Riot and intelligentsia of India

0

In India, the history of communal riots are not at all rare. It is an old phenomenon and yet it seems that we, the native population do not learn too much about it. The administration including the police, judiciary and the political establishment always use this to their advantage in vote bank politics and in turn their respective career. This becomes evident when we look at the response of the police in all these riots (e.g. Bhainsa Riot). Why is this the case and why do we refuse to learn?

The moment we try to look at the riot from the genesis to the final resolution, one common pattern becomes very clear that these are not riots but, in most cases, “pogroms” against a fundamentally tolerant native population. The hatred is not towards the country but the civilization that dominates the philosophical and intellectual sphere of India and also the same for an exclusivist non native religious hegemony to some extent. Since this cultural and philosophical domination is hard to tolerate, the reaction of the inferior philosophy becomes blind hatred, xenophobia, bigotry and physical violence. Such native ideological diversity can be traced back to the thousand years of philosophical, scientific and literary deliberation which thrived under a tolerant society of mutual respect.

The idea that amuses me is the word that the left uses to describe their own anger is “intolerance”. The word itself shows a degraded and inferior value system that cannot talk about mutual respect. This creates a deep-rooted unspoken inferiority complex which manifests through various frivolous social analysis and selective silence of the leftist intelligentsia. On the other hand, a society like India, knows the brilliance of their own value system, philosophical heft and often ignores such nuisance. One example of this phenomena can be found in the lectures of Swami Vivekananda, who once said that in India dresses do not make a person, but character does. It is very hard to understand such abstract notions when someone is not trained for it.

Historically Hindu Philosophy is very much rooted in the abstraction of ideas, which ignores micro details and focus on the big picture. This is important because when the Indic Wing talks about such abstraction in front of an Western audience who do not have much idea about the ancient Indian academia, they become confused. To them lack of numerous examples or data is considered equivalent to lack of proof. But in the theory of “Pramana”, empirical evidence and perceived knowledge are also considered valid for establishing a fact. We ourselves often get confused because of our Westernized education system rejects everything that stems from Hindu philosophy unless a convoluted version of it is appropriated. This is a fundamentally different premise of argument that, creates a huge communication gap.

This inferiority complex of the left and proselytizing monotheistic religions manifests either through elitism or phobia. This ignorance and lack of understanding of the native philosophy often dilutes their scholarship which is then imposed on other dissenting voices in the academia. In such a situation, micro details and further cultivation of ideas do not come from the academia anymore. The system becomes stagnant. This infectious disease fundamentally cripples the thinking of a nation where it stops learning from the mistakes.

In order to overcome this problem and create an environment where debate is the norm and conformity is the exception, the first thing is to disempower the Indian leftist elite and force them to compete for space. While the Indic Wing counters them on a daily basis in twitter, it is simply not enough. We need original research, extensive data collection, peer reviewed papers in various journals which then translate into knowledge. This exercise is going to supplement our scientific temperament and further the electoral gain of the Indic Wing. The tendency to focus on macro picture often stops us looking at the details.

However, Indians love to destroy others in their own game which should be the spirit for now. The left is not the standard that the Indic Wing should use as a yardstick to measure themselves with. We can give a tough competition to ourselves. When this thinking, the standard and the morality change, we can easily make our norms and stop the left in their selective silence in pogroms against the native population.

Is V-Democracy downgrading India to “electoral autocracy” fair or marred with input bias?

0

Swedish organization V-Dem recently released its annual ranking of democracies around the world. And it labelled India, as “Electoral Autocracy”, inferring that elections are mere formalities, and power is in absolute control of one man. When an organization like V-Dem, which follows a “Data-driven Methodology” to rank democracies on various parameters, makes such a claim, it is obvious to make you a closer look.

We take a look at some of their data, and explanations provided in their dedicated section about India “Democracy Broken Down: India”.

Claim-1 Fairness of Election

Blame Claim

Rebuttal-1:
The claim looks outlandish from the fact that 900 million voters regularly cast their votes to vote out and vote in the politicians whom they think most suitable to govern. Just a look at the India’s map depicting BJP ruled states between 2017 and 2019, tells the story how free & fair elections take place in India where ruling parties change often.

