Did Dr B.R really made the Indian Constitution? Why is this so hyped about in India?

It is all Communist propaganda after 1980 when Dr BR Ambedkar was projected as Architect of Indian Constitution. Dr BR Ambedkar was a great man, with all due respect to him The Original Constitution writer was Sir B N Rau.

B N Rau was responsible for the general structure of its democratic framework of the #Constitution and prepared its initial draft in February 1948. This draft was debated, revised and finally adopted by the Constituent Assembly of India on 26 November 1949. As part of research in drafting Constitution of India in 1946, BN Rau traveled to USA, Canada, Ireland and UK. He met judges, scholars and authorities on constitutional law. Rau’s draft was already in place, when Drafting Committee under chairmanship of Dr. B R Ambedkar was setup.

BN Rau not only drafted Indian constitution, but also assisted in drafting the Constitution of Myanmar or Burma! So like Rabindranath Tagore helping 2 nations with national anthems, this great man had contribution to 2 countries with their most important book – the constitution!

It shows the sad stage of affairs of Indian Politics. It is only because of Politics that Ambedkar’s name is taken in Constitution making. Many countries got independence from colonial powers in late 20 century, along with India, India was not an exception. The Modern day nation states running on democracy is a recent day creation. Universal Education to people is a modern day concept. This was not given by Ambedkar. Ambedkar never made the Indian Constitution. The Current Indian Constitution is based on Govt of India Act of 1935 passed by BRITISH.

Drafting

Sir Benegal Narsing Rau, a civil servant who became the first Indian judge in the International Court of Justice and was president of the United Nations Security Council, was appointed as the assembly’s constitutional adviser in 1946. Responsible for the constitution’s general structure, Rau prepared its initial draft in February 1948. The draft of B.N. Rau consisted of 243 articles and 13 schedules which came to 395 articles and 8 schedules after discussions, debates and amendments. At 14 August 1947 meeting of the assembly, committees were proposed. Rau’s draft was considered, debated and amended by the eight-person drafting committee, which was appointed on 29 August 1947 with B. R. Ambedkar as chair. A revised draft constitution was prepared by the committee and submitted to the assembly on 4 November 1947.

Dr B. R. Ambedkar in his concluding speech in constituent assembly on 25 November 1949 stated that:- The credit that is given to me does not really belong to me. It belongs partly to Sir B.N. Rau the Constitutional Advisor to the Constituent Assembly who prepared a rough draft of the Constitution for the consideration of Drafting Committee.

Indian Constitution has taken various features from other constitutions, the concepts of liberty, equality and fraternity were taken from the French Constitution. The idea of 5 year plans was taken from the USSR and the concept of socio-economic rights was taken from Ireland. Most importantly, the law on which the Supreme Court works was taken from Japan. There are many other concepts that have been borrowed from other countries.

Let us take a glance on Constitutions of different countries. Many countries got independence from colonial rule in 20 century. All these countries made their own constitution.

SRI LANKA

As Prime Minister, Bandaranaike convened a number of committees to draft a new constitution, including a drafting committee chaired by the Minister for Constitutional Affairs, Colvin R. de Silva. The resulting document was tabled in parliament, voted on and adopted on 22 May 1972 by a vote of 119 to 16 against.

NEPAL

This constitution was declared on 26 January 1948 by PM Padma Shumsher. The constitution was formed under the chairmanship of Padma Shumsher and three Indian Scholars had helped him to prepare this document. The three Indian Scholars who contributed during its writing were Prakash Gupta, Raghunath Singh and Ram Ugra Singh. It consisted of 6 parts, 68 articles and 1 schedules.

BHUTAN

The Constitution of Bhutan (Dzongkha: འབྲུག་གི་རྩ་ཁྲིམས་ཆེན་མོ་; Wylie: ‘Druk-gi cha-thrims-chen-mo) was enacted 18 July 2008 by the Royal Government of Bhutan. The Constitution was thoroughly planned by several government officers and agencies over a period of almost seven years amid increasing democratic reforms in Bhutan. MYANMAR The 1947 constitution was drafted by Chan Htoon and was used from the country’s independence in 1948 to 1962, when the constitution was suspended by the socialist Union Revolutionary Council, led by military general Ne Win. The national government consisted of three branches: judicial, legislative and executive.

PAKISTAN, BANGLADESH, AFGHANISTAN, MALDIVES also made their own Constitution without any Ambedkar.

Constitution of Bangladesh-

The Provisional Government of Bangladesh issued the Proclamation of Independence on 10 April 1971, which served as the interim first constitution of Bangladesh. It declared “equality, human dignity and social justice” as the fundamental principles of the republic. East Pakistani members of Pakistan’s federal and provincial assemblies were transformed into members of the Constituent Assembly of Bangladesh. The constituent assembly had 404 members. After the war, the Constitution Drafting Committee was formed in 1972. The committee included 34 members with Dr. Kamal Hossain as its chairman and they together drafted the constitution of Bangladesh

Constitution of Pakistan-

After assuming charge as Prime Minister, Chaudhary Muhammad Ali and his team worked hard to formulate a constitution. The committee, which was assigned the task to frame the Constitution, presented the draft Bill in the Constituent Assembly of Pakistan on January 9, 1956.the Constitution was adopted and was enforced on March 23, 1956.the Constitution consisted of 234 articles, divided into 13 parts and 6 schedules.

Constitution of Afghanistan

Afghanistan Constitution was the constitution of Afghanistan . It was drafted by a committee of foreign-educated Afghans, including Sardar Abdul Hakim Ziai and Sardar Abdul Rahim Ziai, appointed for the task by Mohammed Zahir Shah

Constitution of Maldives-

The first written Constitution of the Maldives was codified in the early twentieth century, on 22 December 1932 during the thirtieth year of the reign of Sultan Mohamed Shamsudeen Iskandar III. A thirteen-member committee began work on drafting the constitution on 22 March 1931. The acting Governor of Ceylon Bernard H. Bourdill provided technical expertise in its composition. A first draft was completed on 16 June 1931.After the second republic was declared, new president Ibrahim Nasir ratified a new constitution on 11 November 1968. This constitution was amended thrice, in 1970, 1972 and 1975 respectively.Under the rule of president Maumoon Abdul Gayyoom, a 5th constitution was introduced in 1998.

Changing Semantics by Context

The recent incident related to Kangana Ranaut being subjected to threats by Shiv Sena leaders and forceful action through Mumbai’s local Government machinery over a statement she made about Mumbai and the mum/silence that followed from Bollywood industry, the liberals and feminists, makes one ponder and wonder at the same time “Why the silence?”

There can only be two possible answers to this:

  1. Intolerance, bigotry, fascism, chauvinism has been eradicated from the face of the country or rather from the face of the world, i.e the words and the symbolism behind them has ceased to exist, or
  2. The semantics of the words have changed.

