Media and the Judiciary canard

It’s now given that attacks on judiciary would hog the front pages of newspapers and prime time television till the 2019 General Elections.

Newspapers would speculate on the “allegations” whether the Chief Justice of India ought to be impeached or not but you would never see them beat one’s own brains whether the four “dissenting” SC judges have themselves invited an impeachment motion on their press conference earlier this year (as opined by former SC judge RS Sodhi).

You would see these presstitutes flagpole government’s apparent delay in confirming the appointments of judges, initiated by the SC Collegium, but you would never see them brainstorm if government’s demand for a more transparent appointment system is justified given how a particular judge, belonging to Collegium itself, was ordered by the SC itself to undergo mental “stability” examination!

The Lutyens’ Media would run up any given lampost to browbeat the NDA government for trying to “encroach” upon the judiciary but you would never see them admit that a Law Minister was always the part of the judicial appointment system till the Collegium came about in 1993.

(That “encroached” system got a judgment against the sitting Prime Minister of India by an Allahabad High Court judge. That “encroached” system produced judges of the calibre of Justices Vivian Bose, Hidayatullah, JS Verma etc. What Collegium has produced, well…)

These despicable hacks would drown you with the noise that government is taking over the judiciary. They would never clarify as to how the “A.J. Raja acquittal” or Bapu Asaram guilty pronouncement then came about.

The crooked media would never tell you why sexual harassment charges against judges are dismissed on less-than-convincing grounds.

The deceitful pen-pushers wouldn’t tell an opaque system encourages judges to be manipulated—or why else most of the Supreme Court judges end up getting lucrative post-retirement jobs—and that it must be done away with.

The shameless mainstream media wouldn’t encourage dismantling the opaque system even after names of corrupt former CJIs are presented in a sealed envelope in the court. It would not question a Kapil Sibal why he didn’t ask for “impeachment” motion above allegations of corruption and sexual misdemeanours against the honourable judges.

Best of all, you would never see the gutter media present the fact that after all this, NDA has cleared the appointment of more judges than ever per year.

So cram up the facts and be ready with answers when propaganda hits your face next time.

Media ‘Nautanki’: Media and Opposition lie once more to defame Yogi

After the accident with children, Chief Minister Adityanath immediately reached the spot. After meeting the relatives of the dead at Kushinagar District Hospital, he went to inspect Dudahi railway crossing where the accident took place. When the Chief Minister reached there the crowd became unruly. Some of them started shouting slogans of Vande Mataram and Bharat Mata ji.

Chief Minister Yogi had come to inspect the accident spot on the railway crossing but some of the crowd started shouting slogans of Vande Mataram and Bharat Mata ji. CM climbed the car and took a loudspeaker and said, “Stop the slogan. Stop gimmick (nautanki). This is a tragedy. It would be good if we talk about the solution to the problem. I have come to inspect the spot. Get out of here.”

Chief Minister also visited BRD Medical College in Gorakhpur after inspection of the site. After talking to the injured, he interacted with the media, “The incident is disheartening. I have come to BRD Medical College after visiting the Kushinagar District Hospital and the spot. 17 children and drivers were in that van. 13 children have died. 4 children and drivers admit here. All the facilities are being given to them.”

After the death of the children, the opposition started the work of polishing their politics in this incident. Yogi Adityanath had appealed to his supporters to stop sloganeering. The opposition served this on social media according to their own twist and said that Yogi Adityanath asked not to be nagged by the deceased’s family members and insulted them. Because of this Yogi Adityanath received a lot of criticism.

BJP spokesman from Uttar Pradesh, Shalabh Mani Tripathi, quoted a handle which had tweeted a video in which Yogi Adityanath appears to be reprimanding family members. When the protest against Yogi Adityanath’s statement on social media started, he said that opposition should not play politics on such incidents.

The BJP spokesman wrote in his tweet – “When the painful accident happened, leaving all other work [Yogi] reached out to the victims, disregarding all security protocols, underburning, running from hospital to hospital, even then if there is such disgusting politics, then should I not answer it? The sloganeering was from some political people, not the family, this was said to them.”

He repeatedly made it clear among the people on social media that the statement of Chief Minister Yogi Adityanath was different, but the Opposition is doing politics on such sensitive issues by twisting it; he tweeted out a video clip showing that the supporters were shouting ‘bharat mata ki jai’ and ‘Vande Mataram’ slogans. He also wrote, “Look, a big lie exposed. After the painful incident of Kushinagar, when Yogi ji was running from hospital to village in the burning sunshine, some people were shouting ‘long live (zindabad)’ slogans of flattery. For this, Yogi ji reprimanded them, but the news was made that Yogi ji reprimanded the victims!”

