Art of using power

0

As of this minute Republic TV’s editor in chief Arnab Goswami is being grilled by Maharashtra Police for over 10 hours for the frustration he vented out against Sonia Gandhi (formerly known as Antonio Maino) for her apathy towards the brutal lynching of Hindu Sadhus, under the eyes of Maharashtra Police who were supposed to save them rather than handing them over to the killing mob. Maharashtra police’s involvement in this murder case is so apparent that one wonders if their motto is ‘सद्रक्षणाय खलनिग्रहणाय’ or ‘खलक्षणाय सद्रनिग्रहणाय’.

But MH Police is not the root cause. It is just a part of the system which has been eroded by corrupt (morally and money-wise) politicians and their administrators over the years.  Otherwise, why would a government in MH, which is not even 6 months old would harass a journalist for asking straight questions? Otherwise why would 200+ FIRs would be filed against the same journalist, by the same party leaders and its members? Otherwise why would its goons attack the same journalist and his wife in middle of the night? It’s all happening because they know that even their local leaders are good enough to take on the central BJP government and its machinery. They know that they will get away with any crime, be it murder, corruption, rioting or anything. In a sense they are fearless. No fear of law, no fear of people and certainly no fear for Dharma (those who are raising eyebrows here, don’t understand the difference between Dharma and religion).

People have put faith in BJP to change this course. It was elected in many states and of course at the center. But I can’t think of any concrete action taken by it to instill the respect for law in opposition leaders and administrators. Unfortunately, BJP has too many self-righteous persons who think about their own Dharma (i.e. not getting involved in unnecessary controversy) ahead of their responsibility for people they serve. We talk of decades of corruption and misuse of power by Congress, have you seen any of its leaders going to jail (not interim custody/jail)? They have not been sentenced even in BJP governed states. BJP has not been able to set an example by bringing corrupt politicians and administrators to their knees. BJP’s anchors speak loudly and smartly on television debates. But one wonders, if BJP’s smartness is limited to only debating on television rather than taking firm action against its opposition wherever its needed.

If Arnab can be grilled for over 7 hours, why would Siddharth Varadrajan not be asked questions by Police under Yogi government? Varadrajan is a US citizen. Can any foreign citizen be allowed to spread fake stories (link) against the governments on its soil? Had it been any other country, the government would have asked him to pack his bags. But again, BJP is a party of self-righteous people. Hence, Indian people suffer.

Another related case is of twitter, which bans, shadow bans, suspends, warns and deactivates people who don’t align with its left/minority-leaning ideology. Time and again BJP sympathizers have been blocked by Twitter company in an outright act of going against one’s freedom of expression on public platform. Twitter not just laughs on the face of BJP government, but if needed, it seems ready to throw every article in constitution and every judgement by the honorable Supreme Court which is related individual’s freedom of speech to the dustbin, in order to adhere to its left/minority leaning policies. One wonders, whether they have learnt this art from India’s corrupt politicians and administrators. Has BJP summoned Twitter even once?

Does I&B ministry function at all? Is it not responsible to taking actions against fake news peddlers and companies like Twitter? The less said about I&B minister the better because there is absolutely nothing to talk about his work in this ministry. BJP would serve people well if it learns from Congress the art of using power. Merely having power at your disposal is not enough, one has to learn to use it appropriately for the betterment of people and state otherwise that power is useless. Overall, in terms of taking action again corrupt people, BJP’s first term at center as well as in the state of Maharashtra was lackluster. They have been given second chance at center. If they don’t take any action, then people will be left at their own mercy.

Fact-Checking of fact-checkers: Are they reliable?

Top 40 COVID-19 Safety countries

Deep Knowledge group published its research on Top 40 COVID-19 Safety countries in Forbes. India is not on the list. Okay, no problem. They have also created a list on COVID-19 risk list, and India is on that list. But Pakistan is not on the list. Do you see the problem? Not only Indians but also everyone around the globe doubt about these findings. The Times of Israel says people behind it has an unusual career history [source: https://en.wikipedia.org/wiki/Deep_Knowledge_Ventures].

India is not in the ranking despite the whole world is unanimously praising Modi government for its efforts to protect 1.3 billion people from the corona. Should we pay attention to this article from Deep Knowledge. YES and NO. Let’s see why??

We have seen recently the hidden biased agenda of many internationally recognised organizations. America has raised a question on WHO. There is a serious allegation on WHO to favour China in COVID-19 crisis. UN- another international body is also known for its biased role. International Human rights activist and other agencies also selectively target the incidents to take action and make hue and cry, we all have already observed that. BBC has its own agenda and bias for left-liberals. BBC journalists often cover the stories against India with full enthusiasm whereas they often don’t choose to cover the positive stories in India. BBC loves to show the Indian government in bad lights. The tone of reporting picked by BBC is never neutral on India.

