Sagarika at Hindu-shaming again

0

Responding to Sagarika Ghosh, the journalist known to post fake riot tweets and then deleting them post outrage seems to be a useless waste of time. The lies in her writings makes us wonder why we do not call her troll instead of those who take on her lies. It really is a useless exercise. One cannot attribute lack of understanding to what she writes. She has vested interest in writing what she writes, even if it is full of hatred and lies. There is no innocence in such repeats. Still I am writing.

Why do I write? I do not write to educate her. She is well educated. She knows that what she writes has more holes than the mosquito-nets one uses in the summers. Still she writes and she writes magnificent junk which could compete with the works of CS Lewis, if the intent was not so mischievous. I write in the hope of few who read this post will be forewarned and with expectation that the unsuspecting might not consider her profile as a Journalist as some kind of proof of authenticity of what she writes. So, the Hindu – Hater and Hindu-baiter, Ms. Ghosh wrote “Is the Hindu a Victim?” and she answers herself – No.

It takes an absolutely hardened of heart to write in the backdrop of painful death of hapless Hindu pilgrims to Amarnath in a terror attack in Kashmir and call the outrage emerging out as a response to it as ‘manufactured’ outrage. She is a woman with no heart who believes that anyone outraged on the killings of hapless Hindu pilgrims by Jihadi Islamists have vested interest in feeling thus. She mocks the tolerance of Hindus, who have been termed a docile race, never being an imperialistic religion, calling often used ‘suffering in silence’ phrase in reference to Hindus silently submitting to supremacist designs of expansionist religions as what she call ‘showporn’ line. I have not had the opportunity to attend Oxford like Macauley-Putri and cannot find the meaning of this word, even with some effort.

But then from context and tenor, I could gather it derides the contention of Hindus who have just seen some of their brethren killed in the land which has been wiped off the Hindus in 90s that they do suffer in silence. She scorns at it, derides it and laughs at it. Even knowing fully-well that such killing of Pilgrims while visiting holiest shrines will not cause disturbance or riots in a Hindu-majority nation, she discards the theory that Hindus suffer discrimination silently. She says that such terror attacks are used to put entire Muslim community on notice. So when Hindus are attacked, killed, she in some round-about way establishes a plank to project Muslims as victims. She is more pained at Muslims being made to feel guilty of the violence committed by Muslims against Hindus in the name of Islam, than she is at the act itself resulting in lost of life. A heartless person she is, she considers loss of reputation for Muslims a graver loss than loss of life of Hindus.

Then she picks out another card- that of victim-hood and hides behind the favorite refuge of the liberals- the west. And if you cannot find a decent thinker to hide behind, George Bush would do. So she quotes Bush’s statement that “India is a country which does not have a single Al-Qaida member in 150 Million Muslims”. Of all the people, it is interesting for a journalist, in the face of ISIS flags floating in Kashmir and Kerala, ISIS sympathizers being caught in India to quote such a fake statement from a fake statesman who lied about finding WMD and using it as a pretext to attack Iraq thereby giving birth to ISIS.

She then scoffs on insults heaped on Hindu faith, which has off late become an everyday affair. Those people who claimed that the french publication brought it upon itself by making cartoons derogatory of the Prophet, now claim that there is no reason for Hindus to feel slighted by deliberate trampling over Hindu faith. She quotes the case of Dhoni as Krishna, or what she calls ‘few minutes of Azaan’. She ignores the fact that in all these case people had approached the authorities and sought action.

In the case of latter, it was not even a Police compliant. It was merely a tweet by a singer, which invited Fatwas and huge outrage from Muslims. She has problem with the tweet not with the Fatwa. Even in all the cases she quotes, she comfortably ignores that Hindus, who constitute eighty percent of the population in India, merely knocked the doors for legal recourse available to them, rather then jumping into Azaad Maidan and trampling over and desecrating emblems of national pride placed in the memory of martyrs.

She forgives Muslim appeasement which has been the hallmark of Congress politics and which helped the only dictator we had in Indian history come back and settle a dynasty on the throne for the following generations. But she creates a bogey of Hindu appeasement. As usual there is no data to support that. She is always unperturbed with the dearth of facts. She does not need facts; she does not care for facts. She thrives on rhetoric, she enjoys metaphoric falsehood and hyperbole of dishonesty. That the Hindus are reaching out to the law when their faith is trampled is a fact she does not like.

