The inner workings of India’s nepotism debate

0

The suicide of Sushant Singh Rajput was an addition to a litany of tragic events that we have witnessed this year. As expected the incident got a well deserved national attention. Videos on YouTube, prime time programs, articles and opinions in newspapers and much more. The issue of depression took centre stage again as it does everytime we have a depression related tragedy, only to die off eventually from our collective thought as the world moves on to a different issue. This though is not the first time such a tragedy has befallen the film industry. A lot has been written and discussed about the industry’s copious amounts of problems that hide behind the veneer of glamour and fame. But the problem that stood out yet again was what we all are familiar with – Nepotism.

This is not the first time a debate on nepotism, it has gained so much spotlight. I began wondering why among all the problems that riddle the industry, nepotism stands out the most. Why is that the suicide of an actor caused such an uproar among the masses? Are there any deeper social undercurrents to this?

OF HIERARCHIES..

According to the Canadian psychologist Dr. Jordan Peterson, whenever humans or any natural things involve themselves in any endeavour, be it social, cultural, political or economic, organize themselves naturally in hierarchies. Which means that a small group of people generate the most output and thus has access to most of the resources. As a result of which there remains a large group of dispossessed people who are not able to get access to the same resources and opportunities. In spite of this, the system works fine and practically a very few participants of the system are utterly dissatisfied with the system because notwithstanding the inequality, the underlying hierarchy is based on competence and merit. Which means that people by virtue of working hard can reach the top and gain access to the resources and opportunities that the smaller group of people have.

Although, therein lies the fault-line in the hierarchical system. The system is stable only till the hierarchy is based on competence and merit. But there comes a time when the people who have access to a disproportionate amount of resources create a system that works not on competence but on patronage making it like a metaphorical citadel where no-one can enter regardless of one’s competence. Eventually this cabal starts acting like the gatekeepers for anyone who aspires to enter the elite group. They demand you to conform to the rules that they have set for their benefit. If refused, they make it extremely hard for someone to survive. There are times when an outsider is able to lob him/herself over the walls of the citadel but they remain exceptions that prove the norm. This is when the system starts to break down because the unerlying hierarchy becomes corrrupt. That is what causes people to outrage and demands for reformation of the systems start to take shape.

THE GATEKEEPERS…

By the above description one can get a clue as to what has probably gone wrong in the film industry in India today. People tolerate an unequal system as long as they feel that they have a more or less equal chance to access to the opportunities and resources they desire. But there is an outrage when the people start feeling that the system is unfairly biased towards a group of a certain few privileged elite. The reason why people are outraged is because nepotism has come to manifest a system that is corrupt to the core.

Sushant Singh Rajput was not just any inconsequential actor. He was a successful, budding, immensely talented actor who was let down and bullied by a system that is set up by a certain few elites who have established a quasi-monopsonitic citadel that opens its doors to only those who say the right things and conform to their rules. This is why the issue of nepotism strikes a wrong cord with people. It smacks of a corrupt system that acts as a gatekeeper which serves the interest of the elite few.

WHAT DO WE DO ABOUT IT?

Reformation not revolution – At the expense of sounding like a political conservative, I believe that reforming the system is the best way forward. I do not believe in throwing the baby out with the bathwater. I do not agree with the pointless and hyper emotional appeals for boycott of content of some producers and starkids. It is a short term solution that fizzles out as fast as it gains steam. We need to think about a more serious appraoch as an audience. I do see rays of light through the dark clouds. Today there are more chances for new talents to prove their mettle than there ever were. The most predominant one is the OTT and online phenomenon that has sprung up in the age of the internet. We are seeing some world class content coming out of it in the past few years. It has even made the elited and the entitled to come out of their ivory towers and recognize the paradigm shift where they have to compete on completely different set of terms than they are used to.

We have to make sure that as audience we make the right calls. We have the power to recognize and nurture the right kind of talent. It should be our privilege to have this responsibility. A responsibility which if taken seriously can help many other Sushant Singh Rajputs from going over the cliff.