Recent strike from the US and its allies on Syria for alleged (and unverified) use of chemical weapon by the Syrian Govt. was described as ‘Mission Accomplished’ by the US president Donald Trump, ironically something similar was cited by George W. Bush during initial phase of US attack on Iraq in 2003, the rest, of course, being history. The Middle East has been the most unstable region over past few decades. Numerous civil and proxy wars, misgovernance, foreign invasions, religious conflicts, is strange to none. Seems like the anarchy has itself embraced the Arab world. Though the origin of this adverse turmoil can be argued, there must be something behind that is not letting it settle.

The US has been the common player in the rise of Islamic extremism, civil wars and anarchy in the middle east. Be it the instability in Iraq and Afganistan or the civil wars in Syria and Libya, the US has always been involved by some means or the other. In fact, not only in this region but conflicts all over the world have seen the intercession from the US. Just 22 years of peace is what the Americans have witnessed since their independence. It thus becomes important to know the motive behind these involvements that is putting the sword of Damocles over the planet.

The Military Industrial Complex (MIC) of the US, has been apparently dictating the conflict around the world the over past few decades. Former US president and a decorated Army General ‘Dwight D. Eisenhower’ in his farewell address, quoted the peril involved in not keeping a check on the MIC which can lead to involvement in unnecessary wars (as US has been many times). He indicated that the Govt must guard against the acquisition of influence whether sought or unsought by the MIC, indeed a prescient remark. We see that unlike most other nations the USA has an entirely privatized military-industrial complex, which makes ‘capitalism’ the major player in the scenario with regular arms deals being oxygen for the complex.

‘As it stands today, well-nigh half of the US arms exports went to the war-torn middle east in last five years’ cites a report of the Stockholm International Peace Research Institute (SIPRI). It’s obvious that an amicable region will seldom look for addendum of modern weaponry to their arsenal than an upset one. Saudi Arabia’s $670 bn arms deal with the US last month shows it once and for all and also backs the fact from the US perspective that why it is so keen to keep this part of the world unstable.

Further, the interest of a close ally of America, Israel keeps its form putting efforts to stabilize the situation in the middle east. A stable regime will be an implicit threat to the security of Israel ( having not so great geographic location). The end of totalitarian rule in some Arab countries may sound nice on a bulletin but almost each of them has seen the worst time ever since. The miserable failure of numerous peace talks makes one sceptical of the character of the delegation involved and depicts patently the reluctance and lack of will to resolve the ceaseless conflicts.

The world has been changing at a prodigious rate. A nation’s problem is now no longer limited to its border but has started to influence the interest of the others. Direct warfares have nearly become defunct and proxy wars are in fashion, producing far more detrimental consequences than the former, chiefly for the civilian. The collision of major power in the middle east has spread the spark all over the world, mainly fanning the flames of extremist movements. Thus there is a need to keep a far sight that will be in the interest of the entire human civilization in the long run.

Karnataka Elections – As things stand today, it seems like a tough battle for Congress

After 2014 India has entered a phase that each and every election is important and the liberal media use it to their advantage to create a halo as if they all are cliffhangers.

But if we study the people thoughts and understand the ground realities we can find out that its not that dead heat as projected by liberal media.

The same story which liberal media used in 2017 Uttar Pradesh election, they are trying it out in Karnataka. They created an image as if CM Siddaramaiah is so strong that none of the leaders can ever defeat him.

Now let us see what are all the signals the electorate is giving on the ground for this election

1. Rural distress:

There is a huge rural distress. In most of the rural areas water scarcity has increased and in turn, it is affecting the livelihood of people. So there is huge anti-incumbency against Congress in rural areas

2. Vokkaliga Backlash:

As like seasoned politician Former PM Deve Gowda is now fighting not for winning the election but for defeating Siddaramaiah. Deve Gowda family on the ground has united vokkaligas as like the era of the 90s and which in turn has made sure that the most of vokkaligas think Siddaramaiah as a betrayer.

3. United Lingayats:

Lingayats think Congress is playing electoral politics in their name. First time in the history of Karnataka, Lingayats have come out of the influence of mutts and education institutions. Even Congress has got the signals that they are unable to break the Yeddyurappa’s hold on lingayats, so they stopped mentioning about minority religion status as election date is closing on.

4. Approaching Tribal Communities:

BJP has slowly and steadily approached tribal communities as a separate block as like Tripura and also they are grooming the leaders from their communities.One such approach is giving unprecedented space and access for B.S.Sreeramulu who is from Tribal Nayak(Naik) community. Surely this election is going to change the leadership equation within BJP by creating a new set of leaders who are going to take ideological legacy for another few decades.

