क्या वाकई लोकतंत्र खतरे में है जज साहब?

अभी हाल ही में सुप्रीम कोर्ट के चार वरिष्ठ जजों जस्ती चेलमेश्वर, रंजन गोगोई, मदन लोकुर और कुरियन जोसेफ ने प्रेस कॉन्फ्रेंस कर मुख्य न्यायाधीश दीपक मिश्रा की कार्यप्रणाली पर गम्भीर सवाल उठाए। सुप्रीम कोर्ट के इतिहास में यह पहली बार था कि किन्हीं जजों ने पद पर रहते हुए मीडिया से सार्वजनिक रूप से सुप्रीम कोर्ट के किसी आंतरिक विवाद पर बात की। चारों जजों की शिकायत मुख्यतः प्रशासनिक, प्रक्रियात्मक और तकनीकी किस्म की थी। इसमें रोस्टर प्रणाली और बेंचवार मुकदमों के बंटवारे के तरीके को लेकर नाराजगी जाहिर की गयी। यह भी कहा गया कि मुख्य न्यायाधीश बस “First among the equals” हैं और सिर्फ मुख्य न्यायाधीश हो जाने के कारण उन्हें बाकी जजों पर कोई श्रेष्ठता हासिल नहीं हो जाती।

प्रेसवार्ता में मुख्य न्यायाधीश को सम्बोधित एक पत्र भी सार्वजनिक किया गया। यह शिकायत भी की गयी कि ‘महत्वपूर्ण केसों’ की सुनवाई कुछ चयनित बेंचों को सौंपी गई जिनका संचालन ‘जूनियर जज’ कर रहे हैं और इस आरोप को ‘सीनियर जजों’ के अपमान के तौर पर प्रस्तुत करने की कोशिश की भी गयी। सबसे बड़ी बात यह कि इन सब शिकायतों के आलोक में देश में लोकतंत्र को ही ‘खतरे’ में बता दिया गया। माननीय जजों की पद की गरिमा का पूरा ध्यान रखते हुए उनके आरोपों पर कुछ सवाल मन में उठते हैं जिनकी चर्चा इस लेख में की जा रही है।

पहला सवाल तो ‘महत्वपूर्ण केसों’ की परिभाषा को लेकर है। क्या सुप्रीम कोर्ट जैसी सर्वोच्च अदालत में आया कोई भी केस कम महत्वपूर्ण हो सकता है? क्या संविधान में कहीं भी यह प्रावधान है कि सुप्रीम कोर्ट में आया हुए एक केस किसी दूसरे केस से कम या ज्यादा महत्वपूर्ण है? जवाब है नहीं! सुप्रीम कोर्ट में आई किसी याचिका को लेकर संविधान कम महत्वपूर्ण या ज्यादा महत्वपूर्ण का कोई विभेद या वर्गीकरण नहीं करता। फिर आप ये कैसे कह सकते हैं कि कथित महत्वपूर्ण केस कथित जूनियर जजों को दिए जा रहे हैं? अगर ‘महत्वपूर्ण’ केसों से आपका इशारा हाई प्रोफाइल केसों से है तब भी आपके आरोप कम से कम वर्तमान मुख्य न्यायाधीश के विरुद्ध कहीं नहीं ठहरते। खासतौर पर अगर हम पिछले मुख्य न्यायाधीशों के कार्यकाल में विभिन्न बेंचों को आवंटित हाई प्रोफाइल केसों की ओर नजर डालें तो आपकी प्रेसवार्ता या सात पन्नों का पत्र कोई नई बात तो नहीं कहता।

एक अंग्रेजी अख़बार की ताजा रिपोर्ट के अनुसार राजीव गांधी हत्याकांड, बोफोर्स घोटाला, बेस्ट बेकरी कांड, 2 साल से अधिक सजा पर सांसदों/विधायकों की अयोग्यता, सोहराबुद्दीन मुठभेड़, राहुल गांधी पर बलात्कार के आरोप वाली याचिका, काले धन पर राम जेठमलानी की याचिका, 2G घोटाला, कोयला घोटाला, बाबरी विध्वंस में लालकृष्ण आडवाणी का ट्रायल, आधार केस, IT Act की धारा 66A की वैधता, BCCI का संचालन, विजय माल्या प्रकरण, ये सारे के सारे बहुत हाई प्रोफाइल केस रहे और इन सबकी सुनवाई कथित ‘जूनियर’ जजों ने ही की थी न कि वरीष्ठतम पाँच (यानि कोलेजियम) जजों ने। अगर तब लोकतंत्र खतरे में नहीं पड़ा फिर आज क्या जल्दी हो गई खतरे की? क्या आपके हिसाब से वर्तमान में जो ‘जूनियर’ जज (जिन पर ‘चयनित बेंच’ शब्दों के जरिए आरोप लगाया गया) हैं, उनका कोई फैसला लोकतंत्र के लिए खतरा है? वैसे ये ‘जूनियर’ जज क्या होता है? बात जब मुख्य न्यायाधीश से आपकी तुलना की हो तब तो आप स्वयं को उनके बराबर मानते हुए उन्हें बस “first among the equals” कहते हैं। यानी आप खुद को मुख्य न्यायाधीश से जूनियर नहीं मानते लेकिन बाकी जजों को जूनियर मानकर उनकी न्यायिक सक्षमता पर सवाल खड़ा कर देने में आपको कोई संकोच नहीं।

