(i) उपयोगकर्ता द्वारा कोई वक्फ किन्तु ऐसे वक्फ का केवल इस कारण वक्फ होना समाप्त नहीं हो जाएगा कि उसका उपयोग करने वाला समाप्त हो गया है चाहे ऐसी समाप्ति की अवधि कुछ भी हो;

(ii) कोई शामलात पट्टी, शामलात देह, जुमला मलक्कन या राजस्व अभिलेख में दर्ज कोई अन्य नाम;

(v) वक्फ विलेख” से कोई ऐसा विलेख या लिखत अभिप्रेत है जिसके द्वारा कोई वक्फ सृष्ट किया गया है और इसके अन्तर्गत कोई ऐसा विधिमान्य पश्चात्वर्ती विलेख या लिखत है जिसके द्वारा मूल समर्पण के किसी निबंधन में परिवर्तन किया गया है ;

Latest Developments in Gambling News in India

0

Online casinos have become increasingly popular in India, offering a wide array of games and betting options accessible from the comfort of one’s home. Players can enjoy classics like blackjack, roulette, and slots, as well as live dealer games for an immersive experience.

The Enforcement Directorate (ED) recently made significant strides in cracking down on illegal gambling activities in India. In connection with the Mahadev online gambling case, the ED seized cash and properties valued at Rs 417 crore. The masterminds behind this operation, Sourabh Chandrakar and Ravi Uppal, amassed a staggering Rs 5,000 crore from their illicit betting app, which they operated from Dubai. Chandrakar, aged 28, and Uppal, aged 43, are the main figures behind Mahadev Online Book, an online platform for betting. They notably splurged around Rs 200 crore on a lavish wedding in February 2023, showcasing the immense profits from their illegal enterprise. Recently, the ED conducted extensive searches targeting money laundering networks associated with the Mahadev APP in cities like Kolkata, Bhopal, and Mumbai. These operations yielded substantial evidence, leading to the freezing and seizure of assets worth Rs 417 crore. Furthermore, four individuals were arrested last month in connection with the case.

Mahadev Online Book facilitated illegal betting on various live games such as poker, cricket, badminton, tennis, and football. Additionally, users could engage in card games like Teen Patti, poker, and ‘Dragon Tiger’, along with betting on Indian elections. The ED’s investigation revealed that the platform operated through multiple websites and closed groups on instant messaging apps, managed by individuals known as “panel owners”. These panel owners advertised Mahadev Book’s contact details online, enticing people to participate in the games. Once lured, participants were instructed to contact specific WhatsApp numbers to begin gambling.

The games offered by Mahadev Online Book were rigged to ensure players lost money over time. Initial findings by the ED indicated that collecting funds, creating user IDs, distributing credentials, and managing earnings were all overseen by these panel owners. Players were required to deposit money into “benami accounts” shared online, following which they were allocated panels by the head office in Dubai. These benami accounts were either fraudulently created or obtained for commission purposes.

The illegal operation began in 2017, witnessing a surge in users during the COVID-19 pandemic in 2020. Chandrakar and Uppal, based in Dubai, retained approximately 80% of the operation’s profits, while the platform operated through various panels or branches sold by them, akin to small franchises.

As the Mahadev betting app continues to draw attention in Chhattisgarh, the ED persists in its rapid investigation. Recent operations led to the seizure and freezing of movable properties worth Rs. 572.41 crore. Notably, the investigation revealed links to Andhra Pradesh, particularly through transactions involving a call center based in Vishakapatnam. The supplementary prosecution complaint filed by the ED outlined six FIRs by local police, primarily from Chhattisgarh, along with one from Andhra Pradesh. The accused operated a call center in Vishakapatnam under various brand names, including Tigerexchange, Gold365, and Laser247, to facilitate bets nationwide. Despite regulations prohibiting gaming for stakes in Telugu states, illegal portals continue to operate with minimal intervention from law enforcement, highlighting the challenges in curbing such activities effectively.

No journalist from Gujarat met Arvind Kejriwal: RTI Reveals Kejriwal’s lie on Twitter

0

Delhi Chief Minister & National convener of AAP Arvind Kejriwal’s politics and governance revolves around social media especially Twitter. As the assembly polls in Gujarat and Himachal Pradesh are approaching, Kejriwal is now projecting his bubble of Delhi model on social media which is busted by some social media activists with fact check.

In the same fashion, Kejriwal tweeted on 14th August 2022 at 1:55 PM in Hindi claiming, “Several journalists came to meet me today after visiting the schools, Mohalla Clinics and hospitals. Today, in the meeting they told, “Sir, let the opposition say anything but you have done a tremendous work in health and education”. I replied, “If we get chance in Gujarat, we would do the same good work in Gujarat”.

