confessing to the fact that Advocate Dushyant Dave dubbing Justice Arun Mishra as a ‘henchman’ of Chief Justice Dipak Misra.

During the presser held on 12th January 2018, the quartet of Judges confirmed the fact that ‘they wrote a letter to the Chief Justice of India’ seeking redressal of certain anomalies to be rectified in allotment of cases in the Supreme Court’. They confirmed that the said letter was written a couple of months back. So obviously in the said letter, there was no mention of any PIL (Writ Petition Civil) on the issue of Justice Loya’s death’ as filed by the Congressman Mr Tehseen Poonawala and the other.

If we look back of the chronology of events at this stage, the whole picture will be clear.

The special CBI court Judge BH Loya died on 1st December 2014 due to cardiac attack, in Nagpur. Until November 2017, (nearly after 4 years) I did not come across any investigative reports raising doubt on his death from any quarters, till the Caravan magazine published a report on 21st No.vember 2017. The report callously cast a doubt of the Judge’s natural death (heart attack) and spun a ‘murder’ story around it. Thereafter one after one event started building up.

The Mumbai Lawyers association first filed a PIL in Bombay High Court on 9th January 2018 seeking a probe into Justice Loya’s death. The petitioner relied on the Caravan Story.

Mr Tehseen Poonawala a Congress activist on Social Media filed a Writ Petition seeking orders directing the authorities to conduct a probe in the matter of Justice Loya’s death. The Supreme Court website shows the petition filed by Mr Tehseen Poonawala was registered on 11th January 2-18 but the Diary entry no-shows as 40744-2017 (December 2017)

From the Times Now chat with Mr Tehseen Poonawala, it is apparently clear that the Advocate Sri Dushyant Dave was eager  and also was in a hurry to get the petition filed by Mr Poonawala withdrew from the Supreme Court, as the petition was then listed before the Bench headed by Justice Arun Mishra at Court No 10.

Now, the intriguing aspect is, Justice Chelameswar who confirmed the fact that the said letter addressed to the Chief Justice of India was sent to the CJI somewhere in November 2017 ( as the copy of the letter as available on Internet was w/o date ) but waited almost 3 months without initiating any followup action, but hurriedly met the CJI on the morning of 12th January 2018 only after the WP (Civil) filed by Mr Poonawala was listed before the Bench at Court hall No 10, headed by Justice Arun Mishra?

There was lot of pressure, panic and pandemonium prevailed on 10th, 11th and till 12th Morning in the precincts of the Supreme Court and the lawyer’s chambers. The hurried presser by the Judge’s quartet on the 12th afternoon is the clear indication for this mistrust. Going by these events now we should suspect in another way around.  Why Adv Dushyant Dave and Prashant Bhushan were so confident on Mumbai High Court Bench where the petition on the same issue which was filed by Lawyers association more than the Apex Court?

Did the CPI Leader Mr D Raja meet the Justice Chelameswar before 12th January 2018, during those crucial days of 10th and 11th January 2018?

A stitch in time saves nine’

A timely action (Contempt of Court charges ) against Sri Prashant Bhushan and Dushyant Dave could have prevented this character assassination of the Judges at the Apex court of India. Going by the languages they used against Justice Arun Mishra and the Chief Justice of India, a contempt case is apt. Indecision causes severe damage.

Law Ministry should look into this aspect and order for a secret enquiry to prevent this tendency to repeat in future.

A word on Mr Tehseen Poonawala. He is a known abuser of Modi, BJP, RSS and the like Right-Wing outfits. He had a record of abusive tweets to his credit. Yet he is a verified account on Twitter. If one wonders why Poonawala being a Congress leader now curious to file this PIL? There is nothing Public Interest except the party interest and his own personal interest too. He is young active and aspiring to become the head of Congress Party and he is eager to be in limelight all ways at least till 2019 Elections.

Why Indian Media wants justice for rich, criminals and terrorists only?