कोई कथित महत्वपूर्ण केस कथित जूनियर जज निर्णीत नहीं कर सकता, और करे तो ये लोकतंत्र पर खतरा है, ऐसा परोक्ष निष्कर्ष क्या उन जजों की अवमानना नहीं? ध्यान रहे, ये बात आपने अदालती कार्यवाही में नहीं बल्कि खुली प्रेसवार्ता में कही है। अगर ये ‘जूनियर’ जज या चयनित बेंचें चाहें तो अपनी अवमानना का संज्ञान ले सकते हैं या नहीं? आप खुद अपने न्यायिक विवेक से सोचिए।

‘लोकतंत्र पर खतरे’ वाला जुमला तो और भी हास्यास्पद है। इसी देश में आपातकाल से लेकर शाहबानों मामले में हमने संसद को मजबूर होते हुए देखा लेकिन लोकतंत्र खत्म नहीं हुआ। इसी देश में हमने कश्मीरी पण्डितों का नरसंहार देखा, उन्हें अपने ही देश में रिफ्यूजी बन जाते देखा, उनके ऊपर हुए अत्याचारों की अभी हाल ही में फिर से जाँच के लिए दी गयी याचिका को आपके सुप्रीम कोर्ट से ही ख़ारिज होते हुए देखा लेकिन लोकतंत्र खतरे में नहीं आया। देश दुनिया के इतिहास के बड़े-बड़े घोटाले यहां अंजाम दिये गए लेकिन लोकतंत्र खतरे में नहीं आया। सांसद या विधायक ये तय नहीं करता कि अगला सांसद या विधायक कौन होगा, मुख्यमन्त्री या प्रधानमन्त्री ये तय नहीं करता की अगला मुख्यमन्त्री या प्रधानमन्त्री कौन होगा लेकिन इस देश में जज ही तय करता है कि अगला जज कौन होगा, फिर भी लोकतंत्र खतरे में नहीं आता। अपनी कॉलेजियम की अंधेर नगरी में आज तक अपने RTI की टॉर्च जलाने की भी अनुमति नहीं दी, फिर भी लोकतंत्र खतरे में नहीं आया। लोकतंत्र के खतरे का जुमला यूँ भी न उछालिए कि इसका हाल भी ‘इस्लाम खतरे में’ या ‘सेकुलरिज्म खतरे में’ या ‘इनटॉलेरेंस’ जैसा होकर रह जाए।

अब अपने ताजा बयान में जस्टिस रंजन गोगोई ने कहा है कि सुप्रीम कोर्ट में कोई ‘क्राइसिस’ नहीं है। अगर क्राइसिस नहीं है जज साहब तो ये मीडियाबाजी करने का क्या औचित्य था? जस्टिस कुरियन जोसेफ कह रहे हैं कि ये मामला राष्ट्रपति के संज्ञान में इसलिए नहीं लाया गया क्योंकि सुप्रीम कोर्ट के ऐसे मामलों में राष्ट्रपति की कोई संवैधानिक जिम्मेदारी नहीं है। अगर ऐसा है तो ये मामला मीडिया के संज्ञान में भी क्यों लाया गया जज साहब? सुप्रीम कोर्ट के ऐसे मामलों में मीडिया की भी तो कोई संवैधानिक जिम्मेदारी नहीं है।

आपकी मीडियाबाजी में सुप्रीम कोर्ट की कोई सूरत बदलने की कोशिश तो दिखी नहीं। माफ़ कीजिए मीलॉर्ड, ऐसा लगा कि सिर्फ हंगामा करना ही मकसद था।

Vivekananda’s criticism of missionaries at Parliament of World’s Religions

Today is the 155th birthday of Swami Vivekananda, the great spiritual leader of India. He inspired a generation of Indians to rediscover the rich heritage of India and Hindu faith. His speeches at the Parliament of World’s Religions in Chicago in 1893 have inspired people of India and the world. These speeches unraveled the essence of Hinduism to the world. But they also had some criticism for missionaries and soul harvesters who came from the west.

