PM Modi’s security catastrophe

Narendra Modi; Honorable prime minister of India is a person of great interest. He is the leader of a nation with diverse, views  ideas and ideologies. Yes, many dislike him, many hate him but one cannot sidestep the fact that he is Indias Prime Minister. A person who has many enemies, he should be protected at all costs. People may not agree with him from time to time but the majority of Indians  have chosen him. I will lay down my life to protect his office if I have to. I will dilute my blood with our holy turmeric turn it orange to keep our flag that way. I will extract colour from green leaves to keep the colour green on our flag. Most Indians share my sentiment. Was there a security lapse in our prime ministers movement yesterday ? The answer is yes there was. As a daughter of a decorated police officer who is no more I know a few things. When my beloved father was DIG range Ferozepur I watched him on 15th August protecting with all his might Beant Singh assassinated chief minister of Punjab. Only to find him assassinated 15 days later in Chandigarh.

My point being let’s delve into my father’s brain for a second when he was DIG range Ferozepur under the DGP Mr. K.P.S Gill. My father would have personally sanitized all routes where the Prime Minister could have traveled on even if there were no plan of road travel. He would have communicated to all SSPs under Ferozepur range to have policemen standing on each perimeter that could be a possible route for PMS cavalcade. Already that should have happened yesterday. All senior officials from Punjab including the CM should have personally escorted the PM. The CM and DGP Punjab enjoy a heavy protection around themselves. This protection detail should have been pilot for our PM, along with SPG. Coming back to Beant Singh I heard my father who was up all night on 14th of August in Ferozepur make each and every step for Chief ministers arrival for the Independence day programme in Ferozepur.

There was Intel that there is a credible life threat to Beant Singh at that time. My father averted a crisis only to be taken off this position as DIG range Ferozepur when Beant Singh was assassinated and the new CM took charge who changed and transfered The DGP who transferred my father back to Chandigarh to an ordinary post. Why are our bureaucrats who have studied hard to become a civil servant at the mercy of the state CM who can come anytime and change their position. Transfer them on a whim.

This article is also a plea for the Centre to take back control of powers from CM. They cannot and should not change the police machinery aka its hardworking officers to suit their own political agenda or whoever fills their pockets in some cases. Yesterday a real catastrophe could have happened. Here we have a CM with no experience hiding under the garb of Corona  yet giving a press conference and saying it was a mistake. Well too little too late Sir. Steps that should have taken place:

1. DGP, IGP, SSPS ALL SHOULD HAVE BEEN PRESENT AT FEROZEPUR AND HALF AT BHATINDA.

2. CM OR DEPUTY CM OR CHIEF SECRATARY SHOULD BE PRESENT AT ARRIVAL OF PM

3. ALL THESE FORCES, STATE POLICE, INTELLIGENCE BUERAUE AND SPG SHOULD HAVE BEEN IN CONSTANT CONTACT AND THERE SHOULD HAVE BEEN A GO AHEAD BY DGP PUNJAB ALWAYS SINCE HIS FIRST DUTY WAS TO SANITISE ALL POSSIBLE ROAD ROUNDS EVEN IF HE HAD INFORMATION THAT PM WAS TRAVELLING BY HELICOPTER TO FEROZEPUR BY DEFAULT MODE.

4. AT THE FLIP OF A COIN AT YHE LAST MINUTE PMS ACTUAL METHOD OF TRANSPORT IS DECIDED. SO ALL IN ALL I WOULD NOT CALL IT A LAPSE BUT A FAILURE OF PUNJAB POLICE AND ITS CM.

Is night curfew successful in curbing the spread of Omnicron?

Covid-19 new variant Omicron has totally spoiled the New Year celebration. The world had not yet recovered from the danger of Covid-19, and then suddenly this new Virus Omicron arrived and made the situation lethal.

23 states in the country have reported active cases of Omicron. Out of these 23 states, Maharashtra has reported the maximum numbers of Omicron cases i.e. 460 in numbers and Delhi reported 351 active cases. These numbers will increase drastically as per the forecast by Juliet Pulliam, Director of the South African DSI-NSF Center for Excellence in Epidemiological Modelling and Analysis.

Pradeep Vyas, Additional Chief Secretary of Maharashtra cautioned individuals not to be quieted by the story that the third influx of Omicron is gentle and not deadly. He further quoted that those people who have not been vaccinated yet must take the third wave seriously as the covid-19 variant Omicron is equally deadly and fatal.

Due to the spike in the Covid-19 cases in the capital city of India, New Delhi. The Arvind Kejriwal government banned all the events, canceled all the political, social, cultural, sports events. New Delhi has experienced 120+ new covid-19 cases in the last 24 hours but no death of any individual has been registered yet. Formerly, Lok Nayak Jai Prakash Hospital was taken into the consideration for the Omicron treatment, but the latest update is that the New Delhi government has added 4 new hospitals to counter Omicron are Max Saket, Fortis Vasant Kunj, Sir Ganga Ram City Hospital, and Batra Hospital Tughlakabad.

On 04 Jan, the Delhi government announced there will be a weekend curfew and private offices will run with 50% capacity. Furthermore, government officials will work from home.

Out of the 23 states that reported Omicron, Uttar Pradesh became the 12th state to report the Omicron case. Initially, there were 8 cases of Omicron reported by the officials and in the last 24 hours, 3 got recovered with zero death till now. On Omicron, CM Yogi said that the new Virus Omicron is weak as compared to Covid-19; it is just like a “Viral fever”, he further added that “Do not get Panic” but take proper precautions.

Yogi Sarkar imposed a night curfew from 11 pm to 5 am and only 200 people are allowed to attend the marriage function. And they need to take permission from their respective administrations before proceeding. “No mask, No goods” campaign has been started and shopkeepers were told to follow this on priority. The state government has started a vaccination program for the age group of 15-18 and to make the program successful 39 centers and 2100 booths have been installed.

Bihar became the new state to impose a night curfew from 10 pm to 5 am till 21 January.