5. Islamic Jihad:

Hindus in coastal Karnataka are slowly realising the aggression of Islamic elements under Congress rule. In Coastal Areas RSS is working in two prolonged approach one is taking forward the development mantra and another one is making sure people remember the Islamic onslaught on common people.Congress only banks on Minority votes in the coastal area.

6. Infrastructural Woes:

Bengaluru electorate is fed up with infrastructural woes and they lost faith in the leadership of all parties. Even Rahul Gandhi’s visits did not create any enthusiasm among the people. The only leader who has not yet campaigned is PM Modi. Still, there is a lot of scope for the PM to capture the imagination and providing hope for the electorate of Bengaluru city.

7. CMs influence on OBC Communities:

Sangh Parivar is struggling hard to break the influence of CM on OBC Communities. Eshwarappa is not enjoying the faith as like CM on OBC Communities. Sangh Parivar has to really work hard on creating new leaders among OBC Communities

8. Old Mysuru Region:

Old Mysuru region still trusts JD(S) more than BJP and Congress. BJP has left the battle field wide open for a fight between JD(S) and Congress.

9. Develoment Mantra:

Youths are still carving for a leader who can genuinely speak abt developmental issues. PM Modi’s charisma can be a game changer.

10: Booth level connectivity:

Inspite of ruling for past 5 years congress is still struggling to create connectivity in booths among large parts of the state.As of information i have in hand BJP has already completed setting up of its famed panna pramukh and shakti kendra models in most part of the state and they have already started working on their efforts to creating a wave election for BJP.

Things are changing faster and it seems most of Congress heavyweights are fighting solo battles in keeping their seats safer. To be frank, anti incumbency has already started to creep in among the electorate. Seems to be it is going to be a tough election for Congress.

Congress war on judiciary – high time the court takes action

Since the Judge Loya case judgement came, the Congress started the process for impeachment of the Chief Justice of India. This should not come as a surprise for those who have read about how the judiciary was controlled in the 1970s by the former Prime Minister Smt.Indira Gandhi. It is clear that it is not new for the Congress to sabotage the administration of Judiciary. Coming to the present case there was a PIL (Public Interest Litigation) filed to order a ‘free and fair’ enquiry into the death of Judge Loya who was hearing a case where BJP President Amit Shah was an accused.

In the process, the petitioners brought disrepute to the Judiciary and the judicial process. The court observed “By casting unfounded aspersions on the judicial officers who had accompanied Judge Loya, the petitioners have revealed the real motive of these proceedings which is to bring the judiciary into disrepute on the basis of scurrilous allegations. We find no basis or justification to allow the request for cross-examination.”

It also went on to say that this was a “serious attempt to scandalize the court and obstruct the course of justice.” One of the petitioners, Mr.Prashant Bhushan also asked two of the Judges to recuse themselves from the Bench as they ‘may have known’ two judicial officers who submitted their statements. Therefore it is clear that there was a continuous attempt by the petitioners to bring disrepute and make unsubstantiated allegations against the top court and some of its judges in particular. On the charge of the petitioner asking the judges to recuse themselves, the Apex Court noted that- ‘when a Judge faced with such “wanton attacks to withdraw from a case”, it would amount to “abdication of duty”’.

In no time, the Congress jumped in and started to discuss on initiating impeachment motion against the Chief Justice of India who headed the bench which delivered the Judge Loya case verdict. It cited the unprecedented press conference of the four senior Judges where they expressed displeasure regarding “selective allocation of cases to preferred benches” which also included that of Judge Loya death case. One of the four judges, Justice Chelameswar in a recent interview told that ‘impeachment is not the solution to the problems’.

Despite this the Congress attached other unsubstantiated charges with this against the CJI to move the impeachment motion which was signed by 63 Rajya Sabha MPs. This was led by Mr.Kapil Sibal who had earlier pleaded before the bench headed by CJI to post the hearing of Ramjanmabhoomi case after 2019 elections which was subsequently rejected by the Court. It is noteworthy to mention that Mr.Kapil Sibal had in an interview to NDTV in 2010 told that he ‘does not accept the impeachment procedure as a proper procedure’. It would not be wrong if we say it is nothing less than hypocrisy.

Rightly Vice President Venkaiah Naidu, who is also the Ex-officio Chairman of the Upper House rejected the motion citing several reasons.

“Having considered the material contained in the notice of motion and reflected upon the inputs received in my interaction with legal luminaries and constitutional experts, I am of the firm opinion that the notice of the motion does not deserve to be admitted. Accordingly I refuse to admit notice of motion,” said the Chairman.