I did some investigation of non-profit IFCN which set guidelines and give the certificate to websites which can be onboarded by Facebook, Google Tweeter and another online website to do fact-checking for them. IFCN claims that they have verified that the IFCN certified (signatories) websites are impartial and unbiased fact-checkers.

What I found after two-week long research that they give accreditation quickly to websites and media portals controlled by left-liberal. For example ALT NEWS, This website is very selective in picking stories for fact-checking. They just pick the stories which are supporting their ideology.

Even articles found on ALT News website itself have many false claims and misleading info. The objective of this web site is to show Modi government, all right-wing organizations and associated persons in a bad light. You can see the events in India in the last 2-3 months, from Jan 2020 to April 2020 and compare the selection of news for the fact check by ALTNEWS. The game begins here to brainwash the common man on the name fact-checking and sounding to everyone that they are unbiased and doing very good work of saving India from misinformation. However, in fact, they are building an atmosphere where people of a particular group feel they are targeted. The heinous crime of a particular community is downplayed by ALTNEWS. Surprised !! I have everything to prove my point. keep reading. First let’s see the nexus of left-liberals in the world of journalism, their award business and promotion of their like-minded persons and ideology in various fields..

So the question is what is the standards of Fact-Checking? who regulates the fact-checking business? How to ensure that fact-checkers are neutral? All this fact-checking jugglery started with 2007 election in America when Tampa Bay times created a non-profit project PolitiFact.com operated by Poynter Institute to track American elections. At that time this website was criticised by conservatives, liberals and other independent observers.

What is IFCN? As per IFCN website, “The International Fact-Checking Network is a unit of the Poynter Institute dedicated to bringing together fact-checkers worldwide”. In all Poynter Institute, Tampa Bay Times and the member on the board who donates the money to these institute influence the panel on the IFCN, which is another non-profit project of Poynter Institute.

Who is the owner of the Poynter Institute?

No single owner but there are board members who run the Poynter Institute. Its very interesting to see who are these members.

The Poynter Foundation Board: Brian P. Tierney– CEO Brian Communications, Chairman Realtime Media. Many controversies around him. Just see his Wiki profile. Paul C. Tash– Chairman and CEO of the Times Publishing Company and Chairman of Poynter’s Board of Trustees. Former member of Pulitzer Prise Board 2006-2014. Neil Brown – President, The Poynter Institute Member of Pulitzer Prise Board 2016- Till Date Michael Dreyer – President, The Tampa Bay Trust Company. This trust manages a few trillion dollars of American elite class (Strong group of left liberals). Frank “Sandy” Rief III– Attorney, Allen Dell, Attorneys at Law. He is expert in taking care of Tax issues of elite in Tampa , Florida Elizabeth Sembler – Board Member, Corporation for Public Broadcasting Ex-Staff writer Thampa Bay Times

Explore the above personalities they are closely related to left-liberals groups in America. PolitiFact.com won Pulitzer Prizes in 2009 for national reporting. Paul C. Tash and Neil Brown both were associated with Pulitzer Prize as board members. Pulitzer Prize, Poynter and PolitiFact both are frequently associated with left Liberal. The claim is also supported by a statement from the 2010 Pulitzer Prize winner for commentary, Kathleen Parker- “It’s only because I’m a conservative basher that I’m now recognized after 23 years of toiling in the fields, right?”. Notice the nexus of left-liberals around the globe Poynter board, Pulitzer board, Politifact owners, IFCN panellist.

What is the conclusion? Like-minded persons promote like-minded person and collaborate among themself. Gang of Left Liberals. Be it Pulitzer Prize founders their board members and Poynter promoted IFCN. So let’s come back to IFCN story. All board members run their own fact check web sites in different countries. And then here comes the Mollah!! These fact check web sites can potentially receive $100000 or more every year from Facebook and other similar financial contracts from google, tweeter in return of fact-checking service. Since they are fact-checkers affiliated with IFCN they receive traffic from Facebook and various web sites. Thus They receive additional web traffic from giants like Facebook and Google. So becoming a fact-checker is a good business model, Adsense revenue, you get the donation also so that website can independently perform its task. Many web sites doing it correctly. They pick every news and stories which impacts the nation, do fact check and report as true-false or half-truth.

But the problem starts when Fact-Checking websites start picking the stories very selectively according to their ideology. When IFCN also starts picking the signatories selectively then it becomes very dirty. The websites and their owner endorse a particular ideology, they are boarded quickly. When IFCN panellists themself endorsing a certain ideology and run their web site to support it and rejects websites because they are from another ideology.

Verdict on the stories for fact-checking might be correct but the question arises when these web sites do not pick a story because they don’t want to say that story is true. Really!! Its like mother makes complain to father about mischieve of kid name Ram but never for another one – Abdullah. Father will always think that Abdullah is a very good boy, all mischieve is done by Ram.