To minimize the risk of new Virus omicron many other states have imposed strict night curfews. There is a big list of States who have imposed night curfews to tackle the new variant of Covid-19 Omicron. States accompanied with their night curfew timings are New Delhi (11 pm to 5 am), Haryana (11 pm to 5 am), Gujarat (11 pm to 5 am), Maharashtra (9 pm to 6 am), Madhya Pradesh (11 pm to 5 am), Uttar Pradesh (11 pm to 5 am), Karnataka (10 Pm to 5 am), Uttrakhand (11 Pm to 5 am), Bihar (10 Pm to 5 am).

Health Experts Views on Imposing Night Curfews

Soumya Swaminathan, Chief Scientist WHO, said that there is no science behind night curfew to stop the new Covid-19 variant Omicron.

Fortis hospital Department head, Dr. Vikas Maurya favored the statement and quoted “night curfew cannot break the transmission chain; it might slow down the transmission”.

BBMP Municipal Commissioner Gaurav Gupta on raising active cases of Covid-19 variant Omicron in Bangalore said that people must get alert and informed promptly if any case is found.

Experts have shared their views on night curfew, restrictions on the movement at night in Bangalore. He further quoted “now it’s up to the government to take the final decision”.

Regionalism: The division among us

0

Is regionalism a threat to Nationalism?

India; a union of 28 states and 8 union territories, has diversity in its geography, languages, history, religions, cultures, races, etc. We have read and heard that India has so many languages and dialects, so many religions and so many different cultures. And the thing about all these things is that we are proud of our diversity and we claim: Unity in Diversity. These diversities make us feel proud of our culturally rich country. We have different foods, different dance styles, different dresses, a different way of living and all of these seem pretty cool if we want to explore them. We don’t call these diversities something that diverges us, but we see them as something that converges us into one name; Indian. Being an Indian and having so many different things in our country feels proud. And what do we do when we feel proud? We promote them, right? Suppose you belong from the Northern part of India and you are visiting Southern India… Now you are seeing different food, culture, language, etc. You feel proud of Charminar, Jog fall, Rameshwaram, lake Vembanad, Mysore palace, Golconda fort, Meenakshi temple, etc and you post them on your social media account #Fun#ProudOfSouthIndia#TravelVlog.

Congratulations, you acted like a good citizen who promoted India’s rich culture to other people. You liked the diversity and you promoted it. Now someone on your post commented like this: “Why going there?? We have so many places here in North India… Why visit the dosa walas, who can’t even speak Hindi?”. Well now, someone from south India will reply to this guy as: “You @$%# don’t come to South India then… tell your Biharis not to seek jobs here!”. Now someone from Bihar will reply to this guy: “You piece of %$#@ agar hum nahi honge to tumhare roads bhi nahi hongi”. The fight will go on. They will start abusing each other and the region from which they belong. The cause of the fight is regionalism.

Region means a particular geographical area. Regionalism means loyalty, affection towards a certain region. When people start identifying themselves as a part of the region, regionalism develops in them. Regionalism provides a sense of belonging to the people living in the region. Their belonging makes them feel proud and this further creates more affection, more loyalty towards the region. And when people feel more connected to the region, they will start working for the region. This will help in the growth and development of the region as people feel they are responsible for their region. They help in promoting the arts and the culture of the place, letting people from the other region know about their region. This further helps to understand the different cultures and regions. They not only promote their region, but they also start defending the region, its culture. But over time, a sense of ‘my region is superior’ to yours takes a downturn in the context of regionalism. Now people just don’t defend or protect their region, they start attacking the other regions.

The example above is a simple case of regionalism traversing a downturn. People living in the same country but different regions start identifying more with the region than the country as a whole. This affects the unity of the country as people start thinking about their people and their region. But why does this happen?

When India got independence, there were more than 500 princely states and provinces. The political leaders wanted to organize the country into different states for effective administration. But on which basis a geographical land be demarcated? In many parts of the country, people demanded ‘language’ as the basis for the state’s formation, which means; Tamil speaking region will be separated from the Telugu speaking region and many more. The first committee that was assigned to find the basis on which the states would be reorganized was the Dhar commission. Earlier in 1920, Indian National Congress(INC) supported language as the basis for the reorganization of the states. But after independence, the leader realized that it would not be suitable for the administration purpose and might pose a risk to national unity. Dhar Commission headed by SK Dhar(retired judge of Allahabad HC) reported in the last month of 1948 that linguistic consideration for the reorganization of states would not serve the interest of India. Another committee was formed: the JVP commission.

Members of this commission were Jawaharlal Nehru, Sardar Patel and Pattabhi Sitaramayya to study the recommendations of the Dhar commission. Even they found that linguistic separation among the states would yield division rather than unity. By this time, agitations started in the various parts of the nation. Many leaders advocated Linguistic separation while some were against it. There was no clear image of the decision. Potti Sreeramalu was advocating a different state for Telugu-speaking people from Madras State. He went on to put pressure on the government by fasting. However, on December 16 of 1952, Sreeramalu died. Many people joined his procession and soon the fire engulfed the region. The crowd shouted slogans, destroyed public properties and seven were killed in this storm that ravaged the region. On 19the Dec, PM Nehru announced creating a separating state of Telugu speaking people. K.N. Wanchoo; retired judge of the Rajasthan HC was appointed to look into issues related to the formation of the Telugu state. And on 1st October 1953, Andhra Pradesh was formed; the first linguistic state. This development paved the way for using language as the key factor for reorganizing states. A new commission under Fazal Ali was formed who was the retired CJI of the Supreme Court along with HN Kunzu and KM Panikker. They submitted the report in 1955 and accepted language as the basis for the reorganisation of the states. And soon many linguistically formed states came onto the map of India.

The basic problem with a linguistically formed state is that it creates inequality among the people who belong to the language and who don’t. This inequality is used by the political leaders for gain in the election. They create an image of those who don’t belong to the language as an outsider; someone who has come to take their job, their houses, their spaces, their opportunities, etc. Polarization is a form of politics and political leaders use this form to polarize the people belonging to the region by instigating them, making them hate people belonging to other regions/languages. Pressure starts building between different linguistic groups which finally culminates into violence, damage of public properties. This further affects the economy of the region as businesses will be forced not to recruit people from other regions. The disaffection grows bitter as time passes. We have seen this case in Assam, Maharashtra, Punjab, Southern India, etc.