He claimed that several journalists from Gujarat visited the health and education facilities in Delhi and then met him but he neither mentioned their names nor did he post any photograph with them.

To check the fact, Mr. Sujit Patel did a RTI application on 16th August 2022 as mentioned below:-
Understand from the tweet of Shree Arvind Kejriwal that Gujarati journalists met him on 14th August 2022

Q1. I wish know the details of all the meetings Arvind Kejriwal had on 14th August 2022.

Q2. Copy of visitors book showing visitors met Arvind Kejriwal on 14th AUgust.

Q3. Name the journalist of Gujarat met Arvind Kejriwal

To which the reply was, ‘As per the inputs furnished by the protocol branch and camp office, the requisite information is provided below

Point 1: Honorable Chief Minister has no meeting on 14 August, 2022 in CM office’.

The point 1 in the RTI reply clears that Arvind Kejriwal’s bubble of lies has been busted and his portrayal of Delhi’s education and health model is nothing but a mirage which ends with lies.

Mona Lisa of modern India

0

Created by Leonardo Da Vinci in the 16th century, the Mona Lisa painting is probably the most valued art work in the world, touching almost a billion dollars. Numerous stories abound about it. Some say, Mona Lisa is a man or a transgender but not a woman. Some say the painting is that of a friend of Da Vinci, some say its a noblewoman, some say it’s that of prostitute and on and on the theories go. However, the most striking area of study is that of Mona Lisa’s smile. Is she smiling or is she inviting or is she disgusted or is she angry or is she surprised or is it a mix of emotions. It’s hard to say for sure but the more you think and the more you look at it from different angles, the more you scratch your head. And, this is where it compares to a queer situation that many (if not all) Indians face.

In many ways, Mona Lisa compares to Narendra Damodardas Modi, the Indian Prime Minister. It’s hard to say what Modi will do next and even if he may do something, when will he actually do it. He has his own MonaLisque style of functioning (and smiling) which promises to tell a lot without actually saying or giving away anything. Like Mona Lisa’s smile, it’s hard to read Modi. For a social media statesman which Modi is, his public aura is like that of an elephant’s tusk, which shines bright and majestic but doesn’t tell a lot about what he would do or what he is thinking. Nevertheless, the tusks hide something which no one can predict. Predicting him is far more difficult than predicting Trump, Putin or Xi.

Here is why.

The modern Sanatani’s conundrum

Post Modi’s 2014 victory, elements in the Hindu (Sanatan Dharma) community expected that Modi, the Hindu Hriday Samrat (ruler of Hindu hearts) would take quick steps to stop all appeasement of Muslims (not minorities as minority in India is a pseudonym for Muslims). This included steps like the abrogation of Articles 370 and 35A (articles which provided special status to the erstwhile J & K state of India), solution to the Babri Masjid-Ram Temple issue, abrogation of the 1991 Places of Worship Act, removal of the Minority Affairs ministry, removal of the minority commission, declaration of Hindus as minorities in states where they are a minority, removal of Waqf properties act, getting rid of the Waqf board, freeing Hindu temples from government control, bringing in a Uniform Civil Code, passing an anti-conversion law, complete revamp of India’s education system, changes in names of places and infrastructure named after historical invaders, ending radicalization of Muslims in mosques and madrasas, creation of a cogent population policy and so on and so forth.

In the first term of the Modi government, no big decisions were taken. Hindus who had voted for the BJP (Bharatiya Janata Party) in expectation of such changes gave Modi a free pass as the BJP didn’t have a majority in the Rajya Sabha (upper house of the Indian Parliament). Also, the attacks on Pakistan, introduction of GST, Demonetisation and other significant steps went on to soothe feelings to a certain extent. However, this group of Hindu voters had a bonanza very early on in Modi’s second term. Articles 370 and 35A were abrogated, the 500 year old Ayodhya Temple dispute was resolved and the Citizenship Amendment Act (CAA) was passed. Post this, COVID came and changed the discourse quite a bit.

However, once COVID was under control, the Hindu voter expected the government to look at their other demands. The events in the second half of 2019 had built a lot of expectations. To their dismay, things have not moved in the right direction. They claim the government is not being sensitive to its core vote base and its demands. However, the problem for such voters is that they have no alternative to Modi and the BJP. They also claim how the BJP left its supporters high and dry after it couldn’t dislodge “Begum” Bannerji from West Bengal.