For example – ALT NEWS Did not pick a single story about “Tablighi Jamat” and said that it is true that Tablighi Jamat created havoc in India. They picked all Jamat related story which was false and created an illusion around the globe, not only in India, that Tablighi Jamat is innocent and Muslims are victims in India. Every Indian knows that what Tablighi Jamat actually did in India. This web site has 221K subscribers, 151K fans and 56K youtube subscribers. Now you can imagine the destruction this web site is inflicting to the communal harmony of India. Muslims in India and around the world, who are trusting this web site as a source of correct and unbiased news will be misinformed. As per logic and constitution, the Indian government or Indian police must take action against ALT NEWS if they are doing wrong because ALT NEWS is not a secret web site. Moreover, To keep their dirty secrets guarded, ALTNEWS or supporter of their ideology removed co-founder name from Wikipedia. See the screenshot from the ALTNEWS showing the co-founder name and his article. Also, see the recently modified Wikipedia page from where his name is removed.

If you do fact-finding on Tablighi Jamat on ALT NEWS you will get the illusion that Tablighi Jamat members never defecate in public. However, Actually, Tablighi Jamat members defecated in Narela as per the another authorised source. Not selecting a true story and mark it as true. What does it indicate? On the contrary, ALTNEWS picks similar story but the false one and published that as false. All this drama just to create a better image of a group of persons who are responsible to create corona havoc. Try to recognize these polished tactics which are used by left-liberal and anti-Indians groups under the name of fact-checking.

So next time when you read fact-checking website don’t just notice the false stories, also notice what stories they published as truth, what stories marked as false and What stories they did not touch at all? Do the fact check on all web sites.

Time to do FACT CHECKING on FACT Checkers.

The Arnabs must WIN

0

With what many claim as the strongest govt now at centre after a long time, it’s disappointing to see how a fiery journalistic voice is being muzzled in the open by what seems to be a pliant Mumbai Police. It’s been more than 7 hours #ArnabGoswami is being interrogated even as the culprits who attacked him have been granted bail. How pathetic!

Arnab looks strong as long as we fail to gauge his trauma of being dragged away from his office and made to delay breaking some more important stories that may otherwise go unreported!

Arnab’s body language may convey that he cares little for public support only as long as we fail to take cognizance of the fact that his own FIR against the Youth Congress attackers too needs to progress with similar war-footing and parallel questioning of the culprits to continue in parallel. Unless that happens, there is every chance the Arnabs of tomorrow may shed their dream of breaking honest stories and amassing courage to question the higher-ups in fear of such humiliations under a submissive security apparatus.

Arnab must win so we have some people left in the anti-dynasty ecosystem to bust the fake stories and pseudo theories being propagated by the dynasty rulers. Arnab must win to uphold the voice against the most corrupt dynasty that has fooled a country over a long period of time to rule over them. Arnab must win to establish that a self-made journalist can brew a storm when it is badly necessary, especially when the ruling establishment despite a thumping majority doesn’t have the guts to call a spade a spade and fails to advocate for the majority cause in fear of their secular image being tarnished.

Come what may, Arnab must win. His fiery voice should rock against the pliant, corrupt media barons who certainly arrest the pace of growth and evolution of India in multiple ways. And if nothing can be done to ensure that Arnab wins this, we are heading for even tougher times ahead! This is certainly not what the New India looks forward to.

How Maharana Pratap defeated Mughals: The untold History

“And how can man die better,

than facing fearful odds?

For the ashes of his fathers

and the temples of his gods

–  Thomas Babington Macaulay in Lays of Ancient Rome.

By 1573, Akbar had become the master of North India. He had also conquered Gujarat and now his ambition was to equal the feats of Chakravarti kings of old. Imitating Vikramaditya, he had appointed his own navratnas. His court poets were already writing his paens. The only place not under his dominion in the north was Mewar. Mewar, which under Bappa Rawal, had stopped the Arab invasions in India in 8th century. Mewar, which had defied the self declared second Alexander/Sikandar-e-Sani Alauddin Khilji, and written a heroic chapter in the annals of India by its Jauhar-Saka in 1303. Mewar, without capturing which the route to Gujarat could not be safe.

Mewar was now ruled by Maharana Pratap. Pratap was not a King. In Mewar, God Ekling ruled the country and Maharana was the deputy of God. Akbar had been sending envoys to Maharana Pratap for years. He had sent Jalal Khan, and Man Singh of Amber and lastly Todar Mal. Pratap had politely refused every time. Honour and independence to him was greater than any wealth. The imperialist Mughal king was not amused. He had wanted to add another piece of land to his domain and another bunch of girls to his harem. Battle lines were drawn and war was inevitable.