Modinomics- Antidote to Lutyen theorist

0

Narendra Modi arriving at the pedestal position in 2014 as Prime Minister not only severally cauterized his political opponent, but more important also terrified to those nefarious cartel of corrupt mafia who were operating with impunity in brazen loot of India. And till date in 2020, this elitist, theorist, amazing cartel of power brokers of Lutyen Delhi loot gang is conspiring, abusing and accusing day in and out to Mr. Modi for having lost the sinister plot of continuing the orchestrated the biggest financial burglary of nation.

Till 2014 Corruption was an institutional practice in India with the shameless collusion of financial regulator, financial Institution, dubious company, accountant journalist, middle man, political leaders and armchair academician. Everybody contributed in defending this criminal act and earned their share of loot from the crime proceed.

Among the first of fiercely contested and ridiculed policy of PM Modi was his Jan Dhan Yojana. Private banker avoided the implementation employing logistics chicanery and PSU avoided through proven record of inefficiency but the brazen opposition, reluctance and un-cooperation came from RBI governor. He was no ordinary but a IIM and US educated with huge backing of international institution and Indian Industrial think tank and yet shoddy priority overtook the national interest.

In a country where poor constitutes nearly 60 Crore and are dependent on Government subsidy, the loot of welfare scheme money became the fertile source of corruption by this nexus of a lynch mob led by these Howard academician intellectual contractor middleman under the tacit indifference of RBI. The cash transfer to these scheme were nearly to the tune of 5 lac Crore per year under various State and central sponsored schemes. And majority out of that ended into the pocket of these crooks and circus jokers. This systematic pogrom of financial loot was designed since independence and continued till 2014. The Jan dhan Yozna was first step towards kicking the ass of these elite Lutyen theorist who under the grab of banking reform, profitability, work pressure and logistics issue circumvented all idea of dissemination of financial assistance to these poor citizen of nation. Today direct benefit transfer have zero corruptions and 100 percent efficiency much to the chagrin of these Lutyen theorist.

Following Jan Dhan Yozna brought series of competent reform in rural segment transferring financial support and subsidy with a series of Scheme like housing for all, Ujjawala yozna, Manrega, flood relief subsidy, damaged crop compensation and farmer direct benefit transfer plan.

The circus of theorist who ring fenced for corrupt middleman are yet in denial of efficient welfare at grass root level. The heartburn for not having earned a penny is fueling the fire day in and out.

Another important nexus of loot was institutionalize under RBI behest where nexus of bankers and industrialist looted shameless. Get a loan divert the fund into maze of company, siphoned these fund outside India, make company a loss making entity, close the financially unviable company, negotiate with power broker, squeeze the bank for its stressed assets and finally close the book of bank with NPA as full stop.

The full cartel of Lutyen power broker gang were working in a synchronized fashion and were fixing any remotest resistance or dissent with money muscle and crime. The entire machination had the blessing of indifference from financial regulator of this country. Promoter after promoter were engaged in dubious method of creating Shell Company, benami company, fake ledger account duly assisted by crooks among the accounting institution, consultant and bankers and made an impregnable maze.

Those who mattered at the coveted position obliged this nexus and prostrated before these power center, political master to orchestrate this loot. Not a Single financial regulator include Banker Bank RBI ever raised the Red flag.

To give an idea to the quantum of this financial loot, a rough estimate of minimum 10% of NPA of Banking NDTL (roughly 130 lac Crore) translate into a staggering amount of 13 lac Crore. This entire capital or rather more than this has been plundered siphoned from the system and records have been systematically destroyed.

Modi uncanny mind had most ruthless and uncompromising response to it. The severest of criticism till date to Modi comes from these mafia’s beneficiary. All detractors are active on social and electronic media platform insinuating conspiring, insulting abusing and rejecting any idea of Modieconomics. The Insolvency and Bankruptcy Code, GST, Demonetization, RERA, NCLT, foreign asset Seizure act, Benami property act were series of punitive reform that broke the spine of these black marketer and crooks. Few have landed in jail, few ran away from country, few are on bail few, committed suicide and rest are in queue experiencing gallows like feeling.

Over one lac dubious shell Company and Over 3 Lac crore of capital are under Govt control which were detected after combined action of Demonetization and GST.

This is beginning of a journey. Every crooks shall cry and bleed. And Lutyen theorist will employ every trick under the sleeves to create distraction. But the Lutyen theorist should realize the Modi economics is set to prevail in every walk of financial governance.