Champions of Indian media keep shouting about justice, equality and democracy but only when it suits them. It is said, Action speaks louder than words. Recently, four judges of Indian Supreme Court came out, addressed a press conference regarding a letter which they had submitted to CJI but no action was taken to fix the problem. To rescue our democracy they had to convey their message to people of nation, they said. The above mentioned letter says the CJI was neglecting certain established traditions and conventions which were affecting the functionality of the court and administration too. The letter basically is a complaint about the composition and strength of bench for particular cases. In the letter four judges also told the CJI that CJI is master of Roaster and first among equal and does not have any authority over the other judges of court. If the CJI is only the first among equals, then how can these four claim to be more experienced and balanced is a different story.

After the press conference every media channel took a side tried to achieve their goals in the name of democracy under threat. It is to be noted that this kind of a press conference never happened before and the code of conduct of Supreme Court also suggests that judges are not allowed to talk to Media but the Media didn’t focus on the these core issues because such type of democratization of our Judiciary also puts faith of people in judiciary at risk. But the media was enjoying the moment when Indian Judiciary was in a fuss and being insulted by the Supreme Court judges themselves.

In no time the letter to CJI was dropped and question of probe into Justice Loya’s death was made into the biggest issue of the Day. Panels were decorated, Questions were being asked, and everyone was being shouted at on every news channel. Many days have passed and it is now clear that opposition wanted to use the death of Justice Loya against the ruling party. Pained because of politicization of father’s death son of Justice Loya himself came out and asked media and NGOs not come to him as he knows his father died a natural death. Now the question is this why is media hell bent on politicizing death of Justice Loya, do they really want justice or there is something else.

Justice Brijgopal Harkishan Loya (Ravish Kumar has been talking about it) was a CBI Court judge hearing the case of Sohrabuddin, who was killed in an encounter in Gujarat by police. Congress and other opposition parties and a particular section of our Media is hell bent on proving that Sohrabuddin was killed by Gujarat police in a fake encounter. Notably our Prime Minister Narendra Modi was the Chief Minister of Gujarat at that time and as he was blamed for 2002 Godhra riots even after 15 years, he is still being targeted for Sohrabuddin’s so called fake encounter. Sohrabuddin was accused in 60 different crimes, an AK-47 was recovered from him and he was said to be in contact with Dawood himself but the Media portrays him as some hero who was wrongly killed in battlefield, as they did with Burhan Wani.

Now let’s look at a different case. November 4, 2016 in a small village named Nama of Kumakoleng Panchayat in Bastar, Chattisgarh a 50 year old man Shamnath Baghel was murdered in front of his wife. The man, who was the only hope for the family a father of 3, a patriotic man who loved his country and a man for development of his society protested against Maoist Activities times and again. He was on radar of Urban Naxals since months, he was told many times to keep quiet and not raise his voice again the but he was not scared he wished for better future for the upcoming generations of the people, he chose not to keep quiet. He kept speaking till he was silenced by enemies of the nation.

His wife Vimala filed an FIR against the DU Professor Nandini Sundar, Archana Prasad (JNU Professor), Vineet Tiwari (from Delhi’s Joshi Adhikar Sansthan), Sanjay Parate (Chhattisgarh CPI (Marxist) State Secretary) and others along with Maoists. One of the accused is Nandini Sundar a DU professor, a naxal sympathizer and wife of Thewire.in’s founder Sidharth Vardarajan. As the news came to Delhi it was published in News Papers flashed on News Channels but for once and no update was ever reported about the case except for when Nandini Sundar was given relief from Supreme Court. When Chattisgarh police started acting on the FIR, Nandini Sundar went to Supreme Court submitted a petition for protection in the Court that she was being targeted the by the Chattisgarh Govt., Supreme Court Judge Justice Madan Lokur (One of the Fourt Judges) ordered the Chattisgarh police not to arrest, apprehend or interrogate Nandini Sundar until some material comes to light.