So much so that these Hindu voters have started venting their frustration on Modi via traditional and social media. They claim why the government is dithering on tackling many socio-religious issues. Their usual refrain is, “they have more than 300 seats, what more do they want. So now, in a strange way Modi has been pushed out of the extreme Hindu faction and sits somewhere between Hindu centrists and extremists. Some may call him moderate but I don’t think Modi or his party care about these modern WOKE tags.

The Opposition’s Conundrum

Another disgruntled group that is unhappy with Modi’s ascendancy is the Indian opposition, their voters and sections of the media (variously described as Lutyens media and Khan Market gang). As soon as Modi won in 2014, there was expectation that he would start behaving like Adolf Hitler or Mussolini and would go hammer and tongs against Muslims and his other natural detractors. They expected chaos, violence, civil war, bloodshed and left no tables unturned to make sure that India as a country lost whatever brand it had built over 60 years since partition.

In their hate for Modi, they constantly attacked India, its institutions and lately even the voter. Some even ran to Pakistan and China asking for help to dislodge Modi. Others took and still take covert assistance from international media, forums, politicians and nations to belittle their own country, its people and its achievements. To this group of people, overnight India became an intolerant, deeply divided, sad and negative place to be in. People in this group started behaving like a child who cries over spilt milk.

Their various supporters within the bureaucracy, judiciary and state executive started pogroms of violence (West Bengal mainly and Kerala to some extent) and resistance. They started award wapsi and letter writing competitions. Every day these detractors hit a new low without understanding how deep they were falling in a hole they themselves had created.

The Result

So in essence, eerily enough after 8 years of Modi’s service; BJP’s core Hindu voter (also referred to as Hindu Nationalists) and its most virulent detractors like the Communists (Naxals, Urban Naxals, Maoists included), Socialists (Family run fiefdoms like the Yadavs, Bannerjis, Pawars, Karunanidhis, Raos, Badals, Gandhi’s, Abdullahs, Muftis etc.) and pathological hatemongers (like some in the media, judiciary, and bureaucracy) are in the same corner, albeit for different reasons. Modi hasn’t delivered their dreams and that is where Modi’s Mona Lisa smile comes into play. Or does it? What is behind Modi’s smile?

What could really be happening?

For Modi who is deeply rooted in the RSS (Rashtriya Swayamsevak Sangh), the fundamentals of polity and the idea of India dreamt by the RSS hasn’t changed. And this means, the dream of Akhand Bharat (Undivided India) remains. As I have mentioned in one of my previous articles, “Who ruled India” (https://aruneshchoubey.medium.com/who-ruled-india-3fc4f91a1b44), Modi, his party and its philosophical parent are the only group in India who understand this properly and know that until they rule India from Afghanistan to Arunachal, Ladakh to Lanka, Kailasha to Maldives; India will always be under attack and there will be turmoil. Until then, Best of Luck ruling India! So, that is why Modi and the BJP do not satisfy either the Hindu nationalist or the Left wing narratives.

Modi charts his own course. He is a leftist (ok, a mix of right wing and left wing decisions) in his economic approach, centrist in social policies and conservative in philosophy and thinking. He commits only and only to a strong India and nothing else. So, if a decision has scope to cause harm to India, even if it is a demand from his core constituency, at best he takes a minor step, keeps quiet or provides cover fire through his many lieutenants.

This we can see in the fight for temples in Kashi and Mathura. Similarly, the same strategy has been followed when talking about hijab, beef, halal and loudspeakers on mosques. The strategy is to keep things simmering but not let it boil over. Like water simmering in a kettle builds expectations, similarly keeping things simmering helps the BJP in converting more and more Hindus into its fold. However, the balancing act is to stop things from boiling over.

Secondly, Modi and the BJP are wary of too much change, too soon. This anxiety is the result of a deep seated distrust (Surprise, Surprise!!) of Hindus that Modi and his party have. The cause of this is the division of Hindus into a large number of castes, sub-castes, clans, communities etc. based on a number of factors like language, state, dress, sub-culture and so on and so forth (https://aruneshchoubey.medium.com/india-the-fault-lines-1dbd5546a32e).

Thus, Modi knows that Hindus are not a monolithic community in nature and the divisions institutionalized in Hindu society are very difficult (if not impossible) to roll back. He knows that the Mughals and British couldn’t have created empires without being assisted by the Hindus.

The Hindu has always been open to criticism, debate, arguments, change and transformation. This independent streak makes it difficult to control Hindus, so they have been divided for centuries to ensure they could be ruled if not completely converted and subjugated. Modi knows that one wrong step could see large swathes of Hindu voters desert him. Also, sections of the Hindu voters are very transactional (swayed by prices of potatoes and onions).