The Indian Constitution gives every citizen fundamental rights and also protects these fundamental rights. One of the rights is given by Article 19, which gives the right to move anywhere in the country and the right to settle in any part of the country, right to the profession. But with the politics around the region which creates division, hampers these fundamental rights offered by the constitution. This damages national integrity as people starts associating more with a region. People are identified with states and stereotypical remarks are casually used which further increases the gap.

A healthy competition between states is good for the growth of our nation. However, discrimination based on region creates unwanted division in the country. At the time of our Independence, India was already divided by religions, caste, class, etc. Now regionalism adds up more division to this. Rather than working as units for the whole, regionalism promotes working only for the region. And if regionalism increases, it not only takes the growth of the country down, it disturbs the basic nature of our federalism; cooperation. If citizens of a particular region do not cooperate with other parts of the country, distrust is developed between them. Remember not every region is self-sufficient. It requires many things; goods and services from many other parts of the country and for that there must be cooperation, understanding and affection between people of the regions.

As a citizen, it’s a duty to promote oneness to strengthen national integration. We don’t want to get entangled in fighting with each other and make a favourable environment for an enemy that wants to harm India. We can never be strong if we are divided by regions. Our progress lies in the progress of the entire country and not just to some specific parts of the country. When we go out, we represent India and not some regions. We are seen as Indians, we must, therefore, act like Indians. Imagine if our soldiers were divided into the regionalism lines, they would guard just their region and not the other parts. But fortunately, there is no regionalism in defence forces, there is nothing above the nation to them. Therefore, we must be like them. We must engage in working for national integration, promoting all the cultures of our country and dropping off the divisive lines of regionalism. Nothing will be impossible for a nation where 1.3 billion people will be working for its glory!

It is as simple as that kindergarten story where a single stick is easily broken, but it’s hard to break the bunch of sticks. We are stronger together, we are weaker when divided. And like the Chak De India movie, we all must drop off our regional identity and integrate ourselves in identifying ourselves as I-N-D-I-A-N and end this division among us.

Four years journey of GST: Meaning, problems and suggestions from trader’s perspective

0

Brief Overview of GST

The Goods and Services Tax (GST) is a tax on goods and services. It is an indirect tax that has mostly superseded many other indirect taxes in India, such as excise duty, VAT, services tax, Entertainment tax, Luxury tax etc. The Goods and Service Tax Act was passed by Parliament on March 29, 2017, and on July 1, 2017, it came into force.

In India, GST (Goods and Services Tax) is a single domestic indirect tax law that applies to the entire country. It is a consumption tax on goods and services that is destination-based. It is levied at all stages, from manufacture through ultimate consumption, with a set-off allowed for taxes paid at prior stages. In a nutshell, only value addition is taxed under the GST framework, and ultimately, the end consumer has to bear the tax burden. The concept of a destination-based tax on consumption means that the tax would be collected by the taxation authority that has jurisdiction over the place of consumption, also known as the place of supply.

The term GST is defined in Article 366 (12A) to mean
“any tax on supply of goods or services or both except taxes on supply of the alcoholic liquor
for human consumption”.

So, alcohol for human use is exempt from GST under the constitution’s definition of GST. However, presently apart from alcohol petroleum crude, motor spirit (petrol), high-speed diesel, natural gas, and aviation turbine fuel have been temporarily excluded from GST, and the GST Council will determine when they will be included. Furthermore, electricity is exempt from the GST. Though the central Govt favours to include petroleum and electricity under GST thereby reducing the heavy tax burden on consumers yet the final decision to be taken by the GST council where the state government is also its member and a significant number of states are ruled by the party who is not in power at Centre.

Framework of GST system: Legal, Policy and Administrative

Legal Framework

The legal framework of the GST is governed by four central statutes – the Central Goods and Services Tax (CGST) Act, the Integrated Goods and Services Tax (IGST) Act, the Union Territories Goods and Services Tax (UTGST) Act, and the Goods and Services (Compensation to States) Act), as well as independent state statutes (the relevant State Goods and Services Tax (SGST) Act of each State. Despite the fact that there are multiple SGST legislations, the basic features of the law, such as chargeability, definitions of taxable event and taxable person, classification and valuation of goods and services, collection and levy procedures, and so on, are uniform in all SGST legislations to the extent possible. This is important and required to keep the essence of the dual character of GST. This is because of the country’s federal structure, India has implemented a dual GST approach. As a result, the Centre and States impose GST on taxable supplies of goods or services (or both) made inside a State or Union Territory at the same time.

Policy Framework

The policy of taxation in the GST system is based on a mechanism that assigns different rates to different types of sales which are – 0 per cent, 5 per cent, 12 per cent, 18 per cent, 28 per cent and additionally 0.25 per cent for precious stones and 3 per cent for gold. Harmonized System of Nomenclature (HSN) codes are assigned to every item and rates created for each HSN code is decided by the GST council. HSN code is introduced to classify goods uniformly & systematically. Precious stones, for example, are included by HSN code chapter 71 of the GST commodity tariff schedule. There is a different set of rules and applicability conditions for HSN codes for different traders on basis of annual turnover.

Note: These tariffs are reviewed and updated on a regular basis.

Administrative Framework

The basic administrative framework of the GST system is that the GST is administered in tandem by the Central and State GST administrators, with shared auditing and administration functions. To assist in the management of taxation and taxpayers, the GST Network (GSTN) has been established as a unified national IT backbone through which all tax returns must be processed. The Goods and Services Tax Network (GSTN) has developed an Indirect Taxation portal for GST to assist Indian taxpayers in preparing, filing, and paying indirect tax liabilities, as well as other compliances. It provides IT infrastructure and services for the Goods and Services Tax (GST) implementation make the reader understand that GST applies if in India to the Central and State Governments, taxpayers, and other stakeholders. It provides efficient Backend Services to the Tax Departments of the Central and State Governments on request. Nevertheless, the GSTN network assists Tax authorities in improving Tax compliance and transparency of the Tax Administration system.