Swarajya did an analysis of their Data for various parameters which according to them contributed towards this STEEP FALL of autonomy of “Election Management Body”:

  • Election Commission Autonomy: in 1975 (during Emergency time when Elections didnt take place at all) the score was 1.487, in 2019 it is 0.771.
  • Election Voter Registry: in 2014 the score was 1.136, in 2019 it is 0.732
  • Election Other Voting Irregularities: in 2019 the score went into negative -0.059
  • Election Free and Fair: Score in 2014 was 1.691, in 2019 it is 0.594
  • Election Loser Accepts Defeat: the Score dropped from 1.358 in 2014 to 1.163 in 2019

Apparently, there are no evidences provided why there is a sudden drop in 2019 compared to 2014, which clocked a Record Voter turnout at 67.11% v/s 65.95% in 2014.Do the Authors really believe that Elections are compromised in India? Can they provide any evidence of what has changed from 2014 to 2019? except Mr. Modi has come back with a Bigger Mandate which may not of their Liking.

Claim-2

Rebuttal-2

It makes an astonishing claim that Indian Govt “rarely” used to exercise censorship before Modi became Prime Minister.

India has a “glorious history” of censorship under Congress led Govt. Under UPA Govt, which was predecessor of Modi Govt, IT Minister Kapil Sibal had tried to intimidate Social Media companies to remove the Posts/Pages which were mocking Sonia Gandhi, the Congress President.

It even went ahead with Blocking of 309 web items include Youtube Videos, Facebook Pages, Twitter Accounts, which was ill thought and a PR Disaster for the Govt.

Author and Commentator, Anand Ranganathan has documented 250+ Incidents of Freedom of Expression being suppressed under Congress led UPA Govt, which he had crowdsourced in response to the Claims of Rahul Gandhi & Congress that they stand for Free Speech.

And this is just a sample and not an exhaustive list.

Can the Authors of the Report produce verifiable data for giving a score of 3.5 out 4 to Modi’s predecessor Govt, and how much % of increase of Censorship under Modi Govt, which caused this drastic drop of a Score from 3.5 to 1.5?

Claim-3

On this false premise, they make further ridiculous claim of India being at the same pedestal of Pakistan, where Army and Intelligence Agencies are notorious for making Activists & Journalists disappear.

This doesn’t even deserve a Rebuttal.

Claim-4

Citing a Source it claims that,

Rebuttal-4

Consider following facts:

  • Between 2010 till 2020, 65% of 11000 people charged under sedition were under Modi Govt. But this is also true that Modi has been also in Power close to 60% of the time during this period.
  • Union home ministry has started collecting Sedition Cases data through the National Crime Records Bureau only since 2014
  • Therefore, while the Data after Modi Govt coming to Power, can be regarded as accurate. The Data before 2014, is at the best on the mercy(efficiency) of the Source  which could always be disputed and have some error of margin.

Claim-5

Rebuttal-5

The Source, is a 2016 Report, which has been referenced to make an assertion to rate India’s Democracy in 2020.

Nowhere does that Report, mentions instances of how Journalists and News Outlets taking exception of BJP Govt Policies, are targeted through Criminal Defamation Laws.

Claim-6

Rebuttal-6

If you read through the “Basis(Source)” for this inference

One of them is an open Letter to Home Minister Amit Shah, appealing to him to release Safoora Zargar because she is pregnant, and others because of Covid-19.

India has so many Undertrials who are pregnant, and there are so many people who are serving sentences, even during Covid-19 times. Its astounding what makes Authors think that these so called “Activists” are special, and deserve a special treatment in the eyes of Law compared to thousands and lacs of other Under-trials?

Claim-7

It is also astonishing that this Report solely relies on the “one-sided narrative” of these so called Student Activists

Rebuttal-7

It is a blatant lie. They are not punished for protesting against Govt, rather conspiring for Delhi Riots which claimed the Lives of 50+ innocent people.

Delhi Police has filed the Chargesheet against Safoora Zargar that she incited Mob to Riot.