Now my question is this, if our Media is not opportunist and does not serve political masters and if Ravish Kumar is as honest as he claims to be, if Rajdeep Sardesai is really the champion of dissent for justice and so many are if they are what they pretend to be. Then why not ask for justice Shamnath Baghel, for a man who died protecting our national values, who died for democracy, who opposed naxals, why not?

Because it doesn’t suit their Agenda? Because it doesn’t demean BJP? Because it targets the real problem, May be because it will expose their friends or may be because if they speak against real problems the funding will stop and they will have to live a simple, hard working, full of struggle life alike those journalists who speak for truth.

This situation with the fourth most important pillar of democracy is worrying of course but one thing is true and proven. If you want your voice to be heard you need to be a Minority, a Criminal, A Terrorist or Anti –National or you must have the ability to divide the Hindus else you don’t matter, your life doesn’t matter, and your death doesn’t matter. Nobody cares about Justice for you.

Satire: Judges Press Conference

COURT REPORTER OF SUPREME COURT OF MAHISMATI: This is my updated report after the Supreme court of Mahismati had ordered the ban on sale of fire crackers in the capital region. Recently the 4 Premium Judges from the supreme court of Mahismati assembled in a Tea Garden and invited some of close friends for a heart to heart talks. Some of these friends have been acting as some kind of journalists and claim to be “Know it all” types in Mahismati politics.

The 4 judges talks underlined the issue of justice delivery system in the court and informed to all for the first time that justice is not delivered basis the witness testimonies or evidences rather it is purely basis the seniority of the judges. This universal acknowledged fact (so far hidden from public in the interest of national unity) was let out by the judges in the open for public consumption for the first time. People have appreciated the frankness of the judges and every litigant/defendant is wondering what would have happened if his/her case had gone to another judge who was slightly senior to the judge who actually pronounced the decision against him/her.

There are rumors in the corridors of justice that in future, the Mahismati court judgement will be pronounced as below-

In the light of the testimonies of witnesses, basis the evidences presented in this court and to top it all, basis my seniority in the court, I find the defendant guilty as charged. The guilty can appeal via press conference to media which will act as higher judiciary (higher than Supreme Court of Mahismati) and bring 50 eminent journalists at 0200 hour for the appeal. His appeal will be considered basis the political alignment of the defendant and if the crime is perceived committed by the masses but not by eminent journalists, his appeal will be accepted.

The appellant can also alternatively request a more senior judge to reverse the judgement as seniority is the overall and most meritorious factor in the decision making in the Supreme Court of Mahismati. If the defendant still has any doubts about the judgement, he can also approach the judge’s elder brother or father to cross check the validity of the judgement as they are more senior to the judge and will decide better. Contrary to gender justice, the judge’s mother or elder sisters cannot be approached for re-validation of the decision as Supreme Court of Mahismati has seldom considered the ladies to be equal or more meritorious than the gentleman (so far as the records suggest).

Finally the democracy and judiciary is saved in the kingdom and most lawyers and public have expressed their satisfaction over the public display of affections among the judges

Some lesser-known Ancient and Medieval Sanskrit and Pali texts: A part of our cultural heritage

As I finished reading Amish Tripathi’s rather interesting book on Sita, it occurred to me that acknowledging the importance of Sanskrit in shaping India might very well sound clichéd, but it must be given its due credit. Other than the language having very scientifically defined grammar and phonetics, the fact is that various pieces of priceless literature which touch upon a plethora of fields, such as economics (as discussed here), science, sociology and philosophy, other than great works of love poetry, have been written in Sanskrit. In the context of science, I am referring to documented achievements of ancient Indian scientists in fields like mathematics, astronomy and surgery; I am not talking about religious lore, much of which, with all due respect to everyone’s religious sentiments, can be relegated to the sphere of fiction for all religions, and even if there is some evidence as to the existence of some events and characters mentioned in religious lore, nothing can conclusively prove scientific achievements based on them (social media forwards and random websites pandering to our confirmation biases shouldn’t be taken on face value). Going by the Judeo-Christian texts, even Solomon had a flying vehicle (and there are similar things in ancient Greek, Norse and Egyptian legends), and many popular stories by writers like Joules Verne and even JK Rowling have mentioned things that were really invented later, but that does not mean those stories were true when they were written, nor does referring to real places like Delhi or Mumbai or Hastinapur or Kurukshetra or accurate distances between them, in a story necessarily make that story true, though it is a fact that ancient Indian philosophical texts have inspired scientific enquiry across cultures. It is widely accepted that Sanskrit is good for speech therapy, as you can see here and in this piece by a Muslim scholar, as also this research paper on an official US website.