Mewar had shifted its capital to Gogunda since the capture of Chittorgarh by Akbar in 1568. The capture had been marked by merciless killing of 30000 unarmed civilians by the ‘Great’ Emperor. Haldighati pass was a strategic place en route to Gogunda and it was to defend it that Maharana waited there for the vast armies of Akbar. It was 18th of June 1576, the height of Indian summer. Mughal army was led by Man Singh of Amber, Asaf Khan and Ahed Khan Barha. Rana was leading from the front along with Ramdas Rathor, Ramsah Tanwar, Bhamashah and Hakim Khan Sur.

A small contingent of patriotic Bheel bowmen under Chief Punja was also on his side. The Mughal army by all accounts was at least three times the Mewar army and had better arms and supplies. At that time, Akbar was probably the most powerful King on that face of earth. It takes a special kind of courage to fight when defeat seems certain. Maybe, the courage came from strong religious beliefs or maybe it came from pride in the honour of family. All told, Rana did not leave the field.

The story of battle is too well known to be related here. The heroics of Jhala Sardar, the loyalty of Chetak, the daring of Maharana Pratap and the return of Shakti Singh are stuff of legends. The inevitable happened. Mughals won on the basis of their superior numbers and better arms. How numbers impacted this particular battle can be seen in one particular quote. Al Badayuni the historian, who was accompanying Mughal army asked Asaf Khan, the Mughal commander how he can tell which Rajputs to shoot arrows at. He replied:-

“Shoot at whomsoever you like, on whichever side they may be killed, it will be a gain to Islam.”

– Asaf Khan quoted by the historian Badayuni

By noon, the battle had been decided. Rana and a substantial part of the Mewar Army was in retreat. It is a testament to their valour that the victorious Mughal Army could not summon the courage to pursue them that day. They were tired and wary of ambush in the jungles.

After a few days, with the full might of Mughal Empire behind him, Man Singh captured Gogunda, Udaipur and the fort of Kumbhalgarh. Slowly and surely the Mughal army captured most of the territory of Mewar. Rana was forced to seek shelter in the forests of Mewar. There he lived and there he waited for the right time. He left all the Kingly comforts. Akbar sent expeditions every year against him with armies of more than 1 lakh. The famed generals of Akbar had to be content with the dust of Mewar. Rana fought a guerrilla and imposed heavy damage on the Mughals. Slowly, he regained many cities and forts and towns.

Financially supported by the wealthy Bhamashah, he recruited and trained a new army. By 1582, he was confident enough to take on Mughals in open field again. His battle hardened troops were flush with multiple victories and confident of expelling Mughals.

Dewair is a sleepy town now, but it was a strategic place. It overlooked a ridge through which one could enter Mewar. Mughals were aware of this and kept their strongest garrison there. Pratap made a bold plan. He would attack Dewair in force, capture it and force the Mughals to surrender. The other Mughal garrisons were expected to fall in line. At that time Mughals had 36 garrisons/posts inside Mewar.

A rumour was circulated that Pratap had left the Kingdom. The relaxed Mughals did not expect any surprises. On Vijayadashmi of 1582, Dewair was surrounded by Maharana Pratap’s army. One wing was being led by Rana himself and another one by his son, Amar Singh. The Mughal rout was complete. Its two commanders, Bahlol Khan and Sultan Khan were killed in personal combat by Pratap and Amar. The remaining 36000 soldiers of Mughal army surrendered. It was the final and complete defeat of Mughals in Mewar. All 36 garrisons of Mughals surrendered. Rana Pratap was able to capture almost all the areas of Mewar except Chittor, which had been lost in his father’s time.

Akbar had become very powerful by 1580. He had even cowed down the religious Mullahs by proclaiming Mahzar, the infallibility decree, which made him Supreme Religious leader in Kingdom as well as Emperor. He was shaken by Dewair. Multiple attempts were made by him to win Mewar after that. He himself camped six months in an effort to defeat Maharana Pratap. But, Mughal armies lost every time in front of a rejuvenated Mewar. At long last, they stopped trying. Akbar died without having his dream of conquering Mewar fulfilled.

This glorious tale of resilience, patriotism and victory is not told in our school text books, our public discourse has no place for Rajput victories, but its importance is underlined by Col. Tod in his magnum opus in this manner:

“Huldighat (Haldighati) is the Thermopylae of Mewar ; the field of Deweir(Dewair) her Marathon”

Col. James Tod in Annuls and Antiquities of Rajputana.

Fixing Frankenstein’s Monster

Warning to the reader: You may find the following in extreme contrast to your personal views. The following is my personal view and falls within the *limits* of “Freedom of speech”.

Today I’m going to write about probably one of the most discussed however at the same time a very controversial subject. I want to discuss the validity of our current constitution which governs majority of the population.