On 20 September 1893, Swami Vivekananda delivered the speech titled- ‘Religion not the crying need of India.’  He asked his audience, whether conversions were right.

Christianity must always be ready for good criticism, and I think that you will hardly mind if I make a little criticism. Christian brethren of America, you are so fond of sending out missionaries to save the souls of heathens. I ask you: what have you done and are doing to save their bodies from starvation? In India, there are 300 million men and women living on an average of a little more than 50 cents a month. I have seen them living for years upon wild flowers. During the terrible famines, thousands died from hunger but the missionaries did nothing. They come and offer life but only on condition that the Hindus become Christians, abandoning the faith of their fathers and forefathers. Is it right? There are hundreds of asylums, but if the Muslims or the Hindus go there, they are kicked out.

He went on to say that the asylums set up by Hindus did not discriminate the hungry people who came for help.

There are thousands of asylums erected by Hindus where anybody is received. There are hundreds of churches that have been erected with the assistance of the Hindus, but no Hindu temples for which a Christian has given a penny.

In what could be called a scathing attack on missionaries, he asked them not to teach metaphysics to the impoverished, but to teach them to earn their own bread.

Brethren of America, you erect churches all through India, but the crying evil in the East is not religion. They have religion enough, but it is bread that the suffering millions of burning India cry out for with parched throats. What they want is bread, but they are given a stone. It is an insult to a starving people to offer them religion; it is an insult to a starving man to teach him metaphysics. Therefore, if you wish to illustrate the meaning of “brotherhood,” treat the Hindus more kindly, even though they are Hindus and are faithful to their religion. Send missionaries to them to teach them how better to earn a piece of bread and not to teach them metaphysical nonsense.

He ended the speech by asking Western charities and people of America to help his people to come out of poverty.

I came here to seek help for my impoverished people and I fully realized how difficult it was to get help for heathens from Christians in a Christian land. I have heard so much of this land of freedom, of liberty and freedom of thought, that I am not discouraged. I thank you, ladies and gentlemen.

There is a dire need to read the full text of Vivekananda’s speeches in the Parliament of World’s Religions. Quoting the first line of the inaugural address has become a sort of a fad these days. Hindus must study his speech completely and the missionaries of today must take the advice given by the great sage of India seriously.

Offshoots of RERA-triggered consolidation in the real estate sector in India

The advent of Real Estate Regulatory Act (RERA) has several offshoots; while some of them are quite visible, there are many which are not explicit enough. However, they have a tremendous magnitude. The stringent provisions of the Act have made it clear that real estate development is going to be a highly responsible activity. The real estate development companies will be fully accountable towards the buyers, and there will be a strong focus on delivery of projects than launching.

The real estate sector in India is indeed under the phase of consolidation. Naturally, as it is supposed to be, consolidation has brought a level of discomfort for many real estate companies. Quite a number of small to large real estate developers have lost their will to weather the storm. Every second day, media is coming up with news on some or the other company reeling under troubles and even filing for insolvency. This includes beleaguered realty giants like Unitech, Jaypee and Amrapali Group which have projects spanning millions of square feet of incomplete projects.

The ongoing trends indicate that the sector will have fewer players than earlier. Historically, the real estate sector in India had low entry barriers, and anyone could become a builder per se. Thanks to the stringent provisions laid down by RERA, only serious, skilled, well-capitalised players will be able to enter the business and survive. It will be all about project delivery, no matter how well a project is conceived.

The companies which have long-standing brands will be well-positioned to get benefit out of the ‘survival of the fittest’ scenario. This is why we will find corporate brands such as Tata Housing, Godrej Properties and Shapoorji Pallonji adding more real estate projects to their portfolio through various diverse routes.

It wasn’t a surprise when the top brass of Tata Housing was quoted in a media interview stating that their company is open to bringing more projects under their belt via three routes – joint venture, joint development and outright acquisition of assets. The same goes with Godrej Properties which has been reporting improving sales volumes at a time when most of the real estate developers are striving to keep the ball rolling. The company gives all the credit to their project delivery capabilities and believes that this is how their brands manage to retain consumer confidence.

Tata Housing, on the other hand, has already earmarked a corpus of Rs 800 crore to add 8-10 real estate projects, both greenfield and brownfield. The brownfield projects could be the ones which hold good potential and are available at attractive valuations. The company is reportedly on a lookout to buyout under-construction properties that are under distress.