Since, now and then there is shout and protest against the intolerance, fascist and oppressive environment created by the Central Government and the party in power, it seems improbable that the first scenario is true. Then the logical conclusion is that, the semantics of these words have changed. The just reason for the mum/silence by liberals and the torch bearers for tolerance in this country is that, we are unable to understand the change in semantics, when the context changes the meaning changes. To understand the mum, we need to understand the semantics of these words:

  1. Intolerance: lack of tolerance; unwillingness or refusal by certain group of people and political party or people with certain ideology, to tolerate or respect opinions or beliefs contrary to one’s own.
  2. Feminism: the advocacy of women’s rights, where the women don’t belong to certain ideology and are not outspoken about certain state of affairs, on the ground of the equality of the sexes.
  3. Chauvinism: excessive or prejudiced support by particular group of people and political affiliation for one’s own cause, group, or sex.
  4. Oppression: prolonged cruel or unjust treatment or exercise of authority by the people in power who are affiliated with certain political party or follow a certain ideology.
  5. Fascism: a governmental system led by a dictator or a person elected through democratic process but follows a particular ideology and affiliated to a certain party, having complete power, forcibly suppressing opposition and criticism, regimenting all industry, commerce, etc., and emphasizing an aggressive nationalism and often racism.

So, according to liberals and the only tolerant people of this country, the statement made by Hon’ble Sanjay Raut against Kangana Ranaut does not symbolise or demonstrate intolerance, chauvinism and oppression. All these words are to be used and only apply to the ruling party in Centre or in certain states and specially to people of a particular ideology; these people falling in the category of nationalists, bhakts and sanghis. The action taken by the BMC is highly justifiable and follows due process of law because fascism is contextual and the coalition government and party in power in Maharashtra and Mumbai can do no wrong.

The feminists see no cause of speaking up, because Kangna Ranaut has spoken about an issue for which women are not supposed to speak up. Hence, she does not qualify for feministic outcry and protection of women’s rights. People who are taunting the liberals and protectors of democracy to speak up and come in support for Kangana, do not understand the true meaning of the words “intolerance”, “fascism” etc. The use of these words and cries of feminism are only to be echoed and talked about when they fit a particular scenario, for a particular ruling party, or against people who fall into a particular category of people.

So, the public should learn the new semantics of these words, and stop asking liberals and Bollywood to speak up. The next time Mr. Sanjay Raut throws threat for not worshipping the Chief Minister or his party, or speaking against the way the Government functions; don’t worry, it is not intolerance or bigotry, it is his way of showing love for his party and its Head. When the BMC takes any action without notice, it is not fascism or oppression, it is quick and prompt action.

Remember, the meaning of a word changes with context, the liberals have used the semantics to change the context.

नॉटी मत बोलना, भैयाजी

हमारा नाम है पिंकू। हम बॉलीवुड के एक बहुत बड़े लिबरल सेलिब्रिटी के यहां नौकरी करते हैं। कुछ दो दिनों पहले तक हम भी मिडिल क्लास हुआ करते थे, पर एक निष्पक्ष पत्रकार महोदय ने हालात बदल दिए, जज्बात बदल दिये, कहीं का नहीं छोड़ा। माया नगरी की एक उभरती अभिनेत्री, वही सॉरी बाबू वाली, उनको मिडिल क्लास की विक्टिम महिला का दर्जा दे दिया। हमारे जैसे करोड़ों भारतीय जो मिडिल क्लास होने पर गर्व महसूस करते थे वे अब कहां जाएं? हर साल सरकारी बजट के दौरान मीडिया के ध्यानाकर्षण का विशेष केंद्र हम ही लोग तो रहते थे। न्यूज़ एंकर गला फाड़ फाड़ कर बताते थे -मिडिल क्लास को यह मिला, वह मिला पर मिलता घंटा कुछ नहीं था। बस एक तसल्ली रहती थी की मीडिया में हमारा भी जिक्र आता है। अब यह पहचान भी हमसे छीन ली गई। यही सब सोचते विचारते टीवी खोला तो इन्ही पत्रकार महोदय द्वारा देवीजी का घनघोर निष्पक्ष इंटरव्यू देखने का सौभाग्य प्राप्त हुआ। एकाएक मन मे विचार आया, क्यों न हम भी अपने सेलेब्रिटी भैयाजी का इंटरव्यू ले? घर की बात घर मे रहेगी ये सब कहके बड़ी मुश्किल से भैयाजी को मनाया है।

पिंकू – भैयाजी नमस्कार, आपका स्वागत है हमारे कार्यक्रम ‘कड़वे सवाल खोखले जवाब’ में। बॉलीवुड में कई दिनों से ये पेट्रिआर्कि बहुत ट्रेंड कर रहा है। शुरुआत बड़े कलाकारों ने की अब उनको देखादेखी छुटभइये कलाकार भी खूब पानी पी पी कर ट्वीट कर रहे है। क्या है ये मामला?

लिबरल सेलेब्रिटी – देखो पिंकू, तुमको समझाते है, पेट्रिआरकी मतलब पुरुषवादी सोच जहाँ पर हर काम पुरुषों की मर्जी से होता है, महिलाओं की कोई नही सुनता। अब इस पुरुषवादी सोच वाले मीडिया चैनलों, जनता और तीन तीन सरकारी जांच एजेंसियों ने मिलकर एक निर्दोष अभिनेत्री को ड्रग्स के आरोपों में जेल में डलवा दिया। तुम तो जानते ही हो, अपनी मायानगरी में बहुत से लोग थोड़ा बहुत माल तो मार ही लेते है। इट्स नॉर्मल इन द इंडस्ट्री, यार। कौन सा बड़ा अपराध है ये? बस इसी पुरुषवादी मानसिकता को उखाड़ने के लिए, हम सब मीडिया ट्रायल से पीड़ित देवीजी के साथ खड़े हो गए। देखो, हम पक्के नारीवादी है, महिला उत्पीडन के विरोध में लड़ते रहेंगे। (भैयाजी चिल्लाने लगे) – हम क्या चाहते? ….आज़ादी। अरे पुरुषवाद से…..आज़ादी। ड्रग्स लेने की …..आज़ादी। अरे लड़कर लेंगे……आज़ादी।

पिंकू- काम डाउन, भैयाजी। अचानक से जेएनयू मोड़ में काहे चले गए थे? वामपंथी कैरेक्टर में पूरा घुस गए हो, आराम से भैयाजी यहाँ कोई कैमरा वेमरा नही है, फ़र्ज़ी इंटरव्यू है। ओके, बढ़िया, अब ये बताइये की ये जो बॉलीवुड में कास्टिंग काउच बहुत कॉमन है,  महिला कलाकार को पुरुषों की तुलना में बहुत ही कम फीस मिलती है और फिल्मों में नारी को भोग विलास की वस्तु टाइप दिखाया जाता है यह यह कौन सी आरकि मतलब मानसिकता है?

लिबरल सेलेब्रिटी – यह क्या घटिया सवाल है? हम तुमको संघी कह देंगे,भक्त कह देंगे। बेटा, जो टैग हम तुमको दे देंगे न जिंदगी भर वही बन कर रह जाओगे। नौकर हो नौकर की तरह रहो, ज्यादा रबीश ना बनो,समझे।

पिंकू-अरे नहीं नहीं भैया जी, गलती हो गई हम भी रोल में घुस गए थे आप की तरह। हीं हीं हीं, कई लोग सवाल करते हैं कि बॉलीवुड की जानेमाने कलाकार, महानायक आदि लोग सुशांत के लिए खड़े नहीं हुए लेकिन अब मैडम जी के लिए बहुत ही सहानुभूति दिखा रहे है। ऐसा क्यों भैया जी?