While rejecting the Bail Plea, Delhi Court observed,

“When you choose to play with embers, you cannot blame the wind”

Delhi Police has investigated the Case, and filed chargesheet against Umar Khalid, Safoora Zargar and many others of conspiring for Riots in Delhi.

Court Proceedings are ongoing, it is preposterous, that V-Dem assumes itself the Role of Judiciary and infers that there is no merit in the case against them and they are innocents.

Claim-8

Rebuttal-8

This is a False Claim. The CAA Bill applies only to those “persecuted Minorities” from three neighboring Islamic Countries Pakistan, Bangladesh, Afghanistan, who have migrated to India before December 31, 2014. It allows them to fast track their Naturalization towards Indian Citizenship.

It does not deny Muslims right to Citizenship. They can continue to apply for Indian Citizenship through normal process, and get it like 4000+ people whogot Indian Citizenship in past 6 years during Modi Govt. Many of them are Muslims too.

Every Country has the right to decide their immigration policies, and determine who should be the targeted group for it. US also has similar Lautenberg amendment which enables citizenship to identified persecuted religious minorities in the erstwhile former Soviet Union. Iran was also added later through the Specter Amendment.

Claim-9

Rebuttal-9

Apparently, V-Dem has relied upon the Opinion of Human Rights Watch and BBC to declare that Bill passed by both houses of India’s Parliament are unconstitutional, and India’s Supreme Court can go on vacation.
Unfortunately for them, India’s Democracy is still alive and kicking and It is India’s Judiciary who can decide whether a Law brought by Parliament is as per constitution or violates it.

If V-Dem or Human Rights Watch or BBC are so concerned about India’s Democracy, they should respect various Organs of it and file a petition in India’s Supreme Court to argue against it.

While we can appreciate V-Dem’s effort to try to quantify and adopt a data driven approach to rank the democracies however, it seems that their entire premise is marred by “Input Bias”. If your Basis is “selective” “one sided narrative”, no wonder the Data derived would also reflect that.

Garbage In, Garbage Out.

The real Parivartan is to be ushered in now

0

It all began with the Congress-rule in India in the early post- independence time. Nehru set the direction for the new government towards ridiculing Bharatiya creed and culture, rewriting history suiting the invaders and the colonisers’ interests and perspectives, appeasement of minorities for vote bank purpose and encouraging misuse of power for perpetuating dynasty rule. One glaring instance is the fact of the non-enforcement of family planning regulations on the Muslims.

These tricks were learnt by most other party leaders including the CPM’s and used subsequently in the current opposition ruled states for expanding their own party’s hold.

West Bengal is a classic example. The leftists, after coming to power, started working in the same direction. They campaigned against Hindu dharma and traditions, started vote bank politics and illegal immigration from neighbouring country and misuse of police and administration to crush opposition, interfered in and captured administration in universities, colleges and schools facilitating the maligning of Hinduism and propagation of pseudo-secular philosophy.

It is because of this that incidents like Marichjhapi massacre happened and all jobs and appointments became the prerogative of party loyalists. Party became all pervasive and to an extent that all supply contracts had to have their approval.

People now see that the TMC has further expanded and perfected this array of misrule tricks. The misrule issues like political violence, tolabaji, syndicate, and excessive appeasement are real and undoubted and have gained unprecedented visibility across the state. These issues are the main impediments to flow of investments to West Bengal and consequent job creation. The party still carries the baggage of Sharada, Narada, and Rose-Valleyscams. The victims of the Amphan cyclone not getting the relief fund are obvious now. They were diverted to party workers. The brazen rigging and unprecedented violence in the Panchayat elections prove that the law & order has completely broken down.

CM Mamata’s politics of senseless appeasement like opposing the CAA and appointing a Muslim cleric on Tarkeshwar Temple Board have created much discontent and disillusionment. Further, her controversial and blatantly communal moves like the stipends to Imams and curtailing the time permitted for Durga idol immersion to make way for Moharram procession were ruled unconstitutional by Kolkata High Court. Religious leaders like Sididiqullah Chowdhury and Toha Siddiqui were roped in for luring Muslim votes. Her Muslim appeasement efforts are now underlined and crystal clear to the voters. This sort of misrule cannot be allowed to continue.