Understanding the applicability of GST under different circumstances with some examples

Let us consider some below examples:

  • An individual purchases a scooter for personal use and then sells it to a  dealer after a year. This is not a GST sale because there is no advancement of business.
  • A refrigerator dealer transfers one refrigerator from his inventory to his home for personal use. This is treated as a supply, and GST is applied.
  • The provision of goods or services by a society club trust or other entity to its members will be viewed as a business transaction. GST is applied because it is a supply.
  • Supply of goods on hire purchase shall be treated as supply of goods as there is the transfer of title,
  • albeit at a future date.
  • The transfer of the right to use goods is viewed as a supply of service because there is no transfer of title in such supplies. Such transactions are particularly treated as a supply of service.
  • Contracts for work and catering services shall be recognised as the supply of service.

All the above situational examples are meant to make the reader understand that GST applies only if there is a commercial transaction and that transaction between the parties who are liable to pay taxes under the Act. Every Supply can’t qualify for GST even one is liable to pay tax. Only supplies made in the course or is in furtherance of a business qualify as GST supplies and attract the tax under it.

Meaning of Furtherance of Business under GST

Many a time there is confusion where a supply is within the ambit of GST or not. A simple analysis technique is to answer the below questions and if it is yes, then that supply must attract the GST.

  1. Is the activity, a serious undertaking earnestly pursued?
  2. Is the activity is pursued with reasonable or recognizable continuity?
  3. Is the activity predominantly concerned with the making of taxable supply for consideration /profit motive?

The test may ensure that occasional supplies, even if made for consideration, will not be subjected to GST.

Problems and Challenges Faced by Traders:

  1. Lack of skills: Even though Government assurance to proper guidance and training related to the provisions and process related to GST and Tax filing, traders lacks the basic skills. Lack of training and complexities of the process has made them depend on third parties.
  2. Heavy rush of uploading files: However, the Covid pandemic has put a break in economic activities, yet the volume of trades is not less rather being a highly growing economy, trade volume is exponentially high. It makes to upload a large number of invoices by traders on the portal thus server hanging is a common problem and causes a lot of mental frustration amongst traders.
  3. Modifications/Amendments issues: No amendments or modification is allowed once uploaded to the server in GSTR 1 or GSTR 3 B. Once uploaded but by error invoices under SGST or CGST, if uploaded to IGST, one can’t modify or amend.
  4. Additional Cost: In order to comply with the GST system survey indicated Traders have to spend more money on maintaining software, accountant and other equipment which increased their expenditure without any return.
  5. Higher number of non-filers of returns: Many traders are unable to file returns on time and thus have to pay penalties. Non-filers of GST returns is very common. Traders are unable to file returns on time due to many complexities associated with the return filing process
  6. Credit Reversal: A significant number of traders have to do credit reversal under the non-compliance of payment done to suppliers for which credit was taken within 180 days’ time limit. It is another very serious issue traders are facing.
  7. Time Spent: Traders have to spend more time of their working hours fulfilling the compliances of GST than with the earlier registered tax regime.
  8. Cost of compliance: It has also been found in many surveys that including done by me that there is a significant rise in cost in order to fulfil the compliances related to GST.

Apart from the above problems, there are some other challenges as observed when talking with traders especially small and medium and professionals in the field of GST :

  • In the case of Pending GSTR-3B at least for the last two months, the traders are not able to file GSTR-1 as told by some of the traders. Exerts have told that such issues come in order to comply with CGST Rule 59(6)
  • The most common observation one can make is the poorly maintained server leading to hanging and exponentially increasing waiting time for submission.
  • The government frequently changes the rules and regulations for complying with GST provisions. It has a negative influence on the psyche of honest taxpayer traders who are not generally comfortable with technology. The latest in the series of changing rules was related to TRANS-1in September 2021, which has directed to make available all the previous records again.
  • The traders do not get an input tax credit (ITC) if the supplier by mistake while filling in GSTR-2A declares supplies as B2C instead of B2B.
  • It is also observed during talks with traders and professionals in the fields that many times wrong messages/notices are been sent by government officials/departments which unnecessarily leads to harassment of technically paralysed traders.
  • Another striking observation was that NO GST APPELLATE TRIBUNALS has been formed to date anywhere in India which cause problems to small traders as even for small disputes, aggrieved Traders need to approach High courts which is expensive and hence unnecessary harassment.
  • The next observation that one can view is denial to accept negative figures in GSTR-3B that occurs when sales returns exceed the sale during a particular month. During such a situation, adjustment is been made only to the value of the sale and the rest value is carried over till it if finally adjusted and it let to extra cost and precaution in maintaining the document till adjustment.

Steps to minimize the challenges and problems:

  1. Building the Perception: Biggest challenge at present is to build the perception towards GST because in the last four years since its implementation the most generally the GST is regarded as very expensive. The perception can be changed if some reward or tax relaxation be provided for those who honestly and timely file e- returns.
  2. Common E-return File Centre: Government should set up a common e return file centre run on the PPP model which provides free expertise (a nominal fee) to smaller traders having an annual turnover of fewer than 2 crores. It will certainly help in reducing additional costs on traders to comply with the GST provisions
  3. Intensive Server Management: Due to the high volume of trades both in goods and services and exponentially increase in the volume of trades in future, the biggest challenge is the smooth, fast and effective cloud and server for 24×7 hours. It requires a very sound cloud and server management.
  4. Option for Modification and amendment It is quite unfair to believe that traders will not do any mistakes during uploading invoices in either GSTR-1B or GSTR-3B. Humanely mistakes and clerkly errors are possible so, there must be an option for modification/up-gradation/amendments on the portal at least for one time. It will also help in minimising unnecessary litigation and harassment to traders and honest taxpayers.
  5. Increase the minimum duration to Supplier’s Payment: Presently if the supplier’s payment is not done within 180 days of purchase, credit received as ITC need to be revered. It is disturbing the business environment as most of the traders fail to comply with this. It is suggested to increase minimum days to 360 days i.e one year.
  6. Constituting of Appellate Tribunal: At present for even small disputes, traders have to approach the High court which is a costly affair. It is quite beneficial to constitute specialised tribunals related to GST as it is helpful for small traders and for the government as most of the litigation will be resolved here thus reducing the unnecessary loads on higher courts which have other more important works to do.
  7. Clear guidelines on accountability of Government officials: It is suggested that officers/departments should be accountable for any message/notices sent to traders. In practice many a time, such messages/notices sent to traders are unworthy and add harassment. Any such action by officials/departments should be taken seriously and fines should be imposed if found guilty.
  8. Facility for acceptance of negative figures of Sale in GSTR-3B: During pandemic times it was a common phenomenon where sales return was more than a sale, which leads to the negative value of the sale. But, no facility is there for same. So, it is recommended to provide the facility to accept negative figures in GSTR-3B at the earliest.
  9. Mobile Training Centres: A real challenge infield is the absence of requisite skills among traders necessary for implementing GST provisions. Traders still look at the new regime like a foreign entity and have not been fully equipped with it. So, it is necessary to have some mobile training centres to educate and facilitate the traders.
  10. Simplification of the Process: Many procedures in GST provisions are quite calculative and cumbersome, causing trouble even to professionals. One cannot expect our traders to be data scientists, or engineers or mathematicians. So, it is recommended to take steps to minimise complexities by removing thrones and thrushes of mathematical computation and technology.