लिबरल सेलेब्रिटी– चलो ये बात हम तुम्हे प्रकृति के उदाहरण से समझाते है। ध्रुवीय भालू के बारे में जानते हो? यह भालू खूब खाना इकठ्ठा करता है और फिर लंबे समय के लिए सो जाता है, अंडरग्राउंड एकदम। वैसे ही हम लिबरल लोग भी इस भालू की तरह है। अपना भी वही हिसाब है, हमारा पूरा एक लिबरल गैंग है जो जेएनयू से लेकर मीडिया, बॉलीवुड सब जगह फैला हुआ है। अपना पूरा गैंग देश हित के ज्यादातर मुद्दों पर सुप्त अवस्था में ही रहता है, ठीक इस भालू की तरह। लेकिन जैसे ही अपने लोगो ने किसी को भी विक्टिम व्यक्ति या उत्पीडित नारी का सर्टिफिकेट दिया, हमारे अवार्ड वापसी से लेकर, मोमबत्ती गैंग, ट्वीटर गिरोह मिलकर उसे अंतरराष्ट्रीय मुद्दा बना देते है। किसी पुरुष को भी अगर महिला का सर्टिफिकेट दे दे ना तो उसको महिला ही घोषित कर दिया जाता है, इतनी पकड़ है हमारी समाज मे। अब हम ठहरे सेलेब्रिटी ऊपर से लिबरल तो सबके लिए आवाज़ थोड़ी उठाएंगे, छोटू। खैर तुम नही समझोगे, अनपढ़ गंवार आदमी!

पिंकू- भैया जी प्लीज, अनपढ़ मत बोलिए। बहुत मेहनत से एम० ए० पास किया है। पर आप लोगो से कोई तुलना नही हो सकती हमारी, आपका तो बहुत ही हाईयर एजुकेशन रहा होगा ना?

लिबरल सेलेब्रिटी– हां हां क्यों नहीं। यह एम० ऐ० वगरह क्या होता है? हम बहुत पढ़े लिखे हैं, बुद्धिजीवी क्लास में आते हैं। आलिया से एक क्लास आगे और सोनम से दो क्लास पीछे थे हम। मतलब की इन दोनों के बीच का ज्ञान है, हमें। अब अपने आमिर भाई को ही देख लो, मुश्किल से 12वीं पास किया है लेकिन आज पूरे देश का युवा उनको बुद्धिजीवी मानता है,मिस्टर परफेक्शनिस्ट बन गए। सोचो कैसे? अरे, सर्टिफिकेट अपने लिबरल गैंग ने दिया है उनको। मैं तो कहता हूं तुम भी हमसे एक आध सर्टिफिकेट ले ही लो। किसी भी फील्ड का एक्सपर्ट बना देंगे। डिग्री विग्रि कुछ नहीं होता समझे,हम लिबरल लोग हर फील्ड में ऐसे ही एक्सपर्ट होते हैं। CAA के विरोध में दीपिका जेएनयू जाकर जितना एक दिन में सीखी है ना, इतना तो हम अभी बैठे-बिठाए समझा दे तुमको। 

पिंकू- क्या बात है भैया जी! आप तो सही में बहुत बड़े बुद्धिजीवी है। तो जैसे कि आप लोग बहुत पक्के नारीवादी है और नारी सशक्तिकरण का झंडा उठाते हैं तो फिर यह नारी को नीचा दिखाने वाले भद्दे आइटम सोंग्स पर ऐतराज़ क्यों नहीं करते? जैसे-‘मैं तो तंदूरी मुर्गी हूं यार, गटका ले मुझे अल्कोहल से’।

लिबरल सेलेब्रिटी– अबे, नारी विरोधी, फासीवादी! तू क्या जाने क्रिएटिविटी क्या होती है? सिनेमा आर्ट है आर्ट और हम उसके आर्टिस्ट। ऐसी घृणाभरी बातें करेगा ना तो मैं तुझे नॉटी बोल दूंगा।

पिंकू- अरे नहीं भैया जी! नॉटी मत बोलना बहुत ही भीषणकारी शब्द है। चाहे मेरे घर पर बुलडोजर चलवा दो भैया जी पर नॉटी मत बोलना। दिल से बुरा लगता है भैयाजी।

पिंकू- अच्छा भैयाजी, अंतिम सवाल! जैसा कि आप नारी अत्याचार के विरोध में लड़ रहे हैं तो अभी हाल ही में कंगना को नॉटी बोला गया, मुंबई नहीं आने की धमकी दी गई और अब तो उसका ऑफिस भी तोड़ दिया। तो नारी पर होने वाले इस अत्याचार पर आपके क्या विचार है?

पिंकू- बताइए भैया जी,……..सुन रहे हैं ना आप?…….भैयाजी?……… भैया …….जी…..अरे यह टेप कांहे लपेट रहे हैं मुंह पर!……..ये लो सारा टेप खत्म कर दिया। अरे पंखा ठीक करने के लिए लाए थे अब दूसरा लाना पड़ेगा। लगता है भैया जी अपनी ध्रुवीय भालू वाली गुफा में मौनवस्था में चले गए है। चलिए हम भी चलते है, कोई दूसरा लिबरल भालू ढूंढते है, इंटरव्यू के लिए।

सशक्त जनसंख्या नियंत्रण नीति की आवश्यकता

पिछले 40 वर्षो में देश की जनसंख्या लगभग दोगुनी हो गई है।  वर्ष 1981 में भारत की जनसंख्या केवल 683,329,097 थी परंतु वर्तमान जनसंख्या 137 करोड़ से अधिक है [1]।  एक बड़ी जनसंख्या देश की अर्थव्यवस्था को अग्रसर करने में सक्षम है। परंतु अति विशाल जनसंख्या अनेक समस्याओं को उत्पन्न कर सकती है। चिंता का विषय यह है कि हमारा देश तीव्र गति से एक ऐसी ही परिस्थितियों की ओर अग्रसर हो रहा है।

बढ़ती जनसंख्या का प्रभाव

देश के राजनीतिक दलों ने अपने निहित स्वार्थ तथा “वोट-बैंक” राजनीति के कारण जनसंख्या नियंत्रण की चर्चा तथा अधिनियम से अपने को अलग ही रखा है। देश में आपातकाल (जून 1975 से मार्च 1977) में कुछ ऐसा हुआ कि जनसंख्या नियंत्रण को ठन्डे बस्ते में डाल दिया गया। 1981 में देश की जनसंख्या  68.33 करोड़ थी और जनसंख्या घनत्व 236 व्यक्ति प्रति कि॰मि॰। 2011 में  जनसंख्या 121 करोड़ तथा जनसंख्या घनत्व 368 प्रति कि॰मि॰ थी, सम्भवतः वर्तमान जनसंख्या घनत्व 417 प्रति कि॰मि॰ है, (Table-1)। अगर हमने इस ओर तनिक भी ध्यान दिया होता तथा अन्य क्षेत्रों में समुचित विकास किया होता तो भारत एक सुदृढ़, समृद्ध राष्ट्र होता। देश जनसंख्या दबाव तथा उससे सम्बंधित समस्याओं से मुक्त होता। गरीबी, कूपोषण तथा बेरोजगारी  की समस्या भी जनसंख्या-दवाब से ही प्रभावित है।  उल्लेखनीय है कि वर्तमान विशाल जनसंख्या राष्ट्र प्रगति के लिए प्रतिकूल है। यह संसाधनों के अत्यधिक  दोहन एवं हर स्तर के प्रदूषण को भी उत्पन्न करती है। विशाल जनसंख्या घटती कृषि योग्य भूमि और सिकुड़ते वन-सम्पदा के लिए भी उत्तरदायी है।