Worst was the response of financial regulator in India and responsible head of Institution who assumed their incumbency a seat of sinecure and hedonistic pleasure. The Modi mobilizing state resource for identifying, penalizing and punishing these corrupt has sent sever shock waves.

The quote of Gita – The truth shall prevail. Modi knows what he is doing and where the line will be drawn in this journey.

The antithesis of equality

0

The concept of the right to equality is very appealing, and that must be the reason why it is part of the law of almost every democratic country. But, until yet, there exists no society in the world which has achieved equality. Similar to the concept of democracy wherein the majority decides who must be in power, the lawmakers of various democratic countries must have been influenced to satisfy the majority, and maybe for that reason, equality was introduced and propagated. Although equality is based on the preconceived notion that each and every human being has similar needs, but at the same time, it does not acknowledge that human beings are fundamentally different, and attributing the idea of ‘similar needs’ is not justified. Plus, in a democratic system, ‘similar needs’ is often decided by the majority, and hence, propagating equality will merely favour the majority. This has caused enough destabilization by discrimination in society, and hence, a pragmatic approach is needed to be made.

The thing that needs to be understood properly is that equality can never be achieved. There will always be both superior and inferior set of individuals in any given society. This per se is not problematic, but when this sociological structure is used for discrimination, significant instability in society arises. An analogy can be drawn here with the organizational structure of a workplace for better understanding. In any workplace, the hierarchy is divided based on skill or experience or both. Salary is given by following this hierarchy, as the Boss gets the most, and a junior employee gets the least. But in this case, even if there is a superior/inferior divide, there is no discrimination as both are satisfied with the salary they get. Now, let’s make the Boss a junior employee. At this moment, the Boss will feel discriminated and would complain of not getting a higher salary even though he has the prerequisite skill/experience.

Similarly, a junior employee would feel discriminated if he is not given an opportunity to move up the hierarchy in the workplace. This scenario can also be applied to a given society. While the existence of the superior and inferior divide can never be avoided, the thing that is needed is to build a sociological structure that can give the inferior an opportunity to move up the hierarchy. The ultimate outcome will, of course, not be the elimination of discrimination (as certain forms of discrimination are prejudiced based) rather, substantial reduction of the same. This in simple words, is called equity, which means fairness.

Policies are often targeted to bring equality and not equity. The problem with this is equality might disturb the hierarchical way in which a given society functions and systematically destabilize it by bringing discrimination, whereas, equity is based on the pragmatic functionality of a society as it does not disturb the balance. The Boss can rightly be demoted in the workplace if he does not work well, thereby giving a chance to the next person in the hierarchy to be promoted to his place. Ultimately, the hierarchy remains, but discrimination is reduced. Further, it is also pertinent to note that it will again be problematic if hierarchy in any society becomes rigid. This will completely defeat the purpose of equity and bring in discrimination. Supposing the Boss’s son is appointed as the Boss even if his skill or experience does not match, it would be discriminatory to the once aspiring to be Boss in the same workplace. In sociological terms, if a poor man is born poor, opportunity must be given to him so that he could climb up the ladder and become rich. But, if the society rigidly follows the hierarchy and does not let the poor man climb up the ladder, there will be an active possibility of systematic instability in the society with the poor always being in a tussle with the rich.

For the aforementioned to happen, lawmakers need to properly understand what is needed to bring equity in society by studying society thoroughly. On one hand, inequality is very much part of every society and it cannot be prevented, on the other hand, it is also essential for proper functioning of a society, as supposing if every person becomes rich, there will be no labour left. Hence, it must be noted that inequality is not exactly an issue rather, discrimination needs to be targeted and steps must be taken to dismantle it. This, in turn, will pave the way for having a progressive society.

Will protestors bring down Karl Marx?

These are the times when entire world has started discussing about racism. The hush-hush discussions on racism all across the world has now been openly discussed to bring about good intentional behavior changes across all sides of life including politics, sports etc.

The entire movement against racism has been hijacked by communists but air brushed with terminologies like socialism, liberal values etc. All across the globe Centre-Right ecosystem are seen only responding to the communists but not seen as one setting the agenda on discussion of racism. Here and there, voices are being raised against communists about intentionally hiding racism practiced by Islamic regimes all across the world on fellow minorities and also about neo-communist regimes which is working on actively destroying age old cultures practiced in their countries with brute force and terrorizing fellow citizens with active military support.

