Leveraging COVID-19 crisis to boost Indian Economy

0

These are unprecedented times we are in the midst of a pandemic; world has no experience in dealing with a pandemic so ferocious a pandemic so devastating. It is a nightmare which the world is going thru and there seems to be no panacea. Winston Churchill famously said during World war II “If you’re going through hell, keep going.” That is exactly what we have to do now. This pandemic has affected everything our lifestyle, our thinking our psychology and most importantly our economy.

Outlook for the world economy looks bleak. World GDP is expected to contract by 3% as many countries including the USA, Europe, Spain, Germany, and France are expected to contract by 6-7% as per the IMF report. Indian economy which was otherwise growing at a rate of 5-6% is also expected to suffer its worst recession.

Our Prime Minister on 12th of May 2020 announced a stimulus packaged of Rs. 20 Lakh crores which is roughly equivalent to 10% of our GDP to move the wheels of the economy and has also given a massive thrust to “Make in India Campaign”

Some of the leading journalists have predicted a doomsday scenario for India with growth actually contracting but let us try to make some sense of these numbers. Is it similar to what the situation was in 1991 or things are even worse as the entire western media has cast aspersions on India’s dealing of the pandemic; Even though India is now a much bigger economy of USD 2.93 Trillion and has sufficient Forex reserves but still naysayers are not hesitant to vilify our country for they do not believe in India’s growth story. Though there is some merit in their arguments as tax revenues including GST is going to be much lesser than previous years but let us analyze the entire picture from a holistic perspective.

Let us look at the overall crisis. Indian economy is in much better shape today than what it was in 1991 when a balance of payment crisis loomed largely and there was a chance that India might default on the payment of its external debts.

Importance of Foreign Exchange Reserves:

Foreign Exchange Reserves refer to the international reserves held by a country’s central bank. RBI holds India’s foreign exchange reserves (“FX reserves”) in the form of foreign currency assets, gold, Special Drawing Rights (“SDRs”), and Reserve Tranche Position in the IMF. India’s total foreign exchange (Forex) reserves stand at around US$ 501.703 billion on 05th June 2020

High foreign reserves are considered to be helpful for a developing economy like India which has a large Current Account Deficit. Adequate reserves ensure the availability of foreign financial assets within the country. India’s foreign exchange reserves are sixth largest in the world and it can be stated that there is no balance of payment crisis which was the scenario in 1991.  India is ranked sixth on the list topped by China with over USD Three Trillion in foreign exchange reserves.

India has foreign exchange reserves over USD 500 B which according to the global standards are very high. As per the universally accepted Guidotti-Greenspan rule, the Foreign Exchange reserves should at least equal the short term external debt of a country. If India moves according to this its reserves should be 108 billion USD as it is the STED, as in March 2019. India’s overall reserves are sufficient to deal with the short term debt payments which are $ 108 billion.

The second most important situation under the present crisis is our CAD. Let us look at the major components of CAD. Our CAD is high because of crude oil prices which result in a high negative balance of trade. our BOT was net negative USD 180 B. But what helped us keep our CAD in check is inbound foreign remittances from Indian diaspora and also somewhat thru tourism sector

In 2018-19 our fuel import bill was more than USD 167 Billion dollars, considering the way things are in the current financial year fuel oil bill is going to be less than USD 60 Billion, we imported 259 MMT of Petroleum and petroleum products at average when our average Indian crude basket was USD 70 a Barrel. This price is likely to be reduced to USD 25-30 a barrel and with the reduced consumption as well the import bill is likely to be around USD  60 Billion dollars resulting in a net saving of $ 100 Billion dollars because of crude oil imports.  The import of other items is also likely to come down because of lesser demand.

Our import bill is likely to dwindle to 300 Billion dollars from over $ 500 Billion in 2018-19. However, there is a flip side as well our exports are also likely to come down by $ 100 Billion as there is very little production in the factories and the entire world economy is also undergoing a meltdown.

However, not all is lost for us on the export front as some of our agriculture and fishery produce is unlikely to be hit. Hence net trade deficit is likely to come down from USD 180 Billion to about USD 100 Billion which is a positive sign for a country like India with a huge trade deficit. Also, these numbers do not look good if we are looking at our GDP.

As per RBI data inbound foreign Remittances, Foreign remittance contributed over $ 70 B in 2018 -19 because of which we could manage our CAD to USD 57 B for the year 2018-19 and considering the way things stand even if we take a loss of around USD 30 B towards foreign remittances and inbound tourism we will still end up with a CAD which is around USD 20 B dollars which will be 0.5% of our GDP, also there are chances we might have current account surplus for the financial year 2021.

The major focus of Government has been rightly towards the MSME sector and it can be gauged from the slew of measures announced by the Finance minister including abolishing of Global tender up to 200crore and providing three lakh cores to MSMEs collateral-free Automatic loans.