The motion was unsubstantiated by facts and were mere allegations. As per article 124, Supreme court judge can be impeached on the grounds of “proved misbehaviour or incapacity” which is surely not the case here considering the fact that the motion submitted to the Chairman had words such as “likely” which meant the even those who submitted the motion were not sure of their charges. Therefore without having ‘proven beyond reasonable doubt’ it is preposterous to initiate Impeachment motion against any judge.

What is even more obnoxious is, even after the Chairman of Rajya Sabha rejected the petition, the Congress has continued with its unfounded allegations against the CJI to score political brownie points. In the latest post, Congress Social Media Head Divya Spandana tweeted alleging the CJI of fixing benches.

This tweet qualifies to be a Contempt of Court under the Contempt of Courts Act 1971. It is a scandalous allegation without any substantial merit which brings disrepute to the judiciary and attempts to sabotage its functioning. It is just a matter of who bells the cat.

It is clear now from the turn of events starting from Mr.Kapil Sibal requesting the Ayodhya case to be heard post 2019 elections to the Judge Loya case, both of which has not gone in its way, the Congress is in desperation to come back to power by hook or crook. In the process it has not spared institutions such as the Election Commission and the Supreme Court.

Any reasonable person can relate these actions of the Congress Party today to the Congress of Mrs.Indira Gandhi post Keshavananda Bharati case judgement where the executive sabotaged the functioning of the judiciary by appointing a judge as CJI superseding three senior most judges.

To conclude, as the Supreme Court opined in the Judge Loya case that the petitions were “a veiled attempt to launch a frontal attack on the independence of the judiciary and to dilute the credibility of judicial institutions.” So is the Impeachment motion of CJI, initiated by the Congress Party. It is high time the ‘tolerant judiciary’ initiates Contempt of Court proceedings against those who are making unfounded allegations against it and jail them.

He nailed it in style, leaving Hinduphobic liberal bigots shocked

Hinduphobia is nothing new in India. Especially when it comes to liberal, secular and rational lobby of India, every act of them reflects their hate for Hindus. They write, they paint and they say whatever and anywhere they want against Hinduism in the name of Freedom of Speech.

In some of the recent incidents, they used a rape case to paint all Hindus as rapists, they gave cover to Islamic fanatics who disturbed Ram-Navami processions and then abused Lord Hanuman on Hanuman Jayanti. And each time Hindu was as usual sitting idle, waiting for someone else to act.

But there are some who do not wait for others to act first and lead by example. Abhishek Mishra (@Abhishek_Mshra), member of VHP and a Hindutva thinker, took a token step and cancelled his Ola booking as driver was Muslim. He also posted the incident on his twitter account. He did it show mirror to so-called liberals who had earlier called for boycott of cabs and drivers that have Hindu god’s images on them.

This created a big outcry in liberal lobby and they came out like cockroaches not to miss a chance to criticize Hindus. As usual and as always, morally bankrupt left wing fanatics missed the point completely and connected this with Hindu vs Muslim angle. Most of them also painted it as him supporting Kathua rapists. Soon after his post, Left media and left wing trolls took no time in starting their usual abusive and foolish ways to harass Abhishek Mishra. As reported, they also tried to hack his account and started pressurizing Ola and Twitter to suspend his account.

A lot of anti-Hindu trolls also started giving laughable advises to him like not to use any vehicle as petrol for vehicle is imported from Muslim countries. These Hinduphobic trolls need to know that petrol is not something we are getting from Gulf countries for free like Haj subsidy (discontinued now). We pay the market price for every drop of fuel, and Gulf countries also depend on us for manpower, spices and lot other resources. These Islamic countries are way more rational than Indian Lefts.

It is difficult for a left ideologist to understand that act of Abhishek Mishra was not against Muslims but was in response to the post by a Hinduphobic Rasmi R Nair who connected rape with Hindus and wrote on Facebook to boycott and cancel any Ola/Uber cab carrying the image of Lord Hanuman. Abhishek’s response was also connected to an incident where a Hinduphobic Muslim guy Abid Hasan downrated his Uber ride for cab having Picture of Bajrang Bali.

Both these incidents could not attract any outrage from liberal bigots, instead most of them applauded and supported this Hinduphobia. At same time, nothing stopped them from raising eyebrows on Abhishek’s tweet.

Abhishek is not opposing Muslims (as a Hindu, he can’t) and he is not supporting any rapists. Like every Hindu, he also wants Kathua incident not to be used as a tool of Hindu bashing. Like every Hindu, he also wants liberals, seculars and rationals to respect Hinduism, as they respect Islam and Christianity. Like every Hindu, he also hates to be attacked and preached on every Hindu festival.