All this aside these anti-racism protestors who identify themselves in different forms as communists, socialites, liberals, Marxists etc. call for limiting the involvement of police force but historically once they capture a place, first act they will do will be the total adherence to government formed by them and make call for involvement of Government in all spheres of life. These dichotomies are never answered once. These are very evident in the recently formed CHAZ country by occupying few of the streets in Seattle, US. Then when we go step further on reading more about Karl Marx the founding father of communist ideology it became very evident about his hatred for anything non-white. He has written letters, opinions explaining his contempt for this hatred on non-whites but Marxists completely buried this hatred with the help of continuous in doctrination of class divide across the societies. But former communist Nathaniel Weyl, brought them up in his 1979 book, “Karl Marx: Racist.”

Marx commented below about Mexicans with his fellow communist Engels “In America we have witnessed the conquest of Mexico and have rejoiced at it. It is to the interest of its own development that Mexico will be placed under the tutelage of the United States.”. Also he has called them as lazy Mexicans with respect to annexure of California to United States.

Below are the writings of Marx about fellow competitor Ferdinand Lasalle with full of hatred towards black people

“It is now completely clear to me that he, as is proved by his cranial formation and his hair, descends from the Negroes who had joined Moses’ exodus from Egypt, assuming that his mother or grandmother on the paternal side had not interbred with a n**** . Now this union of Judaism and Germanism with a basic Negro substance must produce a peculiar product.”

What is the worldly religion of the Jew? Huckstering. What is his worldly God? Money. … Money is the jealous god of Israel, in face of which no other god may exist. Money degrades all the gods of man—and turns them into commodities. … The bill of exchange is the real god of the Jew. His god is only an illusory bill of exchange. … The chimerical nationality of the Jew is the nationality of the merchant, of the man of money in general. – This was about his opinion on Jews titled “On the Jewish Question,” which was published in 1844.A clear anti-Semite stance which in today’s world will be condemned by people across countries.

His views in support colonial invasion of British against Indians is as below in New York Daily Tribune.

”English interference having placed the spinner in Lancashire and the weaver in Bengal, or sweeping away both Hindoo spinner and weaver, dissolved these small semi-barbarian semi- civilized, communities, by blowing up their economical basis, and thus produced the greatest, and to speak the truth, the only social revolution ever heard of in Asia.”

Below are his derogatory views on Hindus in New York Daily Tribune.

”that they transformed a self-developing social state into never changing natural destiny, and thus brought about a brutalizing worship of nature, exhibiting its degradation in the fact that man,the sovereign of nature, fell down on his knees in adoration of Kanuman(Hanuman),the monkey and Sabbala, the cow”

Following his Master, the below words are there in The Motorcycle Diaries: “The Negro is indolent and lazy and spends his money on frivolities, whereas the European is forward-looking, organized and intelligent.” Which was written by Che Guevera in 1952.

In spite of being very racist against native communities, blacks the so called intellectuals of modern day will never condemn these barbaric statements but will try to enforce us to look beyond these to create a so called egalitarian society which they were not able to create even after innumerous attempts across different countries.

Will Karl Marx be brought down along with the current anger against colonizers?

Remember in India we have brought down Lenin in Tripura during the year 2018.Hope the world follows it.

Warning: If you are comfortable with the use of strong language and agree with Freedom of Speech then proceed otherwise leave NOW. You have been warned.

So as you may have guessed by looking at the header that it looks like an odd mix, it is since following is result of “brainstorming” during lock down coupled with work from home situation. The Twitter feed was abuzz with #trueindologyforCorrectHistory and #trueindologyforNCERT, it is about a “boring” subject that I care about. Much has already been discussed about the alteration of Indian history on debates both on Social Media platforms and Cable News. I am not going to say to remove what is in the books now since that will leave people with history as their qualifications redundant, we need everything that was either buried and removed or portrayed as grand lies about Bharat to be documented and it has to be done ASAP.

The country was hit by an epidemic about a century ago and killed a chunk of Bombay’s population however our textbooks just give fleeting reference to this disaster and the teachers just tell you what is written in the Government sanctioned Textbooks. This new age however has presented an Opportunity to document what is happening around us and make sure that the facts are not only documented but also added in the textbooks across the boards at school and university level. This will be good time to have the country ready to restructure the health services, this can be a good driving tool for recruiting bright minds who can reshape the health infra of the nation for better system.