Over the past few quarters, a number of global institutional investors, such as Blackstone Group, Goldman Sachs, GIC, Brookfield Asset Management, Canada Pension Plan Investment Board (CPPIB), and Qatar Investment Authority, have been on a spree to acquire real estate assets in India in tie-ups with reputed realty companies. Most of the deals have been under discussion stage, and it is expected that many of these will come to fruition in 2018.

The Congress’ social media folly

The Congress, as we progress closer to the 2019 elections, is moving towards becoming an entity of ill-wishing decadents & unprecedented lowly desperations!

If anyone cares anymore, they’ll notice that post 2014 the Congress has exponentially increased their appetite to resort to 2-bit memes as a ‘robust’ political opposition. Unfortunately though, it’s more than contributing to further decimate the image of the Congress. Let’s be honest, they lost their credibility faster than 3rd wave feminism. The Congress opened Pandora’s Box on the BJP several times, only to be smoked to smithereens. In my free time, for fun, I watch the Congress’s social media channels since I don’t like the Canvas Laugh Club too much. It’s an absolute delight to laugh at the Congress’s social media gaffes. Over Israeli PM Benjamin Netanyahu’s visit to India, the Congress decided to come up with a weird video about Modi’s hugs. Set aside the colossal ignorance of how much that video coming from a political party says about the hospitality of a country in general, apart from displaying an opaquely homophobic sentiment, it didn’t even help them. Instead, it jumped the charts of moronic behaviour to deplorable levels. It is when gimmicks like these are portrayed boastfully does one clearly reek of hapless desperation.

The Congress loves taking unpleasant digs at the BJP. While the Congress routinely preaches their self proclaimed morally condescending approach from a high pedestal, I think they should focus more on realising their falling face value rather than exploiting their own redundancy. What’s even more astonishing, is to see them score consecutively funnier self aa-thoos! Many of their stooges are giving it all they can to proportionate mujahid sheep in gladiator costumes to social justice heroes & play destructively divisive identity politics. It’s either their naivety or pea-brained intellect that they still don’t comprehend the fact that they come out as cosmic-hyper-loyal-loonies for India to enjoy. Many such loonies are a tool for trolls to pleasure themselves with; they end up giving trolls an innate sense of gratification and achievement. With every new narrative put forth by the loonies, it only prompts the fact that they’re painting with a broad brush. Peculiarly, it’s the tremendous bankruptcy of morals within their ecosystem is what worries me. The former is so obvious that it’s potentially a ticking time bomb waiting to explode & disrupt the integrity of India, it has happened once at the starting of 2018. It won’t be long before such cheap stunts are pulled again, the BJP should be vary of that. As time passes, the Congress will push the aggression in their politics to levels that might turn unmanageable for the BJP. The BJP should be ready to douse the fire the Congress will light. In the meanwhile, the BJP should tell their leaders to keep shut since they make  for some quite spectacular  self-aa-thoo moments too.

I go through loony TL’s to get my daily dose of comedy. And it works wonders actually! Traditional stress busters like alcohol will soon be neolithic, people would get high on the comedy of loony sycophancy! Congress social media handles are cringe bombs that go off every now and then, but the shrapnel usually boomerangs. People make fun of Rahul Gandhi, but only the loonies have the audacity to fabricate a genie without even having the pot. On the contrary, I think these loonies—ranging from multifaceted protestors to eminent historians—the spectrum is vast, should be given an award for being the invincible wall our Humpty Dumpty sits on! And as it happens, he keeps falling, even with that kind of concrete support. Rahul Gandhi’s biggest enemy will always be Rahul Gandhi, and it doesn’t even require thought to process that popularly prophetic claim. From cheap copies of the AntiFa to degenerate memes about the PMO’s office; the Congress has been there, done that. And in all it’s reality—as tempting as it sounds, the BJP’s biggest trump card—that Rahul Gandhi is, does not fail to play itself well & right into the hands of the BJP. If at all the Congress wishes to bring itself back into the fray, their social media handles should stop acting like pimps selling themselves out. And that’s going to take much more than massive paradigm shifts from what it currently is. The Congress is walking on pseudopodia, and it won’t sustain for much longer.

The Congress has come a long way in the past 60 years. From the Nehru era till now, the Congress’s credibility depreciates year by year to now being reduced to a mud slinging champion. It has irredeemably tarnished its stature as a political party, let alone an able one. This helter-skelter approach towards wanting electoral success is making the Congress completely oblivious to competency. Their actions explicitly prove what I’ve thought of as a thumb rule to new-age politics for some time now— that poise is passé. Just to put everything in perspective–Congress’s stooges are like bacteria fermenting the batter to make sure it steams well in the pressure cooker that 2019 is going to be. And in all earthly possibility, the Congress’s eye for a 2019 electoral win could very well be nothing but a mirage.