After Assam rape, Hindus dis not use the incident to paint all Muslims as rapist and nobody said Islam teaches rape. After 26/11 attack by Muslim terrorists, Mumbai Blasts by Muslim terrorists or Akshardham Attack by Muslim terrorists, Hindus did not use the incident to paint all Muslims as terrorists, and nobody said Islam teaches terrorism. After Hussain painted derogatory images of Hindu deities, Hindus dis not celebrate “Draw Muhammad Day” like USA. Even after the Owaisi’s derogatory remark on Mother of Lord Rama and his threat to kill 100 Crore Hindus in 15 Minutes, Hindus did not paint Muslims as enemies. This is what our Hindutva is like and this is what keeps Muslims and other minorities safe in India.

Even if the token steep of cancelling the Ola ride is taken at its face value, the Muslim cabbie did not pay the price of being a Muslim, but he paid the price of this selectivity and silence. Whatever bigotry liberals, seculars and rationals are spreading in India, a large section of Muslims are part of it. If rest of the Muslims do not raise their voice and do not separate themselves from Hinduphobics, it will be difficult for a common man to differentiate and a good Muslim will continue to suffer. After every incident against a Muslim, Hindus openly come out in support of them, but in recent days, we did not see any rational Muslim opposing his fellows involved in anti-Hindu activities. These days some Muslims are demanding that a 10-year-old Hindu rape victim be married to her rapist!

Though I too had to do it sometimes, personally I do not like the idea of boycotting someone just for his religious believes because I know a lot of Muslims and Christians who are hardcore Modi supporters. I never cancelled a Muslim driver and do not have any intentions of doing so in future.

Once I downrated an Uber cabbie because all the way he kept explaining me how Uttarakhand tragedy was the punishment to ‘Kafirs’ by Allah for not following Islam. Once again, I downrated a cabbie as all the way he kept abusing Shivaji Maharaj. This doesn’t mean I always get bad cabbies. In another incident, my family was stuck in Koregaon protest of Ambedkarite hooligans and just 10 meters ahead we could see Ambedkarites pelting stones and breaking the windscreens of vehicles. My Muslim cabbie was quick enough to jump out of the driver seat and within seconds both of us covered the windows with mu luggage so in case glass brakes, pieces do not reach my family.

In a country where all the media is Left centric and Hindu has no voice, in a country where raising voice is termed anti-Islamic, cancelling a cab or nor renting house to a Muslim is the only way a Hindu is left with, to show his protest. If situation does not change, unfortunately more and more Hindus will start thinking of doing it in future.

The problem of caste, and the future politics around it

Electoral mobilisation on caste has always been an attractive proposition in Indian polity. But for how long will caste remain the glue? Subaltern caste assertions, deepening of social democracy and increased political awareness of the marginalised and the fact that there are more than 5000 castes & sub castes have made politics interesting.

It is indeed an arduous task for any aspiring politician to navigate the labyrinthine maze of caste permutations and combinations to succeed electorally. Caste alliances are never permanent, they depend more on day to day engagements among various social communities and not political rhetoric as parties think.

There are wheels within wheels in the caste conundrum, caste blocks like OBC will break down to caste like Yadav and things will not stop at that as there are sub castes among the Yadav community. Where do you put a full stop? How are you going to distribute 500 jobs among 5000 castes?

The harsh reality is that caste can never be a source for integration for caste politics, read social justice, always operates through creation of caste cleavages. Cleavages can be inter caste or intra caste, and there is simply no scope for reconciliation and social revolution. As long as there are castes… there will be outcasts. By its very character, caste is hierarchy seeking and it does not operate horizontally I. e. socio political participation of various social communities on an equal footing.

I am keeping my fingers crossed over what shape the widely debated Bahujan movement that aims to represent a wide alliance of dalits backwards tribal and minorities takes but one thing is crystal clear. There is not going to be any social democratization. Firstly I doubt whether the movement will be a starter and secondly, even if it starts it will be reverse caste discrimination. Manu will be there but the caste pyramid will get a bit inverted.

The Bahujan movement will kill the exclusivity of dalit movement. Gradually it will end the privileges that dalits enjoyed by virtue of being a specific class. The dalit cultural agenda will be the biggest casualty. There will always be the fear of dalit movement being eaten up the broader Bahujan movement. The inferior status of dalits were due to their rootlessness and historical deprivation from land but the backwards were always Landed. Even today OBCs have land. How will landless dalits get land from them? Internal contradictions galore among various bahujan communities.