She is not able to hold her flock together and desertions, happening all too often. This puts a question mark on her ability as a persuasive leader. She cannot therefore be depended upon to fulfill her poll promises. On the other hand, PM Modi is carrying the administration and the party very persuasively and therefore able to do tremendous developmental work and at the same time provide a glitteringly clean administration. Time is ripe to bring in the real Parivartan. In electoral democracy, the way out is voting. Vote the guilty out and vote in the party/people/leader with clean image and track record.

Balochistan- ‘The land of the disappeared’

0

Recently Indian diplomat Pawan Badhe hits out at Pakistan in UN Human rights council. India calls Balochistan ‘land of the disappeared’ due to enforced disappearances by Pakistan Army. India asks UN to hold Pakistan accountable for state-sponsored terrorism and violation of human rights.

Balochistan is one of the four province of Pakistan. It is the largest province in terms of land area, forming the southwestern region of the country, but is the least populated. Its provincial capital and largest city is Quetta. Today Balochistan region is divided between Iran, Pakistan and Afghanistan. According to the Pakistan 2011 census The main ethnic groups in the province are the Baloch people and the Pashtun, who constitute 52% and 36% of the population respectively. Balochistan is rich in exhaustible and renewable resources; it is the second major supplier of natural gas in Pakistan. Pakistan is heavily dependent on natural resources available in the Balochistan region but yet it has the highest rural poverty rate in Pakistan as well as the highest illiteracy rate. It is one of the richest region in Pakistan but having the poorest population with no proper electricity and drinking water facilities.

Balochistan has witnessed many insurgencies since Pakistan took the land of Balochistan in 1948. The insurgency started right after the Khan of Kalat was forced to sign the instrument of accession in 1948. It has occurred in 5 different periods. Today Balochistan has become a hell for its own Baloch people.

The Human Rights Council of Balochistan held a press conference in Quetta on 18th MARCH 2021 , revealing the details of the “enforced disappearances” and “extrajudicial killings” that were carried out in Balochistan in 2020. The numbers are shocking – 480 individuals were “forcibly disappeared” and 177 were killed and their dead bodies were thrown in the wilderness. The rights group added that these “conservative” numbers were derived from the information accessible to them from various areas of Balochistan. The actual toll might be higher.

A news article of THE BALOCHISTAN POST covering the human rights violation and forced disappearance in Balochistan.

There are many more people as well who are fighting for an independent Balochistan and also who have sacrificed their lives for the land of Balochistan.

KARIMA BALOCH

Karima Baloch also known as Karima Mehrab was a Baloch human rights activist and dissident. She campaigned for the independence of Balochistan from Pakistan, and was included in the BBC’s list of 100 influential and inspirational women in 2016. Baloch started her career as a human rights and independence activist in 2005, when she attended a protest in Turbat over forced disappearance in the Pakistan province of Balochistan, where she carried a picture of one of her missing relatives.

In 2015, Baloch went into self-imposed exile after terrorism charges were filed against her by the Pakistani state. A year later, in 2016, she was granted asylum in Canada, where she lived until her disappearance and death in December 2020. In 2016, following Indian Prime Minister Narendra Modi’s public speech on Independence Day in which he mentioned the situation in Pakistan’s Balochistan, Baloch addressed him in a video, where she thanked him for mentioning the issue, adding “We will fight our own war, you just be our voice”.

KARIMA BALOCH

ZAHID KURD

Zahid Baloch was abducted by Pakistan’s security forces from Quetta, the capital city of Balochistan, in front of witnesses on March 18, 2014. Zahid has not been produced in any court yet despite many countrywide and international campaigns and calls from human rights organizations for his release. All the international human rights bodies and mechanisms were approached about his case. International media and human rights groups have published many stories to bring the case into light. But, still he remains missing, with his fate unknown.

HRC OF BALOCHISTAN tweets about ZAHID KURD.

MUNIR MENGAL

MUNIR MENGAL is the President of Baloch Voice Association. He was abducted by the Pakistani Army in 2006 and tortured for 2 years. He escaped to France where he is living in exile since 2008. He has been raising awareness about the Balochistan conflict and human rights violation done by Pakistani army in various platforms including the United Nations.