Congress’s Shameless Behaviour During Israel PM’s Visit Will Not Be Forgiven

During the 2014 Lok Sabha poll campaign, Narendra Modi  condemned the ‘dehati aurat’ insult made by Nawaz Sharif in his interaction with Indian journalists. If Gujarat CM and BJP’s PM candidate wanted to use this in his campaign and mock Manmohan Singh, he could have garnered more claps and votes. But he did not. He displayed bi-partisan statesmanship by telling the world that India will not accept this kind of language. He said :

“How dare you (Sharif) address my nation’s Prime Minister as a village woman? There cannot be a bigger insult of the Indian Prime Minister. We can fight with him on policies but this we will not tolerate. This nation of 120 crore will not tolerate its Prime Minister’s insult,”

He went on to condemn the journalists who did not object to Nawaz Sharif’s comment during the interaction.

“The journalists who were sitting in front of Nawaz Sharif when he was insulting our Prime Minister should also answer to the people of my country.” “I want to ask those journalists, I don’t know who were they but journalists of my country who were having sweets sitting with Nawaz Sharif when he was abusing our Prime Minister calling him village woman, I expected those Indian journalists, the country expected them, to refuse the sweets and walk out,”

However, today the Indian National Congress, a 132 year old party which was once led by the likes of Mahatma Gandhi and Sardar Patel has reached a low point which is unprecedented. It made a shameless collection of PM Modi’s hugs with world leaders and posted it on their official handle during an important bilateral visit. This shows that they are jealous, malicious and full of hatred for the current PM.

Rahul Gandhi claimed that his party respected the post of PM during his campaign speech in Gujarat. He said:

“The Congress Party respects the chair of Prime Minister. No one in the Congress is allowed to insult the Prime Minister. Modiji can say anything about us. That is why we took strict action against Mani Shankar Aiyar,”

But from this Tweet it appears that the Congress party does not respect the post of the Prime Minister at all. Their hunger for power and jealousy has clearly frustrated them deeply. The people of India and Modi’s supporters will teach a lesson that Rahul Gandhi and his party will never forget in their life in 2019. This shameless tweet of the Congress party will not be forgiven by the people of India.

If you’re against an ideology, so be it. It is your constitutional right to choose what ideology or religion you may or may not want to follow. But it is when you choose to sport a blind eye to reality is when it’s annoying or rather disgraceful to humanity.

Left liberals speak about the rampant religious fanaticism that’s going unchecked under the current government. I could name a lot of cases where the religious fanaticism came from Islam. But no, an eye for an eye is not the answer. While they weep for a Pehlu, a Sawan for them is just like Tusshar Kapoor in Gayab. There will be no candle light marches, no seditious slogans, no protests. The death of a Hindu will always whither away with the wind like a dandelion in a field. The discourse that every Muslim is innocuous comes from the ever ignorant comprehensive ability of a Left Liberal. It’s a hobby for the Left liberal to defend the human rights of those who annihilate the human rights of others. Liberal poster boy ‘Justin Trudeau’ called ISIS ‘fighters’ to be an extraordinary voice in Canada. It might be his naivety, given the benefit of doubt; but if Hitler were alive, he would’ve been called a ‘Pious monk’ who lost his mind and decided to kill 6 million people; of course by left leaning liberals if it suited their interests.

For 10 long years, we recited the Preamble of India in school. There’s one phrase that has stuck with me ever since – “Equality of status & of opportunity”. India has given a lot more to Minorities than to Hindus. Separate personal laws, special status to Kashmir, non interference in Islamic law, multiple reservations to minorities, allocation of numerous subsidies. The list is long. Is this “Equality of status & of opportunity?” If yes then I have wasted approximately 4000 minutes of my life reciting something which meant jack shit.

The Left’s secularism is prejudiced and false. It is bigoted and discriminating. They are outraged when the government spends money on erecting statues of Hindu idols, but raise their head with pride when they look at the Taj Mahal. I am not saying it is not beautiful, it definitely is, but what is wrong in promoting Hindu culture? Hindu tradition? Is that not what we have evolved from? What is wrong in teaching children what the great sages left for us to see? I agree wiping out the Mughal empire from textbooks is not correct as it is a part of our history, no matter how gore or bloody. But the addition of Hindu tradition and values to textbooks isn’t wrong either. Ask any millennial in India whether or not they have read the Vedas. Ask them if they know about the great Indian sages. I am sure 9/10 will say no.