The government can use USD 50 Billion from Forex reserves and use this amount to transfer Rs. 12000/- into each of 300 Million Jan Dhan accounts. It will serve the dual purpose of spurring the demand and increasing production which is much needed and in turn generating employment.

It is the best time to tweak the labor laws to make them more industry-friendly and do away with those archaic labor laws that disincentives the industry and threaten the businesses.  Academia needs to work in coordination with the industry to design industry-friendly courses so that our vast human resource can actually help in raising productivity

Encouraging banks and NBFC to lend more, even if some of the loans become NPA Government should encourage banks, NBFCs to lend and put more money in the hands of industry. The government should reward banks and NBFCs which dole out loans especially loans to MSMEs. No vigilance and CBI inquiries against loans disbursed in the period. This is a God-sent opportunity to overcome red tape and unnecessary bureaucratic interventions.

Our Pharma sector can be the bellwether of our exports, we can be a pharma factory for the world by supplying medicines and vaccines. It will also give us a chance to showcase our Ayurveda and Naturopathy to the world enhancing our image worldwide.

Every crisis is an opportunity and COVID-19 is also an opportunity for India to stake its rightful claim in the world Pecking order. It is the time for India to step up and become the World “Arogya Guru”, Make in India in style.

Mainstream media should know that war journalism is serious stuff, not cricket commentary

An event of profound significance happened in Galwan valley of Ladakh on. June 15, 2020 night and galvanized the nation instantly as the news broke out the next morning. The mainstream media no doubt carried the news to every nook and corner contributing to the cause of national consolidation. However, a majority of them were also seen going for an overdrive to the extent of creating a kind of hysteria over the issue and thus posing a threat to rational decision making by authorities concerned. In this process they extensively leveraged irresponsible and abusive statements by several opposition leaders who had jumped into the fray as soon as the news of Indian casualties broke out. Whether or not such style of handling issues of such enormous importance as ‘war’ or ‘war like situation’ is in national interest warrants national introspection. Little elaboration.

How opposition behaved?

The reactions of the opposition camp were three types: (a) accusing the government for lack of transparency on what was happening at LAC, and demanding regular sharing of information with them; (b) demanding immediate retaliation against the Chinese; (c) abusing the prime minister in various styles one stooping down to raise question about the breadth of his chest.

Handling by mainstream media

The mainstream media seemingly bothered only about TRP acted more subtly. Conscious that creating frenzy is bound to hamper the process of making rational decisions, many TV channels took the apparently nationalist line  ‘while the whole nation stands united, opposition is asking many (undesirable) questions’. In further pursuance to that line, they kept collecting every bit of abusive sound byte from every possible social media or press statements of known or even non-descript leaders and gave them extensive publicity round the clock. Even the experts invited to speak were tacitly egged on to take extreme position, as if the best strategy of the armed forces can come out instantly through discussions in TV studios!

War journalism is not cricket commentary

When would the mainstream media of the country realize that dealing with ‘war’ or a ‘potentially war like situation’ is not playing a ‘day and night cricket match’? A war is a serious thing and it may span over weeks, months or years. To win a war it calls for great determination, cool courage, self-restraint, intelligent decision making, active contributions – physical, monetary & others from every section of the society. J&K and Ladakh in particular, has been one of the most complex legacy problems handed over to the present government.

Galwan valley is a legacy issue- far complex than meets the eyes

The challenge is far wider considering that at long last Modi govt has set recovery of the whole Aksai Chin as its goal. The action in a particular front, whether at Galwan valley or elsewhere, must fit into the overall military strategy. It should be extensively thought out, well calibrated to comply with both strategic and tactical norms, and part of an integrated whole.  No action can be taken in impulse. Patience, intelligence and courage are all needed in equal measures. Viewed in the overall context, creating a nationwide frenzy calling for retaliation and baying for enemy blood here and now can create undue pressure on the armed forces and force them to make suboptimal decisions.

Deja vu

What India witnessed on Tuesday is a deja vu of how mainstream media, especially the TV channels had conducted themselves during Pulwama episode, and more particularly on the issue of return of wing commander Abhinandan Varthaman from Pak captivity on March 1, 2019. The manner in which these media created a frenzy on the day of his return remains etched on to public memory till date. While the trenchant Pakistani culture of dealing with POWs kept creating doubt about his release till late afternoon, a few of them stooped down to the level of subtly creating a regional angle to an entirely national issue by highlighting his nativity in southern India. Thankfully, the media did not go down further on the issues of caste or religion. But nothing seemed impossible for a TRP hungry media!

How the crisis waned despite the frenzy?

It is hard even to imagine what would have happened had Abhinandan not returned that night! His return had set at rest all the hype. In the case of the Galwan issue as well things have begun to cool after the Indian military and MEA issued statements. From them as well as other sources such as ANI we know that while 20 brave Indian soldiers with a commanding officer were martyred, the casualty in the Chinese side were far heavier to the extent of 43 lives. On Wednesday a US estimate confirmed heavy casualty on Chinese side besides the death of the Chinese commanding officer.

