Money Laundering

PMLA is an effective tool in the fight against money laundering and has helped to create a more secure and transparent financial environment in India.

People want a government in New Delhi who has a ‘clean image’ and ‘strong leadership/governance skills’, and subsequently the same be simulated in state capitals.

इसके पूर्व के दो भागों में हमने Amway India के व्यापारिक कार्यशैली और इस कंपनी के द्वारा  Prize Chits and Money Circulation Schemes (Banning) Act, 1978, के सुसंगत प्रावधानों के अंतर्गत किये जाने वाले अपराध और उससे समबन्धित दंड के बारे में चर्चा की परन्तु वर्तमान समय में Enforcement Directorate (ED) के द्वारा कार्यवाही करने से मनी लॉन्ड्रिंग  का कोण भी सामने आया है अर्थात Amway India भी मनी लॉन्ड्रिंग के अपराध में शामिल है।

प्रथम २ अंको में हमने ये जाना की मनी लांड्रिंग क्या होती है, ये कैसे की जाती है, इसे किस प्रकार परिभाषित किया गया है, इस अपराध का दंड क्या होता है तथा अपराध से अर्जित आय जो मनी लॉन्ड्रिग में सम्मिलित है उसके कुर्की या जब्ती का आदेश कब और कैसे दिया जाता है। इस अंक में हम उसके आगे की कार्यवाहियों के संदर्भ में परिचर्चा करेंगे।

मित्रों इस अंक में इस अधिनियम के अंतर्गत दिए गए  उन प्रावधानों का अध्ययन करेंगे जिनके द्वारा तलाशी और अभिग्रहण (search and seizure) के अधिकार प्रदान किये गए हैं।

इस अंक में हम ये जानने का प्रयास करेंगे की आपराधिक आय से अर्जित संपत्ति के सन्दर्भ में क्या प्रावधान किया गया है इस अधिनियम के अंतर्गत।