अनियन्त्रित मुस्लिम जनसंख्या

विश्व में मुस्लिम सबसे तेजी से बढ़ते धार्मिक समुदाय हैं। विश्व स्तर पर 2010 में इस समुदाय की संख्या 160 करोड़ थी और सम्भवतः 2050 तक 73% बढ़ कर 280 करोड़ होजायेगी [2]। इन चार दशकों में विश्व की कुल जनसंख्या 35%  बढ़कर 930 करोड़ होने की सम्भावना है। जबकि हिन्दूओं की जनसंख्या इस अवधि में 34% बढ़ने का अनुमान है।

भारत में भी मुस्लिम जनसंख्या की स्थिति कुछ ऐसी ही है। Paul Kultz अनुसार, भारत के मुसलमान गर्भनिरोधक विधियों का व्यवहार  करने में विश्वास नहीं करते हैं [3]। इसकारण मुस्लिम महिलओं में प्रजनन दर अन्य धर्मावलम्बियों से अधिक है। देश में  मुस्लिम जनसंख्या का विभिन्न दशको में  विवरण Table 2 में उद्धृरित है [1] । भारत के विभिन्न सम्प्रदायों की जनसंख्या वृद्धिदर  Table 3 में अंकित किया गया है। इससे यह प्रत्यक्ष है कि भारत में भी मुस्लिम सबसे तेजी से बढ़ता संप्रदाय है।  तथा यह धार्मिक जनसांख्यिकी (religious demography) को भी प्रभावित कर रहा है। यह दुर्भाग्यपुर्ण है कि कई धार्मिक एवं राजनैतिक नेता इस समुदाय को अधिक प्रजनन-दर के लिए प्रेरित करते हैं। यह भी चिंता का विषय है कि मुस्लिम समुदाय के एक वर्ग के लिए धर्म सर्वोपरि है, तथा वे देश के प्रति संवेदनशील तथा उत्तरदायी नहीं दिखाते हैं।

आश्चर्य की बात है कि इस धर्मनिरपेक्ष राष्ट्र में इन्हें एक विशेष अधिकार, मुस्लिम पर्सनल लॉ 1937, प्राप्त है। Dr Peter  Hammond ने मुस्लिम समुदाय के व्यवहार की विस्तार से चर्चा की है [4]। उनके अनुसार, यह सम्प्रदाय अपने तथाकथित धार्मिक अधिकार के प्रति अत्यंत सजग हैं। हमारे देश में भी अनेकों मुस्लिम नेता देश में इस्लामी जीवन शैली, शरियत कानून के पक्षधर हैं।  Dr BR Ambedker का कहना हैं कि, “जिस क्षण देश गैर-मुस्लिम सत्ता के अधीन हो जाता है, यह मुसलमानों की धरती नहीं रह जाती है। यह दारूल-इसलाम (इसलाम का निवास) न रह कर दारूल-हरब (युद्ध का निवास ) हो जाता है।” यही कारण है कि मुस्लिम अपने को गैर -इसलामिक व्यवस्था में सहज नहीं रह पाते हैं। धार्मिक संघर्षों का यह भी एक मुख्य कारण है। सभी मुस्लिम धार्मिक, राजनैतिक नेताओं का यह दायित्व हो जाता है कि वे समाज को उनके राष्ट्रीय दायित्व के प्रति जागरूक एवं संवेदनशील बनने के लिए प्रेरित करे।

देश को अविलंब एक सशक्त जनसंख्या नियंत्रण नीति (policy) की अवश्यकता है। हमें एक ऐसे नीति की अवश्यकता है जो जनसंख्या नियंत्रण करने में तथा राष्ट्र प्रगति को गति देने में सक्षम हो। इस सम्बन्ध में मेरे भी कुछ विचार हैं।

राष्ट “एक परिवार दो संतान” के नीति को अपना सकता है। इस का पालन नहीं करने वाले परिवारों पर भारी कर (tax) लगाया जाए तथा विभिन्न प्रकार से दण्डित किया जाए। उदाहरण स्वरूप; रोजगार की क्षति,  विभिन्न सरकारी सहायता (subsidies) से वंचित, तथा सम्पूर्ण परिवार को मताधिकार से वंचित करने का प्रावधान हो। सरकार एक प्रभावशाली नारा, “एक परिवार दो संतान सुख, समृद्धि और सम्मान”, अपना सकती है। भारत में इस जनसंख्या विस्फोट के लिए एक वर्ग (धार्मिक मान्यताओं की सीमा के परे) मुख्य रूप से उत्तरदायी है। इसलिए ऐसे माता-पिता जो बड़े परिवार से आते हों (चार अथवा उससे अधिक भाई-बहनों का परिवार), को एक से अधिक संतान की अनुमति नहीं होनी चाहिये। उसके विपरीत सैन्य बलों के अधिकारियों को तीसरी संतान की अनुमति हो। एक ऐसी राष्ट्रीय नीति शैक्षणिक, आर्थिक, शारीरिक तथा मानसिक रुप से सशक्त जनसमुदाय के निर्माण में सक्षम होगी। 

Why National Digital Health Mission (NDHM) is seminal to transforming India’s medical care ecosystem and fighting pandemic emergency situations

Why NDHM Now?

The recent survey by ICMR on COVID19 situation, records a peculiar observation for Maharashtra, currently the epicenter of COVID19 pandemic– although not entirely unknown– i.e. 70% of COVID19 deaths in Pune and 87% in Maharashtra were due to co-morbidity. With comorbidity — most of it lifestyle diseases like diabetes, hypertension etc that Indians in the past few decades or so have become increasingly prone to— emerging as one of the main causes of mortality in the ongoing COVID-19 pandemic, the importance of a repository holding patients’ health records centrally that can be used to alert the physician to a patient’s medical history at the click of a button would be a huge help.

Migrant population of India especially those moving across locations/cities due to economic and other reasons as well as those wanting to seek second opinion from a doctor could be greatly benefited by allowing the doctor to see the complete diagnosis and previous care provided through sharing / consenting access for the electronic health records (EHRs).

Looking back at how different cities responded to pandemic crisis and the strategies that the successful ones adopted to deal with the situation reveals a big gap that India has on our health and wellness front. India’s Integrated Digital Health Infrastructure is supposed to have two distinct yet interoperable layers—one, the underlying physical infrastructure layer and two, digital /data/ information layer. On physical infrastructure i.e. hospitals, pharmacies, number of doctors, paramedics staff admittedly we do have gaps and there is a massive work afoot to bridge those gaps (e.g. strengthening district hospitals for multi-specialty care. 75 new medical colleges being built adding 15700 new MBBS seats over the next 3 years, Ayushman Bharat health insurance for insuring 50 crore Indians etc). However the biggest gap where even the basic framework is lacking is around the digital/ data / information harnessing layer on top of physical health infrastructure layer. Starting with basics, we don’t yet have a common repository of Indian citizens’ medical records which could be accessed using unique ID from anywhere (with proper access and security protocols) for the quick, efficient and effective diagnostics and medical care. The Govt though NDHM is attempting to build a digital stack on top of physical infrastructure leveraging digital technologies such as cloud, big data, analytics, Block-chain etc. Learnings from the successful experience of COVID19 containment and suppression by Hangzhou, the capital of Zhejiang Province in China using big data and information technology, like QR codes, to track and stop the spread of the corona virus has provided necessary impetus for acceleration of NDHM.