Lessons for the mainstream media

What lessons do these two incidents convey to the mainstream media? Who knows it better than them that most opposition leaders in India are so obsessed with political interest that they cannot cooperate with the ruling party even while dealing with enemies of India? Therefore, to deal with war or war like situation, they need to be more mature. Media is called as the fourth pillar of democracy. When India has an elected government that has massive mandate, the people have trust in it and they should allow to retain it.

Similarly, the Indian armed forces are one of the finest in the world and there is every reason to have confidence it its capacity, prudence, patriotism and strength. By creating a frenzy, the media will help dislocating the public confidence in both political and military leadership. Will that not be akin to acting like the infamous ‘fifth columnists’ of the enemy within India? The ‘Galwan’ issue should make a major portion of mainstream media to introspect in these lines.

For the time being two sides have disengaged from the scene of confrontation. However, there is no guarantee that Chinese side will not make new misadventure in any other sector around the LAC in J&K or elsewhere along  kms of Indo-China border. In such an eventuality the mainstream media will have an important role. It will do a service to the nation if it considers a paradigm shift in the style of dealing with such situations and apply it generally to war and warlike situation.

Unraveling the “I am here for you”

Deck- Are people with mental health issues ready to open up and are people ready to listen without judgements?

Sanskriti Falor

Sitting at lunch, swiping through social media and suddenly receiving the grave news of Sushant Singh Rajput dying of suicide, left me in utter shock. I remember discarding the news as fake and checking at least 10 websites before letting it sink in. Within a few hours my Instagram feed and Whatsapp were filled with pictures of the actor and speculation of his depressed state. At one side, there were people urging everyone to be empathetic and kind and on the other were media organisations stuffing mics in the face of the actor’s family.

There was a blaze of despair on social media over the passing of the artist who was an ideal example of a “Self-made” actor. His struggles and hard work helped him make a mark in both his television as well as Bollywood careers. His fellow actors as well as several reports claimed that the actor was suffering from depression. His death started a conversation on mental health and healthy communication over various platforms.

Mourning a celebrity’s death is not new in this country or anywhere in the world. Every time an ideal or famous icon dies, social media and news websites flood with their memories, tributes, celebrating their careers, expressing sorrow. This death was different than the others, firstly, because it was untimely and he had a longer life ahead which is why it came as a shock to all of us, secondly because it was a suicide and since it was one it opened a room for discussion on mental health and it’s likes. These two are also the reason for speculations, conspiracy theories and sometimes (at least in this case) unsettling images going around the internet.

While the actor’s death is extremely saddening, so is this sudden outburst of “Talk, Seek help, I am here for you”. As someone struggling to keep her own mental health in check on a daily basis, I believe it is easier to say ‘I am here for you’ than apply it because being there for someone suffering from anxiety or depression is a process, it requires a constant effort. It is extremely triggering to see people; who ignore when you talk, don’t listen properly, disregard mental health as a phase; putting up stories preaching that they are there for you.

One of the tweets that went viral after Sushant’s death said, “If suicide ever crosses your mind just know, I’d rather listen to your story than attend your funeral”, this tweet made me realize that people would see and recognize your depression only if it leads to suicide. None of us ever knows what anyone is going through, consistently being kind to all everyday is the one thing we should practice. Not everyone wishes to discuss their issues, hence kindness is what’s going to help in the longer run to understand the importance of mental health and not a one-day burst over the internet.

There has been a need to bring a change in how people perceive mental health and to de-stigmatize it, especially in a country like India where we constantly get to hear things like, “How can you be smiling and still be depressed?”, “Depression and all is nothing, you’ll get over this phase”, “You just overthink a lot, try not to”. Everyone does need to educate themselves more on mental health, better things to speak, better ways to help friends and most importantly better ways to be there for them.

Accepting mental health issues is more than being philosophical and writing poems on twitter to talk about problems. Lost in the trend of being aware about these issues, people have seized to go beyond that and make an effort to understand them and how they take a toll on someone’s mind. Things like, “He had it all, money, fans, good career; why did he take his life?”, need to stop because happiness and peace cannot be bought with money and fame.  Everyone has different issues and a unique way of dealing with them, while some can choose to talk about it others just want people to be there, no questions asked but no one likes a temporary, I am here for you.

The demise of Sushant was extremely appalling and disheartening. People actively addressing the issue of depression and mental health is just the beginning of a long journey for India. Addressal of the issue brings awareness and would in-turn lessen the stigma around therapies, consuming medicines and seeking help. Making an effort and acknowledging that the society is flawed is one step forward towards a non-judgmental society. The band-width of problems surrounding mental health is wider than it seems, some people don’t have any friends to talk to, some don’t have the resources to seek help and some are blamed for seeking attention when they decide to finally talk about it. The world’s more cruel than we think and what triggers someone no one knows. People with mental health issues need space to interpret their suffering, warmth and kindness but no one wants to hear that their problems are not real and that ‘they’re too sensitive’ or ‘too depressed’. We need to be each other’s cheerleaders; not judge and disregard feelings.