The cultural chauvinism and literalist reading of religious texts among large sections of religious rightists to make “scientific claims” without any concrete evidence is much talked about (this is done not just under a Hindu banner, but among Muslims and others too, as you can see here, here and here, and in this context, this video debunking notorious Muslim preacher Zakir Naik’s critique of the theory of evolution also makes a nice watch, and this issue in the Hindu context has been pointed out and rebutted not only by leftists but even eminent Hindu right-of-centre intellectuals, as you can see in this article, this one and this one), and we do indeed have to learn from modern scientists tirelessly working in laboratories across the world with appreciation and an open mind without baselessly accusing all of them of plagiarism or cultural appropriation. That said, as acclaimed author Vikram Chandra pointed out in an interview, some in the left-leaning political camp too have been guilty of being overly reductionist about Sanskrit as being a language that has texts that have advocated caste oppression, patriarchy and some other regressive ideas, but haven’t all civilizations had their social evils, and can’t one say that about languages like Persian, Arabic or even Urdu, given Maududi’s writings in that language validating purdah, for instance?

The one basic commonality in most of what we know as India, acknowledged as a geographical and cultural unit for centuries, is the prevalence of what we can describe as Hindu culture (that manifests itself even in the Durga Puja being observed by sections of ethnic locals of Meghalaya and the dance Hojagiri performed by sections of ethnic locals of Tripura), and speaking of our linguistic diversity, even the common thread of influence, even if not origin, is Sanskrit, even for Urdu, a combination of Persian and Hindi, for Hindi is derived from Sanskrit (the word ghar, for instance, used in Urdu is derived from the Sanskrit word grih, and the Sanskrit word ‘dukh’ figures in Ghalib’s couplet Ibn Maryam hua kare koi, mere dukh ki dava kare koi). Indeed, it is only desirable for all Indians to identify with and appreciate wonderful aspects of our ancient heritage, which is the heritage of all South Asians, irrespective of religion, just as many Muslims and Christians in Iran, Indonesia, Egypt and Greece celebrate their pre-Islamic/pre-Christian heritage, and there are  Indian Christians and Muslims who are scholars of Sanskrit, some I know personally, and of course, there are historical examples like Mian Mir and Dara Shikoh from the Mughal period, whose worldview I have discussed here.

As our former president Dr. APJ Abdul Kalam stated – “Sanskrit is a beautiful language. It has enriched our society from time immemorial. Today many nations are trying to research Sanskrit writings.” He also suggested that Sanskrit scholars, apart from their academic activity, should take up the task of locating missing literature in Sanskrit available on palm leaves spread in different parts of the country so that these could be documented and preserved, and that they should avail of digital technology for documenting those scriptures both in audio and video form which can be preserved as long-term wealth for use by many generations. Unfortunately, a decade since Dr. Kalam voiced these concerns, this is an issue that still deserves attention. It also remains a sad fact that in many parts of India, despite our national motto ‘Satyamev Jayate’ and Doordarshan motto ‘Satyam Shivam Sundaram’ adopted by the Congress party having been in Sanskrit and the upgrading of the Sanskrit College in West Bengal by the Trinamool Congress government there in 2015, and despite some left-leaning commentators pitching for Sanskrit in their own style (as you can see here and here), there remain few enthusiastic takers for Sanskrit courses, and acknowledging and celebrating the importance of Sanskrit gets mired in unnecessary and baseless political controversies.