Modi needs to ensure that the economy keeps ticking so that these transactional voters are also kept in good humor. Thus, a lot of stuff that his core constituency wants is dealt with mildly and slowly. There will be sudden spurts of action and then silence for a while and then again a spurt and then a lull and on and on this game goes. For India’s sake Modi is ready to mimic climate change, where things change slowly and people get used to it, finding solutions on the way. He knows that until the Hindus are united to a point where they are ready to leave him and the BJP behind in resolution of Hindu causes, only then can he be completely sure of taking quick, strong and decisive decisions.

Until then, he will behave like a Candy Man saying and doing a few things here and there, keeping his voters in good humor. Also, his trusted lieutenants like Amit Shah, Fadnavis, Himanta Biswa, Yogi and others will make the right noises about everything “right” ranging from UCC, temple corridor constructions etc.

Thirdly, Modi, BJP and the RSS are aware that to beat the Islamist-leftist nexus in India, the solution is not to create a Muslim second class citizenry. This may surprise many! Make no mistake that Modi is not serious about this. In Parliament, he had mentioned FDI (Foreign Destructive Ideology) in a reference to ideologies which were foreign to India. He knows that communism, Islamism and any faith which is not rooted in India is incompatible with India’s future.

What Modi believes is: Violence and war will be counterproductive in the longer term and will also be bad for India’s branding and economy. Waging economic warfare against his opposers (local and international) is the best bet. Thus, the best way to deal with Islamism is Ghar Wapsi (Return to Hinduism) using Saam Daam Dand Bhed (persuade, purchase, punish, and exploit the weakness). Ghar Wapsi is the single biggest reason why BJP dithers on having a national anti-conversion law. The current situation allows it to reconvert people. Modi understands that before he can take on Pakistan and Afghanistan and reclaim other territories, he needs to win India.

This will not be possible unless he squeezes the opposition and its supporters. However, this Ghar Wapsi will be done at the pace with which the earth goes around the sun. It will be so slow that it will happen and people wouldn’t even realize it. Under this, temples converted into mosques will be reconverted (already started), madrasas closed or transitioned (already started) and mosques converted into temples as Ghar Wapsi picks up. The same tactics that Islamists and Christian missionaries used against Hindus will be used against them.

Restrictions on NGOs which ran on foreign money has caused a lot of heartburn as much of this money was used for anti-India activities. Modi and his party think of Indians who have been converted into Abrahamic faiths as children of Hinduism who were forced to convert. The next few decades will be used to incentivise conversion into Hinduism.

Finally, Modi also believes that his supporters need to stop looking up to him to resolve societal issues. The Hindu society cannot outsource its responsibility to Modi, BJP and the RSS. Thus, Modi believes in empowering the society to resolve its own issues.

However, it is equally true that there is a risk that if he or the BJP cede the Hindu leadership space to the society, they may be left behind. So, sometimes just covering fire on Hindu issues may not be enough.

And, therein comes the art of balancing. If Modi and his successors end up creating a fine balance, then a thousand years from now Modi’s picture could be competing against MonaLisa’s at the Louvre.

The right wingers versus the rest

0

Politics has always been a minefield, with many factions and parties continually fighting for control. Right-wing critics of the left have become increasingly vociferous in recent years, and vice versa. This article probes some of the fundamental concerns that separate these two parties.

Who are the Right Wingers? This question has no one solution, just as there is no single definition of what it means to be a right-winger. Right-wingers are individuals who hold conservative political beliefs in general, however, there is a wide spectrum of viewpoints within the right wing. Some want less government and fewer regulation, while others urge for a robust military and aggressive foreign policy. Most right-wingers share a belief in traditional values and a distrust of progressive or left-wing views. The right-wingers are a political group that advocates for conventional values. They are champions of less government, reduced taxes, and a robust national defense.

There is a lot of chatter these days about so-called “right-wingers” destroying countries. But what about the other side of the political aisle? Aren’t there also left-wingers and moderates who share responsibility for the world’s condition of affairs?

Right-wingers and the rest of the political spectrum have long been at odds. Conservatives advocate for less government, fewer taxes, and less regulation. They are also more socially conservative. The rest of the political spectrum favours greater government, more taxes, and increased regulation. They are also more socially liberal. As the two sides have gotten increasingly politicised, this strain has only intensified. It appears like there is no way to reach an agreement on the areas that are most significant for both parties.

The contemporary political scene is growing more divided, with Right Wingers on one side and the rest on the other. This is a hazardous trend with potentially devastating implications. We must uncover a process to harmonize our differences or we will continue to be split and dominated by those in control.