Way Forward

By combining a large number of central and state indirect taxes to implement GST was a defining moment in India’s financial framework. It has smoothened the path for a unified common national market. The GST has successfully mitigated the cascading effect i.e tax on tax which was a common feature of the previous tax regime thus minimizing the tax burden on the final consumers. So, from a consumer perspective, the reduction in tax burden is the main benefit of the GST. Further, due to the entire neutralisation of input taxes across the value chain of manufacturing, the GST is making Indian products more competitive in both domestic and foreign markets.

Moreover, the introduction of e-way bills, combined with a crackdown on bogus invoicing, has aided in the collection of a significant amount of GST income that had previously been evaded or under-reported. Various initiatives, such as linking the customs portal with the GST portal for credit availability on imports, providing proper means for matching input tax credit, increasing automation of the refund procedure, and ensuring the smooth operation of the Invoice Registry Portal, have all aided in the reduction of tax compliance.

Despite the fact that India under the Modi government has set an example for the rest of the world by successfully completing one of the country’s most difficult tax reform projects yet there are many grey areas that are in urgent need to be resolved. As the challenges discussed above, the 15th Finance Commission has also raised concerns about the GST regime, including the multiplicity of tax rates, shortfalls in GST collections compared to forecasts, high volatility in GST collections, inconsistency in filing returns, and states reliance on compensation from the Centre, among other things. IT difficulties have harmed the core principles on which the GST statute was based, namely the seamless flow of input credits and simplicity of compliance. Small and medium-sized firms are still adjusting to the tech-enabled environment.

The law is still a work in progress, and the process of evolution cannot be removed in such a complex trip. In the future, the government should continue to take steps to fulfil its promise of a “Good & Simple Tax.”

The hidden side of M K Gandhi

M K Gandhi went to South Africa in 1893 to practice Law there and returned back to India in January 1915 after 21 years. In South Africa, Gandhi first introduced his ‘non-violent passive resistance’ against the British to extract concessions for Indians living in South Africa. Gandhi was totally unconcerned about the plight of local Africans in the hands of the British. He considered Indians of South Africa as better positioned vis-à-vis local Africans, possibly for being brown in skin color. Gandhi’s racial stratification was later observed in India when he did not oppose the Hindu caste system. He gave the Indian untouchables a grand name of Harijan and lived with them many times, but, unlike Savarkar, did not fight against Hindu caste system.

In 1909 Gandhi went to England from South Africa to push for the rights of Indians living there. While in England, Gandhi talked to many Indians there about India’s freedom movement and shared his opinion about those Indians, as well as, his own perspective with Lord Ampthill in a letter. Gandhi wrote that letter on 30 October 1909 to Lord Ampthill. Lord Ampthill was a British Civil Servant and Governor of Madras from 1900 to 1906. On returning to England in 1906, Lord Ampthill took up the cause of Indians in South Africa. He chaired an Advisory Committee on Indian students in the United Kingdom but disagreed with the Secretary of State for India on the issue of Constitutional Reforms. On 13 July 1909, Lord Ampthill was appointed as Deputy Lieutenant of Bedfordshire.

Lord Ampthill wrote an introduction to Joseph Doke’s book M. K. Gandhi: an Indian Patriot in South Africa in 1909. So, Gandhi knew Lord Ampthill very well and considered the latter as a well wisher of India. This letter of Gandhi to Lord Ampthill is an eye-opener. The contents of the letter exposed what Gandhi thought about the then Indian leaders and their method of freedom struggle. His mentality towards British, modern Western civilization and his future course of action, when he would return back to India after six years, were also visible in the letter. The future split of the Indian National Congress in 1923 into ‘pro-changer’ and ‘no-changer’ groups was hidden in that letter too.

The first decade of the twentieth century was important from the point of view of India’s freedom struggle. Violence against the British officers and rule had started crystallizing in India. Many prominent nationalist leaders were directly and indirectly in favor of armed and violent struggle for freedom of India. There was another group who opposed any violence. Taking advantage of the division in the nationalist leaders, the government prosecuted Bal Gangadhar Tilak on a charge of sedition and inciting terrorism and deported him in 1908 to, Burma (Myanmar), to serve a six-year prison sentence. Revolutionary Sri Aurobindo Ghosh was arrested for Alipore bomb case in 1908. After one year he came out of the jail and gradually shifted to spiritual life. Barin Ghosh, another convict of the same case, was sent to Cellular Jail. Savarkar was arrested and put under trial in 1910. Gandhi’s letter to Lord Ampthill should be understood in the above mentioned context.

Gandhi in his said letter wrote, inter alia, “I have for some time past been wishing to place before Your Lord-ship the result of my observations made here during my brief stay on the nationalist movement among my countrymen……….. I have made it a point to see Indians here of every shade of opinion. Opposed as I am to violence in any shape or form, I have endeavored specially to come into contact with the so-called extremists who may be better described as the party of violence…….

I have noticed impatience of British rule. In some cases the hatred of the whole race is virulent. In almost all cases distrust of British statesmen is writ large on their minds. ……… I have practically met no one who believes that India can ever become free without resort to violence……. It may then be just possible that the British rulers in India may at least do as the Indians do and not impose upon them the modern civilization. Railways, machinery and corresponding increase of indulgent habits are the true badges of slavery of the Indian people as they are of Europeans……. To me the rise of the cities like Calcutta and Bombay is a matter for sorrow rather than congratulation…….