Why don’t these people, she with satisfaction call “Internet Hindoos” (she takes pride in coining the term, rightly or wrongly, I would not know nor do I care) remain just that- Internet Hindus- unobtrusive, virtual inhabitants of virtual world. So when Hindus are asked to scientifically prove the veracity of their claims on Ram’s birthplace, or Calf which Hindus worship is slaughtered in mid-street, she would rather have Hindus keep quite and go their way, without making much noise which could cause quiver to her glass of champagne on quiet evenings in her posh dwellings.

She then quotes a BBC report of 2011 claiming that often Muslims are the victims in the terror incidents, which is such an absurd claim in itself. When you are talking of Hindu Victimhood, what is the relevance of this quote? Muslims are the victims of their terror is nothing new. It is not for nothing that Muharram is observed. Beneath the religious overtone, Islam is essentially a religion of empire. The wars began right after the demise of the prophet. There was no role that Hindus played in it. It was a power-struggle then, it is a power-struggle now. Also it is a very Pakistani line to take and is as hollow as Pakistan as a nation is. When terror activities happen in Pakistan, is it a surprise that Muslims die? Do they have any non-Muslims there to die in such sorry incidents? Where do all the non-Muslims disappear in a Muslim majority nation, and once they disappear it is hardly surprising that the victim of Muslim terror will also be Muslims.

She briefly shifts her vision to Bashirhat, probably as a deliberate attempt to create the fake image of neutrality. But reading on, one can hear Paul Newman speaking in the Tennessee Williams Drama “The Cat on A Hot Tin Roof”- “Be careful, lady, your claws are showing.” She, in half a sentence, covers the 65 years old man lynched in Bashirhat and the juvenile in jail for a Facebook post, as she says- “Equally nasty and sinister are fake pictures”. When the fake pictures have caused neither unrest nor violence, how can it be equated with real violence on the ground which left people dead and devastated, she does not pause and care to explain. She has gone unchecked, unquestioned for so long that she is hardly bothered.

She with a deft movement of her hands waves off the contention that Bengal has become a hotbed of Hindu hatred. She is a journalist. Facts must be forcing their way through the high walls of her villa. But she ignores them. She ignores that before Bashirhat, there was Malda; that the HC in Kolkata had come down heavy on the West Bengal government for indulging in Muslim appeasement. But what do the Honorable judge know which this enlightened soul does not?

She laments falling participation of Muslims in Indian Bureaucracy and politics. She presents Sachar Committee report as her argument. The objective of constituting the committee was always under cloud. Irrespective, she quotes the report of a committee constituted in 2005 and the report which dates back to 2006 to somehow implicate the new-rise of confident Hindus. She calls it muscular nationalism which slaps sedition charges on Muslims celebrating the victory of Pakistan, with Pakistani Flags. Pakistan is a nation which kills and mutilates our soldiers, and she calls those Muslims who celebrates an enemy nation as Victim of this muscular nationalism. I wonder what kind of nationalism Ms. Ghosh would have preferred- An effeminate, guilt-ridden, fumbling and fake nationalism which does not cry for its own and which cheers for those who kill and main its own? Would she rather prefer a nation which exists but considers its existence, its being, its history as a mistake from the past, an accident that one has to live with? She does not tell.

I must tell you Ms Ghosh the tale has taken a turn. This India, that is Bharat and that was Hindustan is proud of its today and its yesterday, however painful the past might be when a religion of majority was pushed to sideline, surviving at the mercy of minority, from Mughals to the British. The wheels have turned and cannot be turned back. Please learn to live with it. Hinduism, by the virtue of what it is, has tolerance and co-existence inherent to it. But it must not mean that Hindus must go down and fade into oblivion without a protest. Even the cases, she so cunningly present to demonstrate what she claims is militant face of Hinduism, only proves the intent and desire of Hindus to follow the law of the land.

Even today, as I write this, a Parliamentarian mocks and insults Hindu faith and all Hindus do is outrage on social media and explore legal recourse. No, Ms Ghosh however, bleak a picture you might want to paint, you will never find Hindus trampling over Tricolor and kicking the Memorial for the Martyrs. This is our nation, and we love it too much. This is the only nation we have, in case you have not noticed and we shall be as muscular as need be to defend it.

Ekla Chalo: Tribute to Lt. Ummer Fayyaz

When the dark rises and lights falls,
when the righteous is weak and evil is tall,
when your world bows to the wicked,
don’t be afraid, Oh, my beloved!
you must walk alone.

Whether they disregard you,
or resist you through,
whether the path is fire or sea,
don’t be afraid, Oh my beloved!
you may walk alone.

Even if it means sacrifice of life,
you must thrive, be the flame,
to light this evil world,
But, you must walk alone.