Every patient having a health ID on the lines of AADHAR has been central to the new National Digital Health Mission (NDHM) that Prime Minister Narendra Modi announced from the ramparts of Red Fort in his 15th August independence speech. National Health Mission (NHM) which is primarily about the underlying physical infrastructure has been in discussion since Modi first came to power in 2014 but the recent COVID19 pandemic has starkly brought out the gaps and limitations in the NHM and forced the Govt to prioritize digitization of healthcare system on war footing. The possible and a robust answer to the challenge could be digitization of the entire health care ecosystem to the extent possible, which will essentially be an icing on the cake as far as physical infrastructure like more hospitals, more doctors, cheaper generic medicine stores, health and medical coverage through Ayushman Bharat etc

What are the Key Ecosystem Building Blocks for NDHM?

As per GOI 2017 National Health Policy (NHP), different building blocks have been identified for creating a National Health stack. A few fundamental components are as below:

National Digital Health ID: every Indian citizen will have a unique Digital Health ID, which will be on the lines of AADHAR ID (AADHAR linkage will be necessary for the people availing Govt scheme related benefits) and uniquely identify the individual. This unique patient ID will not only help save costs and time on the redundant testing for the individuals by way of having all health records tied to it but also help migrant’s workers and those availing Ayushman Bharat scheme who need to travel to different cities for work and other economic reasons. The health ID for every Indian citizen will work as their health account.
The citizen’s health ID will enable rule based access to comprehensive database of the individual’s medical records from anywhere in the world. This will of course be preceded by proper validation, access control and consent mechanism by the citizen to the user. The health ID would enable access to every test, disease and diagnosis, and medical reports together with medicine details in it for an individual.
The mission has been rolled out on pilot mode in six Union Territories. Chandigarh has already enrolled 4000 citizens and is moving ahead with full enrollment targets.

National Health Registry (NHR): This is a common register with two separate modules: the register for provider of health services and register for consumer of health services. The registry will hold an authentic, standardized and updated geo-spatial data of all public and private healthcare. The Indian Space Research Organisation (ISRO) is the project technology partner for providing data security. Govt estimates that more than 20 lakh healthcare establishments such as hospitals, individual doctors, clinics, diagnostic labs, pharmacies and nursing homes would be enumerated from the provider side.
This resource repository shall also be leveraged by public health professionals and policy makers to assess trends and enable advanced research towards ongoing and forthcoming healthcare challenges arising from other determinants of health such as disease and the environment. Approximately 4,000 trained professionals have been engaged to approach every healthcare establishment to collect information. This repository for the first time will bring providers and consumers of the health services on the same platform.

Online Pharmacy
An online pharmacy, is a pharmacy that operates over the Internet and sends orders to customers through their logistics partners i.e. mail, shipping companies, or online pharmacy web portal. Although the draft guidelines for online pharmacies have been created by the Govt, they have still not being released and hence there is a haziness on when e-Pharmacy Rules will get finalized. This is one of the impediments in the sector attracting investments and innovations. For the success of NDHM, the Govt will have to address this issue on priority. From an online pharmacy platform perspective (e.g. Netmeds, now owned by Reliance), the customer journey goes as below:

Customers (patients) get their e-prescriptions uploaded to central patients records databases, and are able to order fulfillment online (via web or app), either for home delivery or for pickup at a nearby pharmacy via click & collect.

There are 3 different models which are likely to emerge/have emerged in online pharmacy
1) Customers browse about the product online but buys it via brick and mortar stores 2) Customers browse the product online, order online but pick up from nearby brick and mortar store 3) Customers browse the product online, order online and receive the home delivery of the products via logistic partner of the pharmacy.
Full integration of generic drug stores (Jan aushadhalaya-the low cost generic medicine pharmacies started by GOI) into NDHM will need to be undertaken on priority.

Coverage and Claims Platform (CnCP):
CnCP provides the building blocks required to implement any large-scale health insurance program, in particular, any government-funded healthcare programs. The single biggest problem with the current healthcare services in India pertains to coverage and claims procedures. More so with Ayushman Bharat scheme additional 50 crore citizens have been enrolled for health insurance. Normally it takes anything between average 3-4 hours for completing paperwork of a simple claim and more than that for a complex claim in hospitals. Besides involvement of the multiple entities (patients, insurance co, third party administrators (TPAs) and hospital), the process is also complicated due to lack of automation wherein the patient and their relatives are expected to furnish every bill, every invoice in a manual manner. 50 crore Indians who are already a part of Ayushman Bharat would be hugely benefited by this platform. But for 80 crore Indian who are outside Ayushman Bharat will need their Insurance services provides and TPAs seamlessly integrated (though open APIs) with the

Digital Health Stack. This would also necessitate an efficient and effective fraud management system a la Income Tax department.

Centralized Health Records & Analytics Framework

Aimed to bring a holistic view combining information on multiple health initiatives (including apps like Aarogya Setu) and feed into smart policy making, for instance, through improved predictive analytics; Heath analytics is expected to provide decision support to stakeholders on multiple “themes”, like quality of care and quality of data, by analyzing aggregated data from providers.
The framework design must ensure that analytics data is collected or created at the source i.e. when a medical record is being prepared for the EHR. o Analytics data can be aggregated by using either a subscription model or a push model where the data is sent mandatorily to one or more government controlled analytics systems.

NDHM Operating Model and Nodal Agency:

The National Health Authority (NHA), the apex agency responsible for the implementation of Ayushman Bharat Pradhan Mantri Jan Arogya Yojana (ABPMJAY), has been given the mandate by the govt. to plan, design, build, and roll-out and implement the NDHM within the country.

A new entity, National Digital Health Mission (NDHM), will be charged with the responsibility of implementation.

The core building blocks of NDHM such as Health ID, Digi-Doctor and Health Facility Registry shall be owned, operated and maintained by the Government of India. Private stakeholders will have an equal opportunity to integrate with these building blocks and create their own products for the market.

NDHM will be a government owned body, so as to ensure control within central and state governments o It will have two arms – one for policy & regulation, and another for operations & service delivery

Key components of NDHM Operating Model

National Health Electronic Registries: Electronic registries will hold a single source of truth for all patients’ health data and manage master health data of the nation.

A Federated Personal Health Records (PHR) Framework: to solve twin challenges of access to their own health data by patients and to healthcare service providers for treatment, and availability of health data for medical research – critical for advancing our understanding of human health.

A National Health Analytics Platform: health analytics platform is expected to generate a holistic view combining information on multiple health initiatives, derive trends and feed into smart policy making, for instance, through improved predictive analytics.

Other Horizontal Components: Including, and not restricted to, Unique Digital Health ID, Health Data Dictionaries and Supply Chain Management for Drugs, payment gateways. Shared across all health programs.