Baloch activist raises issue at UN, says 'Balochistan facing pandemic of impunity' | International - Times of India Videos
MUNIR MENGAL telling the forum at Geneva about the Human rights violation happening in Balochistan .

BRAHUMDAGH BUGTI

Brahamdagh Khan Bugti is the founder and leader of the Political Organisation Baloch Republican Party, a Baloch nationalist group. He campaigns for the rights of Baloch people around Europe. He is currently living in self exile in Switzerland. Bugti accuses Pakistan of serious human rights violations and blames Pakistani media for not highlighting the frightful situation in Balochistan including military operations, enforced disappearances, torture, and killing of Baloch civilians and political activists. In an Interview with the Republic, he called Pakistan a terrorist state and the Pakistani army a terrorist supporting army.

He says that the CPEC in Balochistan is an illegal project because it aims to exploit the resources of Balochistan. It does not include the wishes and consent of the Baloch people. The increasing Chinese influence is also dangerous for the region and neighboring countries. The influx of Chinese and people from other parts of Pakistan without any regulation is aimed at reducing the Baloch people to a minority and looting their resources.

BRAHUMDAGH BUGTI is active on twitter and tweets about the situation in BALOCHISTAN.

HAYAT BALOCH

A day before the 74th Independence Day of Pakistan, Hayat Baloch, a student of Karachi University, was dragged out of his house in Turbat, on to his front lawn, by the armed Frontier Corps (FC) on the suspicion of involvement in terrorism. The forces then tied him up and pumped eight bullets into his body while his parents, pleading for mercy, watched in horror. Hayat was not given a chance to explain his innocence or the right to ask the reason for the treatment he received.

Pakistani newspaper article reports that killing of Hayat Baloch was trending on twitter.

Therefore it is true that Balochistan has become a LAND OF DISAPPEARED because of the human right violation done by the Bajwa’s Pakistani Army and Imran Khan Government. So BAJWA’S Pakistan should concentrate and focus on their own land and not on Kashmir because they are doing the exact same thing which they say that the Indian government is doing in Kashmir and Pakistan should stop commenting and begging on international platforms about Kashmir. They should focus on improving the lives of Baloch people and other Pakistani citizen instead of only reciting the name of Kashmir to gain votes and fake sympathy of other Islamic countries.

Education needs to be affordable!

0

“Sir, if not now, when? If not you, who?” we all should ask this question to our prime minister, our education minister, and all authorities that are responsible for it.

As we all know that the rate of inflation is increasing very fast every year. There is not much difference between our expenses and income. We are rarely able to meet our primary needs, therefore, we are beginning to compromise our needs.

Inflation did what it was supposed to do, but the saddest part is that many parents are not able to educate their children in the best colleges due to high fees. The result will be that the future of future generations will not be called bright.

Today educational institutions are taking arbitrary fees and increasing their own bank balances. They do not even think about the condition of their students how they are paying their fees.

In 2021, if you want to study MBA in top government colleges in India then you will have to pay 9 to 23 lacs per annum, if you want to study in top IIT colleges, you will have to pay 1 to 2 lacs per semester and if you study the same courses in private colleges, you will have to pay almost double of that fees.

Instead of these fees, we shall have to pay enough money to coaching institutes for preparing for the entrance exams. We also have to pay the living costs to hostels, PG, flats, etc.

Thus, now we can say that education cost is not college fees only, college materials like books, etc, coaching fees and living fees are also included in it that is very high and very difficult to pay for a middle-class family.

The condition of the students of rural areas is very complicated. They have to suffer a lot along with their family financially. Due to lack of enough capital, many students start to compromise with their goals and leave their study in the midway. This makes them mentally disturbed and many students even commit suicide nowadays because of mental disturbance. This affects negatively the growth of our country.

Our government should take action against those institutions that charge arbitrary money. The government should also constitute a law that follows a one fee policy all over India. This will be helpful to stop charging high money and enable the students to fulfill their dreams.

The government should donate consistently to private institutions so that they can be able to provide quality education to their students at low fees. This will be the best way to add value to the youths’ life.