High time to confront modern Hitler- the Dictator President Xi and his bully country

0

It’s brutally shocking to hear that 20, probably much more, of India’s soldiers have been martyred. Its probably the biggest casualty at border after Kargil war.

As India’s Jawans are dying to secure our borders, it’s time for Indians to take a pause and think about the future. These casualties, deaths, scuffles, and probably even firing and worse things will keep increasing with China’s larger goal to be a bully. It’s a nation just like North Korea, or Nazi Germany ruled by a dictator and whose ambition is territorial expansion. So it won’t be wrong to say that Mr. Xi is the 21st century’s Hitler, and therefore consequences, not only for India but for entire world, could be serious. Very very serious!

We, and whole world, must take on China on economic as well as military front. Refuse to buy any product, phone, toy, automobile that even has  a spare part built from china. Of course getting a complete list could be tough, but surely if we all come together, we can identify all those products.

Chinese software as well medicines need to be totally boycotted. Let us complete and share a list of all Chinese digital platforms that make money from Indian operation.

It’s also important that we, all adults, are prepared and willing to participate in this battle. It could be a long war, it may take a few months or year, but there may be a time when I and you may be needed to be drafted in Army. We must be prepared for that.

China is like a drunkard who believes it can rule and subjugate the world with its economic and military muscles. It must remember that even USA has not been able to win any war in past many decades. It can stop our economic progress, it can stop our peace, but it can not break our pride to defend our nation and its sovereignty.

Talk to your friends, and do everything, small or big, that you can do help our soldiers.

The WAR is already on. Lets fight in every possible capacity.

And yes, it’s not jingoism. We are the most peaceful nation. We believe in innovation, peace, love, and human development.  But we can’t see our soldiers getting brutally killed. We can’t keep being bullied every day.  We can’t leave our soldiers alone to die. We can’t go to border today, but we must find a way to be a part of this battle. NATION FIRST.

Umpire Shamim Dad’s son’s health deteriorated; had to sell house and jewelry for treatment

0

The state panel umpire gets two and a half thousand rupees a day. The life of many umpires runs on this basis. But the umpires also sat down when the games were closed due to Coronavirus. Madhya Pradesh umpires and scorers set an example by collecting nearly two lakh rupees in an hour after the health of the son of an umpire from Chhindwara deteriorated.

Shamim Dad of Chhindwara is the state panel umpire. He was a sports officer in a private school. He borrowed and opened a sporting goods shop before the lockdown, but the shop closed down causing losses. His son had a serious illness and the doctor asked for the operation.

Shamim told, ‘My house, jewelry are all sold out. Now only two-wheelers are left to sell. In bad times, Ramesh Kushwaha of ‘Umpire Scorers Association’ came to be the deity. On his initiative, the state umpires and scorers collected about two lakh rupees in an hour. This is an example. His son is currently undergoing treatment at a hospital in Nagpur. “

To help Shamim, international umpire Nitin Menon and Bobby, who worked as a curator with the Bangladesh Cricket Board, extended their helping hand. This incident is also being seen as an example of Hindu-Muslim unity. Kushwaha said that a lot of money is seen in cricket, but the ground reality is different.

When the problem occurred on Shamim Bhai, all the umpires and scorers of the state together collected 1 lakh 87 thousand rupees voluntarily. MP Cricket Organization (MPCA) has also assured help. Earlier, the financial condition of umpires of the Indore Divisional Cricket Organization (IDCA) had also deteriorated due to the lockdown. The ration was also over in the house of many. After which the financial assistance and ration materials were distributed by the IDCA to the 10 umpires and scorers of the division.

“Jai Bhim – Jai MIM” is an insult to Babasaheb

Other than the rise of the right-wing Hindutva ideology in the recent past, one of the interesting trends in Indian politics is the deepening bond of Dalit leadership and Islamists. Though there is nothing new or wrong in two or more groups joining hands to achieve common political objectives, the Dalit leaders are digging the grave their own graves by colluding with the Islamists. The reasons are as follows:

  1. Ideologically, it is against the ideas and ideals of Babasaheb Dr Bhimrao Ambedkar whose work is the ultimate source of inspiration for Dalits in modern India.
  2. Practically, it is against the safety, welfare and development of Dalits.

In this article, I prove the first point, i.e., the idea of Dalit-Muslim unity is not only different but also antagonistic to the thoughts of Dr Ambedkar on Islam and Muslims.