A Hindu’s response to Tufail Ahmad’s ‘Abrahamic Hindutva’

0

As a Hindu reading the recently published article on Firstpost, my first response was anger and hurt. Later while I continued reading the article, I realised how little Tufail Ahmad actually knows about Hinduism that I started laughing out loud.

Tufail Ahmad is a former BBC journalist and author of the book, “Jihadist Threat to India – The Case for Islamic Reformation by an Indian Muslim”. I have always respected Ahmad’s anti-Jihadi, pro-reformation and pro-liberal stance, and to that extent I agree with him. He has often spoken up in support of the Uniform Civil Code and in favour of eradicating the growing threats of ISI in India. However, in this article written prior to the most recent article in question, he claims that:

Abrahamic Hindutva, Hinduism influenced by jihadism of Islam, denotes a growing inability of Hindu youths to comprehend their Hindu identity as sufficient in itself – without a reference to Islam and Christianity. We are witnessing a closing of the Hindu mind which is increasingly unable to defend ideals.

This is where I have a huge problem in accepting Ahmad’s narrative. According to Ahmad, the cow vigilantes who fight towards the protection of the gentle cow is akin to Muslims who fight towards spreading Sharia, enacting forced conversions, killing numerous people (sometimes even their own), and cultivating fundamentalist Wahhabism.

Tufail Ahmad’s false equivalency proves only one thing; that he has no inkling of what Hinduism and ‘Hindu theology’, as he calls it, is all about. Throughout the entire article, Ahmad has constantly used this false equivalency:

Muslims believe they must kill you if you insult Prophet Muhammad. Hindus similarly believe that they should kill you if you harm the cow. The theological views associated with Prophet Muhammad and the cow are identical and murderous. In Pakistan, you can be legally punished with death for blasphemy. In India, Hindu youths out to defend Hinduism are willing to kill you for transporting cows.

While the Quran (5.33 & 5.34) clearly says that anyone who commits blasphemy against Allah and his messengers will be put to death or crucified unless they repent, there is no such rigid law in the Hindu Dharma Shastras that says one should kill people for harming the cows. Therefore, the theological views associated with the Prophet Muhammad are not identical with the Hindu view and this clearly shows that Ahmad is not acquainted with the basics of Hindu Dharma.

Tufail Ahmad speaks the truth when he says that Sanatana Dharma has been pluralistic since its conception. However, during the Vedic period, which is arguably more than 5000 years old, no Abrahamic faiths existed. When our scriptures revealed the verse in one of the Upanishads, “Ekam Sat Vipra Bahudha Vandanti”, which means “that which exists is ONE, but sages call it by various names”, none of the monotheistic religions were in existence.

Such an all-encompassing world view could only come from Sanatana Dharma, and it certainly did not include the religious denominations that originated outside of the Indus Valley plains. The pluralistic nature of Sanatana Dharma is applicable only to the six philosophical schools (Shad Dharshanas) and the six traditions (Shan Matha) and not to the Abrahamic faiths. However, the current day Hindus have been indoctrinated to co-exist with other faiths in the name of  “tolerance”, which is now threatening the very existence of Hinduism within its own birthplace called India.

Pluralism, according to Hindu Dharma, only extends to the range of the various denominations within Hindu traditions, while all other belief systems that reject the Vedic authority are false doctrines. This argument has been constantly echoed by Dr David Frawley, Dr Frank Morales in his book Radical Universalism and many other Hindu intellectuals and scholars.

This is not the first time Hindus have arisen from their slumber to take up arms in fighting off invaders and hijackers of the Hindu Dharma. While Hinduism advocates peace through its principle of ahimsa, fighting wars for the establishment of Dharma, when all other efforts to reconcile have failed, is not prohibited. Be it with weapons, like in the Mahabharatha war, or with debates, like how Sri Adi Sankaracharya defeated the Buddhists and made them to abscond, Hindus have fought against forces that have threatened the survival of Hindu Dharma.

When any right wing Hindu groups are constantly maligned and berated by the largely pseudo-secular and Westernised liberal media, even after 1200 years of constant persecution and struggles, what else does Ahmad expect from the Hindus? We Hindus have no mandate, like the Jihadis do, which instructs us to wage wars in order to proselytise our Hindu Dharma. We can only defend ourselves from people who wish to belittle Hindu causes and Hindu Dharma.

Divorcing Hinduism from Hindutva is a common tactic handled by the left-liberals, so that while not offending and antagonizing the Hindus, the establishment of a Hindu Rashtra can still be opposed. According to Savarkar, the original preceptor of the concept of Hindutva or Hindu Nationalism, Hindus are those who consider India to be the land in which their ancestors lived, as well as the land in which Vedic civilization thrived.