Today, our education system is not as good as it should be. Even many authority universities are following 50+ years old syllabus that is no longer in use. Universities should change their syllabus after every 5 years so that the students could get the opportunity to learn new things that would make them more relatable to this age.

Our education system focuses on degrees, not on skills and every sector wants skills first. Our universities should introduce vocational education to their students and try to develop soft skills in them. In this way, they can become skilled and fulfill the needs of their interested industries. Thus, they can become self-sufficient.

OCI: Overseas Citizens (or assumed Criminals) of India

0

The recent reiteration of rights, privileges, and rules for OCI cardholders may not be entirely new but some of these rules appear punitive as if all Overseas Citizens are “Criminals.” As an OCI, I never felt intimidated during my frequent visits home but now the Ministry of Home Affairs (MHA) has put me on notice, and I felt insulted. I understand that the restrictions are based on the MHA document of November 2019 but that does not make everything right.

Is MHA’s own failure in March 2020 to enforce the restrictions on Tablighi Jamaat during the nationwide lockdown leading to a broad-brush approach to tightening the rules on all OCIs? As many as 2500 Tablighi were found staying as a congregation against government orders, many traveling across India and hiding in the mosques, and hundreds were arrested for violation of visa rules.

A year later, MHA reiterates the restrictions on OCI cardholders requiring, “prior permission for a set of activities that include research, journalism, mountaineering, missionary or Tablighi work, and visits to restricted areas.” My most serious objection is on “research” and the second on “journalistic” activities. These should not have been coupled with activities leading to conversion under the guise of religious freedom and going places that are restricted for national security reasons. I fully support that anyone engaging in such anti-national activities must be punished to the highest degree. In fact, s/he must not be allowed to enter India in the first place. This must be the highest priority of India’s intelligence to track them rather than suspecting all OCIs and treating them as “criminals.”

In my informed view, undertaking research by an OCI is generally an intellectual and academic exercise that must remain an unrestricted opportunity for India to progress and prosper, and be part of the global community of researchers. Similarly, when journalistic activities are unduly curtailed, India is in denial of respecting freedom of the press, the lifeblood of longstanding democracy. Therefore, MHA’s approach to broadly restricting legitimate research, journalism, and travel, etc. is inappropriate, unjustified, and perhaps unlawful.

Any citizen is innocent unless proven guilty whether living in India or overseas. I fully respect the decision made by the Modi government on tightening rules against foreign exchange transactions for unlawful conversion and inciting anti-national propaganda under FCRA. Similarly, I appreciate and stand behind the removal of Article 370, initiating CAA, and the Farmer’s Bill for the benefit of an average farmer. However, in most cases, the Government failed in launching a widespread campaign and communication to the common men/women- what and why?

Likewise, the documented rules and restrictions by MHA are without much rationale. I suggest that MHA and MEA (Ministry of External Affairs) collaborate and engage India’s foreign missions worldwide to reach out to OCIs and assure them that the restrictions on activities like research, journalism, and travel are not meant to intimidate, insult, and insinuate the law-abiding OCIs. It can’t hurt, but a benefit, to offer examples of what type of research and journalism may be questionable for OCIs and what places may be out of bounds for them and why?

OCI card process: While, on the topic of OCI, let me draw attention to the archaic rules and unfriendly website for the ‘miscellaneous services’ being riddled with unnecessary documentation requirements. For example, when seeking renewal or replacement of an OCI card under miscellaneous services, why not a simpler application process because most personal and family history of the applicant was recorded with the initial OCI approval? Another example of ambiguity is that the Reissue/ Transfer of OCI is MANDATORY stating, “Once after completion of 50 years of age.” What if the first OCI card was issued to a person only after the age of 50? I believe, s/he need not get the OCI reissued but the statement is at best very vague. Being in a similar boat myself, I was confused and when initiated the process, it was the most painful exercise and therefore I did not complete it.