In his brilliant book titled “Pakistan or the Partition of India”, Ambedkar argues in favour of the Partition with a complete transfer of populations so that Pakistan becomes a homogenous Muslim population, while Hindustan becomes a non-Muslim (mainly Hindu) population. The central argument was that even if Hindus and Muslims are somehow made to live in one country, as one people, bound by a single constitution;  a system thus formed will eventually be disrupted from within. To support his argument, he insists:

How the Muslim mind will work and by what factors it is likely to be swayed will be clear if the fundamental tenets of Islam which dominate Muslim politics …are taken into consideration.

Dr Ambedkar mentions the following fundamental political tenets of Islam (He also mentions, as evidence,  the anti-Hindu activities and speeches of the Islamists of his times, which were based on these doctrines.):

“… In a country which is not under Muslim rule, wherever there is a conflict between Muslim law and the law of the land, a Muslim will be justified in obeying the Muslim law and defying the law of the land.”

“The world is divided into two camps, Dar-ul-Islam (abode of Islam) and Dar-ul-Harb (abode of war). A country is Dar-ul-Islam when it is ruled by Muslims. A country is Dar-ul-Harb when Muslims only reside in it but are not rulers of it … India, if not exclusively under Muslim rule, is a Dar-ul-Harb and the Musalmans according to the tenets of Islam are justified in proclaiming a Jihad.”

Desecration of Amar Jawan Jyoti during the Azad Maidan riots. 11 August, 2012. Mumbai.

“Islam does not recognize territorial affinities. Its affinities are social and religious and therefore extraterritorial. This is the basis of Pan-Islamism. It is this which leads every Musalman in India to say that he is a Muslim first and Indian afterwards.”

The pride of “their services over centuries to Islamic causes” and the threat of “an avalanche”.

Today, there seems to be a total lack of both idealism and realism in the Dalit leadership when they completely ignore these basics of Islam as explained by Dr Ambedkar. It is impossible for any sane person to believe that these political leaders are not aware of the simple truths that the above mentioned political doctrines of Islam are :

— clearly, regularly and sufficiently expressed by their Islamist collaborators. The most out-standing expression being the open display of anti-Kafir hatred and violence during the recent anti-CAA riots. Read : https://www.opindia.com/2019/12/worst-of-2019-anti-caa-protest-riots-anti-hindu-visuals/amp/

— applicable to the (so-called) lower caste Hindus as well as they apply to the (so-called) upper castes.

All members of the SC/ST/OBC communities, whom these leaders claim to represent, must ask themselves a simple question: Why did Ambedkar not collude with the Islamists of his times, even though he was so frustrated with the attachment of the upper-caste Hindus of his times with the caste-system and other social evils?

The following words of Ambedkar about Islam make his views absolutely clear:

“The brotherhood of Islam is not the universal brotherhood of man. It is brotherhood of Muslims for Muslims only. There is a fraternity but its benefit is confined to those within that corporation. For those who are outside the corporation, there is nothing but contempt and enmity. The allegiance of a Muslim does not rest on his domicile in the country which is his but on the faith to which he belongs. To the Muslim ibi bene ibi patria is unthinkable. Wherever there is the rule of Islam, there is his own country. In other words, Islam can never allow a true Muslim to adopt India as his motherland and regard a Hindu as his kith and kin.”

(Emphasis added, ibi bene ibi patria means “here our life is good, so here is our fatherland”)

However, not everyone was as rational as Ambedkar. One of his own followers, Jogendra Nath Mandal, colluded with the Muslim League and joined Pakistan cabinet. He was assured by the Islamists that the new Muslim-majority country will be a safe haven for Muslims and Dalits, away from the tyranny of a Brahminical rule. That this ignorant leader’s decision proved to be a horrible tragedy for lakhs of Dalit men, women and children should not surprise anyone.

If we are serious about carrying on the legacy of Babasaheb, we must ensure that the people who lead us or claim to be our leaders should never fool us into treading a path which is, in essence, the same as that of Jogendra Nath. If we do so, and abandon the path of Dr Bhimrao, shouting “Jai Bhim-Jai MIM” while pretending to be his followers, we are destined to be doomed.

MHRD: COVID warrior in disguise

0

Ever since the pandemic started and later appeared in India, Ministry of Health & Family Welfare and Ministry of Home Affairs have been in news due to obvious reasons of a health crisis in the country and nation-wide lockdown measures. Government of India has been working day and night with extreme measures and care to ensure minimum damage to the lives of people due to the global outbreak of coronavirus. Though unabated efforts of every ministry and unit are appreciable, I wish to highlight why the Ministry of Human Resources Development is a COVID warrior in disguise.

At times when MHA is ensuring the minimum transmission of the disease and MoHFW is ensuring maximum recovery of lives, MHRD is ensuring sound mental wellbeing of around one-fourth of the population directly and of rest indirectly, in addition to ensuring learning continuity, accessibility and digital equity.