The services offered by NDHM can be categorized as

 Client/Patient services- These include secure health ID for all Indian citizen, personal health record, national health portal etc

 Services for healthcare providers. These include summary care records, digital pharmacy and pharmacy supply chain, digital diagnostics, hospital digitization

 Technical services includes data and cyber security, information governance, defining service standards etc

Applications Building Block

Following Public/Government Apps such as Reproductive and Child Health (RCH), NIKSHAY (Online TB Patients monitoring application), e-Raktkosh, Health Management Information System (HMIS), among others are expected form a key part of building block applications. Telemedicine ought to be given a high priority given the low Doctor-Population ratio, especially in rural areas.

Private health apps such as Hospital Management System applications, claims applications currently being used by various service providers will be an integral part of the application stack. Open Source Products for their flexibility, adaptability and cost advantages will be expected to be leveraged for the sharing of real-time patient data among the members of the medical/surgical/nursing teams for delivery of tertiary care

Benefits, Limitations and Way Forward

Through this mission GOI is aiming to achieve following:
 Easy accessibility of data/information to all the participants: The platform will be available in the form of an app and website and hence easily accessible to the participants

 Re-engineered processes with higher degree of automation leading to shorter turnaround times/cycle times and better customer experience

 Coverage and cost: With seamless integration of systems and data hub creation, NDHM aims to significantly improve operational efficiency, coverage, cost and customer experience for all the stakeholders/participants

 NDHM has proposed the creation of a National Health Stack to make both personal health records and service provider records available on cloudbased services using the internet. It has been designed along the lines of India Stack where a set of cloud-based cashless services like digital payments can use application programme interfaces or APIs to transfer information through the system.

 The NDHM still does not recognize ‘Health’ as a justiciable right. There should be a push draft at making health a right, as prescribed in the draft National Health Policy, 2015.

 One of the biggest concerns is regarding data security and privacy of patients. It must be ensured that the health records of the patients remain entirely confidential and secure. The Western countries who have implemented NDHM mission ahead of India have learned a hard way to deal with Electronic Health Records and are still struggling with the same. Privacy and confidentiality issues in fact tend to increase the cost of health. Software companies escalate the cost in order to make the system more robust- the cost is indirectly borne by the end-user (Patient) only. GOI will have to be particularly watchful of these issues with deep potential to undermine the benefits due to additional costs.

 In addition, the failure of a similar National Health Service (NHS) in the United Kingdom must be learnt lessons from and the technical and implementation-related deficiencies must be proactively addressed prior to launching the mission on a pan India scale. Digital literacy could be another concern in some parts of India (although the situation has improved a great deal due to digital payments and Direct Benefits Transfer (DBT) that Indians at large seem to have embraced in a big way).

 UK’s National Health Service (NHS) started deployment of an electronic health record systems in 2005 with an objective to have all patients with a centralised electronic health record by 2010. Several hospitals acquired electronic patient records systems as part of this process, but there was no national healthcare information exchange. The program was ultimately dismantled after a cost to the UK taxpayer was more than £10 billion, and is considered one of the most expensive healthcare IT failures. According to The Independent, the project had been beset by changing specifications, technical challenges and clashes with suppliers, which left it years behind schedule and way over cost.

 The standardisation of NDHM architecture across the country will need to find ways to accommodate state-specific rules. It also needs to be in sync with government schemes like Ayushman Bharat Yojana and other ITenabled schemes like Reproductive Child Health Care and NIKSHAY (Tuberculosis eradication by 2025) etc.

 Among its key performance measures, NHA a la its British counterpart NHS will have to look at overall patient satisfaction. This could be a complex metric build using variety of service related parameters and ultimately resulting into a single Patient Satisfaction Index (PSI) which will be useful in timely monitoring, control and correction. NHS uses plethora of 21 different electronic systems to record data on patients. These systems are not well connected and hence do not communicate well with each other. There is always a risk doctors treating a patient will not know everything they need to know to treat the patient effectively. There were roughly 10% (as many as 11 million) patient interactions out of total 121 million where information from a previous visit could not be accessed. Half the Trusts using Electronic Medical Records used one of three systems and at least those three should be able to share information. One tenth of Trusts had application/system proliferation in that they used multiple systems in the same hospital. Dr who participated in the research said, “Hospitals and General Practitioners (GP) often don’t have the right information about the right patient in the right place at the right time. This obviously has potential to lead to errors and accidents that can threaten patients’ lives. Another issue with NHS which has come to light and needs to factored in while building NDHM in India is around data security. Apparently the Information on millions of NHS patients was sold to international pharmaceutical companies, in the US and other nations for research, adding to concerns over USA ambitions to access remunerative parts of the NHS after Brexit.

The concern over lack of transparency and clarity over the data and how it is used remained paramount.

 Govt of India had drafted online pharmacy related regulation but yet to notify it. This has hindered investments in the sector. GOI will have to notify the rules for the online pharmacy. Reliance industry has acquired Chennai based online pharmacy company by name NetMeds. Amazon is also making big strides besides some other players like Apollo Pharmacy etc. Besides Jan Aushadhalaya started by GOI for low cost generic medicines will need to be integrated in the NDHM platform

 Issues due to delay in finalising online pharmacy policy

 Lack of investments: The pharma sector is expected to be $35 billion industry by 2023 as per some industry reports. Lack of clarity will always discourage entrepreneurs and investments won’t come in easily leading to slower improvement of the current infrastructure. More than 100 start-ups this year got funded in the fintech space while less than 25 start-ups got funded in the healthcare space (in-spite of fintech being much more complex in terms of execution and regulations)

 Lack of innovation: Due to fewer entrants, innovation in this space will also be quite slower than in any other category. Healthcare needs more innovation in order to improve the current standards of patient experience and lead to better outcomes.

Time to reconsider our medical services

History is not just about the facts. Moreover, it’s about the context and who is telling it. When the vaccine to fight the Wuhan virus will be available; probably we’ll forget about the crisis we’ve faced during this pandemic.

The pandemic has revealed that how vulnerable we are to the biological warfare. Researchers and experts have made claims that Covid-19 was a trial weapon of Beijing to test international response to a biological weapon.

We may establish several hundred Covid-19 test facilities but still most the patients are not getting proper attention due to the lack of fundamental medical services.

Indian medical infrastructure is severally damaged. A government primary health care unit is less appropriate than a private clinic but let us put aesthetics aside for a moment and focus on active human resources in medical services.

There is a huge shortage of doctors in India. As of now we only have approximately one million registered doctors in India including experts of every field.

Most of the people in remote villages and in major cities as well are treated by registered/unregistered pharmacists. A significant portion of patients in India take drug without a prescription and a doctor’s consultation. We already are aware of premature deliveries deaths of women in India but where stand to today to resolve the issue, is a Kryptonite question which makes the so-called largest democracy superman vulnerable around it.

According to the NEET, almost 77,000 candidates take admission in the medical colleges for MBBS program but only around 50,000 graduate the course. One-third of the candidates fail and it is not because of the education system or professors. The fundamental reason is reservation in medical examinations. The one deserving candidate is left without admission and the one who must be left out is given admission in medica college.

We already have this flaw with other education institutions. There was no need of doing this with medical services. At least it could be excused from undeserving candidates but our parliament cannot stomach the fact if excused one sector of our system will become more convenient and they will lose one topic to mock their political enemy.

It is the necessity of the moment to reconsider our health services and induct more convenient norms to make this sector vital so that a tax-payer can take a bit of taste of his own money.