It is interesting to note, as has been discussed in considerable detail in this article, that Dr. Kalam was critical of communalism under any religious banner and was a practising Muslim who interpreted Islamic theology very liberally such that his adherence to his faith did not come in the way of his commitment to humanism and Indian nationalism (which is possible as per several interpretations of Islamic theology), something that should be encouraged, and is, in my view, the only feasible way to ideologically combat Muslim extremism, as discussed here.

Dr. Kalam believed that Indians of all faiths, while being committed to modern human rights values, should be bound together by an over-arching sense of culture, which would lay emphasis, among other things, on our ancient Sanskrit texts. While freedom of religion is  a human right, and I certainly don’t wish for India to emulate the moral and religious policing in Islamic theocracies like our western neighbour, which is a self-destructive route that destroys freedom of thought, the onus of a composite, syncretic culture or  acknowledgement of historical wrongs (such as vis-a-vis Dalits for upper caste Hindus) should not be made to rest with only the Hindu majority, and it is necessary for our fellow Indians who are Muslim or Christian, while enjoying their religious freedom (including of apostasy from their faith), to embrace India’s ancient heritage as their own, and condemn any extremism from within their communities historically or in present times, as many already even do. This was a point reiterated by Guru Golwalkar of the RSS, who had evolved his views considerably by the time he wrote his book A Bunch of Thoughts, which, though misrepresented by many left-liberals, makes some interesting points, as discussed here [without in the least stereotyping everyone in the Sangh Parivar in a negative fashion as I have clarified here, here, here and here, I am not denying that there are many of those in the Sangh Parivar who are only spurred by zeal arising primarily out of confirmation bias in favour of birth-based Hindu identity, manifesting itself in reprehensible speech and action, and they must try and undertake dispassionate analysis, but leftists or minority community right-wingers can hardly claim a non-violent record, and any unlawful violence is a threat to our democracy and rule of law, and differences must be resolved constitutionally with legal punishments sought if necessary, rather than setting off cycles of violent revenge, and we’ve seen hundreds of jihadist terrorists and Hindu rioters, like in the massacres in Ode, Sardapura, Naroda Patiya and Gulbarg Society in the Gujarat riots of 2002, being made to serve prison terms, as also a BJP MLA, Manoj Pradhan, for anti-Christian violence in the Kandhamal district of Odisha in 2008, though it is unfortunate that many politicians believed to have fanned riots like Azam Khan, Sajjan Kumar and Jagdish Tytler not being punished has come in the way of a sense of closure to Sikhs and Jat Hindus (think Muzaffarnagar), just as Kashmiri Pandits being denied that sense of closure with those responsible for murdering their kin going unpunished, and there are some such riot-accused politicians in the BJP too, and we need judicial reforms such that it isn’t felt that politicians can evade justice, the way Manu Sharma from a political family almost did in the Jessica Lal case].

And while one may have many serious differences with the ideological and policy approaches of Prime Minister Narendra Modi, including on the issue of handling the question of communalism (and I do, which is not to say that I support appeasing communal and regressive Muslims, that parties like the Congress, Trinamool Congress, SP and RJD have indeed unfortunately engaged in), I believe that everyone ought to acknowledge and support efforts made to integrate the minorities by encouraging them to adopt ancient Indic cultural facets without compromising on their religious beliefs, even by the BJP, such as outreach attempts to practising Muslims to participate in the International Yoga Day celebrations in 2015, telling them that chanting what they may see as religious words or verses was not compulsory and that yogic exercises are very similar to namaz, being beneficial for physical fitness. And Prime Minister Narendra Modi and other senior BJP leaders have, time and again, unambiguously stressed the need for religious tolerance, and even acknowledged positive contributions to the country from our fellow Indians of minority religious groupings, as discussed here, and indeed, Muslims enjoy better civil liberties and security of life and property in India than many Muslim-majority countries.