That last line can be called controversial as I mentioned majority instead of ALL. I have my reasons to say so, which I want to discuss in my following rant and in the process try to fix some of the problems with it (as if it’s possible?)

Our constitution has undergone about 100+ amendments since it’s inception in 1950. That’s more than one amendment per year since Independence in 1947.

Our Constitution holds a high regard in our political ecosystem and all the policies originate from that system. The idea of a constitution is basically the same in the entire democratic world. The similarity between almost all of the constitutions across the world is that in the end it aims towards the betterment of its population and thus the nation as a whole (or vice-versa). Today we will discuss about the shortcomings and the validity of our current constitution, which was written during the times when poverty was at higher end, literacy was at its lowest, socioeconomic differences were at their worst, there was no such thing as open market or global trade (as far as India was concerned).

When constitution of India was written ideas were borrowed from the Democracies across the world during those times and the point to remember here is that most of those countries were much ahead of India in terms of economics, education, health services, etc. Our constitution was framed by borrowing ideas and ideals from countries which were nowhere near the cultural diversity like our India, that is Bharat. Most of those ideas were from inherently western societies which were mostly made up of one or two different cultures, unlike India which was and is a multicultural society, with multiple languages and variety of theological streams amongst other things.

A constitution is supposed to bind all of the population under one umbrella and provide equal opportunities to all of its constituents, having said this, an special effort can be made to uplift the most downtrodden in the population, but not like we do by offering Reservations.

Reservations are probably one of top 5 burning issues of discussion that we have in our country. A tool that has been mismanaged so badly that instead of doing good it has done more damage. As the basis of Reservations are majorly caste/religion driven it creates an inherent divide and sense of isolation. It could have been true that during the early years of Independence, when the divide really existed and was practiced, during that stage reservations may have made sense however in current times it is just a reason for discontent. If it cannot be abolished then it should be updated to counter the disparity that exists today, which is economic.

Economic disparity is one of issues that is not ignored However it is one of the least discussed. Ever since India underwent economic reforms during early 90’s, the populations were exposed to an entire new dimension of choices in all aspects of life, that led to Emergence of a new vibrant private sector providing jobs to unemployed graduates during those days. In the end, by the turn of century there were a lot more people in the private sector than India has ever seen before, however most of the workforce in the middle class was unable to reach the upper levels as, believe it or not, were tethered due to reservations that took a toll during 90’s. The institution’s (both providing Education and jobs) were bound by the law to reserve seats based on caste and/or religion. Merit was sidelined, by the constitution. As I have mentioned above the constitution has to uplift both it’s population and the nation and neglecting merit has done nothing but create hindrance in the progress of the Nation. Replace caste/religion with merit and economic condition, this will help bring in a much larger population who will help the Nation. A bright student coming from a low income family will be delighted to experience the transparency in the system and will have true respect for the constitution as the student will see it in action.

Religion Talking about religious bias in India is again a very sensitive, red hot topic may be in top 3. Since India, that is Bharat, has never imposed any religion upon anyone, it’s constitution should not favour any religion. We are supposed to believe that this is true, however reality is different. The laws that govern the major religion do not apply to second major religion in India, from marriage laws to divorce to property/inheritance laws the treatment is different. The constitution makers could not see beyond their limited vision, the disparity it will create in Future. This un-equal treatment led to severe ill treatment of the half of the population of the second major religion in India. As one half was taking advantage of the protection or rather blind eye that constitution provided. This brings me to my next point. Male Vs Female rights.

Male Vs Female rights and laws:- In this paragraph I will talk a little bit about the laws that concern our citizens, irrespective of any divisions. It is true that women have faced the brunt of times and have been subjected to many crimes both during war and peacetime. The constitution does provide the protection to the females as we have seen that sex determination tests were made illegal and jailable offense, triple talaak was outlawed, a strong deterrent against dowry is in place in India. The last one is the one which is most misused laws at present. There has been a steep rise in the number of false cases filed under Section 498A than the actual cases were there was actual crime. The solution for this can be formation of gender neutral laws, because as a citizen of the country everyone has to follow same set of laws, and it is important to form laws which are gender neutral to ensure fairness and trust amongst males and females who make up the population of the Nation.

Education it cannot be left unchecked, entire portion curriculum that still follows the changes made by British in 1835 has to be removed and local history has to be included as a compulsory subject. It must be made compulsory that all children have to have minimum of high school education and if religious institutions are providing education then they should be made responsible that modern Education of science and computers is included, as we cannot afford to have children growing up with non-scientific approach towards life. Universities should be made to dismantle all student unions as universities are not designated for politics it’s only goal is to impart knowledge to build citizens with knowledge and capability to take the Nation to new heights.