In fact, the outsourcing of these services to VFS Global as the exclusive service provider, in my view, is an unwise decision. I have seen many conversations among the OCI users about VFS Global not being friendly, prompt, and courteous because of the “exclusivity.” The consulates and embassies generally are not accessible to take calls and if you are lucky to get through to talk, they simply ask to contact VFS Global. I wonder if MHA has ever made an attempt to seek their services to find firsthand how difficult it is to communicate with them. I define VFS as a VERY FRUSTRATING SERVICE.

I strongly recommend that MHA/MEA periodically survey the OCIs about the issues and challenges they face and use that feedback to change/improve the rules and processes. The OCIs may not engage in rallies and protests to express their dissatisfaction, but they deserve clear and concise communications. The OCIs should not only be a source of investments and foreign exchange reserves in India but proud community ambassadors for promoting India’s rich cultural heritage and economic interests. While I am pleased to acknowledge improved engagement of Indian missions abroad with NRIs and OCIs, there remains considerable room for improvements.

Producer responsibility: E-waste and its significance

0

Introduction

With rising environmental and public health issues, the proper disposal of end-of-life commodities has become a hot topic among policymakers. Policymakers have been concerned with how to handle the waste that has emerged. In the last decade, the authorities have placed a responsibility on manufacturers of these products to be accountable for their end-of-life treatment. The producer may also opt to assign this duty to a third party, known as a producer responsibility organization (‘PRO’), which is compensated by the producer for managing used products.

What is producer responsibility?

  • Producer responsibility principle puts forth that manufacturers and importers of goods bear certain liability for the environmental effects of their goods over the course of their lives. The majority of the measures are based on the EPR concept, which holds manufacturers accountable for environmental effects during a product’s life cycle. The EPR is based on the polluter-pays principle (PPP), but it highlights the products’ life-cycle effects.
  • The scheme is focused on the idea that manufacturers must offer financial incentives to collection systems, manufacturing facilities, and the recycling industry in order to meet the government’s goals for collecting and processing of waste.
  • The producer should be interested in the overall implementation of the EPR framework, not just the collection.

Producer Responsibility Organizations (PRO)

PROs would be enrolled in the structure in order to satisfy legal responsibilities on behalf of their member companies. They provide producers with a kind of contractor service. However, the manufacturer is solely responsible for supplying final proof of reprocessing/export of plastic packaging.

Relying on their expertise in the area, PRO registration may be divided into 3-4 groups. Start-ups, on the other hand, will enroll as PROs on the website. The following guidelines must be kept in mind:

  1. Producers or brand owners must ensure that an equal amount of plastic is obtained and processed on their own or by PRO.
  2. Producer or brand owner or PRO will lead implementation and provide funding for producers to promote plastic recycling as mandated by the Rules.
  3. The programme would encourage waste pickers’ inclusion in a way that enhances their workplace conditions and wages.
  4. PROs/Importers can also receive certificates from certified processors in return for proof of recycling or recovery, which will satisfy ERP requirements.
  5. Producers/brand owners will be able to communicate with ULBs, processors, and the informal sector individually or collectively (through registered PROs).

Significance of Extended producer responsibility

Extended Producer Responsibility (EPR) is an environmental conservation policy in which the product’s manufacturer assumes responsibility for the product’s entire life cycle, including take-back, recycling, and safe disposal. EPR is an environmental policy strategy that holds manufacturers accountable for returning goods after use and is focused on polluter-pays concepts. As a result, the producer’s liability for a commodity applies to the post-consumer stage of its life cycle.

EPR focuses on emissions arising from the final stage of product disposal and recycling in order to minimize the environmental effects of the product’s life cycle.

EPR has two key goals:

  1. increasing product collection, reuse, and recycling, and
  2.  Financial responsibility during the product’s life cycle.

The four major approaches are included in EPR:

  1. Product take-back approach
  2. market-based approach
  3. quantity standard approach
  4.  Economic approach.

E-waste Management through EPR in India

EEE goods that have outlived their usefulness have external consequences in terms of human health and the hazards to environment. Extending the burden for waste management is one way to pressure producers to internalize commodity externalities.

The control of waste is subsidized by public money in the conventional model, where local municipalities are responsible. EPR transfers the responsibility to the producers and away from local authorities by making them responsible for waste management.