MHRD, under the able guidance of Minister Dr Pokhriyal, has been working hard on integration of technology in education through various initiatives such as Operation Digital Board, E-Pathshala, DIKSHA, VIDYADAAN, SWAYAM, SWAYAM PRABHA and #BharatPadheOnline. These platforms ensured ample learning material and sources for students all across the nation to continue with their regular schooling digitally. SWAYAM PRABHA, a kind of an initiative, allows 24X7 access to video lectures on 32 DTH Channels.

Swayam Prabha : FREE DTH Channel for Education

Despite so many platforms to ensure learning continuity during the lockdown period, MHRD felt that accessibility and digital equity is a major concern. To sort it out, NCERT has recently signed an MoU with Rotary International to develop e-learning material to telecast on all NCERT TV and Radio Channels for all levels. This will allow learning to travel efficiently in rural routes, where the availability of gadgets and internet connectivity is an issue. Availability of content in regional languages will further add to learning friendliness.

Ensuring learning continuity and accessibility, even in the remotest areas of India, is a big success for MHRD and must be acknowledged. These efforts have not only kept schooling continue but have effectively engaged student and teaching community in constructive distractions away from anxiety and emotional stress due to the pandemic. Diverting tender minds from a psychological crisis and involving them in productive learnings and innovations is a big challenge to achieve in a population of 1.3 Billion and MHRD is doing exceptionally well.

MHRD in collaboration with the Ministry of Sports and Youth Affairs floated a digital version of Fit India Movement to promote fitness among students through indoor games and exercises. This not only maintained physical stamina and helped boost immunity, but also ensured sound mental well-being and good family time.

Central Board of Secondary Education cited lockdown as “Golden Period” as the board in an endeavour to help teachers who are facing disruption in education due to the ongoing COVID-19 pandemic, launched a free online teacher training certificate program that can be taken by educators. These online real-time training programs conducted by experts are turning out to be highly efficient as it rightly targets convenience, scalability and adaptability. The academic unit of CBSE has floated various initiatives and platforms to ensure that the right content reaches students at the right time. The academic restructuring will ensure minimum loss to learning and academics all across India.

Central Board of Secondary Education

Ministry of Human Resource Development has left no stone unturned to ensure that children, even in the remotest area of rural India, are left unconnected to regular schooling. With such diversity and vastness in India, comes bigger obstacles. MHRD has worked and is continuously engaged in challenging these obstacles during the pandemic. I am sure the digital revolution that MHRD has established will go a long way in defining Post COVID New India.

Indo China clash: An inevitable bloodbath

I would suggest to my friends that they should refrain from frying up their grey matter, in regard with the latest India China clashes on the border. No need to inflate one’s ego by giving tutorial to Modi Government in how to conduct business with China.

I know that after 1962 Indo Sino war, which was utter humiliation for Indian side, this bloody clash is the singular most outrageous incident has happened but then it’s also the most important one. No doubt 20 of ours men died in this clash but it was inevitable. If one decipher the whole thing in cold manner then one can easily understand the reason why China went on to make things all bloody, at this juncture of time when China’s goodwill around the world is in question.

The present leadership of China under Xi, is at the receiving end and his position day by day is getting weaker in the Communist Party of China. Various reports from the western intelligent outfits are indicating that dragon is wounded by the Xi government’s handling of Chinese Corona Virus and it’s subsequent effect on her global position as well economy. There was a dire need on the part of Chinese to flex her muscles to tell the world that Dragon is in no mood to back off from the position they have taken in this regard.

The whole Chinese hegemony game plan was going their way up till 2014 but then the come across a stumbling block when they lost their biggest ally, India. Their main asset, Sonia Gandhi governed Congress lost the power and with that their well cultivated left liberal moles lost their muscles.

Chinese handled first Modi government with kid gloves but Modi coming back in 2019 rattled them. Modi government’s handling of Jammu Kashmir matter and cultivating Laddakh as Union Territory along with aggressive claim on Gilgit Baltistan, was a more bad news to China than Pakistan. China was so used to spineless Indian government so far that persistent display of spine by India’s Modi Government was not something which was in China’s interest.

If one look through the Chinese eyes then it’s quit understandable that China could not afford for long, to not to punish India for showing her spine. It was the perfect time for them to do so as right now Modi government is battling in various fronts. After fanning anti CAA protest on communal line, the whole Sonia Gandhi led Congress as well her allies are all out for blood and busy making sure that Corona pandemic drowns the Modi government in the economic mess. So a Chinese punch at this time, which can be claimed by Congress led opposition as well left liberal media, as a Modi government failure then its all music to the ears for Chinese. With this China can hope to see their assets in India getting relevant back into Indian politics and put India back into shelf.

Personally I am mighty pleased with this new development as, it ends the suspense for me. I was looking for long the opening where China will make her move and now its a done thing. Things might go bloody for sometime but I am sure that China will cut her losses very fast. China tested India and what firsthand experience they had, is not something which is going to help them in these tiring times. China cant afford a war with India right now as India doesn’t have any option but to hold on, at any cost. War right now is bad business for Chinese. It will take place but in another time in future.