The Left loves reading and sharing articles that expose the so-called patriarchy of Karva Chauth but have a hush hush attitude towards Sharia law which is regressive, oppressive and neolithic. To my astonishment, they even defend it! The Constitution of India has given us rights to free speech but they use it only to demean Hindu ideals. However, speaking against Sharia is not compliant to their secularism. While, if one Hindu screws up, it’s taken as if all of Hinduism is a full blown anti Abrahamic element. And at the same time, these stupefying group of people share articles about how the first Church was build in India in around 52 AD.

Over the years, the Left has totally distorted the idea of secularism. Real secularism will only be achieved by the implementation of a Uniform Civil Code. However, they never be an advocacy to this as the appeasement tactics that they currently use will be rendered worthless.

The Left is nothing but a sensationalizing bigoted troupe dancing to the tunes of their masters. They are like this irritating Indian Uncle who just wishes that our family shreds so that they can have a piece of the pie! The Left can masquerade as the Utopian ideals of civilization for as long as they want to, but it doesn’t change the fact that they’re mostly a group of waffle minded Marxists with no work in hand.

Will the Supreme Court unify or divide?

A recent PIL filed by a citizen questions the rules framed by the executive in order to run the functioning of the state funded schools. The petitioner feels that, in particular, the Shloka recited as prayer in the morning assembly, “Om, (O Lord) Keep me not in the Unreality (of the bondage of the Phenomenal World), but lead me towards the Reality (of the Eternal Self) (O Lord) Keep me not in the Darkness (of Ignorance), but lead me towards the Light (of Spiritual Knowledge), (O Lord) Keep me not in the (Fear of) Death (due to the bondage of the Mortal World), but lead me towards the Immortality (gained by the Knowledge of the Immortal Self beyond Death), Om, (May there be) Peace, Peace, Peace”, has its origin in Vedas and since the Vedas are Hindu texts, this prayer may not be acceptable to those sections of the society who follow faiths other than Hinduism and hence is in contravention of article 28 of the constitution.

The Supreme Court has asked the central government to confirm and verify whether the prayers held in the morning assembly of the state run schools is a religious instruction of one particular religion, violating certain specific provisions of the constitution of the country. A lot of debate is currently underway on why the Supreme Court entertained this PIL which some think is frivolous, some feel is politically motivated, and some feel that it is provoked by foreign NGOs in order to hurt the feelings of the majority community in the garb of our constitutional provisions.

Whatever the reasons that the Supreme Court considered for admitting the PIL, it is rather more pertinent to examine how such a PIL should be dealt with, because this is not a simple issue of rescinding the Morning Prayer at schools. A lot more is at stake, and if the Supreme Court decides to rescind the Morning Prayer as it stands, then it will send a signal that it is anathema for one section of our society to respect a good thought simply because that thought originated from the religious texts of a different section of the society. Thus the broader implication of the Supreme Court’s decision will really be on how the ideal of “unity in diversity” enshrined in the spirit of the constitution will be achieved.

The time is ripe to focus on this issue because the world has become very divisive and sensitive today due to trends rooted in technological development. It is easy to observe that due to social media people are comfortable in their own groups and have become intolerant towards others who think differently or follow different faiths. Thus polarization in society is getting worse.

In this context, the court need to give a serious thought whether the prayer and Shloka are giving any particular religious instruction. The origin of the prayer may be from ancient religious texts but when you come to the literal meaning or sense it is creating then one need to ponder that isn’t the same message given by most of the religions that we all need to come out of darkness and seek light in the form of peace, unity, integrity and harmony of human race or is it impinging in any way on the liberty of the citizens in their thought, expression, faith, beliefs, and worship.

Indian Judiciary, has been one of the strong pillars of our democracy, and in response to Emergency, the Supreme Court introduced PILs which became a very important and crucial instrument devised by the courts to directly reach the public. Further, India’s judges have a long history of judicial activism that would be all but unimaginable in the United States. In recent years, judges required Delhi’s auto-rickshaws to convert to natural gas to help cut down on pollution, closed much of the country’s iron-ore-mining industry to cut down on corruption and ruled that politicians facing criminal charges could not seek re-election.

Our Constitution is the sacred document and the strength of our democracy propounding the spirit of “unity in diversity”.  It can really take us forward if followed in true spirit and sense for which it was created. So, once again it will be the testing times for our judiciary to see that constitutional values in our country are understood and followed in a holistic manner and not subverted in order to placate some sections of the society. The Supreme Court of India has got a rare and very important opportunity to pave the path of harmony and show the way for how the ideal of unity in diversity enshrined in our constitution will be achieved.

It remains to be seen if the Supreme Court will live up to the high expectations it has created.

Supreme Court appointed judges pays back to Congress ideology

Today 4 senior judges of Supreme Court out of 23 came in front of media and accused Chief Justice of India, Deepak Mishra and openly claimed that top court is “not in order” and CJI is transferring selected cases to his preferred benches. And also added, due to this Democracy would not survive in the country.