Mission ‘denigrate India’ sabotages PM Modi’s vision of making India a ‘Viswaguru’: Here is how

From the country of snake-charmers as proudly exhibited by the first Prime Minister to his Western girl-friends ignoring the negative impact on the same on country’s overall image to getting Banaras nominated as the first-ever Shanghai Cooperation Organization (SCO)’s Tourism and Culture Capital during the period 2022-2023, India, the home of world’s one of the oldest civilization and culture, has come a long way since independence 75 years back.

Now, the PM of India is proudly taking his visiting counterparts or the heads of states from developed countries to Sabarmati Ashram, Banaras Ganga Arati, Lotus Temple travelling in Metros, etc. showcasing the country’s proud heritages, possessions and developments. The Indian Institute of Science (IISc), Bangaluru, has been ranked the “world’s top research university” scoring 100 out of 100 marks in the Quacquarelli Symonds (QS) World Rankings 2022, an annual publication of university rankings. Commenting on the ranking of Indian institutions, Ben Sowter, Director of Research at QS, said, “This year’s edition of the QS World University Rankings demonstrates the excellent work that many Indian universities are doing to improve their research footprint, with positive consequences for their reputation on the global stage. India’s Higher Education institutions’ graduates have been the most desired Chief Executives of the world’s top Multi-National Corporations now.

In the meanwhile, India has been the world’s Information Technology’s Super Power matching the forecast of US President Bill Clinton in 2000 when he visited Cyber City in Hyderabad, is the 3rd largest economy in Purchasing Power Parity (PPP) and the 5th largest economy in dollar term overtaking United Kingdom (UK) her two centuries long colonial master which looted $45 trillions worth of riches and responsible for several genocides of millions of Indians, 3rd largest military power in the conventional sense, and latest being vaccine capital of the world. So far India has supplied 25.44 crores of Covid19 vaccine doses to 101 countries after adequately meeting its own large population’s requirement despite the blockade of raw material supply by the liberal West during the early days of vaccine production. Here, it is imperative to note that when India started supplying free doses to poor countries, the liberal and developed West, which uses to give lectures to developing and under-developed countries including India about human rights and liberal democracy and are the inspiration of Indian intellectuals, had blocked and stored their production of vaccine four to five times of their actual requirements callously ignoring poor countries desperate needs.

Most recently, India has been successful in controlling the dreaded pandemic Covid19 on par with developed countries administering more than two billion doses of vaccines -manufactured based on domestically developed and imported formula- in less than two years when the country’s leading news weekly India Today (matching with several Western naysayers) forecasted on April 22, 2021, with the headline “India will take 12 years to vaccinate entire population, reach herd immunity in 8 years at current pace: Report”. On July 18, 2022, BBC, which was at the forefront among the Western media demeaning the Indian Government’s fight against the pandemic, announced “India becomes the second country to cross two billion Covid jabs”. This milestone is accomplished mostly free of cost despite domestic politics motivated vaccine hesitations, vaccine destructions, etc. The other country is China which has crossed this milestone amidst reports of frequent ongoing lockdowns in the country’s major cities that have impacted her economy, the phenomenon has been given goodbye in India since early 2022.

Now, the whole world practices Indian civilization’s gift for human health and well-being recipe Yoga and observes International Yoga Day accepting PM Modi’s appeal for the same in 2014 in his first appearance in UNO. Why this scope of Soft Diplomacy, which benefited in building a positive image for the country, was not explored earlier is a billion-dollar question. Now, India enjoys strategic autonomy in its own right. Her top diplomats and leadership with uncompromising confidence used to question Super Powers over the rationalities of their various policies that impact the world economy, security, environment, and international laws and have started asking for their accountability. During the early phases of the Yemeni Civil War and Ukraine wars, India not only rescued her citizens trapped in the war zones but also rescued citizens from other countries including Pakistan and the West despite its leader having been branded ‘fascist’ in those countries.

With the latest development, what is wrong to work for Viswaguru status for India as envisioned in the early 20th Century by the country’s greatest seer Swami Vivekananda, who captivated the Western intellectuals with his address to World Religion Congress in Chicago in 1893? Swami Vivekananda presented India’s past glory to the world, the values it had adhered to in the past and the concern it had shown towards the welfare of all without any discrimination. Gurudev Rabindranath Tagore had predicted that ‘India is destined to be the teacher of the world.’ Similarly, this aspect was elaborated by Sri Aurobindo. He predicted that ‘India will be the moral leader of the world.’