In present condition my advice to all those Indians, whose blood is boiling with Chinese inflected bloodbath is that instead of preaching the Modi Government, just watch the coming incidents unfolded and cut yours contribution, which you people are making to China’s coffer by buying, selling and using things which bears the stamp of China. Don’t look up for the excuses and blame the Indian government for not breaking ties and business with China, as India cant afford it right now as Indian economy is addicted to Chinese.

A conservative justice turns liberal to Trump conservatism

Associate Justice of Supreme Court of the United States (SCOTUS), Justice Antonin Scalia, died on 13th Feb, 2016. As per the US Constitution, the President of the United States (POTUS) gets to appoint the replacement for the deceased Justice. The nominee has to be approved as Justice by the US Senate, in its Senate Judiciary hearings. The nominee is put to the severest test by members of the Senate Committee and there are instances of candidates being rejected- as say Robert Bork. Or Clarence Thomas passing the Senate hearings in a no holds barred inquisition like proceedings, into his alleged sexual encounters with one Anita Hill. There are Nine on the SCOTUS and they are appointed for life. On the death of Justice Scalia, the then Democratic POTUS Barack Obama nominated Merick Garland as his replacement. He was perceived to be a wonderful candidate with a blemishless record of service as Circuit Judge of Appeals Court in the District of Columbia.

In a divisively partisan position, the Republican majority Senate refused to even give audience to Merick Garland, for a hearing. The Republicans said that with Presidential elections due in Nov,2016, “Barack Obama was a lame duck POTUS” and it was only for the incoming POTUS after the elections for nominate the replacement. There was nothing in the US Constitution to this effect, but it was of no consequence as the Republicans played dirty. Donald J Trump, became POTUS on the Republican ticket. And promptly he nominated Neil Gorsuch to replace the deceased Antonin Scalia for SCOTUS Jusriceship.

Neil Gorsuch was identified as a ‘conservative with Republican values’. Donald J Trump got a chance to replace a retiring Justice Anthony Kennedy also with a controversial candidate in Justice Bret Kavannaugh, and whose Senate hearings in the wake of his alleged sexcapades attracted worldwide attention. Kavannaugh passed the tough test, as the Republican majority was unyielding and uncompromising.

With two nominations during his term as POTUS, a rarity in the over 200 year history of SCOTUS, Trump was seen to have pivoted a Liberal majority Court of 5:4 to 5:4 in favour of Conservatives. Remember the decision of SCOTUS in Obergefell v Hodges on 26th June, 2015, when Obama was POTUS. The SCOTUS by 5:4 majority upheld gay marriage in the US, thanks to untiring efforts of a Republican lawyer in Ted Olson and Democratic lawyer in David Boies, (the two who fought on opposing sides in the Bush v Gore SCOTUS battle in 2000) who joined forces, in a bi partisan manner, for a cause. To redeem a dream, they said and wrote (white House was lit with rainbow colours then, to signal the approval from the POTUS administration).

So, with the appointments of Justice Neil Gorsuch and Bret Kavannaugh to The Nine on SCOTUS, it was perceived that there would be a pivot in favour of conservatism. It got noted so, also when Donald Trump’s views on Immigration policy got the nod from SCOTUS. So, the expectation in the matter of issue on Title VII of Civil Rights Act of 1964- vis a vis rights of gay and transgender employees was that the now conservative SCOTUS would side with the Trump administration and rule against gay and transgender rights, perceived to be Liberal values.

Alas not to be, as none other than Justice Neil Gorsuch, a Trump nominee at that, a conservative to boot, has penned the majority opinion. By a 6:3 and not the anticipated 5:4 reverse – the SCOTUS has ruled that it was discriminatory under Title VII to Civil Rights Law of 1964 to deny the benefit of equality in rights to employment to those with a different sexual orientation or transgender characteristics.

It is a huge win for the liberals under a Republican administration and by a majority opinion written by a conservative appointee of Donald J Trump. Justice knows no hues. An appointee to be a Justice of SCOTUS was not like picking a pet dog to perform the tricks you have trained it to. When it comes to intellectual honesty, the appointee on the SCOTUS will surely reveal his true colours, even rainbow ones, as on this historic occasion. Surely, this decision and one awaited on disclosure of Donald J Trump’s personal income tax records, will have a huge impact on the re-election bid of Trump against the democratic nominee in former Vice President (for two terms and 8 years under Barack Obama) Joe Biden. Now, contextually read the verdict in Bostock v Clayton on 15th June,2020, to appreciate the landmark nature of this rainbow appearance. (Maybe Trump will light up the White House in darkness, to express his administration’s response).