As a Hindu, if I believe that India is my janma bhumi (birth place) and punya bhumi (the place where my Hindu Dharma originated), therefore, I am a Hindu Nationalist or a Hindutva follower. Would that make me a Hindu terrorist or Abrahamic Hindu who is akin to Islamic Jihadist? If all Hindu organisations that fight for Hindu causes and for the survival of Hinduism is to be maligned as “terrorist”, who actually speaks for and fights for the protection of Hindus and Hindu Dharma?

India did not thrive under liberty, like Ahmad claims; the Indian civilisation thrived under Vaidika Dharma. Liberty or freedom is defined as:

A condition in which a man’s will regarding his own person and property is unopposed by any other will.

Such a concept of freedom and liberty is totally a Western idea, which cannot be applied to the Indian civilization, especially to Hindu Dharma. According to Manu Smriti in Chapter 2 verse 6, one’s own will is the last of which you live according to, preceded by the Vedas, Smritis and the conduct of virtuous people. Our own will is not a reliable means of knowledge, hence reliance is always placed on the highest authority, the Vedas. As such, the Hindus have always regarded the Vedas as the ultimate authority, which also call for the protection of the cows and veneration of the cows. Therefore, Ahmad’s fundamental argument that our ancestors practiced liberty, while we Hindus are becoming increasingly “close-minded”, calls his qualifications to write about Hinduism into question.

Therefore, my dear Hindus, there are no Abrahamic Hindus. There are only Hindus who transgress the laws of the country, and the rightful authority must detain them and punish them according to the law. There are also Hindus who have studied about Hinduism and know what their scriptures say. Then there are Hindus who simply feel very bad about their own religion because people like Tufail Ahmad want to portray some rebellious Hindus into terrorists. This is where the danger lies if we allow a bogus term like ‘Abrahamic Hindutva’ to get into established narrative.

Pakistan Military is a version of ISIS

0

Pakistan, India’s problematic sibling, hostile neighbour and mothership of terrorism. A country which caught between ‘Military and Mosque’ as described by Hussain Haqqani. Pakistan has a record of hanging, executing its Prime-Ministers so as to pave way for their Megalomaniac Generals.

From General Ayub Khan to General Musharraf all have taken control over the civilian government. After the Kerry-Lugar bill was passed in US parliament, the long tradition of  Military Coup has come to an end. But that surely does not put an end to the power and strength that military has in Pakistan and its ‘larger than life’ image among the Pakistanis.

Pakistan was deliberately kept in a vulnerable and volatile condition by the military to retain its importance and control. In fact the military has so much control over the country that its nearly impossible for any civilian to think or act its way. It is the only military in the world which colonises its own citizens and is ruthless in genocide of its own countrymen. From supporting various radical Islamic elements to creating safe terror heavens, Pakistan’s Military has done it all.

There is so much interference of military in civilian matters that its like an undeclared martial law. Pakistan military is a significant equivalent of ISIS and must be punished for war-crimes by International Society.

Sadistic pleasure of Liberals: Their source of happiness lies in mocking our value system

0

‘National prosperity= A + B+ C, where

A= GDP,

B= Number of people we are lifting up every year above poverty line

‘C’ is the one which no one talks about in this country but is the most important and that is our Value System.

C= Our cultural values which are eroding.

The above are not my words. These are words of a famous Indian scientist. He said these words while educating a group of ‘ liberal intellectuals’ when they as usual was too busy with their agenda. He went on to say, “Whatever may be your agenda I am not going to take it up & discuss”. Yes I am talking about our ex President Dr. A. P. J Abdul Kalam.

“Ask not what your country can do for you , ask what you can do for your country”.

Dr. Kalam really showed us the path as to what one can do for the country as an individual and help it reach her golden age. But the problem is our liberal elites doesn’t know much nor do they care about ‘A’ and ‘B’. It doesn’t suit their narrative & thought process. Their only contribution to the country is eroding & degrading the ‘C’ factor.

Our ‘left liberal intellectual’ finds a certain kind of hidden joy in ridiculing our value system & aesthetic culture.

To be precise they experience a ‘sadistic pleasure’ by ridiculing it. Whatever may be the context & reference they don’t leave a chance to mock the ‘Bharatiya’ culture. Their favourite words include ‘ Bhakt, Sanghi, internet Hindus, Gaumutra and various others. They belong to all backgrounds- journalists, film personalities, film critics but are mostly filled with writers & historians who are neither aware of the rapidly changing new India nor are they aware of the deep roots & ancient civilization which Bharat has. In fact I should say they are aware but deliberately trying to subvert it and hide it under the carpet to suit their narrative.