Under the EPR scheme, producers are granted primary responsibility for managing e-waste. The Rules impose such acts on the producers in order to operationalize this obligation. The following are the main duties together under Rules:

  1. Collecting end-of-life goods, either individually or in groups, and ensuring that the waste is routed to a certified dismantler or recycler.
  2. Financing and coordinating a transparent scheme to cover the costs of environmentally sustainable e-waste management.
  3. Educating people about the dangers of e-waste and how to properly dispose of it
  4. Obtaining permission from the state pollution control agency, keeping annual reports of e-waste treated, and filing annual returns in a prescribed format.

Conclusion

EPR strategy can play a significant role in formalizing the strengthening of electronic waste and waste plastic through the producer take-back strategy, as well as improving the country’s economic aspects.

The opposition is long dead

0

The enduring sights of anti-CAA protests were that of a youth gone astray, boldly pointing a pistol at a brave police personnel or that of an old women at Shaheen Bagh protests, one of whom even made it to the pages of the Time magazine. Anti-CAA protests were one of the two biggest anti-government campaigns in Modi’s second term. The second major agitation against the current regime has been the farmers’ protests, which is currently ongoing. Again the memorable images has been of rabid separatists desecrating the Tricolour, or unruly youth showcasing innovative new utility of tractors by creating mayhem in the heart of the capital or the famous tweets in support of the protests by a few well know international pop as well as porn stars.

Pray, where has been the opposition in all this? It is ironic that be it the anti-CAA protests or the farmers’ agitation, the opposition has been consigned to the footnotes of the biggest anti-government protests during Modi 2.0. There has been raging debate that the opposition has not been playing its role but the point is that the opposition is long dead and India should not live in denial any longer!

So how did we come to such a pass? At a national level, two entities could provide credible opposition to the Modi government, the Congress and the left combine. I lay bare the rot in both these entities in my recently released book ‘The Crusader: How Modi Won 2019 Elections.’ However, suffice to say here that their visceral hatred for Modi has blinded them to their own ideologies and instead, they have unleashed a malicious ‘anti-Modism’ propaganda as their only war cry, which has not cut much ice with the people of India.

Hence, sadly, a moribund opposition has ceded the space for setting the political narrative and with that, the capability to productively regulate and channelize the dissenting forces. As a result, a motley combination of urban naxals, so called left-liberals, separatist forces and disgruntled sections of the society have filled in that vacuum and taken the centre-stage in the absence of an appropriate political narrative. Not surprisingly and indeed, unfortunately, this mix is generating a shrill discourse with a clear anti-India flavour to it.  What is even more dangerous is the fact that the opposition, which lacks the strength of numbers in parliament and do not have the ability to politically lead a challenge on the streets, is trying to piggy-back on this motley crowd just to serve their own vested political interests.

The adverse consequences of having a clueless opposition, are there for everyone to see. Firstly, anti-social elements infiltrated the rudderless agitations that led to arson, mayhem and loss of lives. The desecration of the Tricolour on January 26 this year was clearly the handiwork of separatists’ elements within the fold of farmers. Far from denouncing, a few Congress state units actually went into a celebratory frenzy on Twitter. Hence, the criticism that the opposition is encouraging and indulging in anti-India activities seems to be on point.

Secondly, without doubt there are international forces conspiring against India, as I prove it in my book sharing certain facts, which are looking to exploit fault lines within our country. They seem to be doing the back seat driving of the narrative that presents India in a poor light at the global stage. Thus, the enemy states are exploiting this perfect opportunity, and seem to be firing from the shoulders of a doomed opposition to prove their own point. Imran Khan quoting Rahul Gandhi at the UN in 2019 post the abrogation of Article 370, to build his case against India, is a damning example.

Luckily, post COVID, India’s global stature has improved with the way we have stood up to China’s expansionist urges as well as due to our successful vaccine diplomacy, being at the forefront of saving lives across the globe. The negative global press in certain quarters has not had any adverse effect on the ground. An opposition has a key role to channelize conflicting impulses and give them an appropriate direction, which is missing in our polity today. Ironically, it is not a problem of their own making but the Modi government is beset with it and needs to, somehow, find an answer to that vexed issue.