We are going to see interesting as well as frightening times.

Yogi govt is working smartly to eliminate the monster of Japanese Encephalitis from UP

Encephalitis is a life threatening disease causing acute inflammation of the brain. A person afflicted with encephalitis requires serious medical attention.

Cause– This disease can occur to people of any age group but children and elderly are more likely to be afflicted with the disease. It is caused due to bacterial infection, parasites or may be prompted by other infectious diseases. Encephalitis is a non-communicable disease. Japanese Encephalitis is a big problem in Uttar Pradesh. It has killed thousands of children in last 30 years. According to WHO, Japanese Encephalitis affects children and it is caused by a mosquito-borne flavivirus.

Last year we all saw in news, 60+ children died in a hospital in Gorakhpur because of Encephalitis. But it’s incorrect to assume that Encephalitis is present only in Gorakhpur. Encephalitis cases are coming from various parts of India and UP. Gorakhpur is the center point because in this whole area there is one hospital where treatment for Encephalitis is available and patients from many neighboring districts are coming here for treatment. It is the only hospital in a 300 sq. km patch of land to have decent facilities to treat these diseases.

Monsoon in Gorakhpur seldom brings cheer. For the past 30 years, 1000s of children are dying rains of encephalitis in the season of Monsoon. Last government was very incapable if we talk about the measures taken by Akhilesh Yadav for the eradication of Encephalitis. The number of deaths stood at 5850 in 2014, 6917 in 2015 and 6121 in 2016. In the name of eradication, this JEV Akhilesh started few extra ambulances, added few extra beds in the BRD hospital. He announced a separate hospital in Gorakhpur in 2012 for JEV but it is still far away from completion. He was busier in roads, Metros and other projects but ignored the basic problems like this. Because only the poor class was suffering from JEV. There were very few vaccination campaigns during his tenure for Encephalitis but none of the campaigns made any significant progress because they didn’t monitor them properly. Instead of fulfilling his promise of eradication of Encephalitis he announced the compensation of 50,000 Rupees to those who lose their children to this killer disease. A lakh would be given to the survivors who are permanently disabled. And even this was a total failure because in 2016 only 8 got compensation. So less than 1% patients got the compensation in 2014, 2015 and 2016.

The BRD College has been pleading with the government for a decade now for the need for a special unit to deal with encephalitis cases. Even though the government is aware that the patients from neighboring states and even countries like Nepal visit the facility for treatments, but it has hardly made the government feel responsible enough to allocate funds to battle the disease. There is a shortage of doctors, nurses and other medical staff. Last year the encephalitis ward at BRDMC was run entirely by students from other medical colleges across the state. Even land required to set up special care units for encephalitis has not been provided, with no real measure to curb the incidents

Cases of Encephalitis can be reduced to significant numbers by providing a clean environment. That’s where Yogi is making an impact. After the Yogi government took charge, an awareness and public participation campaigns were launched in May 2017 in 38 districts that are considered to be the worst-hit regions. The drive was supposed to cover over 88 lakh children, for which the Centre provided 1 crore vaccines. He started clean drives in all the villages affected by Encephalitis. He started a vaccination drive named DASTAK with the help of UNICEF and UNICEF is praising Yogi Government’s efforts.

A detailed programme has been prepared to combat Encephalitis. Facilities at BRD hospital has been improved According to Govt. officials, the vaccination work will be completed by April 2018. Awareness camps are in place to make people aware to keep their surroundings clean. The educational institutions, as well as NGOs, have joined hands. Mal-nourishment is another cause of the spread of this disease. Therefore, to make sure that pregnant women, lactating mothers, and infants are getting nutritious food, aanganwadi workers also involved in this work. The school children are also getting educated about this dreaded disease.

Why the impeachment saga is an opportunity in disguise

“In the middle of difficulties, lies opportunity”, said Albert Einstein.

Each tragedy leaves the hint of a comedy yet to be unfolded, each misfortune comes seeded in felicity yet to be born. In the same way, the latest action of the opposition parties to impeach the Chief Justice of India and the subsequent developments, no matter how “unfortunate and mischievous” they may be, have the potential to open up and settle many academic debates that would eventually go to strengthen the constitutional jurisprudence in India once the ominous dust kicked up around the matter is settled. The issue, although denting the image of the judiciary in an unfathomable way, is nothing less than a seed falling on the fertile ground.

In the evolutionary process of society, each event has its significance. In the ontological argument, the question whether the opposition should have initiated a motion of impeachment against the CJI, and whether the Chairman of the Rajya Sabha should have shot it down on his own, both carry equal significance. To the students of Constitutional Law, the development leads to a rich mine of potentialities where the outcome is likely to put forth a windfall of lessons that would help in setting definite regulations and precedents in areas that hitherto suffer from constitutional uncertainties.