In the present times Covid-19 is spreading as is evident by the increasing numbers. The problem we face is not the numbers of deaths but the alarming rate of infection. The lock down was supposed to put brake on this disease when it was wreaking havoc in the West, it helped however the infections have been rampant since states relaxed the lock down. This is important to talk about since the Government cannot have everyone locked in and wait for the pandemic to blow over, the responsibility of stopping this merchant of death now lies with population of this country (just like every other responsibility). I can only talk about what I see in my locality, the shops are open, there are people on roads with Masks on but social distancing is being ignored for most part. The people will have to understand that the responsibility of saving our lives lies with us, because once dead we will only be a data-point in some statistics.

Girija Tickoo murder: Kashmir’s forgotten tragedy

After the Kashmiri Pandits Exodus on the 19 January 1990, the Jihadi terrorists sponsored by Pakistan were constantly attacking the Kashmiri Hindus who didn’t flee the valley and various reports of atrocities keep coming quietly. When tragedy became the new normal for Kashmir, the public with a very limited memory ignored many stories of pain and anguish; one heart wrenching unfortunate story was of Girija Tickoo’s brutal rape and murder that happened thirty years ago in June 1990.

Girija Tickoo was a Kashmiri Pandit married woman from Bandipora and worked as a laboratory assistant at a government school in the Kashmir valley. She fled the Kashmir region alongwith her whole family and settled in Jammu in the aftermath of the “Azadi Movement” by the JKLF(Jammu Kashmir Liberation Front, headed by Yasin Malik) militants. One day, she received a call from someone who told her that the communal separatist movement in the valley had subsided and she can come back and collect her salary dues. She was assured that she would return home safely and the area was now safer.

In June 1990, Girija set out to return to valley, collected her salary dues from the school and headed to her local Muslim colleague’s home to pay a visit as she was visiting the area after long time. Unknown to her, she was closely tracked by the Jihadi terrorists who kidnapped Girija from the home of her colleague and took her to an unknown place while keeping her blindfolded. Apart from that colleague, all other people in the locality either watched silently when she was being abducted in front of public, or were okayed to see this, for they believed that she was a ‘Kaafir’ and hence they shouldn’t think too much for her.

After few days, her dead body was found roadside in an extremely horrible condition, the post-mortem reported that she was brutally gang-raped, sodomized, horribly tortured and cut into two halves using a mechanical saw while she was still alive. Yes, an alive woman was cut apart into pieces by the sharp saw, right from the middle of her body! It’s impossible to imagine her pain, agony and cries that she must have undergone during the unthinkable ordeal. Just try visualising it, if you can, even the 2012 Nirbhaya case brutality wasn’t that worse.

The Human Right activists, the courts and the governments did not respond to this gory killing and no arrests were made, nobody even was specifically named for this crime. The hyperactive omnipresent mainstream media didn’t broadcasted her story, as they do for crime against certain communities, for several years. No placards were written to seek justice for her, no protests, no outrage, zero zip nada! The only mentions this shameful atrocity received was on the websites displaying the stories of Kashmiri Genocide and in the book titled “Beyond Terrorism- A New Hope for Kashmir” by former Congress Cabinet minister Salman Khurshid.

A young woman in her twenties, who worked as laboratory assistant, no connection to politics, WAS THAT SUCH A CRIME TO GO THROUGH SUCH A HATEFUL BRUTALITY? Probably the only crime was that GIRIJA TICKOO WAS AN INDIAN, A KASHMIRI PANDIT, A HINDU Woman, so nobody sought justice for her or to see her culprits get punished. There were many similar cases in the Kashmir since 1989-90, where the jihadi mob carrying not only the terrorists, but sometimes neighbours and colleagues of PARTICULAR COMMUNITY came in large numbers shouting ‘Aazadi Aazadi’ slogans outside Hindu homes, forced their entry inside and then raped Hindu women and immediately shot down Hindu men, few others were so terrorised that they had to convert to Islam to save their lives and dignity of their women and daughters.