They say whatever will help, advance their cause at the moment, switch talking points in a heartbeat, and then act indignant if anyone uses the exact same argument they were using five minutes ago.

They are ruthless shameless & shows their disdain through their every words. Not even rivers & ghats are safe .

Take for example Mrs. Sagarika Ghose. From ‘internet Hindus’ to her rants against Lord Ram she derives a special joy in mocking our culture. The ancient Saraswati River which has mentions not only in our Vedas & Shashtras but the recently concluded Prof KS Vaidya report found out that the existence of River Saraswati is no myth. But according to her ‘Saraswati’ River was a creation of ‘Sanghis’.

Whether it is Lord Krishna or whether it is Haryana their agenda remains same and crystal clear.

During the visit of Shinzo Abe in December 2015 Modi did something refreshingly different from his previous counterpart. He decided to break the shackles & make a visit to Varanasi offerong prayers at Dashashwamedh ghat along with Abe. They prayed and performed all the rituals. This irked the liberals of our country. They could never imagine an India beyond Delhi, Taj Mahal & Red fort.

Their hatred and discomfort was visible. They tried to give it a secular coating by saying Modi is pushing his Hindutva Agenda by doing this. Actually these so called intellectuals are still in awe and all drooly over the Mughal aristocrats & invaders. They feel modern India owes a gratitude to them. Gratitude for invasions and looting our country? Gratitude for the violence ? They want to be identified and associated with them to pacify their superiority complex.

For some of them members from all communities should fast on Ramzan to uphold the plurality of India including non Muslim students studying in AMU.

For some of them the students who confessed that no food is being served during day time are ‘Sanghi’ agents and hypernationalists. But without any verification & solid evidence they start peddling lies of no non veg being served in BHU (I myself did a vocational training prog a year ago from BHU. Believe me there are no such dictates).

Eminent Historians in our country believe Rani Padmavati was just a fictional character. They find solace when Bollywood directors distorts history. For them Rani Padmavati may be fictional but according their figment of imagination Holy shrine of Amarnath was discovered by a Muslim.

For them Hijab is a source of women empowerment and freedom but Karva Chauth is regressive & patriarchal event. Women practicing it are medieval & backdated.Words and logic mean nothing to liberals.

Inside many liberals is a totalitarian screaming to get out. They don’t like to have another point of view in the room that they don’t squash and the way they try to squash it is by character assassination and name calling.

They will point any single small aberrational mistake committed by the Right. Harass them threaten them and even target them at their workplace. That is what gives them pleasure. But all their sins and fake news should be buried in dust. As if the constitution had given them the solemn power to do so. So what if a photoshopped image of UP CM Aditynath Yogi’s pic is circulated. So what if he is called Hindu militant leader but Burhan Wani a designated terrorist is called headmaster’s son. Whatever it takes to give them joy. Deep down liberals are lonely unhappy creatures who find no joy in countries’ progress and are suffering  from Anhedonia. (Anhedonia is the inability to experience pleasure from activities usually found enjoyable). Their only source of joy is sadistic pleasures by mocking our Culture.

Our hypocritical liberals also include another genre. Our much revered stand up comedians. Cracking sexist jokes are their birthright and having selective knowledge about the ongoing political happenings is their unique trait. A lady comedian can call ‘Mayawati’ an un**c*able fatty. But when a common man points that Mayawati is playing Dalit politics they feel it is a violent assault on Dalits. Such is their selective amnesia.

A parliamentarian uses a dog filter to show support to a group but how ironical that the same man in the Rajya Sabha takes name of private citizens to threaten him & bully him. Entire liberal brigade sadistically takes pleasure of teaching him a lesson.

And if you think it is just a phenomenon in India you are grossly mistaken.

After Donald Trump won the presidential race the liberal Hillary fan boys/ girls took to the streets with #NotMyPresident placards burning vehicles & breaking window panes. They were protesting against Trump’s rule who was not even sworn in by burning America’s flag. Linda Sarsour the leader women’s march group a blue eye girl of the Liberal Democrats who has deep connection with Hamas feels that she can’t be a feminist & a Zionist at a same time. She passes remarks and uses abusive language on  another activists because she calls their bluff out. Madonna calls for bombing the white house.

Champions of freedom of expression, the liberal brigade have their own terms & condition which comes in fine print.

A vocal Jewish Trump supporter Milo Yiannopoulos was attacked and his vehicles were torched in the run-up to his speech in Berkeley University. Instead of blaming the rioters, the liberal establishment blamed it on Milo Yiannopoulos’ appearance.