Is the present government in New Delhi doing anything different or deviating from the above-stated objectives of three eminent seers of India that India be Viswaguru? If not, why then does every effort of the present government to accomplice the above objectives being mocked and abused by people of eminence, looks like in missionary spirit? Yes, I do agree that personal opinion over government policies differs from person to person, intellectual to intellectual, organization to organization and party to party. But, when the issue concern to national image, glory, security and the people’s wellbeing, there is a need for a unit. Since the 2019 General Election and during the reign of Covid19, more than 600 columns written by Indians and Western opinion makers with inputs from Indians denigrating the Indian government, her civilization and culture were published in Western print media. If the Electronic Media campaigns are added, the list will have more than a thousand. Verbatim such as intolerant, elected autocracy, fascist, dictatorship, Islamphobist, etc. has got free flow. Is it anything less than “missions denigrate India sabotages vision Viswaguru” and insult three eminent seers who in fact pioneered this proposition century back?

On March 22, 2022, a former cabinet minister of Foreign Affairs tweeted “Sad to note that India was not in the forefront of establishing peace between Russia and Ukraine. But we are Vishwa Guru” as if he was not aware of India’s position over the issue and its well-recognized constraints which prominent stake-holders of the conflict appreciate. Taking a swipe at the Prime Minister over the state of unemployment in the country, the Grand Old Party former President on July 30, 2022, alleged that the “Raja” (King) has now become a “Vishwaguru” (global leader) in “creating joblessness” as if his party had jobs for all the citizens during its rules for several terms, and Covid19 and on-going war in Europe supposed to have no impact on economic activities in globalised India.

The reasons why India should claim Viswaguru are because she gave countless theories in Science, Mathematics, Astronomy and Ayurveda, thanks to the country’s ancient civilization and research by her sages. India is the only country to have a university education during very ancient times. They were destroyed by lunatic invaders. All these research were burnt down to ashes as they were victims of invaders’ hate and jealousy of Indian culture, heritage and civilizational value system and teaching.

Judicial reforms (Access to justice)

0

Justice is an essential element of any civilisation. Its prevalence leads to order and progression whereas its absence may lead to chaos and anarchism. Justice can be seen dispensed only when it is accessible, transparent, reliable, and unbiased.

The journey of Justice in India started as early as in the 3rd Century B.C when Kautilya emphasised on the need for an efficient, effective, and impartial justice mechanism. Distinctions were made between civil matters and the matters of criminal jurisprudence at an early age. He, in his treatise Arthashastra, dedicates Kantakashodhan Adhikarna to the criminal justice system, thus elaborating the parameters of the rule of law.

Justice then, was not only accessible to all but also instant. As time passed various rulers came and different definitions of justice and justice delivery emerged. Different cultures, communities, nations saw different principles of justice, some being moral, some based on conventions, whereas some relied on pure literature. However, one key concept to uphold the justice mechanism was common in all the sections and that was accessibility. Judicial system is of no use if people are not able to benefit from it. Inaccessible and partial justice leaves resentment in the people which is not good for the state.

Legends have it that Manunidhi Cholan, in order to make justice accessible, had installed a bell of justice in his kingdom. Not only the bell was answered with sincerity but the justice was also dispensed immediately. However, with the advent of Britishers, Justice in India faced a huge setback. Pendency in the cases increased exponentially and when combined with police brutality, the scenario was very exploitative to its genesis. Justice became no longer accessible to the common man.
India got independence from the British empire and a new constitution vowed to take the judicial system to the path of progression.

But Justice was reaching the masses at a very slow pace. With the turn of the century, the need for an accessible and inclusive judicial process started increasing. Soon it was realised that with the prevailing pendency of cases, poor judge to people ratio, and existence of vacancies at all levels of judiciary, it was difficult for justice to reach the people belonging to all sections of the society. Thus in 2005, an ‘E-Courts’ project was conceptualised under National Policy and Action Plan for Implementation of Information and Communication Technology in the Indian judiciary. It gave way to the future but its potential was not tapped completely.

In 2020, Covid spread like wildfire, having severe implications not only in economic and social domains but also in legal institutions. Countries like Belgium, Denmark, Greece, Portugal, etc. introduced video conferencing for court hearings during the pandemic as soon as they could. Similar stance was observed by the Indian Courts as well. The ‘e-committee’ of the hon’ble Supreme Court took on the challenges aggressively.

While during the pandemic, electronic filing of the cases and digital payments system smoothened the sail upto an extent, a broad map was being prepared for the tech savvy 21st century courts via ‘Digital Courts’ project. The project aimed to infuse top technologies in improving the digital infrastructure currently available with the courts.

The proposed reforms envision digitising paper based processes. Which would enable the litigants and lawyers to file a case from anywhere and at any time, thus delivering justice across the geographical barriers. It further aspires to remove redundant and obsolete practices like enormous paperwork, transferring thick files, duplication of efforts, judicial delays, and appearance of clients at multiple windows.