This is just the tip of the ice-berg, if only the founding ideas of our constitution were not borrowed, if only the makers were far-sighted, if only the amendments made later on were not driven by political ambitions, if only they would have done their jobs properly. All we can do is wish.

Elitism: Dawn of destruction

0

Why should we raise voice against any injustice when it is budding in the society? Does the sense of being an elite work as a tool to divide and rule?

History could teach us in detail but let us take just three example from contemporary India.

1. West Bengal: There had been a prolonged communist regime in West Bengal. We know the story of how Communists came in power after the Congress rule in the State. But what we really do not know or rather made not know is about one of the many specialties of communists regime, that is “false sense of being an elite”. Who is elite? A select group that is superior in terms of ability or qualities to the rest of a group or society. Now, what exactly is this “false sense of being an elite”? In layman’s context or rather in modern terms, It’s the self made claim that I am special and if I don’t speak anything against the crimes/injustice that takes place in the society, then people will continue treating me special, tolerant and secular.

How this works? Alike every society there are also crimes in communist ruled places. What’s so special in communist ruled society? In the beginning, due to the effect of this elitist mindset people choose to remain silent on small crimes. Slowly that small crimes converts into injustice and this injustice will become a trend in a very little span of time which would later turn into oppression. Now, the interesting fact about this elitist mindset and it’s ecosystem is that it holds people back every time while raising their voice against crimes in the society even when communist rule is over. Not just this, if you raise this concern then these very people will try everything possible to suppress you down because it becomes the new normal in such society. They may even argue that how come communist be elite because both are 180 degree opposite in bookish terms, but you will have your answers in their argument that highlights their detachment from the basic reality. It can be verified clearly in some deeply rooted communist zones of Bengal and somewhat in across Bengal.

2. Kerala: Kerala is also a deeply rooted communist state. You will meet many people (typically communists/converts/radicals who are in substantial numbers now) from Kerala who considers themselves so special that many of them have declared themselves ultra elite and separated themselves way distant from Indian way of living life. Some of these even possess the mindset of separatists. The effect of this can be seen in rapidly changing demography of Kerala and also in the fact that some of the ISIS terrorists have links in Kerala. All these are the result of the same “sense” adopted by people of Kerala in the beginning.

3. Kashmir: To know the on ground situation of Kashmir, you may have discussions with many veterans of Army who had been serving there in Kashmir during 1980s or before. They confirm about the presence of some similar “sense” in Kashmiris (Typically Pandits) since very long (i.e. mid 1920s). These Kashmiris also chose to remain silent when the non-Pandits as well as some poor Pandits were oppressed and proselytized in the valley during 1950s, 1960s, and 1970s. This in turn took a form of such a huge divide that was out of control of these people and finally ended up in horrendous pogrom of Kashmiri Hindus in 1990. Had they raised flag against these issues in the beginning and not indulged themselves in this Elitism, many things could have been under control/avoided.

PS: I am not justifying any crime/conversion/pogrom. My focus is on this “false sense of being an elite” and its outcome in long run.

The rise of a hoax: Secularism

0

How do you define Secularism? Secularism, as defined in the Merriam-Webster dictionary, is “indifference to, or rejection or exclusion of, religion and religious considerations”. In certain contexts, the word can connote anti-clericalism, atheism, desire to exclude religion from social activities or civic affairs, banishment of religious symbols from the public sphere, state neutrality toward religion, the separation of religion from state, or disestablishment.

Is India truly a secular state?

As we have seen in the definition of secularism, the word in itself means there should be a clear line of separation between the state and the religion of it’s subjects. Does India really do that? For generations, thanks to the 42nd Amendment act, we have been fed a wrong definition of secularism. We have been told that India is a secular state because of it’s special laws to protect the minority. It’s time now that people actually look up to the real meaning of the word used with so much liberty and
understand that India is not a secular state. India never was a secular state. India is a tolerant state.

India is tolerant state because India is a Hindu state. The Hindu nature of the Indian society has made it into a tolerant state. For a nation like India which is inherently pluralistic, which is not religious in the sense of Abrahamic religions, which never had a centralized “Church” and which welcomes diversity, secularism is a farce and a joke of the highest order. We need to have a system which is wholly indigenous, rooted in our civilizational ethos, grows out of our natural diversity and does not carry colonial Euro-centric and Christian theological biases.

The 42nd Amendment Act of 1976 was introduced by the then PM of India, Mrs. Indira Gandhi, during the controversial times of the Emergency. Regarded as one of the most controversial amendments in the Indian history, the amendment was a way by the dynast to increase the power of her office. Apart from an attempt to reduce the power of the Supreme Court and High Courts to pronounce upon the constitutional validity of laws and attacking the India’s federalism by transferring enormous powers from the Office of a Chief Minister to the Office of the Prime Minister, it also amended the Preamble and changed the description of India from “sovereign democratic republic” to a “sovereign, socialist secular democratic republic”.