Very similar on how contrary views from within Muslim community are subdued as it threatens the joyful happy family of liberals. Take for example how Shazia Illmi was not allowed to speak on the issue of Triple Talaq in Jamia University or for that matter how Ramdev was not allowed in JNU.

The sadistic joy of liberal brigade doesn’t exclude mocking ancient scriptures on Ajanta & Khajurao. They find joy in calling the Missile Man of India as ‘bomb daddy’! Such is the nature of modern day liberalism.

You have often heard the line ‘terrorism has no religion caste & creed’. Don’t know how much truth lies in that statement but by observing the peculiar behavioral pattern of liberal intellectual I can conclude: Liberal elite intellectuals have no religion caste creed gender or even nationality. They have one & only one single motto of ridiculing their own country & mocking their own value system in the name of being ‘anti establishment’. They don’t even spare the veterans & Jawans, mocking and insulting them by saying they joined the forces due to lack of educational degree and economic crisis.

I m not going to write in details of how to counter this sinister, evil & malicious brigade who are masquerading as Liberals. May be I will leave that for some other day. But I do want to tell it clearly to clear the confusion that certainly by not playing victim card or the usual lame reply of ‘ignore them or don’t give them importance’ . Or even by simply putting facts in front of them because liberals don’t believe there is such a thing as “fact” or “truth.

Did you know: You cannot Trademark a ‘Kitkat’ but a ‘Toblerone’

0

Are Trademark grants biased? Aren’t ‘Kitkat ‘ and ‘Toblerone’ both chocolates? Are the trademarks for a specific colour or shape tough to crack? A lot many such doubts would frolic in your mind.

Alas! Nestle’s attempt to trademark the KitKat shape was smashed.

Preface

In the 19th century, Bass beer emerged as one of the biggest beer companies, which had a ‘Red Triangle’ embossed on its bottles. This vermillion triangle was the only geometrical figure which, the world associated beer.

Bass grabbed the first mover advantage by being the first in line to get the Red Triangle trademarked on 1st January,1876. It is the oldest trademark in the UK, with a monopoly of almost 141 years, so far.

The value of trademarks is judged with its longevity. Trademarks have a limited time span of 20 years, to encourage competition.  However, a monopoly can be achieved by renewing the same after every 5 or 10 years depending upon the respective jurisdiction.

Complexities Of Intellectual Property Laws

Trademarks are usually ‘logos’, ‘name’, ‘colour’, ‘sound’ registered in relation to a specific goods and services. Therefore, it is possible for two businesses in different fields having the same name such as ‘Dove’ should we call it a chocolate or a soap?

To crack the Trademark registration, try to make it distinctive. ‘Kodak’ being an invented name is regarded as the uncontroversial Trademark.

It is trickier to trademark shapes and colours. A series of Trademark fails with an attempt to trademark a shape and a colour specifically with the consumer goods companies, elucidates the complexities of the IP Laws:

  • Lindt failed to trademark its gold foiled bunny chocolate in Germany.
  • Cadbury failed to trademark the shade of purple with respect to Dairy Milk chocolate.
  • Kit-Kat failed to trademark the Four fingered chocolate wafer.

Even after such complexities, companies attempt to apply for trademarks as it provides exclusivity to their brands against all infringing imitators.

What went right: TOBLERONE

Toblerone, a US-based chocolate brand has successfully trademarked its triangular shape.

What convinced the UK court?

The triangular shape of the chocolate was pivotal to its advertising campaign. It’s advertisement emphasised on using triangular honey from triangular bees.

However, post the pound’s Brexit- induced drop, they recently modified the design, to reduce its weight by giving bigger gaps between the triangular shapes of the bar to lower its costs.

Will this modification jeopardise its Trademark?

They chocolatiers argued that the new bar retains its overall length, they have just increased the gaps between the iconic triangles on a specific bar only sold to limited retailers and not to the full range of products.

What went wrong: KITKAT

Nestle attempted to trademark the shape of KitKat; a four-fingered chocolate bar.

The UK court believed that the rectangular bars with breaking grooves were not distinctive enough, you don’t get to see the bars, its inside the wrapper.

Moreover, it was discovered that there existed a similar Norwegian bar called “Quick Lunch” having the similar pattern since 1937.

However, Nestle has been granted trademark registration in other countries of the world like Canada, Germany, France, Australia, and South Africa, etc.

Nestle has its history of patience in trademarking the difficult marks. It took more than 40 long years for it to register the slogan,”Have a Break” as a trademark, which was granted in 2006.
Well, the Four-fingered bar is just the beginning!

Consciousness, Hinduism and India

0

Do all religions teach the same thing? No they don’t. Is everyone born equal? In terms of temperament and physiological make up, they are not. It is only Hinduism that sees this diversity and assigns work accordingly, so you really don’t have to become someone else.