The project focuses on Judicial Reforms at an unprecedented level. It has the capacity to deal with traditional issues associated with Indian Judiciary as well as various contingencies of contemporary times.

It has been observed that the majority of cases in the Supreme Court hail from the neighbouring states only. To bring justice geographically closer to people, 125th and 229th reports of the Law Commission recommended creating regional benches of the Supreme Court. However, the technological reforms which empower people to attend hearings, file claims, and upload documents online resolves this problem up to a great extent. Without having to travel,  justice becomes affordable and cost effective.

Subordinate judiciary is often accused of corruption prevailing in its premises, which makes the justice delivery process a nightmare for litigants. The proposed reforms also seem to remove this obstacle in accessibility to justice as the transparent system due to online payments and machine reading of receipts will save them from any harassment if present.

In the post-covid era, the new normal will be based majorly on technology, hence the judicial reforms shall follow similar lines as well. Artificial Intelligence and the Internet of Things should be used for recommending the schedules of the process by coordinating with multiple actors at various levels. Thus, saving time and resources of the stakeholders involved.

The future generation reforms should not be a half-hearted effort, since it  will have the potential of serving complete justice sitting miles away. By using the blockchain technology, the digital signatures, smart forms, digital footprints all can be secured completely, thus reducing chances of forgery or duplication and systems like Optical Character Reader can be put in place for making legal documents machine readable. All of this without compromising transparency  and giving due attention to the privacy of the litigants at the same time.

Even though justice is not linguistically variable, litigants are. Artificial Intelligence can be further brought in to translate the judgements even in the regional languages of the remotest place, so as to benefit the poor and bring the judicial institution a step closer to them. Digital Case Management System, Interoperable Criminal Justice System will smoothen the functioning and coordination of the executive and judicial agencies. It will aid in seamless transfer of documents and information at a speed of a click and is bound to have a multiplier effect on other organisations as well.

The reforms include data driven decision making at judicial levels. It shall enable targeted interventions and resource allocation from the side of the judiciary. It will minimise inclusion and exclusion errors as well. The data harnessed can be used for research purposes too as a comprehensive repository of case laws will always be accessible in the public domain. From minutes of the courtroom happenings to the judgement as pronounced by the judges, all shall be recorded in the electronic format. Transcription of court proceedings will build trust and transparency in the system. Now, as the data generated in the process will be huge, storing it could’ve been an issue in other cases but here cloud based computing and storage mechanisms nib the problem in its bud.

In simple terms, technology does have a solution to the accessibility of justice. Incorporating technology at regular steps brings justice closer and accessible to the people in proportion. It may be argued that due to the huge digital divide already predominant in Indian society, its reach in the masses might not be as even as expected.

The challenges however are not limited to just that. Digital and legal literacy, internet penetration, huge digital infrastructure requirements, change management, etc. also pose a good threat to the aim of judicial accessibility in the post-covid era. Behavioural change would be a challenge which policy makers and implementing agencies know very well and adoption to new mechanisms might also not be seen in a good light by some stakeholders.

Many courts in the country even lack basic electronic infrastructure and assuming that they will all come on board to the new mechanism quickly is just being over optimistic. Moreover, every High Court has its own distinctive administrative practices. The conventions might also be different at various courts, so the uniformity the reforms suggest or aspire to bring in the governance framework might not yield sweet fruits in the primitive stage.

Prima facie, it may appear that the very people the reforms aim to benefit, might end up getting hurt because of the lack of awareness regarding judicial framework as well as newly inducted digital practices. This may result in justice to be skewed.

However, a deeper analysis of the reforms suggests that this scenario has already been taken up in the reforms and the presence of omnichannel service delivery platforms, kiosks and ‘E- Sewa Kendras’ at respective courts will prevent that from happening. Sufficient care has been taken for the people who belong to the far flung areas of the society as for the backward areas or the areas with no smartphones or the internet, systems like ‘Interactive voice response system services’ will be placed for the users which will enable them to access the services seamlessly. Such services will also take care of the persons with disability.

Justice will not only be more accessible but also inclusive. Non-State actors such as NGOs, civil society groups may augment the reach of the reforms to the people and make justice more accessible to them. Moreover, if these reforms are complemented with government initiatives like ‘Bharatnet program’, ‘Pradhan Mantri Gramin Digital Saksharta Abhiyaan’, ‘Digital India’, etc. it will yield best results. With the advent of 5G and increasing smartphone penetration in rural areas, the picture of reforms is not a grim one.