Since then valley became hotbed of terrorists and the once famed Heaven-On-Earth has turned into Hell of bloodshed and hatred for its original natives. Even after three decades, being a Kashmiri Pandit is still a crime in the Kashmir in 2020, as demonstrated by Jihadi terrorists organisations in the recent brutal murder of the Sarpanch Ajay Pandita just a few weeks ago.

The truth of 1975 emergency

These are the popular lines of Rashmirathi, when Lord Shri Krishna tried to calm down Duryodhana and finish the dispute. He asked for just 5 villages but Duryodhana denied even that too! The same situation goes for Former PM of India – Smt Indira Gandhi.

The story is about how did Indira Gandhi made fool of the whole country by twisting the constitution, just for the sake of being in power.

So, let’s go back in 1969 when Congress was divided into two parts: Congress (R) led by Indira Gandhi and Congress (O) led by Morarji Desai. Indira Gandhi insisted the then President of India – V.V Giri to dissolve the Lok Sabha. Lok Sabha was dissolved on 27th Dec 1970 and the country was forced into elections!

Indira Gandhi fought election from Raibareilli and was given tough competition by Raj Narain. Raj Narain was a famous activist and had gone to jail multiple times while raising his voice for the poor, for justice. The D-Day arrived and Indira Gandhi won by a huge margin of 1 Lakh 10 Thousand votes. No one doubted her victory but Raj Narain was not satisfied. He approached Shanti Bhushan Ji (father of Prashant Bhushan Ji) to help him to file a case against her in the Allahabad HC.

After full investigation in to the case, it was found that chemical treated ballot papers were used during the elections. Therefore, it was now proved that the elections were rigged. Out of all the charges against Indira Gandhi, the major charge was a violation of Representation of People’s Act 1951 which says the following:

Using gazette officers, army, police for elections is prohibited under Section 123 (7); spending more than limit, and using a religious symbol for election”

The allegation was that Indira Gandhi took the help of Yash Pal Kapoor who was a gazette officer at that time! Yash Pal helped her throughout the elections, right from organizing the rallies, meetings, etc. So, now the question was, when did Yash Pal Kapoor resign?

Indira Gandhi said that Yash Pal resigned on 13th January 1971 and his resignation was orally accepted on 14th January 1971. The petition said that the official order of resignation was on 25th January 1971 when elections had already finished.

The hearing of the case went for three days – 18th, 19th and 20th March 1975. Indira Gandhi was going to become the first-ever PM to be in the trail. When questions were raised on Yash Pal Kapoor, Indira Gandhi said that under the Rules of Instructions for the Protection of PM when on Tour or Travel, which is also known as the blue book, it is written that her step was legal. Shanti Bhushan Ji requested the same book to be produced but Indira Gandhi refused the court by saying that it was confidential. She gave the reason of public safety for not producing it!

After insisting, the court got the chance to read the book. Shanti Bhushan Ji said that the same book during Nehru’s time said that the district administration is not responsible for arranging the election meetings but this book now validates the same. That means Indira Gandhi got the rules amended! So, now the biggest question in front of the court was, whether the amendment was done with her consent? Did she know about it?

This was an interesting scene now because if she had said no then the amendment would be declared null and void (invalidated) and if she said yes then it would be proved that she used corrupt practices!

Indira Gandhi Said YES!

According to Indian law, an action can be considered corrupt only after the candidate files the nomination! So, on what date did Indira Gandhi filed the nomination? Only this question will now end up the case. Indira said that she filed nomination on 1st February, 1971 but Shanti Bhushan produced a document in the court “Additional Written Statement by Indira Gandhi” which said that she took the decision of fighting the elections from Raibareilli on 29th January 1971, and the document had her signatures!

INDIRA GANDHI EXPOSED

On 12th June, 1975, the Allahabad High Court declared the election of Indira Gandhi from Rae Bareilly constituency “null and void”, and barred Gandhi from holding the elected office for six years. The High Court, while rejecting the charges of bribery, found her guilty of misusing the government machinery for election campaign purposes.

Indira Gandhi was in full anger now! She immediately approached the Judge through her council and got a stay for 20 days to appeal in Supreme Court. The worst part was that Shanti Bhushan Ji was not in Allahabad at that time. Had he been there, he would have raised voice against this demand of stay also, forcing Indira Gandhi to go to jail immediately. And had this been done, India would not have witnessed Emergency!