Violent methods must mean acceptance of modern civilization and therefore of the same ruinous competition we notice here and consequent destruction of true morality……. Passive resistance is soul-force exerted against physical force. In other words love conquering hatred……. The information I have given Your Lordship is quite confidential and not to be made use of prejudicially to my countrymen……..” [Source:  “The Collected Works of Mahatma Gandhi”, page 200-202; https://www.gandhiashramsevagram.org/gandhi-literature/mahatma-gandhi-collected-works-volume-10.pdf]. Today Indians should compare the so-called ‘Mercy Petition’ of Savarkar vis-à-vis the above mentioned letter of Gandhi.

Thus six years before his return to India from South Africa, Gandhi was not only taking interest in the Indian freedom struggle, but also weighing the strength and weakness of the then nationalist leaders from his own view point. He was sharing his observations about those leaders with British officials to position himself before British administration as a future benign and non-violent freedom fighter of India. Gandhi succeeded in his scheme.

When he landed in Bombay (Mumbai) on 15 January 1915 from South Africa, he was given grand welcome and international press coverage, which was not possible without covert British sponsorship. A new leader of the Indian freedom movement was born on that day. Critics of Gandhi, till date, claim that Gandhi was implanted by the British to replace violent freedom movement by non-violent passive resistance. The critics also say that without Gandhi India could have achieved freedom after World War-I.

World War-I spanned between 28 July 1914 and 11 November 1918. On his return to India at the initial phase of World War-I, Gandhi, the worshiper of non-violence, supported the British in the war. Gandhi agreed to actively recruit Indians as the war combatants. Gandhi launched the Champaran Satyagraha in 1917 in defense of farmers forced to grow indigo, and the Kheda Satyagraha, against iniquitous taxes in Gujarat, followed, but both were protests against specific iniquities and not yet a mass movement against the Empire as a whole.

Turkey lost in WW-I and was dismembered by the British and its allied group of countries. When defeated Turkish people were engaged a Civil War against British supported continuation of Khilafat, Muslim community of India launched a mass movement in 1919 to keep that Islamic Khilafat, two thousand kilometers away from India, alive. That was a weird development in Indian politics.

Khilafat Movement in India was led by the famous Ali Brothers. Gandhi took the opportunity and dragged the Indian National Congress, and Indian Hindus to support and participate in the Khilafat Movement. Gandhi was elected President of the First All-India Khilafat Conference in 1919. Gandhi thought to achieve Hindu-Muslim unity in the process. But his short sighted move resulted in large scale killing of Hindus, rapes of their women, forceful conversion of many in the notorious Moplah riots in Malabar area of Kerala during 1921-1922. Instead of condemning the communal riots committed by the Moplah Muslims, Gandhi justified the atrocities on Hindus.

Orthodox Muslim leaders of India did not like Ali Brothers giving importance to Hindu Gandhi for the Islamic cause of Khilafat Movement so much so that elder of Ali brothers had to make a public statement in Lucknow “Yes, according to my religion and creed, I do hold an adulterous and a fallen Mussalman to be better than Mr. Gandhi”. Khilafat Movement died when the new ruler of Turkey, Kemal Attaturk in 1924 abolished the Khilafat and exiled the Khalifa, Muhammad VI.

Khilafat Movement had nothing to do with India’s freedom struggle. But the majority of Indian Hindus were fed on a propaganda that the movement was against British rule In India. The word Khilaf also meant ‘opposition’. Hence Hindus were made to think that the Khilafat Movement was for opposing British rule in India. In WW-I, over one million Indian troops served overseas for the British, of which about 75,000 died and another 67,000 were injured. That was the first major contribution of M K Gandhi, the worshiper of non-violence and truth, in the independent struggle of India.

Gandhi’s misadventure with Khilafat Movement had a devastating effect on Indian politics. It brought Islam in a big way inside the Indian politics. Khilafat Movement united all Muslims of British India in one group for the first time for the cause of Islamic Ummah. Muslims were officially made to feel as a different entity in India. By supporting and participating in the movement, Gandhi and the Congress Party accepted the religious identity of Muslims above their national identity. The extra-national allegiance of Indian Muslims and support for Sharia were also accepted by Gandhi and Congress Party in principle. The concept of ‘two nation theory’ became a construct and Muslims of British India gradually started their assertion for a Muslim country which culminated into division of India and creation of Islamic Pakistan in 1947.

Between 1915 and his death, Gandhi very cunningly deceived the poor Indians to position him as their leader. Congress leader Sarojini Naidu once said that it was very costly to maintain the poverty of Gandhi. M K Gandhi traveled in the third class compartment of the railway. But a full coach was to be reserved for him, which could have otherwise accommodated 70 to 80 poor passengers. Gandhi drank goat’s milk, but the monthly cost of goat maintenance was equal to the monthly salary of a couple of Primary School teachers. More than 70 per cent of Indians were poor then and more than 80 per cent were illiterate. The large poor and illiterate Indian mass, Hindus in particular, could see their reflection in Gandhi’s lifestyle. They identified themselves with him and followed him blindly.

Gandhi showed his aversion towards modern medicine selectively in the case of his wife. In 1944, when Gandhi’s wife suffered from pneumonia, British doctors told Gandhi that Penicillin injection could cure her; however, Gandhi refused to have modern medicine injected into her body, and she died. But 20 years earlier, Gandhi himself underwent emergency appendectomy, a modern surgery, to remove his inflamed appendix.

Gandhi’s gross hypocrisies were guarded by British and Western media, as well as, Indian National Congress. It was not for nothing that Jinnah called M K Gandhi “wily Gandhi”. Gandhi was the wrong man in right time and right place.

Atrangi Bhaiya Ji of Uttar Pradesh

0

[Disclaimer: This is a satire on the current state of electoral politics/campaigns in UP and not a movie review. Spoiler Alert!]