The 4 judges who claimed these, are:

  1. Justice J. Chelameswar
  2. Justice Ranjan Gogoi
  3. Justice Madan B. Lokur
  4. Justice Kurian Joseph

The issue is very serious and this incident happened first time in India that SC judges came in front of media and done the press conference and accused the CJI.

But the thing is, why this happened? Who is behind this? Why have CJI judges done the press conference like this? Who made them do this blast in the judiciary?

Let us analyze that in detail.

First, we will get to know about some decisions taken by our CJI Deepak Mishra.

  1. He reverted back the Mayawati’s government decision on Reservation in Promotion in UP.
  2. He got death threat because he rejected the 1993 Mumbai serial blast convict Yakub Menon’s appeal to stop his execution.
  3. He upheld the death sentence to four convicts in Nirbhaya rape case.
  4. He passed the order to play Nation Anthem in cinema halls before starting of every movie.
  5. He gave rights to women to enter in Sabriwala Temple in Kerala.
  6. He gave orders to Delhi Police to upload every FIRs online within 24 hours.

These all are some bold decisions taken by him. And he never felt afraid to stand against all these bad things happening even after death threats.

Now come to the point that why these 4 senior judges accused him. The main two causes of this are:

  1. He is leading the bench which will pass the judgment on Ram Janambhoomi issue and slammed Kapil Sibbal for delaying this issue.
  2. He ordered a Special Investigation Team (SIT) to reopen 1984 Sikh Riots cases and investigate 286 cases related to it.

The Congress played a very good move and judges appointed him in past pays back. Previously, I was a little bit confused why our top judiciary have done this but later seeing some incidents and reports in media after that, I came to know that these all the things are pre-planned and have done to weaker his judgment, put pressure on him and low down the standard of SC.

The senior leader of the left party, D. Raja met Justice J. Chelameswar before this. KTS Tulsi supported them, who represented Robert Vadra in DLF land case, 1993 terror attackers and also, he his nominated for Rajya Sabha by Congress.

Suddenly, all Modi haters came into support of these 4 judges and accused CJI. The picture got cleared enough after that.

My friends, if you are thinking that this is a big and bold move against the wrong things happening in SC by these 4 judges then you are on the wrong side.

Yes, many things are happening wrong in SC but the problem is not our CJI, the real problem is judges like these who was appointed long back by Congress and appointment system of judges in the judiciary which is going to reform by our CJI and Modi government for more transparency.

This incident happened just to question CJI decisions in future openly, lower down the morality of SC and question the constitution of India.

Book Review : ‘Hinduism and Nature’ by Nanditha Krishna

‘Hinduism and Nature’  is a book that blends spirituality, mythology, and an analysis of environmental awareness that is embedded in Hinduism. Nanditha Krishna, in her book, tries to bring out the close harmony between nature and the Hindu faith. The author quotes verses from Sangam literature, Bhagavad Gita, Vedas and Upanishads to explain the commitment that our forefathers had for the environment. This view presented in the introduction was particularly enlightening:

Hinduism has a cosmic, rather than anthropocentric, view of the world, an ontology sharply different from the Abrahamic religions which believe that ‘God created mankind in his own image'(Genesis 1:27) and ‘let them have dominion over the fish of the sea and over the birds  of the heavens and over the livestock and over all the earth and over every creeping thing that creeps on earth’ (Genesis 1:26) Hindu traditions acknowledge that all life forms- humans animals and plants are equal and sacred , and thus appropriately placed to take on contemporary concerns like deforestation, intensive farming of animals , global warming and climate change.

The book is filled with stories attached to forests, rivers and mountains across India. While emphasizing on the central role of nature in Sanatan Hindu culture, the author incorporates tribal belief systems and traditions as well in her book.

Nanditha Krishna explains how compassion and respect for animals, plants and our environment is embedded in the Hindu rituals and festivals at appropriate junctures throughout the book. The narrative starts with Rig Vedic people, who worshiped forces of nature like sun, fire, rain and wind. While retaining core values, it is also evident that some evolution has occurred in sacred texts in accordance with changes in material life. This is reflected in post- Vedic texts like Puranas.

In spite of being politically divided, the entire subcontinent was united by Hindu Dharma. From the book, it is evident that the geographical references in Mahabharata and Ramayana were not entirely fictional. When the new capital of Indraprasta was built after burning Khandava forests, a large number of animals and plants were killed. The author remarks that those who built cities over the destroyed forests wanted to take some measures to make amends. The corrective stance was reflected in subsequent religious texts.