Let’s talk on the motion of removal of the CJI, which is popularly known as ‘impeachment motion’ in media, though the word ‘impeachment’ comes with specific reference to President of India under Article 61 of the Constitution; for judges of the Supreme Court, Article 124(4) of the Constitution mentions the word ‘removal’ instead of impeachment. The motion of removal of the CJI, as submitted to Rajya Sabha by Ghulam Nabi Azad last Friday containing signatures of 71 MPs of Rajya Sabha (7 have retired now) from the Congress and 6 other parties, contained ‘5 grounds of misbehaviour’, hence the opposition pitched the case to the Chairman of Rajya Sabha for removal of the CJI.

However, on Monday, Venkaiah Naidu, the Chairman of the Rajya Sabha, drew the curtain on the motion by rejecting it altogether. While doing so he had observed – “Members of Parliament who have presented the petition are unsure of their own case… the phrases used by the Hon’ble MPs themselves indicate a mere suspicion, a conjecture or an assumption. The same certainly does not constitute ‘proof beyond reasonable doubt’, which is required to make out a case of ‘proved misbehaviour’ under Article 124 (4)…I am also aware it is imperative that we should have extraordinary, important and substantial grounds for the removal of a judge.”

Though the Congress found the decision “ill-conceived and hasty”, the decision of the Chairman stands in complete conformity with the existing law. In a series of cases, the courts have taken this position that the Speaker/ Chairman is the final authority to decide whether the accusation against a judge of the Supreme Court requires investigation before consideration of his removal proposal by the parliament. Section 3(1) of the Judges Inquiry Act, 1968 provides for admission of such motion by the Speaker or the Chairman and subsequent action on it.

In Sarojini Ramaswami Vs Union of India (1992), the SC had set the guidelines in unambiguous terms: “Every Judge of the Supreme Court and the High Courts on his appointment is irremovable from office during his tenure except in the manner provided in clauses (4) and (5) of Article 124 of the Constitution of India. The law made by the Parliament under Article 124(5), namely, the Judges (Inquiry) Act, 1968 and the Judges (Inquiry) Rules, 1969 framed thereunder provides that… the Speaker/ Chairman is to decide whether the accusation requires investigation. If he chooses not to act on the accusation made in the form of motion by the specified minimum number of Members of Parliament, the, matter ends there.” This position has been reiterated in a series of judgments, the most recently being Justice P.D. Dinakaran vs Hon’Ble Judges Inquiry Committee (July, 2011).

Incidentally, Justice S. Ramaswami was the first judge against whom a motion of removal was initiated in the parliament and during the investigation on the corruption charges against him, 10 out of 14 charges were found to be true by the inquiry Committee. However, despite concrete evidences of corruption and misuse of power against justice Ramaswami, Kapil Sibal, assisted by J.S. Khehar, who was then an advocate in the Punjab & Haryana High Court and who later became the 44th CJI of India, put up a 5-hour long spirited defence of Ramaswami as his counsel in the parliament on May 10, 1993 and ensured that the impeachment motion failed in the House. Whereas the Kapil Sibal of 1993 hated the idea of impeaching a judge with proven misbehavior, the Kapil Sibal of 2018 is hell bent on impeaching a judge by inventing and imputing misbehavior to him.Chief Justice Dinakaran of Sikkim High Court, on the other hand, saved himself from the ignominy by resigning from his post in 2011.

The present episode leaves open many questions. The opposition says that the CJI is guilty of misbehavior while the Vice-President says there is no proof prima facie. In such a scenario, the first and foremost question is, what constitutes “standard of proof”?

In common law jurisdictions, the standard of proof is nothing but clear and convincing evidences that happen to be beyond reasonable doubt and carry a level of certainty around them. However, the ‘preponderance of probabilities’ may also constitute a standard of proof. In various decisions of the Supreme Court, such as in Dr. N.G. Dastane v. Mrs. S. Dastane (AIR 1975 Supreme Court 1534), it was held that the Court can “act on preponderance of probabilities and arrive at a conclusion, and need not expect that all the conditions prescribed are to be satisfied beyond a reasonable doubt.” So, while Naidu believes ‘suspicion, conjecture and assumption’ has no role to play in establishing proof beyond reasonable doubt, will preponderance of probabilities, if any, play a role in framing a jigsaw fit of charges from the 5 grounds of misbehavior listed against the CJI, once the matter reaches the court?