SUPREME COURT OF THE UNITED STATES

BOSTOCK v. CLAYTON COUNTY, GEORGIACERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR THE ELEVENTH CIRCUIT

Facts of the case

In each of the cases an employer allegedly fired a long-time employee simply for being homosexual or transgender. Clayton County, Georgia, fired Gerald Bostock for participating in a gay recreational softball league. In Altitude Express fired Donald Zarda days after he mentioned being gay. And R. G. & G. R. Harris Funeral Homes fired Aimee Stephens, who presented as a male when she was hired, and later had informed that she planned to “live and work full-time as a woman.”

Each employee sued, alleging sex discrimination under Title VII of the Civil Rights Act of 1964. The Eleventh Circuit held that Title VII does not prohibit employers from firing employees for being gay and so Mr. Bostock’s suit could be dismissed as a matter of law. The Second and Sixth Circuits, however, allowed the claims of Mr.Zarda and Ms. Stephens, respectively, to proceed.

The aggrieved employee Mr. Bostock and Employers Altitude Express and R. G. & G. R. Harris Funeral Homes have come up with the present appeal before SC

Appeals

The Appeals were heard by nine member bench, and majority of 6:3 held that “Title VII of the Civil Rights Act of 1964, which prohibits discrimination “because of sex,” includes gay and transgender employees.” The ruling will extend protections to millions of workers nationwide as against discrimination based on sex.

Majority View

GORSUCH, J., delivered the opinion of the Court, in which ROBERTS, C. J., and GINSBURG, BREYER, SOTOMAYOR, and KAGAN, JJ., joined

(i)     Title VII makes it “unlawful . . . for an employer to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual . . . because of such individual’s race, color, religion, sex, or national origin.”

(ii)     Title VII’s terms interpreted in accordance with their ordinary public meaning at the time of their enactment resolves these cases

(iii) A statutory violation occurs if an employer intentionally relies in part on an individual employee’s sex when deciding to discharge the employee. Because discrimination on the basis of homosexuality or transgender status requires an employer to intentionally treat individual employees differently because of their sex, an employer who intentionally penalizes an employee for being homosexual or transgender also violates Title VII.

(iv). The employers do not dispute that they fired their employees for being homosexual or transgender. Rather, they contend that even intentional discrimination against employees based on their homosexual or transgender status is not a basis for Title VII liability. But the said argument has been rejected holding ignoring the law as it is no excuse.

(v)  The employers contended that homosexuality and transgender status are distinct concepts from sex, and that if Congress wanted to address these matters in Title VII, it would have referenced them specifically. But when Congress chooses not to include any exceptions to a broad rule, this Court applies the broad rule. Finally, the employers suggest that because the policies at issue have the same adverse consequences for men and women, a stricter causation test should apply. That argument unavoidably comes down to a suggestion that sex must be the sole or primary cause of an adverse employment action under Title VII, a suggestion at odds with the statute.
Thus the majority held that an employer who fires an individual merely for being
gay or transgender defies the law and allowed the appeal filed by Boston and dismissed the appeals of employer.

Minority View

ALITO, J., filed a dissenting opinion, in which THOMAS, J., joined. KAVANAUGH, J filed a separate dissenting opinion.

Alito,J in his view expressed the following

(i) The Court’s majority decision may pressure employers to suppress any statements by employees expressing disapproval of same-sex relationships and sex reassignment procedures. Employers are already imposing such restrictions voluntarily, and after today’s decisions employers will fear that allowing employees to express their religious views on these subjects may give rise to Title VII harassment claims.

(ii) Today, many Americans know individuals who are gay, lesbian, or transgender and want them to be treated with the dignity, consideration, and fairness that everyone deserves. But the authority of this Court is limited to saying what the law is.

The Court itself recognizes this:

“The place to make new legislation. Lies in Congress. When it comes to statutory interpretation, our role is limited to applying the law’s demands as faithfully as we can in the cases that come before us.”Kavanaugh. J expressed the following in his dissenting opinion.

(i) It’s the role of Congress and the president, not the court, to alter Title VII.

(ii) “When this Court usurps the role of Congress, as it does today, the public understandably becomes confused about who the policymakers really are in our system of separated powers, and inevitably becomes cynical about the oft-repeated aspiration that judges base their decisions on law rather than on personal preference,”

(iii) The best way for judges to demonstrate that we are deciding cases based on the ordinary meaning of the law is to walk the walk, even in the hard cases when we might prefer a different policy outcome.

Constitutionally, while the majority has ruled that it was ‘discriminatory’ – the minority has suggested that it was not for the SCOTUS to rule on it- but for US Congress to make the changes. The perennial debate on Legislature vs Judiciary turf war continues. We in India are not immune to it and it is not a tussle unfamiliar to us as well. Judiciary gets to have the last word. For, it is final. But the Legislature could always have the say, if they so choose. By amending the law itself. Then again, Judiciary would get to have the last word on that too. Ultimately, what would prevail is the philosophy of the men who matter ie. on the Bench. Leaving it open to those who accuse the Judiciary of morphing into ‘unelected tyranny’. Whatever, an endless and fascinating debate!