So, what happened next? Indira Gandhi approached Nani Palkivala, a popular Supreme Court lawyer. He helped her to get a conditional stay which said that she will continue to act as PM but will not vote in the Parliament. On 24th June, 1975, all the opposition party leaders demanded her resignation. Indira approached Faqruddin Ali Ahmed, the then President of India, to declare emergency. Reason given was threat to national security and civil war like conditions created by opposition.

During this time, she brought the 39th amendment act in the parliament and since all the opposition leaders were in the jail, she got it passed. The 39th amendment act validated her elections as it had a retrospective effect. And all these amendments were put under the 9th Schedule of the Indian Constitution by which even the Supreme Court can’t do anything. All this was done before the final Supreme Court judgement, within those 20 days of stay. Now, on 11th August, 1975, the court quoting the 39th amendment act dropped all the charges against her.

So long as the court did not dispute the validity of that legislation, it had no option but to exonerate Mrs. Gandhi of the charges against her. As Justice H. R. Khanna put in his opinion:
“The petition is being dismissed because of changes made in law during the pendency of the appeal.”

The Prime Minister’s opponent, Raj Narain, had asked the court to strike down the amendment itself, on the grounds that it was unfair to change the election laws retroactively, and that this change tampered with the “basic structure” of the Constitution.

He also maintained that the legislation was invalid because at least two dozen Members of Parliament were prevented from attending the session at which it was passed since they are in jail under the emergency.

But the judges, who wrote five separate though generally concurring opinions, did not accept these arguments.

So, this was all about the 1975 Emergency!

Womanhood: An Indian perspective

0

For centuries the robust cultural attributes of the indian society has caught the imagination of the westerns and in the far east alike and for that a major share of credit goes to the women of the country who had been an integral founding limb of this heritage. If today the India we live in is viewed as colourful and vibrant and relatively safe in a volatile geographical zone then anyone with the slightest understanding of the community’s societal ethos will not find it difficult to unearth the secret behind the recipe. With the mushrooming of media channels, for the dearth of topics the debate centred on women’s inequality status in a male dominated society might have found an entry into our living rooms  but the fact of the matter is these agendas are superficial and have looked politically driven at times. Any man worth his salt  is fully aware of the opposite gender’s  overall contribution to the exercise of society building and its significance in the History Books.

Today, the role has by no margin diminished; if at all with india on its way towards becoming a new age global economies go to market, the influence has only increased by immeasurable standards which at times has become difficult for a section of shallow minded individuals to come to term with.

Power and money may be the two biggest lure that drives a man’s business ambition but the tool to attainment lies in the emotional stability and calmness of mind and that is enabled through the chain of relationships that the man shares with the special women in his life. If it is the mother who sacrifices her ways of leading life to accommodate the interests of a growing kid then the luckier ones find a best friend in their sister and as life evolves the girlfriend, for the lack of a better word and then the wife becomes the best companion to confide to. The amount of Love and affection that encompasses these relationship is directly proportional to anyone’s professional success.

An essence of a woman who is the nurturer lies in her ability to take care, love and shower affection and emphatically allow herself to absorb the emotional downpour of anyone who opens up their heart to her. It is her nature that provides the basis of harmonious existence in the society and to distrust and disrespect her stature and compassionate qualities is not only a shame but is a harbinger of deep loss of happiness to the community at large.  Delicacy is a virtue that has been God gifted to women and for any man filled in abundance of it around him is a fortunate soul and for those who fail to realize this is either lunatics or has lost their sense for taste and judgement.

From an Indian context the society has changed more in the last twenty years than in the last two hundred years. In a free for all education set up to create notions of divide between two genders will not only alienate realities from fantasies but will also make it difficult for the future generations of women to accept the bargain for which it is pivotal for people across political lines and poverty lines to realize the larger significance of women in the continuous exercise of society building beyond being home makers. Not that her profile inside the house has changed but her need outside has increased and to allow her to fulfill her new ambitions and dreams along with the raising kids and cooking meals is a trend that need to be respected and given equal space to.

The clear heart and aspiring mind of a modern woman makes the society an elated space and to be breathing the same air is an honour and privilege and calls for life line celebrating period.