The decline in leftist media

A war is going on in the Indian media industry. The industry, which has hitherto been infested with leftist propagandists, appears to be slowly turning right. The once-popular newspapers and television channels lost their sheen and are on a decline. And these media houses, unable to digest the change, are heaping abuse on the new, emerging media houses for toeing the line of whom they call the ‘right-wing forces’.

What could be the reasons behind the decline of media houses, which reduced themselves to leftist propaganda machines? Well, the people no longer are ready to be hoodwinked by the tactics of the Left. They no longer get attracted by the romanticized terms such as socialism and egalitarian society, as they fully understood that the noble-sounding words can’t bring about any improvement in their lives.

The other important reason behind the decline of the left-leaning media houses is their incessant efforts to promote Islamism in the garb of liberalism. The left-leaning political parties that are not able to come to terms with the strengthening of the nationalist forces, started unleashing violence by exploiting the existing fault lines in the society. Whether it is the violence in Delhi in the aftermath of the Shaheen Bagh Islamist uprising or the riots that broke out in the United States after the death of George Floyd, the Left has played an active role in stoking violence. And people are not happy with the role played by many media houses, which went all out to give legitimacy to the violence and anarchy.

It is a well-known fact that these media houses were patronized under successive Congress governments. They, in the name of getting scoops, had unimpeded access to the corridors of power and even managed to transform themselves into power brokers. The infamous Radia Gage exposed the murky dealings involving some ‘five-star’ journalists, who sold their journalistic souls to Satan for the sake of money and power. Such kind of unimpeded access was curtailed after the BJP-led National Democratic Alliance (NDA) came to power. Unable to digest their reduced importance, they attacked the Modi-led government ferociously. Their strategy, however, worked to their disadvantage and led to the consolidation of nationalist forces. It even resulted in the emergence of a section of journalists who are sympathetic to the cause of nationalism.

The media houses and their journos, who are filled with their pathological hatred for the Modi-led union government, even acted as the mouthpieces of the enemy nations through their opinion pieces and social media posts. Enemy nations such as Pakistan and China leveraged the anti-India rants of these journos to portray India in a negative light in the international arena. The behavior of these journos generated a lot of anguish, which resulted in people detesting the kind of journalism they practice.

The nationalist sentiments, just like in many parts of the world, are at an all-time high even in India. People want fair and unbiased reporting. They want their media to discard ‘vulture journalism’ and stand by the country. They want their media to cease to be Hinduphobic and stop stigmatizing Hindus. And, they no longer want to patronize the leftist media, which enslaved itself to the ‘first family’ that reduced India’s grand old party into their family enterprise. They prefer to call all these journalistic creatures as Lutyens Media and detest them.

These days the Lutyens media is talking a lot about the economy and using the economic slump as a weapon to attack the Modi-led union government. In the process, they completely exonerated the Chinese Wuhan virus for the downturn. But they conveniently ignored the fact that the same Chinese Wuhan virus severely dented their business and made them lay off their employees, push their content behind paywalls, and bank on sponsored content.

As the leftist media refuses to change its ways and adamantly sticks to its agenda peddling, the new, emerging media houses, which managed to accurately sense the people’s sentiments, are racing ahead of their competitors. For example, the relatively new Republic TV headed by Arnab Goswami raced ahead of its long-established media houses in attracting more eyeballs. The latest data released by Broadcast Audience Research Council (BARC) India clearly shows how the channels owned by Republic Media Network took an unassailable lead in the English and Hindi news segment, closely followed by Times Now. The channels such as the NDTV, which gained notoriety as Left-Islamist propaganda machines, are nowhere near.

These legacy channels, however, are not ready to accept their defeat in a gracious manner. The newscasters of these channels are trying to attribute motives to the journalistic practices of the emerging media houses and trying their level best to portray them in a negative light. Their rants on social media are a manifestation of their bitterness.

Their frustration emerges from their inability and unwilling to accept the fact that this is a new India and they don’t have any other way except changing their course or sink into oblivion graciously.

Absolute ideas and thoughts in western societies

Recently you have noticed an incident on twitter when an Iranian-Canadian ex-Muslim Armin Navabi posted a cartoon of Kali Maa to offend the follower of the Hindu faith. Let me give a little background, in the result of recent riots in Sweden when a right-wing political party person from Sweden tore the Quran, Armin decided to tear the Quran himself and in addition, he decided to spit on it as well in a YouTube video which he posted on his YouTube channel. Some believers of the Hindu faith showed him support from India and the world, then he decided to make and post that cartoon in order to instigate Hindus.

Here you have to understand the mentality of the person, Armin and many other neo atheists in the western societies tend to call themselves atheists but they are still trapped under Abhramic ideology because they behave in the same way a religious person in Abhramic countries would behave only difference is that their gods have changed, it can be anything they say they believe in logic, science, and Humankind. But the real question is the people who believe in humans are not humans as per the recent phenomena?

Western societies had to separate the state from the religion in order to sustain and lead a peaceful life for their people and arguably they have managed to do so to a larger extent. But societies don’t evolve overnight, their thoughts and ideas are shaped by the surroundings they have been raised, the school of thought they have seen. In general society’s ideas and thoughts are very limited because they and their ancestors have experienced the abhramic school of thought which fundamentally dictates either this or that. It’s rigid in a way that these are the rules you have to follow and not flexible which exist in Indian society. Don’t get the wrong idea we are not talking about people here, we are just talking about ideas and thoughts in general, there can be individuals with multilateral thought process in western societies and similarly individuals with bilateral thoughts. One of the reasons for this goes to fundamentals of the abhramic school of thought which dictates either you believe in this school of thought or you are against it, which is in absolute terms(this or that).

That can be the reason for the western institutions many times pointing out that Indian societies have become intolerant because they don’t understand the society and their lens of ideas doesn’t allow them to. Not denying that there can be problems in Indian society regarding law and order but you cannot pick up an individual case and generalize the society. Well, you must be thinking oh! you are taking Armin Navabi’s case and generalizing yourself, No Armin is just one of the many atheists who jumped in his support because they too believe that way, also let us give you another example down and you can yourself find many different reasons why I thought so.

You can clearly see the distinctively separate left and right in the political scenario in western societies, that’s one of the reasons they tend to copy their western template and paste it on Indian society when they call Modi, BJP, and RSS intolerant without any evidence or proof simply because according to their school of thought either you are left or right there is no place for the multilateral school of thoughts which exist in fundamentals of Hindus as well as Indian society. You have to understand humans and their ideas are flexible and too complicated to just simply put it in black or white.

One more example, western societies tend to introduce titles like Feminism, Secularism, and tolerance/intolerance which all are absolute in nature. You are either a Feminist or not a Feminist there is no scope for flexibility. Again these ideas are very good but only work for societies having absolute ideas with this or that, it tends to fail when you put it in the Indian context.

Indian society must look for thoughts and ideas by looking within and looking at our history and reality. We have thousands and millions of school of thoughts and ideas in our civilization and history. There is nothing wrong with looking at western societies and appreciating their ideas which they apply to evolve their societies but if we want to improve and evolve our society we have to look for answers within instead of looking outside.