Why were the words socialist and secular added to the preamble? We will discuss about socialism sometime later. Today, let us focus solely on secularism.

Article 14 of the Indian Constitution empowers the concept of Equality before the law, The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth.
Article 15 (1) and (2) prohibit the state from discriminating against any citizen on the ground of any religion, race, caste, sex, place of birth or any of them. These articles provide that there shall be no restriction on any person on any of the above bases to access and use the public places such as shops, restaurants, hotels, places of public entertainment etc. or use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to the use of the general public.

When the Indian constitution already had the provisions to prevent any kind of discrimination on any grounds, was it really necessary to add secularism to the Preamble?

Let us roll back to 1969.
Until now the Indian National Congress had complete support of the Indian people because of their contribution to the Indian Independence struggle. But things were changing slowly. After the Nehru-Liaqat pack, people like Dr. Shyama Prasad Mookherjee left the government and started anti Congress campaigns. The economy was on a downhill and the Congress was slowly losing the support of Indian people.

On 12 November 1969, the Prime Minister of India Indira Gandhi was expelled from the Congress party for violating the party discipline. The party finally split with Indira Gandhi setting up a rival organization, which came to be known as Congress (R).

The split can in some ways be seen as a left-wing/right-wing division. Indira wanted to use a populist agenda in order to mobilize popular support for the party. The regional party elites, who formed the INC(O), stood for a more right-wing agenda, and distrusted Soviet help.

With this split, it was clear that the Indian politics will never remain the same. If it was already not enough, Indira Gandhi decided to declare an emergency. A chaotic situation was awaiting the country. People were slaughtered. Anyone speaking against the government was put behind bars. The people’s favorite Indira Gandhi started losing her support. This is where the amendment act came into the picture. Secularism came in as a tool to start the politics of appeasement.

A tool that has been inherited in the same form till date. The addition in the Preamble was never about following the real definition of secularism of separation of religion and state. It was just the opposite. It was a way of giving minorities an advantage over the majority communities. It paved the way for special provisions and laws for the minority community of the country while neglecting the demands and needs of the majority. This amendment of the constitution was the stepping stone for the communal tensions that we witness today.

How can India be a secular state when there is not even a Uniform Civil Code? How can a state be called secular yet have the presence of multiple religious laws for its citizens. How can we call India a secular state when a subsidy is given for Haj yatra and not for Tirth Yatra? How can we call India secular when a fruit vendor is arrested for naming his stall as ‘Hindu fruit’ but Halal verification for products are completely normal? There reason why things like this are happening in the country is because we are a tolerant nation. We are a nation that has lived its life with the virtues of Hinduism since ages.

India’s beauty is in India’s pluralism. Pluralism is defined as the freedom of communities to practice their own beliefs as long as they are headquartered in India, respect India’s national integrity, engage in meaningful debate with each other and not attempt to proselytize to convert others. This is possible in India only because of its Hindu nature. India should work towards a solution based on Dharmic norms where sustainability of natural order becomes very important. For example, one faith cannot encourage its followers to kill or convert others through fraudulent means. Suppose Hinduism and Islam are to co-exist in this model, then there should be mutual respect between then, and those injunctions in Islam which encourage believers to kill infidels must either be expunged through reforms, or should be given suitable non-lethal symbolic interpretations.

Dharmic pluralism rather than secularism is therefore India’s way forward. And Dharmic Pluralism is only possible when we as a country come together and accept the fact that we indeed are a Hindu Nation.

Nation wants to know why FIRs against Arnab Goswami

On 24th April, 2020, in the midst of the Covid-19 Pandemic, the Supreme Court of India, came to the rescue of the maverick anchor Arnab Goswami of Republic TV. It stayed further proceedings in the multiple FIRs lodged against him in Maharashtra, Jharkand, Telengana, Rajasthan and Chattisgarh (all opposition ruled States, just saying). The Court has granted interim protection from arrest of Goswami for 3 weeks, while granting him time to move a Mumbai Court for anticipatory bail. It has further directed that the multiple FIRs would get morphed into one proceeding in Maharashtra, by transferring the FIR from Nagpur to Mumbai, to be taken to its logical conclusion.

A bench of Justices D Y Chandrachur and M R Shah passed the said orders in the petition filed by Arnab Goswami challenging the multiple FIRs against him for his ‘inflammatory statements’ against the Congress President Madam Sonia Gandhi, in the course of a debate on the Palghar incident, in which three persons, including Sadhus, were said to have been lynched, on his channel. Going beyond, the apex court has also stayed any future FIRs that may get filed on the same ‘cause of action’ against Arnab Goswami, to suffer a similar transfer to Mumbai.