To address the issue of change management, training programs should be organised at various levels for court staff, judicial officers, advocates and their clerks, etc. and general awareness programmes for the masses. Tutorial videos, video programmes and series regarding the judicial office can be uploaded on various social media platforms, media platforms and educational platforms for empowerment of the masses. Legal aid programmes especially for the poor and the marginalised groups hold the key for filtration of the reforms to the lower strata of the society.

21st century justice system App based startups, online consultancy services, application based solutions may enrich the judicial process by making the judicial system’s services more accessible. For example, ‘Nyaaya’ an initiative of Vidhi Centre for legal policy aims to provide comprehensive and detailed information on legal topics covering various aspects of law under its ambit with which people engage in their day to day life. More such initiatives are bound to come in future which will empower all the stakeholders involved in a comprehensive manner.

Thus, the reforms have the potential to transform the judicial process in India with the ecosystem approach, and thereby promote synergy amongst involved institutions. Justice which was traditionally seen as institution centric is becoming more people centric and these reforms enhance the process by bringing justice close to the people in numerous ways.

Medium of instruction in Indian schools

0

A global perspective is required in today’s environment. With globalisation and an increasingly shrinking world, our need to know English has grown significantly. I attempt to provide my views, as well as the benefits and drawbacks of teaching English as a medium of instruction against the local language in Indian schools, and to highlight how India may be a better place by providing its students with knowledge of both. Many nations have evolved into great powers without having a state language or forcing one language on everyone (Japan, South Korea, Germany, France).

This is how it should be done. English must be taught as a language of instruction in schools, including Government and private institutions and some specialised programmes such as medicine and engineering. To everyone’s advantage, we must reform our regulations so that kids are not discriminated against because of their mother language. This will make it simpler for youngsters to acquire both languages with equal ease – which should be everyone’s objective. We can do this by fostering bilingualism in them from an early age.

English has become the worldwide language of business, education, and diplomacy for a variety of reasons. But what are these specific reasons? Is English truly so superior that it should supplant local languages all across the world? Let us examine the reasons for and against English as a medium of education in greater depth.

The most apparent justification for using English as a medium of education is that it is widely spoken. More than 350 million people speak English as their first language, and over 1 billion speak it as a second language. This makes it the world’s most frequently spoken language. It’s no surprise, therefore, that English has become the lingua franca of international communication.

Another reason why English is used as a medium of education is that it is thought to have benefits over other languages. Many people think that English is a more logical and succinct language than other possibilities, making new terminology simpler to learn and retain. Furthermore, because of its regular spelling and grammatical norms, English is reasonably easy to read and write. This can make studying English easier for pupils who are currently failing in school.

There are, however, significant disadvantages to utilising English as a medium of education.

There are several reasons why schools should employ the local language as the medium of education. For one thing, it is the language in which youngsters are most comfortable and hence learn most quickly. It is also the language kids will use in their daily lives, therefore it makes sense to educate children in it. Additionally, adopting the native language as the medium of education can help kids develop cultural pride and solidarity. Finally, it can assist to slow down the rate at which youngsters acquire English, making it simpler for them to focus on their studies. It is common knowledge that learning should take place in the language that a youngster is most comfortable with.

This is because when they are not battling with another language, they perform better and learn more quickly. It makes no sense to force-feed them English when they do not need to learn anything other than their own tongue. This includes how they interact with others, how sociable they are, and how inventive they may be when it comes to learning new things. All of this demonstrates that you do not need to teach your child English at such an early age if you want him or her to succeed.

There has long been discussion regarding whether English as a medium of instruction or educating in their native language is better for children. Some claim that the former is the only way to ensure that children have access to the greatest education and possibilities available, whilst others think that local language instruction is more effective and good for children. So, which strategy is best?

Both English and local language training have advantages and disadvantages. On the one side, English as a medium of instruction may provide youngsters with more opportunities to learn about various cultures and become global citizens. Furthermore, because English is considered the language of business and commerce, studying it at a young age might provide youngsters an advantage in their future careers. Children, on the other hand, learn more successfully when they are taught in their original language, according to studies. They are also more likely to remember and apply information in real-world circumstances.

Finally, there is no one-size-fits-all response to this topic. The ideal method is determined by the child and what works best for them. Some children may thrive in an English medium setting, whilst others may do better in their own language.

To summarise, the use of English as a medium of teaching in education has both benefits and drawbacks. Before making a choice, it is critical to examine the context in which it will be utilised. Many elements must be considered, including the pupils’ level of skill, the aim of education, and the resources available. The most significant variables to examine in this scenario are whether the pupils are ready for English-medium education and how to utilise English successfully in the classroom. Language of instruction is a critical problem in education.

We must ensure that we educate our pupils on how to study languages rather than just what to learn. Remember that imparting knowledge is simple, but encouraging critical thinking is more difficult.