The general mentality about Sanskrit as well as other ancient languages, such as Pali, is merely restricted to the famous epics, and a general awareness of the vastness of the corpus of literature that these languages have produced is evidently missing from the Indian psyche.

Here is a list of four lesser-known texts to understand the magnificence of these sidelined languages:

  1. KALIVIDAMBANAM By Nila Kantha Dikshitar

For all those deeply upset about the lack of integrity of self-styled Hindu godmen and medical quacks, it may comfort them to know that our ancient forefathers were not oblivious to this menace, which has existed and continues to exist in every civilisation. A satirical piece of work by Nila Kantha, Kalividambanam (‘Mockery of Kalyug’), written sometime during the 17th century, warns the tricks and traits of each social type. Sorcerers, astrologers or physicians, the author leave no stone unturned for mocking the tricks of each social type. In an excerpt describing physicians, he writes-

Svasthair asadhya  Arogais ca jantubhir n’ asti kim cana

katara dırghaArogasca bhisajam bhagya Ahetavah.

Natidhairyam pradatavyam  natibhıtis ca rogini

naiscintyan nadime danam  nairasyad evan antime

The healthy and the terminally ill are of no interest,

Doctors thrive on hypochondriacs and those suffering from chronic diseases.

The patient must neither be given too much hope nor too much fear.

In the first case he will not pay up because he has no worry,

in the second because he has no hope.

  1. MATTAVILASHA PRAHASANA By Mahendravarman

Mattavilasha Prahasana or ‘A Farce of Drunken Sport’, written by Mahendravarman, is a 7th century Sanskrit satirical play set in Kanchipuram. The play exposes how a rot had set in reformist cults like Buddhism and Jainism and also heterodox Shaivite orders, as them having fallen prey to the same ills in the Brahmanical order they had set out to reform. This one-act play revolves around the drunken adventures of the central character, Satyasoma, and his wife Devasoma, and their journey to recover a lost skull bowl. Mattavilasha Prahasana predates Canterbury Tales, written by Geoffrey Chaucer (1340-1400) that also pokes fun at the power-hungry monks of the Catholic Church.

  1. LOKAPANNATI By Saddhammaghosa

Lokapannatti narrates the story of Upagupta, who was a 3rd century BC Buddhist monk. According to the stories in Ashokavadana (written in Sanskrit), Upagupta was a teacher of Ashok, the Mauryan emperor. In Lokapannatti, a Pali text, Upagupta is sent to tame Mara (the devil) by Ashok himself to the enshrinement ceremony festival. Science-fiction has been an integral part of ancient Indian literature. Lokapannati too consists of a story, which narrates the tale of King Ajatashatru, who had gathered the relics of Buddha to hide them beneath a stupa and built robots, known as ‘bhuta vahana yantra’, in order to protect these relics. Later in the story, Emperor Ashok had disarmed these mechanical robots. The story also finds a mention in the book Reignited, written by Dr. APJ Abdul Kalam. Those impressed by the Wonder Woman comics having a combination of science-fiction (that evil female scientist in Ottoman Turkey), historical fiction (reference to actual historical events like World War I), religious lore (Olympian deities) and fantasy, would be glad to know that there is an ancient Indian text combining all these genres too!

  1. KALAVILASA By Kshemendra

Kshemendra (990-1070 AD), a Kashmiri poet, was the pupil of the highly celebrated literary exponent and philosopher, Abhinavgupta. Kalavilasa is considered to be one of the greatest works of Kshemendra. The text, which is a satire, consists of ten cantos and deals with the vices of the society. The artistry of Kshemendra’s writing is marked by his recognition of the fallibility of human nature. He begins subtly by describing the vices in the society. Soon the tone of the satire changes to preaching morality and good conduct. Here is an excerpt from Kalavilasa, which ridicules doctors-

The physician becomes a renowned success
After he has killed a thousand patients with his concoctions,
Swapping around their various constituent drugs
in an attempt to figure out his own science.