Hindu puranas promised incentives to those who plant trees and punishment to those who fell trees. The author quotes Varaha Purana  which says promises that a person who plants a banyan, two pomegranates, five mango trees and ten flowering plants/creepers shall never go to hell. The Agni Purana says that plantation of gardens leads to eradication of sins whereas the Padma Purana warns of punishment in hell for felling a green tree. In the light of rapid deforestation and urbanization in modern India, a strong belief in these puranas could help us combat climate change.

While writing about sacred graves of India, the author is aided by her experience as an environmentalist. She outlines the tribal and Hindu traditions wherein religious sanction has been instrumental in conservation of forests and biodiversity. The author laments the erosion of the faith and urbanization that has led to decline in people’s commitment to conserve these forests. The practice of offering terracotta horses to deities of sacred groves  described in the book in particularly interesting

The mythological story behind each major river, mountain and lake of India is presented lucidly. It is quite clear from the book that the divinity attached to the water bodies because of these mythological stories helped in their conservation. Hinduism smartly blended the larger interest of society by attaching sacred value to rivers, forests and wildlife even though the society had transformed into a more materialistic civilization over the centuries. I was particularly impressed to learn that a King in Cambodia has build Angkor Wat temple inspired by Meru Parvata .

The book explains that the principle of ahimsa (non violence)  was extended to animals as well. Initially Vedas explicitly prohibited killing of animals for food. Later, this message became more implicit as deities like Shiva, Vishnu and other gods became a part of Hindu faith. This was ensured by assigning animals as vehicles to various Hindu deities. The book captures the rationale behind this aspect of Hinduism succinctly. While writing about the sacred value attached to cows, the author clears the air on beef consumption in Vedic society by interpreting the controversial word ‘goghna’ from Panini’s texts. ‘Goghna’ , according to Panini is a ‘receiver of the cow’ and not a ‘killer of the cow’ as translated by leftist historians.

Unfortunately, the boundary of this sacred space, involving rivers, wildlife, lakes and forests around temples is shrinking due to growing population and wants of the people. As the author rightly points out, we have forgotten the art of living in harmony with nature. The author captures the deep reverence that Sanatana Hindu Dharma had for nature convincingly in her book. She also stresses the need to draw lessons from our ancient philosophies and alter our attitudes in order to save the earth

The book is not only informative and seamless in its flow, but also forces the reader to contemplate about the disconnect between ‘modern’ Hindus and nature. It also nudges every reader, irrespective of their religion towards a greener lifestyle and a compassionate attitude towards all living beings.

Ripple up, Ripple down

So now they are saying Ripple is dead. All the running around, trying to buy Ripple is now futile. Really?

What they fail to understand is that Ripple – the “currency” and Ripple – the “technology” are two discrete things.

Satoshi must be turning in his grave looking at his creation being monkeyed around by bunch of “gold digging” idiots. (And don’t tell me he/they can still be alive). Bitcoin had three main objectives as a currency.
1. Maintain a secured ledger
2. Keep transaction fees low
3. ‎Finalize the transition quick.

The core objective was never really to become a trading instrument. Today, it survives as a superior ledger, but is suffering from all old age ailments. CoinMarketCap would disagree, but from a technology standpoint, it is indeed true. It has reached its shell life in terms of its journey as an alternative currency. It can no more compete with the Fiats. It is not cheap on transaction fees, nor quick.

On the other hand, blockchain is the future. In the coming few years, there will not be a field that blockchain will not grace. The concept is so elegant that it will find its way into our daily lives in every sense. Be it IOT, financial transactions (not just interbank like Ripple), real estate, IP/copyrights – there are 200+ real life application areas that are being explored. Though the visibility of the commercial side of blockchain is higher (read ICOs), there is indeed a lot of technology research taking place right now. At the very least, the ICOs are bringing in a lot of funds upto the techie.

Back to the Ripple story. The “currency” Ripple may be considered as just another moolah raking instrument. It has remote connection with the “technology” Ripple and the real-life problem that it is trying to solve – making inter-bank transactions quicker and cheaper. (btw, the role of Ripple is only to cover the transaction fees in the Ripple network). Ripple now has the presence, association and commitment of a few majors in the banking industry. So the technology Ripple is here to stay. At least, they will make sure it stays (shareholders stake).

A closing anecdote. The market that Ripple is trying to enter into is currently monopolized by Swift. So in effect, Ripple’s revenue could become equal to Swift’s current revenue in some time (assuming 100% market share). Maybe a little more owing to the superior transactional capabilities. But where did the current Ripple currency market cap of $100 billion come from? What projections are these? And what is the basis?

Doesn’t matter as long as the market is performing, does it?