I recently watched a Hindi movie Atrangi Re. Twenty five minutes into the movie, I realized that there are uncanny similarities between Rinku Suryavanshi, a character played by Sara Ali Khan, in the movie and Bhaiya Ji in his real life. Bhaiya Ji in his real life has been behaving exactly the same way Rinku was behaving in the movie. The more I paid attention to the movie, the more I would find instances where Bhaiya Ji said or did something similar to what Rinku was doing.

Rinku was too young when the biggest tragedy of her life hit her, she saw her parents burn to ashes right in front of her eyes. She kept clapping thinking it was Sajjad(a character played by Akshay Kumar) doing a magic trick as usual. Once she realized what actually happened, it was too late, she couldn’t do anything to stop it from happening. But later to cope with that trauma, she never let Sajjad die in her mind. He lived in her memories. Bhaiya ji had a very similar experience. He was in power when the biggest tragedy of his life hit him, he literally saw all his capital turn into pieces of useless paper when PM Modi announced Demonetization. He kept saying that black money is good for economy, it helps in the time of recession or Modi government should allow at least a week’s time before the rule is applied instead of just four hours. What else could he have said at that moment? He would never say, “let me take care of my cash, I need some time, without cash contesting UP elections in 2017 would be a waste of time.” Would he? Or for that matter would anyone else say he has crores of cash stacked up in his house? He couldn’t do anything to stop DeMo from happening but to cope with this trauma, he never let go power away from him in his mind.

PM Modi inaugurates Kashi Vishwanath Temple Corridor, Bhaiya Ji says it was Samajwadi who did the work and should inaugurate. PM Modi inaugurates Purvanchal Express or Bundelkhand Express, Bhaiya Ji says it was Samajwadi who worked on these and should get the credit. PM Modi inaugurates Kanpur Metro, Bhaiya Ji says the same thing. Ram Temple, Bhaiya ji, the same thing. Bhaiya ji still believes that Samajwadi is still in power in UP, his Sajjad still lives and is as real as Rinku’s.

In the movie Sajjad magically appears whenever Rinku wants and disappears as easily whenever she wants. Bhaiya ji’s case is also the same. When it is time to inaugurate something, Bhaiya ji’s Samajwadi magically appears but when two thousand meters of Agra-Lucknow Expressway (built between 2015 and 2017) collapses because of the corrupt practices, Bhaiya ji’s Smajawadi disappears, then it is BJPs doing. When government institutions raid black money hoarders, Bhaiya Ji’s Samajwadi magically appears as a political victim, but when the authorities actually find crores and crores of cash, gold and property papers, Samajwadi very conveniently disappears, then P. Jain is BJP. When there is a crisis in the state like Covid, Bhaiya ji’s Samajwadi is no where to be found, but when there is an election, does not matter if it is a local body election or a state election, Bhaiya ji’s Samajwadi magically appears and claim they were the ones who were helping people all that time. There are countless number of such instances in Bhaiya ji’s life, if you just pay attention, you could find them yourself.

Also read: Mahagathbandhan: A Cry for help!!!

The one difference between Rinku’s life events after her trauma and Bhaiya ji’s life event after his trauma is that Rinku was fortunate to meet some people who actually helped her overcome her trauma. S. Venkatesh Vishwanath Iyer aka Vishu (a character played by Dhanush) and his friend Madhusudhan aka MS (a character played by Ashish Verma) actually tried to fix Rinku’s mental state with all the compassion and medication. However, unfortunately, Bhaiya Ji is still looked at as a laughing stock. No body is willing to understand what he has gone through. Instead of helping him, people are making memes. They say he inaugurated Taj Mahal or he is Toti De Gama who found India; ‘Toti‘ or water tap because he stripped taps, tiles and other things from the walls when he was asked to evict his government bungalow. No body is willing to give him a benefit of doubt that he is not some small time thug who would steal just water taps or wall tiles.

Is this the way to treat somebody who is suffering? Where is your compassion people?

This kind of response is actually making his condition from bad to worse. He has been making weird statements all along. “Google maps can help see how the car was overturned”, “BJP removed one of the two pilot seats from the Rafale Jet”, “PM Modi promoted pakoda because he wanted to promote Dalda/refined oil owned by his friends”, “its a BJP vaccine” as if BJP is a research institute or a pharmaceutical company, or “Piyush Jain was raided by mistake” raided by mistake? A dozen other places were raided along with Piyush Jain; all by mistake? I mean this is the very limit. The man is saying anything. Of course, after all these meaningful, sensible, educated, knowledgeable, well researched, statements the EVM will be hacked in 2022. That would also make logical sense.

More, importantly, remember, time and tide wait for none and nothing is permanent. As Asaduddin Owaisi very aptly articulated, Yogi and Modi are not going to live for ever, what will you do then? He is actually right, they are not immortal or eternal beings that will live for centuries. Would you like memes be made on your condition then? Just imagine.. my bad, no need to imagine, just remember the times before 2017.

Do I need to write everything here? Don’t you guys read AmarUjala or Dainik Jagran? Just remember how government and the authorities used to make real time memes on your life.

Thank you for reading the article, I hope you liked it, let me know what you think via comments. Please do follow my blog and share it with your friends and family.

By the way, I found the movie Atrangi Re quite interesting. I found it both hilarious and emotional. The comic punches would actually make you laugh. Have a look at the trailer here:

2022: Can Biden save America from recession?

As the year 2021 draws to a close, it would be worthwhile to take stock of the highlights of the by gone year. It is not an attempt to list every major event, but focus will be limited to the US economy. It is obvious that the economy was ravaged by the pandemic for most of the year although there were signs of abatement in the later part. In a series of positive developments, the country witnessed businesses slowly starting to reopen, people finding jobs and life slowly returning to a semblance of pre-pandemic normalcy.

However, much of this has been short-lived, given new challenges and threats that could eventually bring hardships to millions, particularly the low-income segments of society. Among the many challenges three stand out. Inflation, defying all expectation of being short lived, has continued its upward spiral. Secondly the supply chain crisis is nowhere near resolution. Thirdly, the resurgence of COVID and its new variant, Omicron continue to the sap the morale of Americans at large, who desperately need a break. In essence, 2021, although infinitely better than 2020, had not ushered in the revival and cheer most expected.

The issues first.