You figure out what you are naturally good at (varna) and find a skill that aligns with this varna for your living. Hinduism is rooted in consciousness because that is where differences and diversity really collapse and the ultimate aim is to realize this consciousness. When your actions are aligned with your natural varna (not a jaati assigned at birth), it is easier for the mind to turn inwards and have this realization.

The awareness of this truth is missing from most of the Right-Wing Hindus today. We are no different than our ideological opposites in the sense that we mostly target or call out an individual’s actions instead of consolidating our thought processes in line with this truth and dealing with opposing ideologies accordingly.

Vedanta begins where the purpose of religion ends. In Hinduism, there is no concept of God. Consciousness without qualities is the absolute truth and the deities represent consciousness + material qualities. In consciousness all religions cease to survive. This is the truth we as Hindus should use when we deal with semitic religions, as they do not and would not dare to say the individual is in essence the absolute truth. In Vedanta the concept of God or Ishvara is only a relative entity useful only for the evolution of the seeker.

The same truth should be used when dealing with left liberals whose ideologies of socialism is based on body identification that is ignorance of their real identity as consciousness. All of left-liberals actions and outlook can be tied back to this ignorance time and again. Dharma and varna when used for self realization are infinitely better ways of organizing societies where the emphasis is on living in harmony with nature and respecting all forms of life.

How do we empower Hindus to understand this truth to deal with other ideologies ? How do we create awareness that both semitic religions and liberal ideologies are based on relative truths and can never answer questions relating to diversity in nature, existential questions about purpose of life, or the nature of consciousness itself and its recursive nature in manifesting as matter. Take their books and Gods away, their religions cease to exist. Take all the Hindus scriptures and Gods away, consciousness would still be.

While on one side we battle these ideologies at a transactional level, it is imperative that we create some sort of a mass awareness that every Hindu knows his religion is better than the rest simply because its foundations are unbreakable. How do we use this truth when we are faced with existential threats? How do we use this truth to counter missionaries / mullahs / liberals who target the susceptible among us? How do we use this truth in solving Mandir / Masjid, Kashmir issues, conflicts whose roots lie in difference of ideology?

While we fight these battles mainly on the lines of our religious or ideological identities, when we go back to our real identity as consciousness i believe Hindus would get a lot of focus, energy and a clearer perspective in fighting issues at a spiritual level where victories would create cascading effects on battles fought at mental and physical levels.

RAW & ISI- Fight for dominance

‘Research and Analysis Wing’ isn’t a department in a University where a bunch of scrawny unkempt Professors work on a thesis, RAW is India’s equivalent of the likes of CIA & MI5 where a phalanx of well-trained and committed officers strategize and work on gathering information vital to the security of the Nation.

Snoop organisations of all nations deny that they have undercover assets in other countries to spy & and in some cases, subvert. But, people privy to information on such organisations know that it is not true. James Bond and his antics maybe a bit too exaggerated, but toned-down versions of Bond do exist. They may not be romancing beautiful blond’s and driving ‘Aston Martin’ at breakneck speeds in hostile countries, but may well be assimilating critical data about troop mobilisation, weaponisation and preparedness of enemy that could help security forces periodically re-access threat perception of a hostile country.

India is bigger of the two warring siblings, but when it comes to intelligence, Pakistan’s ISI is far bigger than RAW. ISI is powerful, resourceful & dreadfully frightful. It’s like James Bond cast in a negative role- a very dark and negative role would be apt.

ISI isn’t just the eyes and ears of the Pakistani army, it’s also the incisors that the army uses to rip its enemy apart. India, Afghanistan and the Middle East are its theatres of influence, it has also made huge inroads in Nepal, Bangladesh and Sri-Lanka.

For years RAW has had its task cut out. It’s scope was limited to gathering Intel, monitoring the airwaves to pick up enemy chatter and keeping tabs on enemy spies and infiltrators. Critical Intel that helped the security forces to secure India from enemy attack and terrorism.

RAW was denied the teeth to inflict damage on its own, that role remained the sole prerogative of the Armed Forces, it was RAW’s job to provide actionable Intel and leave the rest to the forces.

Recent years clearly indicates a changed strategic thinking vis-à-vis RAW, a role enhancement of sorts is evident, the tight leash that restrained RAW from offensive roles has slackened, RAW can be seen in a new ‘Avatar’- that of a limited combat role without the combat fatigues covertly deployed in hostile countries to infiltrate enemy ranks. In other words- strike and subvert the enemy deep within his territory.