Secondly, can the Chief Justice of India be considered as an Institution of trust himself?

The question was settled by a Supreme Court bench led by the CJI Deepak Mishra himself when it rejected a petition on April 11th this year filed by a Lucknow-based lawyer Ashok Pandey who sought a writ of Mandamus to “evolve a procedure for constituting benches and allotment of jurisdiction to different benches”. Quoting an earlier judgment of the State of Rajasthan Vs Prakash Chand (1998) and also a recent judgment of a Constitution Bench in Campaign for Judicial Accountability and Reforms v Union of India (2018), the CJI-led bench affirmed that the Chief Justice of India is the undisputed master of roasters. Writing the judgment, Justice Chandrachud had opined, “as a repository of constitutional trust, the Chief Justice is an institution of trust in himself.” The judgment implies there should be no occasion to deny the trust reposed in the CJI and hence he should constitutionally be always trusted. However, with the opposition attacking on this very ‘repository of constitutional trust’, the question remains whether the repository of constitutional trust vested in the Chief Justice is absolute or is still open to judicial scrutiny?

The third question is whether this legislative decision of Venkaiah Naidu to reject the motion of removal of the CJI is subject to judicial review?

The settled position of law is that conducting businesses of the House, such as admitting or rejecting a motion, including a removal motion under Art 124(4), which is no different from any other motion under rules and procedures of Rajya Sabha under Art 118, is an exclusive right of the Chairman, and hence the courts can’t interfere in his legislative right. However, after the historic Keshvanand Bharti Vs State of Kerala case (1973) decision, where it was famously settled that parliament can’t interfere with the ‘basic structures’ of the constitution, the Congress can cling on to the thin argument that ‘independence of judiciary’, which certainly is a basic structure of the constitution, stands today in peril hence the Supreme Court must step in and review the decision of the Chairman.

The three important questions raised above can finally and comprehensively be answered once the matter reaches to the doorsteps of the Supreme Court. To the Congress, the battle is electoral guided by its political insinuations, hence the party is certain to take the issue to the Supreme Court. However, from a value-neutral perspective, the episode presents an excellent opportunity to the constitutional institutions to fix the matter by plugging those nagging gaps in procedures and set definite precedents to avoid recurrence of similar situations in future. That’s why the episode is nothing less than an opportunity in disguise.

Bollywood: the place belongs to hypocrites

Although Bollywood always have been place of hypocrites, but in recent times through its attention-seeking antics on crucial issues, it is making mockery of itself. I have tried to list out few examples, which clearly reflects their agenda and narrow, self-centered approach.

Hypocrisy 1 – Have you seen any Hollywood actor talking in Spanish or Chinese? But you always find actors of Hindi film industry talking in English at every other occasion except at screen. They earn their bread from Hindi, but felt ashamed in speaking Hindi at public places. This is one of the most significant irritant in Hindi cinema actors and in this aspect they should learn from regional cinema actors.

Hypocrisy 2 – In general, actors seems to be the largest synthesizers for animal life and their extra-large love appears at time of  Diwali, Holi and other Hindu festivals. But it disappear during other occasions and at the time when their godfather gets jail for killing of critically endangered animal. As the whole world witnessed their outrage recently when they even questioned judiciary for sentence to their Mai–Baap Salman Khan.

Hypocrisy 3 – Crime and Bollywood. Karim Morani is a producer facing charges of rape, son of Mahesh Bhatt had connections with terrorist Hadely, Sooraj Pancholi is facing the charges of killing his girlfriend, but we found no campaign against these people and no #MeToo campaign. And many more incidents like these come out at regular intervals, but we never found Javed Akhtar tweeting about these, although he questions the intelligence of NIA and High Court in cases of national importance.

Hypocrisy 4 – One thing common I found in all these celebrities about their opinion is that terrorism and crime has no religion. But one rape case happens (although its very unfortunate, and it should be condemned) and they started maligning temple and country. These are the people who never use Hindustan word, but to show anger against rape they used words like “Hindustan” and “Dev sthan”. It  clearly shows their agenda and hate against majority religion of this nation. Was it necessary to use these uncommon words to show outrage or was it a planned agenda?

Hypocrisy 5 – The actresses who does not feel shame on dancing  on songs  like “main to tanduri murgi hoon yaar Gatkale saiyan alcohol se oh yeah/Gross objectification of women body” and “sidhe andar aao raza” and when they talk about women empowerment, irony feels like it should die now.

There are many more such incidents, but these are some prolific ones and clearly shows their hatred  and reduces their credibility in public eyes. Hope they understood the anger of common people against their selective outrage and  could earn some respect.