Prices have remained high for an abnormally long period during 2021. Data published by the US Bureau of Labor statistics (BLS) is indeed revealing. In the last twelve months, food prices saw an uptick of 6.1%. On the other hand, energy prices rose by 33.3% during the same period. Per the BLS, gasoline prices rose 58.1% since last year, the largest increase since April 1980. For instance, in the state of California, a gallon of regular gas remained higher than $4.00 per gallon since June. This has wrought untold hardships and miserable living conditions for millions of Americans.

Secondly, the unending supply chain crisis continues to put extraordinary pressure on the US economy. Although there was some improvement in reducing congestions at major ports, many experts think the US is still not out of the woods. In fact some experts think1 the supply chain crisis could continue well into 2023. The consumer will bear the brunt and pay higher prices for food and other consumables.

Thirdly, the resurgence of COVID and the new variant Omicron have opened a new front for an already embattled economy. How quickly the variant will spread or how deadly it will be is still under cautious review by the health experts. On the other hand, there has been an alarming surge in new Covid infections. As of 29th December2021, the seven-day average of COVID-19 cases topped 280,0002, almost as high as was witnessed in January. Many businesses fear that a lockdown will wipe them out.

At a time when the US economy’s post pandemic economic recovery was at best tardy, this baneful convergence – of rising inflation, supply chain challenges, resurgence of COVID-19 and Omicron variant – is a cause for concern.

Many businesses, large and small most likely may not survive a lockdown this time around. Given the precariousness of the economy, many experts have been cautious about prognosticating the prospects of the economy in the upcoming year.

How has the response to these challenges been?

The response to rising inflation has been tepid. According to Mohamed El-Erian3, Chief Economic Advisor, Allianz, “the characterization of inflation as transitory is probably the worst inflation call in the history of the Federal Reserve and it results in a high probability of a policy mistake”. Inflation, which stood at 6.8% as of November 2021, marked the biggest 12-month move since 1982. The Fed must step in quickly to tame inflation.

One thing is clear. The US economy is in no robust health now and must tread extremely carefully in the New Year. Albeit for reasons beyond its control, America is slowly and surely losing its position as the preeminent economy in the world.

Much will depend on the Biden administration’s forthright leadership as well as its ability to inspire confidence in its own decisive responses in seeing the country through. This too may prove to be a challenge.

For starters, the President’s approval ratings have been sliding for some time now. CNN4reported that Biden now had the lowest net economic rating for any president at this point through their first term since Jimmy Carter in 1977.

In fact, the tanking of Biden’s image had its origins in Afghanistan. The bungled withdrawal was in fact a preview of sorts for what was in store. The visuals of desperate Afghans climbing and running alongside the US Air Force plane in Kabul as well as images of few Afghans falling from the sky not only shocked Americans but also numbed the world. Biden had quickly failed his first major test.

Biden certainly has botched the Afghanistan test. But he will have no room or time for any faux pas while rescuing the US economy. It can push the economy into a deep recession. If the President’s past performance is any indication of the future, America may have really challenging times ahead.

Despite all the negativity, the American economy is a behemoth that has survived multiple train wrecks, largely because of the innovation, ingenuity, and hard work of market participants in staving off catastrophe. But nevertheless, the dangers persist and are very real.

Mythological Story of Trimbakeshwar Jyotirlinga Mandir

0

The meaning of the word Trimbak (Tri Ni Ambak) is Lord Shiva’s three eyes and his three eyes are known as the sun, moon, and fire. And it is also believed that Trimbak means “Trinities” or “Trimurti” which represent Brahma, Vishnu, and Mahesh.

There is another story told in Lingpurana about the word Trimbak. Linga Purana says Triambak is the father of light Sun, Moon, and Fire

Trimbakeshwar is the name of the island of Gautam Ashram area called Jambudvipa of Bharat Dvipa of India, Where the Dandak forest is located. But its old name is Trisandhya. And the name Trimbakeshwar has derived from the father’s name three lights Sun, Moon, and Fire.

The Mythological Story of Trimbakeshwar Jyotirlinga :

The story of Trimbakeshwar Jyotirling is very exciting. Two elements govern all the world (Universe) 1) The Shiva element and 2) The Shakti element we called it sky and earth. These two-element are run the whole world. One day an argument started between the Shiv element and Shakti element “I am the bigger”. And to show their power Shiva elements and Shakti elements started to increase their size. In this fight, the entire universe began to cover. Fear started coming into everyone’s mind.

The power of the Shakti element started to decrease, and Lord Vishnu merged with the Shakti element and continued the Shakti element’s expansion. By seeing this Lord Vishnu communicated with Lord Shiva from within and divide Shiva’s elements into 12 parts with his Sudarshan Chakra and set these 12 parts on the earth which is called 12 Jyotirlinga. That twelve parts are known by the name 12 Aditya. This 12 Aditya started regulation of twelve months. Every month Sun brings different light which is called Dwadashadityam such that there are 12 Jyotirlingas, one of them is Trimbakeshwar Jyotirlinga is called Adya Jyotirlinga.

Trimbakeshwar Jyotirlinga at the foothill of mountain Bramhagiri. From Bramhagiri hill holy Godavari river originates. According to mythological stories, Lord Brahmadeva does penance on mountain Brahmagiri to please Lord Shiva, since that, this hill is known as Brahmagiri Parvat.

On Brahmagiri Parvat there was an ashram of Gautam Rishi. Gautam Rishi performed a penance on this hill to please Lord Shiva to remove his sin of killing a cow. Lord Shiva was pleased and asked Gautam Rishi what he wants. Gautam Rishi wants to take bath in Ganga Manta’s water to remove his sin of killing a cow. Lord Shiva accepted Gautam Rishi’s wish and sent Ganga mata’s water to Brahmagiri Parvat, but the Ganga river disappeared from there again and again.

Because Ganga manta does not want to leave alone there. Ganga manta says Lord Shiva to stay with her at Trimbakeshwar. And Lord Shiva accepted the Ganga manta request and originate on the land of Trimbak in the form of Jyotirlinga, which is known as Sri Kshetra Trimbakeshwar Jyotirlinga Mandir.

In the Padyapurana says on Sahyadri Parvat there is one Jyotirlinga, whose darshan destroys all the sin.