In the few years of its new ‘Avatar’, RAW has notched up a string of successes. Pakistan that used to sing paean of its ISI has now started to raise a hue & cry about RAW and its covert and disruptive activities within Pakistan.

They now blame RAW for the Baloch unrest, terrorism within Pakistan is the handiwork of RAW they claim. RAW is active and meddling in Afghanistan is another allegation. Mohajir incitement is an old gramophone record of theirs, but they keep renewing their claim. So much so that they even claim that Imran Khan’s Osama allegation is at the behest of India. Murmurs about RAW’s hand in Panama papers to defame Nawaz can also be heard in the power circles of Pakistan.

Carte Blanche, Pakistan blames India and the Research and Analysis Wing for all its troubles.

The surgical strikes saw the Army’s elite commandos working in tandem with RAW to strike targets deep within POK and Myanmar underlining the importance of accurate intelligence. RAW and it’s officers remain away from the limelight, relegated to the shadows, but their contribution to the Nations security will always remain in the limelight.

RAWage of the snoops is a clear and present danger to India’s enemies.

Is the MASUKA fiasco a distraction?

0

The National Campaign Against Mob Lynching (NCAML) had organised a rally for the Manav Suraksha Kanoon (Masuka) pledge on 12 July 2017. The Masuka law is an anti-mob lynching law proposed for the protection of human lives against crimes perpetrated as mob lynchings. About 30 participants of the rally were detained by the Delhi Police according to an article.

First of all, the Award Wapsi Brigade and the liberals of the media world are devoted proponents of the Masuka law. This brigade is well known for its animosity against Hindus, which may not be obvious due to the liberal and secular garbs they utilize to hide their distaste for the right-wingers. As a result, this entire campaign of ‘Stop Mob Lynching’ has been enacted and on-going for the past 1-2 months in a very systematic manner. The liberals have joined hands to enact a law that will inevitably be needed for themselves in the future, because as we know, the left voice is in its last leg.

This stump in the plan towards enacting the Masuka law is surprising. We have to accept that the liberals are also intelligent, and they very well know how to play victims. Their seamless planning in the introduction of the draft Masuka bill and successful online campaigning, makes one think that they would not have organised any protests or rallies without obtaining the correct permission. Therefore, when the rally that was supposed to happen in Jantar Mantar was moved to outside the parliament, then we have to concede that this was a deliberate attempt to distract and politicise the group’s pledge and their campaign against mob lynchings.

Masuka is a law that is especially being drafted and proposed to protect the minorities in India. Instead of Manav Suraksha Kanoon, they could have named it as Minorities Suraksha Kanoon. Anas Tanwir, a lawyer and one of the key members of the drafting committee for Masuka, said in an interview with TwoCircles.net, “It is a specialized law. Because in many cases of lynching it was evident that cow or beef was secondary but identity of the victim was primary reason of their targeting.” When Tanwir says ‘identity of the victim’, what he means is the religion of the victim. Therefore, it is obvious that Masuka is a law for the protection of the minorities, aka Muslims. The BJP, RSS and VHP often get blamed for playing communal politics, but one has to wonder who here is actually playing communal politics.

A detailed inspection of the Masuka draft bill reveals several sections that may already be provided by other laws in the Criminal Acts/Sections in Indian Penal Code. Certain sections of the draft bill do not have any relation whatsoever to the mob lynchings. For example, Section 10 of Chapter V titled “Other Offences and Punishments Thereof”, described the punishment for dissemination of offensive material as follows:

Notwithstanding anything contained in any other law for the time being in force, whoever publishes, communicates or disseminates by any method – physical or electronic, any offensive material, shall be punished with imprisonment of either description for a term of not less than one year which may extend to three years, and with fine which may extend to fifty thousand rupees.

The above law has been inserted into a dubious section of the bill, calling into question the qualifications of the drafting committee. If the Masuka law, which is the Minorities Suraksha Kanoon, ever comes into fruition, this law will stifle the freedom of speech and freedom of expression, which are so cherished by the liberal brigade.

We can only come to the conclusion that the Masuka bill may not even be enacted. Unless of course if the Congress comes back to power, then there is no doubt what is going to happen. The appeasement mentality of the Congress geared especially towards the minorities and the liberal media, is enough to secure this Minorities Suraksha Kanoon. In the meantime, one has to reflect on why the NCAML is deliberately creating a ruckus to gain publicity and instigating the Central government to act. All we can conclude is that this entire ‘Stop Mob Lynching’ brigade is creating a distraction from larger issues at hand, especially to do with the encroaching Islamic terrorist and Marxist problems in India. It would be wise if the Central government does not give much fuel to this burning fire.