Shiv Sena must leave the legacy of Goonda Raj in order to survive in democracy

Day after demolishing property of Manikarnika star Kangana Ranaut for raising voice against the system and arrest of three Republic Network journalist for reporting on Shiv Sena, they have stooped to another low where goons of Shiv Sena attacked a 66-Year-old ex-Navy officer just for forwarding a cartoon over WhatsApp, ironically the founder of Shiv Sena himself was a cartoonist. Some days before they have shown their inefficiency for the justice of mob lynching of Hindu sadhus in front of Maharashtra police. Democracy in Maharastra is seeing dark days under the Shiv Sena administration.

Maharastra, specifically Mumbai has seen the history of gangsters in the beginning decades of India’s independence. With the Economic boom in the nineties and Mumbai being the financial capital of the country, Law and order of Maharastra by and large where they have managed to eradicate the gangsters. But in absence of gangsters after seeing so many years of their influence it created a vacuum which Shiv Sena is trying to fill by being the gangsters themselves.

Shiv Sena as a party was started with good intentions in their own words on the teachings of the great Shivaji Maharaj, which Shri Bala Saheb Thackrey the founder of Shiv Sena managed to make it relevant for so many years. But as the legacy passed on to the son of Shri Bala Saheb Thackrey, Uddhav Thackrey they started behaving more like those gangsters than the great Shivaji Maharaj himself.

One of the shocking things is all those so-called placard holder Bollywood lobbies and the award-wapsi gang have not said a single word on this behaviour of the state government. Since 2014 they have been chanting intolerant India but suddenly there is complete silence in that nexus. Either they are scared of the real intolerance they are seeing or they are silent because they have themselves been doing PR campaign for this government on twitter.

The great Shivaji Maharaj’s legacy and school of thought believe in justice which they claim to stand for but their recent actions dictate otherwise. Shiv Sena needs to understand that they should leave their legacy of goonda raj behavior if they are looking for any future in a vibrant and growing democracy like India.

Indoctrination and the families of Jihadists in Kashmir

Kashmir has been the Apple of discord between both India and Pakistan since from the day of detachment in 1947. Pakistan with its malafide intention always endeavour to knock down the edifice of tranquility and future of Kashmiri youth in Kashmir. Due to the conspiracy and double-dealing strategy of Pakistan towards the devastation of Kashmir, the state since from 1990’s, has been witnessing a trend of Pan-Islamism, clearing Kashmir Valley of the Hindu minority presence and young boys disposed to lay down their lives in the name of ‘Jihad’, the holy war. Separatist groups perceived as secular were abandoned by Pakistan, favouring other Islamist substitutions, when they started moving away from the Pakistani’s stance to see Jammu and Kashmir merging with Pakistan.

Islamic terrorists endeavoured to bring structural changes at cultural levels of the Kashmir society since the inception of militancy, as in the year 1989 and in the early 1990’s there was a mushroom growth of militant organization’s in Kashmir advocating ‘Nizam-e-Mustafa’ (Rule of the Prophet) as the objective of their struggle. Simultaneously, all cinema houses, beauty salons, wine shops, bars, video centers, use of cosmetics, listening to music or any such form of entertainment were banned by militant groups. There were bans imposed on the selling of cigarettes and on the circulation of Indian national- and Jammu based newspapers in the Kashmir Valley. Islamist groups threatened to bomb houses, where women refused to wear veils.

Such diktats bear a striking similarity to the ones imposed by the Taliban in Afghanistan and recently by ISIS in Iraq and Syria. Various Islamist groups like Jamaat-e-Islami and its militant wing, Hizbul Mujahideen, the radical women’s wing, Dukhtaran-i-Millat,Jamiat-ul-Mujahideen, Allah Tigers, Jamiat-ul-Ulemma Islam, Al Badr, Al Jihad Force, Al Umar Mujahideen, Muslim Mujahideen, Islamic Students League, Zia Tigers, and many such organization’s decreed the objective of their struggle as Islamization of the Socio-political and economic set-up,merger of Jammu and Kashmir with Pakistan and establishment of an Islamic Caliphate.

Religious radicalization has its growing influence in the State of Jammu and Kashmir. Majority of the Muslim youth in the Kashmir Valley is increasingly inclining towards extremist political, social and religious ideas repudiating and challenging the status quo. There has been a sudden heave in Pan-Islamism in Kashmir’s Muslim society gradually marginalizing an initial pro-nationalist agenda of insurgency. Rabidly fanatical clerics are indoctrinating the youth with Wahhabi ideology, whereby they reject the old Kashmiri tradition of people visiting and paying obeisance at the shrines of popular saints (Sufis and Rishis), terming it a violation of the teachings of Islam.

The youth are told that it is the duty of Muslims to capture power and impose Sharia Law,which disapproves democracy and legitimates Jihad as means for establishing an Islamic Caliphate. All these situations in The state of Jammu and Kashmir are posing more challenges to our Brave Army Jawans who are always putting efforts to end the roots of Pakistan-based Jihadi groups like Hizbul Mujahideen, Harkat ‌ul Ansar, Markaz Dawa-wal-Irshad and its militant wing Lashkar-e-Taiba who are extensively active in the Kashmir Valley as they found it easy to mislead the gullible people in Kashmir.

All these Kashmir-destructive policies are trapping the Young intellectuals to pick up guns and to fight against indian armed forces in the name of Jihad and devastating their future and assassinating the expectations of those parents which they dream of their Children’s.The outcome of every wrong is always a punishment and like that the future of every terrorist is encounter.The parents who raise-up a child for their old age comforts, when their child got killed in an encounter looses all hope. The brave Army jawans always trying hard as nails to Catch the terrorists alive to save the hope of their parents and reform them but because of the curse which they will face after “surrender ” Let them to kiss the death. There are some parents whom have only one child and that too got killed in an ecounter and then no one among the bosses of the so called Separatist groups never come to ask them about their situation. they live a life of sufferings after that & always pained by the killings of their child and even unable to feed Themselves.

These youth who are being brainwashed by the Pakistan sponsored groups are being sold for a single medical seat in Pakistan which are later being sold to royals of state on high rates.Nowadays, Islamic Militants are the new role models for the unemployed youth in kashmir who are being made to believe that Muslims across the world are fighting and dying for them as a service to Islam.The disappearances of Osama bin Laden and Mullah Omar have been turned into myths and replaced by stories that Allah helped them to disappear and these stories are used by Islamic clerics in Kashmir while preaching to the youth in mosques.

The education system has been destabilized, with the mushrooming growth of Madrassas outpacing the modern institutions of education. ‘Jihad’ is not only fought with arms and weapons in Kashmir now but ,also has a cyber dimension to it. Social media is being used in glorifying militancy and an ideological war is being fought in this new operational theater, using web based applications that allow creation and sharing of messages. ‘Electronic Jihad’ includes activities such as the provocation to engage in terrorist activities and carry out violent attacks, radicalization and recruitment of supporters and carrying out a psychosomatic war aimed at increasing the enemy’s vulnerability.

The Term jihad has been mis-interpreted and jihad is not just a war, rather it can be understood from a universal humane perspective and its philosophical moral principles can be used in greater human and social welfare. It is the responsibility of every responsible citizen of Jammu and Kashmir, Media, civil societies and most importantly the political leaders who have been acting as the corporal hosts of the State to educate the youth of the Valley and discourage them to hero-worship militants, who majority of the times, are angry victims of pseudo- religious eyewash and economic deprivation and save the future of kashmir from the destruction and devastation of Pakistan led policies.