In one word, sensational. But, in another word, Constitutional. The presiding judge was Justice D Y Chandrachud. Remember, it was he speaking from the pulpit who had said, “The destruction of spaces for questioning and dissent destroys the basis of all growth–political, economic, cultural and social. In this sense, dissent is a safety valve of democracy.”

Going beyond these words, in the P D Desai Memorial lecture, Chandrachud added, “The attack on dissent strikes at the heart of a dialogue-based democratic society and hence, a state is required to ensure that it deploys its machinery to protect the freedom of speech and expression within the bounds of law, and dismantle any attempt to instill fear or curb free speech,” he opined.

Commitment to the protection of deliberative dialogue is an essential aspect of every democracy, particularly a successful one, Justice Chandrachud said. He added, “A democracy welded to the ideal of reason and deliberation ensures that minority opinions are not strangulated and ensures that every outcome is not a result merely of numbers but of a shared consensus”.

Justice Chandrachud said the “true test” of a democracy is its ability to ensure the creation and protection of spaces where every individual can voice their opinion without the fear of retribution. “Taking democracy seriously requires us to respond respectfully to the intelligence of others and to participate vigorously, but as an equal in determining how we should live together,” the supreme court judge said.

Yes, the order from the Supreme Court is quite sensational, but nothing unusual, considering the circumstances in which it came about and the personalities involved. Social media went viral that ‘Nation Wants to know how Arnab Goswami’s petition filed at 20.17 on 23rd April, got listed at 10.30 a.m. on 24th.” It was in the wake of the viral video that Arnab himself put out in the aftermath of some goons attacking the car in which he and his wife were proceeding. He alleged that the target of his ‘inflammatory statements’ may have been behind the instigated violence and even challenged the political leader to ‘bring it on’. That was the sensational part. Not the protective order itself, for it is perfectly constitutional and timely.

FIRs lodged against Arnab Goswami were all by ‘party men’ aggrieved at the ‘inflammatory statements’, against their high command. The FIRs were not at the instance of Madam Sonia herself. In India, we have seen far too many instances of such FIRs, inspired by the acts of ‘public spirited citizens’ getting cast by the wayside, as not sustainable. Recall the FIRs against Mahendra Singh Dhoni for posing as God in a magazine or the actor Priya Warrier’s famed wink of the eye or even the FIR against Ramachandra Guha and other ‘intellectuals’ for writing an open letter to the Prime Minister Modi. All the FIRs had to go and away they went. So, the orders that Arnab Goswami has been granted is nothing unique or unusual.

The fact that the petition that got filed on 23rd April got listed on 24th also makes sense. Like or lump it, Arnab Goswami is a news anchor who comes home to the drawing rooms, on idiot box, on a daily basis with his cacophonous ideological food fights. ‘Medium is the message’, said Marshall McLuhan. Goswami is a media moghul. His megaphone Republic TV is imbued with the fundamental right of free speech. As Justice V R Krishna Iyer said once, “The freedom of speech of a writer must be put on a higher pedestal than that of an ordinary person, much like in the United States their Supreme Court has conferred a longer latitude for a cartoonist to lampoon the leaders”.

It is true that in the United States of America- freedom of the press is its First Amendment. Hate speech in the United States is not regulated, in contrast to that of most other liberal democracies, due to the robust right to free speech found in the American Constitution. The U.S. Supreme Court has repeatedly ruled that hate speech is legally protected free speech under the First Amendment. The most recent Supreme Court case on the issue was in 2017, when the justices unanimously reaffirmed that there is effectively no “hate speech” exception to the free speech rights protected by the First Amendment. In Matal vs Tam in June, 2017, The Nine said from the bench “Speech that demeans on the basis of race, ethnicity, gender, religion, age, disability, or any other similar ground is hateful; but the proudest boast of our free speech jurisprudence is that we protect the freedom to express the thought that we hate. A law that can be directed against speech found offensive to some portion of the public can be turned against minority and dissenting views to the detriment of all. The First Amendment does not entrust that power to the government’s benevolence. Instead, our reliance must be on the substantial safeguards of free and open discussion in a democratic society.”

Arnab may be right or may have gone overboard. He appears to have the licence to do either. It is true that our Art.19 fundamental right to freedom of speech is not on the same pedestal as First Amendment in the US. Our Constitution has carved out ‘reasonable restrictions’. The remedy for the aggrieved entity lies in suing for defamation (which law our Supreme Court had upheld as constitutional). Problem lies with the criminal jurisprudence where the Police administration or the Magistracy mechanically entertaining such FIRs at the instance of ‘total strangers’ said our apex court.

It is quite troubling that the lower rungs, where the mischief’ is planted continues to play truant, compelling intervention from the highest court. Nation wants to know why despite the clear and stated position of law, against the registration of such FIRs, the position continues to be the same.
